Attachment K: Program Access in Existing Facilities

 

Please Note: Paragraph 37 of the Settlement Agreement requires that within three months of the effective date of this Agreement, the City provide signage as necessary to comply with 28 C.F.R. ' 35.163(b), after having surveyed all facilities that are the subject of this Agreement for the purpose of identifying those that have multiple entrances not all of which are accessible.

 

The technical requirements and, where appropriate, the scoping requirements of the Standards are used as a guide for determining whether a program or activity held in an existing facility is Areadily accessible to and usable by@ persons with disabilities and for determining what changes are necessary to make this program or activity accessible if it continues to be provided in the existing facility in question.  See 28 C.F.R. '' 35.150 (b)(1), 35.151.

                     

In order to ensure that each of the City=s programs, services, and activities operating at a facility that is the subject of this Agreement, when viewed in its entirety, are readily accessible to and usable by persons with mobility impairments, the City will take the following actions:

 

1.                  Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the Columbus Library Branch, located at 4350 East Twenty-Second Street:

 

a.                  Parking: The space that is designated as Avan-accessible@ has a narrow access aisle and the space itself is narrower than 96 inches.  On the shortest accessible route to the accessible entrance, provide at least 1 van accessible space designated as reserved for people with disabilities.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

b.                  Single-User Unisex Toilet Room

 


i.                     The toilet room sign is mounted on the door.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

ii.                   The toilet room door requires 8 pounds of force to operate.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

iii.                  Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards '' 4.28.1, 4.28.3.

 

iv.                 The lavatory hot water and drain pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.

 

v.                   The toilet centerline measures 19 inches from the side wall.  Provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards ' 4.16.2, Fig. 28.                       

 

vi.                 The distance of the far end of the side grab bar to the rear wall is 46 inches.  Provide a side grab bar that is at least 42 inches in overall length, with the far end mounted at least 54 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Standards ' 4.16.4, Fig. 29(b).

 

c.                  Drinking Fountain:  The higher drinking fountain is a protruding object that is not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

d.                  Telephone:  The pay telephone does not have volume control.  Provide an accessible telephone that is hearing aid compatible and has a volume control mechanism.  Standards ' 4.31.

 

2.                  Within 12 months of the effective date of this Agreement, the City will complete the following modifications to Golf Links Complex, located at 2400 South Craycroft Road:

 


a.                  Parking:  Although there are 10 parking spaces designated as reserved for persons with disabilities, there are no van accessible spaces.  On the shortest accessible route to the accessible entrance, provide 1 van accessible space and 9 standard spaces designated as reserved for people with disabilities.  Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.6, 4.30.7(1).

 

b.                  Accessible Route:  The route between the accessible parking spaces and the playground equipment is gravel and therefore is inaccessible to persons using wheelchairs.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

c.                  Drinking Fountain:  Although a lower drinking fountain is provided at Building 2, there is no drinking fountain provided for people who have difficulty bending or stooping.  For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards ' 4.1.3(10)(a).

 

d.                  Building 1 Toilet Rooms with Stalls

 

i.                     Men=s Toilet Room

 


(1)               There is no accessible toilet room sign.  Provide a toilet room sign with raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

(2)               The air dryer protrudes into the walkway and would not be detectable by a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

(3)               No rear grab bar is provided in the toilet stall.  Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall; mounted 33 to 36 inches above the finished floor; with a diameter between 13 and 12 inches; with 12 inches between the grab bar and the wall; and at least 12 inches between the grab bar and any other object, such as a toilet seat cover dispenser.  Standards '' 4.1.3(11), 4.22.4, 4.17.6, 4.26.2, Fig. 30.

 

(4)               The toilet paper dispenser is inaccessible because it is mounted too far forward from the rear wall.  Provide a toilet paper dispenser that is mounted with its top at least 12 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards '' 4.1.3(11), 4.22.4, 4.17.3, Fig. 30(d).

 

ii.                   Women=s Toilet Room

 


(1)               The toilet room sign has a centerline that is 52 inches above the finished floor.  Provide a toilet room sign with raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

(2)               The air dryer protrudes into the walkway and would not be detectable by a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

e.                  Building 2 Toilet Rooms with Stalls

 

i.                     Men=s Toilet Room

 

(1)               The toilet room sign is not accessible.  Provide a toilet room sign with raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

(2)               The air dryer protrudes into the walkway and would not be detectable by a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

ii.                   Women=s Toilet Room

 

(1)               The toilet room sign is not accessible.  Provide a toilet room sign with raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.


