Attachment J: Modifications to Altered Facilities

Please Note: Paragraph 29 of the Settlement Agreement requires that within three months of the effective date of this Agreement, the Town will provide signage as necessary to comply with 28 C.F.R. § 35.163(b), after having surveyed all facilities that are the subject of this Agreement for the purpose of identifying those that have multiple entrances not all of which are accessible.
In order to ensure that the following spaces and elements in Town facilities, which have been altered after January 26, 1992, are readily accessible to and usable by persons with disabilities, the Town will take the following actions:
- Anna Belle Farmer Park: Within 18 months of the effective date of this Agreement, the Town will complete the following modifications:
- Parking: Although the parking lot has a total of 14 spaces, it does not have a van accessible parking space reserved for persons with disabilities. On the shortest accessible route to the accessible entrance, provide one van accessible space designated as reserved for people with disabilities. Ensure that the van accessible space is a minimum of 96 inches wide and served by access aisles at least 96 inches wide. Provide a vertical sign with the International Symbol of Accessibility and an additional "Van-Accessible" sign located below it such that these signs cannot be obstructed by parked vehicles. Ensure that parking space and access aisle for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 2% in all directions, and that their surfaces are firm, stable, and slip-resistant. Standards §§ 4.1.2(5), 4.6, 4.30.7(1).
- Picnic Tables: The park has five picnic tables, all inaccessible to persons who use wheelchairs. Provide at least one picnic table on an accessible route such that there is knee space at the table at least 27 inches high, 30 inches wide, and 19 inches deep, and such that the height of the top of the table is between 28 inches and 34 inches above the ground. Standards §§ 4.1.3(18), 4.32.3, 4.32.4.
- Accessible Route: There is no accessible route connecting the parking lot, the picnic area, play equipment, and the Gazebo. Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public. The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and have a running slope of less than 5% (or have been constructed as a fully accessible ramp) and a cross slope of less than 2%. Standards §§ 4.1.3(1), 4.3, 4.5, Fig. 7.
- Gazebo: The Gazebo does not have an accessible entrance due to the presence of steps. Provide a ramp that is at least 36 inches wide and has a slope not exceeding 1:12 and a cross slope not exceeding 1:50. Provide level landings at the top and bottom of the ramp that are at least as wide as the ramp and at least 60 inches long. If the ramp changes direction, provide a level landing measuring at least 60 inches by 60 inches at the change in direction. On both sides of the ramp, provide handrails between 1¼ inches and 1½ inches in diameter with a continuous gripping surface. Ensure that the handrails extend at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface, that they are mounted between 34 inches and 38 inches above the ramp surface, that they will not rotate within their fittings, and that they have ends that are rounded or return smoothly to floor, wall, or post. Provide edge protection that is at least 2 inches high at the ramp's drop off sides. Ensure that the ramp and its level landing at the top and bottom are designed and maintained so that water does not accumulate on walking surfaces. Standards §§ 4.1.3(19)(a), 4.3, 4.33.5, 4.1.2(1), 4.1.2(2), 4.8.5.
- None of the play equipment is usable by children with disabilities. Ensure program access by providing at least one piece of play equipment that is on an accessible route and has a transfer platform to enable children who use wheelchairs to use it. 28 C.F.R. § 35.149.
- Sidewalks at Specified Intersections: Within 24 months of the effective date of this Agreement, the Town will complete the following modifications to Town sidewalks at the locations specified:
- Intersection of State Highways 82 (Thornton Street) and 64:
- At the south-west corner, the route is inaccessible. The sidewalk has numerous cracks with lips at cracks and joints, contains gravel, and is not smooth. The path is only 27 inch wide at a location between a Simon's Ace Home Center display tractor and sand bags placed around a sign. The curb slopes 8.3% at the top and 11.7% near the street. The flare slopes 7.4%. Provide one accessible route connecting sidewalk and curb ramp at this corner of the intersection that, to the maximum extent feasible, coincides with the route for the general public. The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%). Standards §§ 4.1.3(1), 4.1.6(1)(b), 4.3, 4.5, Fig. 7.
