United States v. QuikTrip Corporation

On July 15, 2010, the U.S. Department of Justice filed a lawsuit against QuikTrip Corporation, together with a Consent Decree proposed to settle the lawsuit, in the U.S. District Court for the District of Nebraska. The Consent Decree, approved by the Court on July 19, 2010, established a $1.5 million fund to compensate individuals who experienced discrimination in violation of Title III of the Americans with Disabilities Act (ADA) at QuikTrip gas stations, convenience stores, truck stops, and travel centers.

The Lawsuit. QuikTrip Corporation owns and operates more than 550 gas stations, convenience stores, truck stops, and travel centers located throughout the Southeastern, Southwestern, Midwestern, and Southern regions of the United States. The lawsuit, filed under Title III of the Americans with Disabilities Act, alleged that QuikTrip Corporation had discriminated against individuals with disabilities by failing to design, construct, alter, and remove barriers to access at QuikTrip gas stations, convenience stores, truck stops, and travel centers so they were accessible to individuals with disabilities.

The Consent Decree. The Consent Decree, which lasts for a term of four years, requires QuikTrip Corporation to make all of its current facilities accessible, provide fueling and other types of assistance to individuals with disabilities, establish a toll-free telephone number and grievance procedures for the receipt and investigation of ADA-related complaints from customers, make its website accessible, adopt an ADA-compliant service animal policy, pay a maximum civil penalty of $55,000, and establish a $1.5 million fund to compensate idnviduals who experienced disability-based discrimination in violation of Title III of the ADA at QuikTrip facilities.