 

(2)               No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards '' 4.1.3(11), 4.22.6, 4.19.6.

 

(3)               The air dryer protrudes into the walkway and would not be detectable by a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

(4)               The toilet paper dispenser is mounted too far from the rear wall.  Provide a toilet paper dispenser that is mounted with its top at least 12 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards '' 4.1.3(11), 4.22.4, 4.17.3, Fig. 30(d).           

 

 

3.                  Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the Joel D. Valdez Main Library, located at 101 North Stone Avenue:

 

a.                  Parking

 


i.                     Lower Level 1:  Although the parking lot has a total of 51 parking spaces, including 1 standard space and 1 van-accessible space designated as reserved for people with disabilities, the van-accessible space does not have an access aisle, it is not on the shortest accessible route to the accessible entrance, and there is inadequate vertical clearance at the space or on the way to or from it.  On the shortest accessible route to the accessible entrance, provide 1 van accessible space and 2 standard spaces designated as reserved for people with disabilities.  Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

ii.                   Lower Level 2:  Although the parking lot has a total of 96 parking spaces, including 6 standard spaces designated as reserved for people with disabilities, some of the reserved spaces are not served by access aisles or their access aisles are too narrow and the signage for each of them can be obstructed by parked vehicles.  On the shortest accessible route to the accessible entrance, provide 4 standard spaces designated as reserved for people with disabilities.  Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

b.                  Accessible Route B First Floor Children=s Books Section:  The route between the book carousels is only 29 inches wide.  Provide an accessible route between the carousels with a minimum clear width of 36 inches, except at doors, where the width may decrease to 32 inches.  Standards '' 4.3.3, 4.13.5.                       

 

c.                  Elevator

 


i.                     The elevator doors do not automatically reopen without contact for an obstruction at 5 to 29 inches, and the doors do not remain open for at least 20 seconds after reopening for an obstruction. Provide doors that open and close automatically with a reopening device that will stop and reopen the car door and hoistway door automatically if the door becomes obstructed by an object or person.  Ensure that the device is capable of completing these operations without requiring contact for obstructions passing through the opening at heights of 5 inches and 29 inches above the finished floor; that door reopening devices remain effective for at least 20 seconds, after which the doors may close; that the minimum time from notification that a car is answering a call until the doors of that car start to close is 5 seconds; and that the minimum time for elevator doors to remain fully open in response to a car call is 3 seconds.  Standards '' 4.10.6, 4.10.7, 4.10.8, Figs. 20, 21.

 

ii.                   Although emergency communications are provided, the door to the emergency communications equipment requires tight grasping or pinching to operate.  Provide a two-way communication system such that it does not require voice communication, the highest operable part is a maximum of 48 inches above the finished floor of the car, and it is identified by a raised symbol and lettering located adjacent to the device.  If the system uses a handset, ensure that the length of the cord from the panel to the handset is at least 29 inches.  If the system is located in a closed compartment, ensure that the compartment door hardware operates without tight grasping, pinching or twisting of the wrist.  Standards ' 4.10.14.

 

d.                  The drinking fountains near the Men=s and Women=s toilet rooms and the counter at the computer reservation center are protruding objects that are not cane-detectable.  Provide accessible routes at these locations such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

e.                  Magazine Displays:  Throughout the facility, some magazines are displayed as high as 74 inches above the finished floor.  Ensure that each magazine display has a minimum of 36 inches of clear width between units and with reach ranges of between 18 inches and 54 inches (maximum height of 48 inches is preferred) above the finished floor.  Standards ' 8.4, Fig. 55.

 

f.                    Lower Level Meeting Room, Children=s Meeting Room, Second Floor Conference Room, and Third Floor Conference Room:  The assembly areas, including meeting and conference rooms, are inaccessible to people with hearing impairments because no permanent or portable assistive listening system is available.  Provide a permanently installed assistive listening system (ALS) in each room or a portable ALS with an adequate number of electrical outlets or other supplementary wiring necessary to support a portable assistive listening system in each assembly area.  Also provide the number of receivers for use by the general public as in accordance with Standards ' 4.1.3 (19)(b) and signage indicating their availability.  Standards '' 4.30, 4.33.