- At the north-west corner, the route is inaccessible. The curb ramp has a slope of 9.6% with a cross slope of 2.7% and a 11.9% flare. The curb ramp has an uneven surface, and a significant deposit of gravel where the road meets the curb ramp. Provide one accessible route connecting sidewalk and curb ramp at this corner of the intersection that, to the maximum extent feasible, coincides with the route for the general public. The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%). Standards §§ 4.1.3(1), 4.1.6(1)(b), 4.3, 4.5, Fig. 7.
- At the south-east corner, a ramp was installed, but it is inaccessible. The 232 inches long ramp is not located at the corner, and runs parallel to Highway 64. The built-up curb ramp impermissibly extends into the Highway. The ramp slopes 6.7% with a 4.8% cross slope, and 2.2% flare. The ramp lacks handrails and edge protection. Provide a curb ramp located so that it does not project into the street and all aspects of the ramp or curb cut comply with the Standards. Standards §§ 4.1.2(1), 4.1.2(2), 4.1.6(1)(b), 4.3.8, 4.7.6.
- At the north-east corner, a ramp was installed, but it is inaccessible. The 300 inches long ramp is not located at the corner, and runs parallel to highway 64. The built-up curb ramp impermissibly extends into the Highway. The ramp is not located at the corner, but is east of the intersection. The curb ramp slopes 4.6% with a cross slope of 4.2%, and a 2.5% flare. There is a deposit of dirt and gravel where the curb meets the street. The curb ramp lacks handrails and edge protection. The built-up curb ramp impermissibly extends into Highway 64. Provide a curb ramp located so that it does not project into the street and all aspects of the ramp or curb cut comply with the Standards. Standards §§ 4.1.2(1), 4.1.2(2), 4.1.6(1)(b), 4.3.8, 4.7.6.
- Intersection of Main Street And State Highway 82 (Thornton Street)
- North-West corner (by the Red Fern): The route from the accessible parking space on Main street to the sidewalk is inaccessible because there is no way for someone who uses a wheelchair to get on or off the sidewalk near the parking space or at the corner. Provide a curb ramp near the parking space and at the intersection corner that are at least 36 inches wide, have a maximum slope of 1:12, are located so that it cannot be obstructed by parked vehicles, and have stable, firm, and slip-resistant surfaces with a detectable warning extending the full width and depth of the ramps. If the curb ramps are located where pedestrians must walk across it, provide either flared sides (with a maximum slope of 1:10) or handrails or guardrails to protect against cross traffic. Standards § 4.3.8, 4.7, Fig. 12.
- South-East corner (near liquor store): The route on the sidewalk is inaccessible because there is no way for someone who uses a wheelchair to get on or off the sidewalk at the corner as the curb is 2 inches high. Provide a curb ramp that is at least 36 inches wide, has a maximum slope of 1:12, is located so that it cannot be obstructed by parked vehicles, and has a stable, firm, and slip-resistant surface with a detectable warning extending the full width and depth of the ramp. If the curb ramp is located where pedestrians must walk across it, provide either flared sides (with a maximum slope of 1:10) or handrails or guardrails to protect against cross traffic. Standards § 4.3.8, 4.7, Fig. 12.
- North-East corner (near church): The route on the sidewalk is inaccessible because there is no way for someone who uses a wheelchair to get on or off the sidewalk at the corner curb. Provide a curb ramp that is at least 36 inches wide, has a maximum slope of 1:12, is located so that it cannot be obstructed by parked vehicles, and has a stable, firm, and slip-resistant surface with a detectable warning extending the full width and depth of the ramp. If the curb ramp is located where pedestrians must walk across it, provide either flared sides (with a maximum slope of 1:10) or handrails or guardrails to protect against cross traffic.
