ATTACHMENT I: Modifications to Newly Constructed Facilities

Please Note: Paragraph 48 of the Settlement Agreement requires that within three months of the effective date of this Agreement, the City provide signage as necessary to comply with 28 C.F.R. § 35.163(b), after having surveyed all facilities that are the subject of this Agreement for the purpose of identifying those that have multiple entrances not all of which are accessible. The chart below lists the facilities surveyed by the Department, the access issues identified during the survey, and the actions required to correct the access issues. Required actions are listed using an alphanumeric code. The key to the alphanumeric codes is provided in Attachment M to this Agreement. In order to ensure that the following spaces and elements in City facilities for which construction was commenced after January 26, 1992, are readily accessible to and usable by persons with disabilities, the City will take the actions referenced by the alphanumeric code and described in detail in Attachment M to this Settlement Agreement within the time periods specified below, which time periods will begin to run on the effective date of this Agreement.

2.2. Exterior Entrance and Doors: The building does not have directional signage posted at inaccessible entrances and does not have the International Symbol of Accessibility posted at accessible entrances. D16 36 months
2.3. Interior Entrance and Doors: All of the interior doors are inaccessible because they require more than 5 pounds of force to open. D2 36 months
2.4. Ramp located on the inside near the main entrance: The ramp is inaccessible because the ends of the handrails are not rounded or returned. R4 36 months
2.5. Locker Room:    
2.5.a. There is no accessible room signage provided. D26 36 months
2.5.b. The bench is inaccessible because it is not fixed to the wall. LR1 36 months
2.6. Toilet Room with Stalls (Men): The door is inaccessible because it requires 9 pounds of force to open. D2 36 months
2.7. Toilet Room with Stalls (Women):    
2.7.a. The door is inaccessible because it requires 10 pounds of force to open. D2 36 months
2.7.b. The sanitary napkin dispenser is inaccessible because the controls require twisting of the wrist to operate. TR3 36 months
2.7.c. The top of the vanity protrudes into the walkway and is not detectable to blind persons using a cane. AR8 36 months
3. Lester Park Ballfields, located at Farm to Market Road 2965 & Deen Road  
3.1. Parking (near the playground and picnic area): The parking lot, with a total of 40 parking spaces, is inaccessible because it is not firm, stable, and slip resistant, the spaces are unmarked and there is no signage. This lot requires 1 van accessible space and 1 standard accessible space. P3 36 months
3.2. Picnic Pavillion: The picnic tables are inaccessible because none provide the required knee space. PD6 36 months
3.3. Route to BBQ grills, horseshoe area and playground equipment: The routes are inaccessible because they are not firm, stable, and slip resistant. AR1 36 months
3.4. Parking (near the ballpark lot): The designated van accessible parking is inaccessible because the access aisle is 60 inches wide. P8 36 months
3.5. Route from parking to ballfield: The route is inaccessible because its slopes up to 9.4%. AR1 36 months
3.6. Assembly Area (Baseball Fields): None of the bleachers have wheelchair seating as an integral part of the fixed seating plan. AA7 36 months
3.7. Toilet Room with Stalls (Men): There is no signage provided for the toilet room. TR18 36 months

4.2.a. The toilet room sign is mounted on the door and has no raised or Braille characters. TR17 36 months
4.2.b. The door is inaccessible because there is an 8 inch step within the door's required maneuvering clearance. D13 36 months
4.2.c. The lavatory is inaccessible because the hot water pipes are not insulated or otherwise configured to protect against contact. TR12 36 months
4.2.d. The urinal is inaccessible because the rim is 19 inches high. TR20 36 months