 

g.                  Women=s Lower Level Toilet Room with Stalls


 

i.                     The pressure required to open the door is 15 pounds of force.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

ii.                   Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards '' 4.28.1, 4.28.3.

 

iii.                  The toilet seat cover dispenser is mounted at 48 inches above the finished floor and requires a forward reach over the toilet.  Provide a toilet seat cover dispenser such that it complies with Fig. 5 for a forward reach or with Fig. 6 for a side reach and such that it is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach, respectively, by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

iv.                 The lavatory counter and the sanitary napkin dispenser are protruding objects that are not cane-detectable.  Provide accessible routes at these locations such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

v.                   The lavatory hot water and drain pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.

 

vi.                 Toilet Stall for People with Disabilities

 

(1)               The stall is only 43 inches wide and the toilet centerline is 21 inches from the side wall.  Provide a toilet stall that is at least 60 inches wide and at least 56 inches deep for a wall-mounted toilet or at least 59 inches deep for a floor-mounted toilet, such that the centerline of the toilet is exactly 18 inches from the near side wall or partition, and there is at least 9 inches of toe clearance above the floor at the front partition if the stall is no more than 60 inches deep.  Standards ' 4.17, Fig. 30.

 


(2)               The toilet paper dispenser is mounted on the side wall opposite the side grab bar.  Provide a toilet paper dispenser that is mounted with its top at least 12 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards ' 4.17.3, Fig. 30(d).

 

(3)               The rear grab bar is 24 inches in length.  Provide a rear grab bar that is at least 36 inches in overall length with the closer end no more than 6 inches from the side wall.  Standards ' 4.17.6, Fig. 30.

 

h.                  Men=s Lower Level Toilet Room with Stalls

 

i.                     The pressure required to open the door is 15 pounds of force.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

ii.                   Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards '' 4.28.1, 4.28.3.

 

iii.                  The toilet seat cover dispenser is mounted at 56-1/2 inches above the finished floor and requires a forward reach over the toilet.  Provide a toilet seat cover dispenser such that it complies with Fig. 5 for a forward reach or with Fig. 6 for a side reach and such that it is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach, respectively, by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

iv.                 The air dryer and the lavatory counters are protruding objects that are not cane-detectable.  Provide accessible routes at these locations such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

v.                   The lavatory hot water and drain pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.

 


vi.                 Toilet Stall for Persons with Disabilities:  The stall measures 41 inches wide, the toilet centerline is at 20 inches from the side wall, the flush control is on the closed side, the toilet paper dispenser is mounted on the side wall opposite the side grab bar, and the rear grab bar is only 24 inches long.  Provide a toilet stall that is at least 60 inches wide and at least 56 inches deep for a wall-mounted toilet or at least 59 inches deep for a floor-mounted toilet, such that the centerline of the toilet is exactly 18 inches from the near side wall or partition, and there is at least 9 inches of toe clearance above the floor at the front partition if the stall is no more than 60 inches deep.  Standards ' 4.17, Fig. 30.

 

i.                    Women=s First Floor Toilet Room with Stalls

 

i.                     Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards '' 4.28.1, 4.28.3.

 

ii.                   The air dryer, lavatory counter, and metal shelf are protruding objects that are not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

iii.                  There is insufficient turning space within the toilet room.  Provide an unobstructed turning space at least 60 inches in diameter or a T-shaped space complying with Fig. 3(b).  Standards '' 4.22.3, 4.2.3, Fig. 3.

 

iv.                 The lavatory hot water and drain pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.

 

v.                   Toilet Stall for Persons with Disabilities

 


(1)               The toilet seat cover dispenser is mounted at 48 inches above the finished floor and requires a forward reach over the toilet.  Provide a toilet seat cover dispenser such that it complies with Fig. 5 for a forward reach or with Fig. 6 for a side reach and such that it is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach, respectively, by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

(2)               The stall measures 42 inches wide, the toilet centerline is 20 inches from the side wall, the flush control is on the closed side of the stall, and the rear grab bar is only 24 inches long.  Provide a toilet stall that is at least 60 inches wide and at least 56 inches deep for a wall-mounted toilet or at least 59 inches deep for a floor-mounted toilet, such that the centerline of the toilet is exactly 18 inches from the near side wall or partition, and there is at least 9 inches of toe clearance above the floor at the front partition if the stall is no more than 60 inches deep.  Standards ' 4.17, Fig. 30.

