ATTACHMENT J: Modifications to Altered Facilities

Please Note: Paragraph 35 of the Settlement Agreement requires that within three (3) months of the effective date of this Agreement, the City provide signage as necessary to comply with 28 C.F.R. § 35.163(b), after having surveyed all facilities that are the subject of this Agreement for the purpose of identifying those that have multiple entrances not all of which are accessible.

The chart below lists the facilities surveyed by the Department, the access issues identified during the survey, and the actions required to correct the access issues. Required actions are listed using an alphanumeric code. The key to the alphanumeric codes is provided in Attachment M to this Agreement.

In order to ensure that the following spaces and elements in the City’s facilities in which alterations occurred after January 26, 1992, are readily accessible to and usable by persons with disabilities, the City will take the actions referenced by the alphanumeric code and described in detail in Attachment M to this Settlement Agreement within the time period specified below, which time period will begin to run on the effective date of this Agreement.

2.2.b. The route to the picnic table pavilion is inaccessible because it is not firm, stable, or slip resistant. AR1 6 months
2.3. Picnic Table. The picnic tables are inaccessible because none provide the required knee space. DW1 6 months
2.4. Gazebo. The framed openings are 72 inches high, and the corner brackets protrude into the circulation path, posing an overhead hazard to individuals who are blind or have low vision. AR6 6 months
3. Fowler Park, 800 C Avenue    
3.1. Exterior Route. There are no accessible routes connecting the various park amenities (e.g., play areas, benches, trash and recycling cans) because the routes are not firm, stable or slip resistant. AR1 6 months
3.2. Picnic Table. The picnic tables are inaccessible because none provide the required knee space. DW1 6 months
3.3. Drinking Fountain. The drinking fountain is inaccessible because the hardware requires tight grasping, pinching, or twisting of the wrist to operate. DF2 6 months
4. Reeves Park, 761 Augusta Street    
4.1. Exterior Route   6 months
4.1.a. The route into the park is inaccessible because the driveway that provides a means of pedestrian access for people with disabilities from the sidewalk has an apron slope ranging from 9.7% to 11.2%. AR1 6 months
4.1.b. The route between the accessible parking and the sidewalk to the gazebo is inaccessible because it can be blocked by legally parked cars. AR1 6 months
4.1.c. The route between the accessible parking and the sidewalk to the gazebo is inaccessible because it narrows to 29 inches wide. AR3 6 months
4.1.d. The ramp to the Gazebo is inaccessible because there are unbeveled changes in level of more than ¼ inch at the base and between the boards. AR1 6 months
