Addendum and Extension of Settlement Agreement between the United States of America and the City of Philadelphia and the Philadelphia Police Department under Title II of the Americans with Disabilities Act, DJ # 204-62-226

Settlement Agreement (8/2/18)

  1. On August 2, 2018, the United States Department of Justice (Department) and the City of Philadelphia and the Philadelphia Police Department (PPD) (collectively, the Parties) entered into a Settlement Agreement (Agreement) under Title II of the Americans with Disabilities Act of 1990 (ADA), 42 U.S.C. §§ 12131-12134, and the Department’s implementing regulation, 28 C.F.R. Part 35.  The Agreement, which is wholly incorporated by reference herein, had a term of three years and was set to expire on August 2, 2021.  See Agreement, paragraph 24.
  2. This Addendum and Extension (Addendum) extends the Agreement by one year.  The Agreement will expire on August 2, 2022, instead of August 2, 2021.  This Addendum is necessary because PPD has not fully implemented the training requirements of Paragraphs 14 and 15 of the Agreement.
  3. This Addendum also requires PPD to report to the United States every three months how many police officers have been trained.  The first report is due three months from the date of this Addendum, and the reports must continue until training is complete or this Agreement expires, whichever occurs first.  PPD must send the reports by email to charlotte.lanvers@usdoj.gov or as directed by the United States. The subject line of emails will reference Philadelphia Police Department and DJ# 204-62-226.
  4. The person signing for PPD represents that they are authorized to bind PPD to this Addendum and agrees that PPD shall continue to comply with the obligations set out in the Agreement throughout the term of this Addendum.