 

j.                    Men=s First Floor Toilet Room with Stalls

 

i.                     Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards '' 4.28.1, 4.28.3.

 

ii.                   No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards ' 4.19.6.

vi.                 The toilet stall measures 42 inches wide, the toilet centerline is 20-1/2 inches, the toilet paper dispenser is mounted on the side wall opposite the side grab bar, and the rear grab is only 25 inches long.  There is no accessible stall provided.  Provide a Astandard@ accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall=s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

 

k.                  Women=s Second Floor Toilet Room with Stalls

(2)               The toilet flush control is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.16.5, 4.17.2, 4.27.4.                       

 

(3)               The toilet paper dispenser interferes with the use of the side grab bar.  Provide a side grab bar that has at least 12 inches between the grab bar and any other object, such as the toilet paper dispenser.  Standards '' 4.17.6, 4.26.2, Fig. 39.

v.                   Because 6 toilet stalls are provided, at least one should be configured as an Aalternate@ stall for ambulatory people with disabilities.  Provide at least one stall that is exactly 36 inches wide with an outward swinging, self-closing door and parallel grab bars complying with Fig 30(d).  Standards '' 4.22.4, Fig. 30(d).

 

vi.                 Toilet Stall for Wheelchair Users

 

(1)               The toilet stall measures 55 inches wide, the toilet centerline is 20 inches, the flush control is only the Aclosed@ side, and the rear grab bar is only 24 inches long.  Provide a Astandard@ accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall=s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

 


(2)               The toilet paper dispenser is mounted less than 1 2 inches under the side grab bar.  Provide a toilet paper dispenser that is mounted with its top at least 12 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards ' 4.17.3, Fig. 30(d).

 

n.                  Men=s Third Floor Toilet Room with Stalls                       

 

i.                     The pressure required to open the door is 10 pounds of force.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

(1)               The toilet stall for persons with disabilities is 55 inches wide.  Provide a toilet stall that is at least 60 inches wide and at least 56 inches deep for a wall-mounted toilet or at least 59 inches deep for a floor-mounted toilet, such that the centerline of the toilet is exactly 18 inches from the near side wall or partition, and there is at least 9 inches of toe clearance above the floor at the front partition if the stall is no more than 60 inches deep.  Standards ' 4.17, Fig. 30.

 

(2)               The toilet paper dispenser interferes with the use of the side grab bar.  Provide a side grab bar that has at least 12 inches between the grab bar and any other object, such as the toilet paper dispenser.  Standards '' 4.17.6, 4.26.2, Fig. 39.

 

(3)               The rear grab bar is 24 inches in length.  Provide a rear grab bar that is at least 36 inches in overall length with the closer end no more than 6 inches from the side wall.  Standards ' 4.17.6, Fig. 30.

 

 


4.                  Within 24 months of the effective date of this Agreement, the City will complete the following modifications to the Randolph Community Center, located at 200 South Alvernon Way:

 

a.                  Building 1 B Gym and Meeting Area

 

i.                     Parking Next to Building 1: One of the parking spaces reserved for persons with disabilities narrower than 96 inches and the access aisle for the van-accessible space is only 65 inches wide.  Provide designated accessible parking spaces that are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Provide van accessible spaces that are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  Standards '' 4.1.2(5), 4.6.3, Fig.9.

 

ii.                   Exterior Entrance: There is no signage with the International Symbol of Accessibility at the designated accessible entrances, and no signage with the International Symbol of Accessibility at inaccessible entrances directing users to the accessible entrances.  Provide accessible directional signage with the International Symbol of Accessibility at inaccessible entrances directing users to the accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances.  Standards '' 4.1.3(8)(d), 4.13, 4.30.

 

iii.                  Lobby Telephone:  The  highest operable part of the phone is 55 inches and requires a front reach.  Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards.  Standards '' 4.31, 4.30.7(2).

 

iv.                 Lobby Information Counter:  The information counter at the Building 1 lobby is 42 inches high.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor.  Standards '' 7.2(1), 4.3.  Alternatively, provide a clip board.


 

v.                   Classrooms: No permanent or portable assistive listening system is available.  Provide a permanently installed assistive listening system (ALS) in each meeting room or a portable ALS with an adequate number of electrical outlets or other supplementary wiring necessary to support a portable assistive listening system in each assembly area.  Also provide the number of receivers for use by the general public as in accordance with Standards ' 4.1.3 (19)(b) and signage indicating their availability.  Standards '' 4.30, 4.33.

 

vi.                 Single-User Unisex Toilet Room B Building 1 Lobby

 

(1)               The signage provided is inaccessible because it is mounted on the door.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

(2)               The pressure required to open the door is 8 pounds of force.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

(3)               No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

(5)               The rear grab bar at the toilet is 24 inches in length.  Provide a rear grab bar that is at least 36 inches in overall length with the closer end no more than 6 inches from the side wall.  Standards ' 4.16.4, Fig. 29.

 

b.                  Building 2B Performing Arts


 

i.                     Picnic Tables Next to Building 2: There is insufficient knee clearance for a person using a wheelchair to sit at the picnic tables and they are not on an accessible route.  Provide at least one picnic table on an accessible route such that there is knee space at the table at least 27 inches high, 30 inches wide, and 19 inches deep, and such that the height of the top of the table is between 28 inches and 34 inches above the ground.  Standards '' 4.32.3, 4.32.4.

 

ii.                   Music Room Entry:  There is inadequate maneuvering clearance on the pull/latch side of the door, which requires a forward approach.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards ' 4.13.6, Fig. 25(a).

 

iii.                  Music Room, Photo Studio, and Auditorium Doors: In each, the room entrance door requires more than 5 pounds of force to operate.  In each, provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

iv.                 Auditorium

 

(1)               There is no accessible route from the audience area to the performance stage.   Provide an accessible route connecting the wheelchair seating locations to all spaces used by performers.  Standards '' 4.3, 4.33.5.

 

(2)               There is no assistive listening system available.  Provide a permanently installed assistive listening system serving the fixed seating.  Ensure that the seating served by the system is located within a 50 foot viewing distance of the stage or playing area and has a complete view of the stage or playing area.  Provide the number of receivers required by section 4.1.3(19)(b) for use by the general public and signage indicating their availability.  Standards '' 4.30, 4.33.

 

v.                   Single-User Unisex Toilet Room Near Music Room

 


(1)               The signage provided is mounted on the door.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

c.                  Ramp:  The slope of the ramp between the parking to Buildings 3 and 4 exceeds 1:12, especially the portion that extends past the level landing.  Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces.  Standards '' 4.3.8, 4.8.

 

d.                  Building 3 B Pottery Studio

iii.                  Single-User Unisex Toilet Room

e.                  Building 4B Arts and Crafts

 

i.                     Parking Behind Building 4:  The parking reserved for persons with disabilities behind Building 4 is not located on the shortest accessible route to the accessible facility entrance.  Provide fully accessible parking that is located on the shortest accessible route to an accessible pedestrian entrance to the facility.  Standards ' 4.6.2.

 


ii.                   Although a lower fountain is provided for persons who use wheelchairs, there is no fountain provided for persons who have difficulty bending or stooping.  For each lower drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards ' 4.1.3(10)(a).

 

iii.                  Single-User Unisex Toilet Room

5.                  Within 24 months of the effective date of this Agreement, the City will complete the following modifications to the Randolph Golf Complex, located at 600 South Alvernon Way:

 

a.                  Parking:  There is no van accessible space.  Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Ensure that there is at least one van accessible space and that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

b.                  Golf Pro Shop Counter:  The retail counter at the Golf Pro Shop is 41 inches above the ground.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the ground.  Standards '' 7.2(1), 4.3.

 

c.                  North Snack Shop Counter


 

i.                     The order counter at the North Snack Shop is 38 inches in height above the finished floor.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor.  Standards '' 7.2(1), 4.3.

 

ii.                   The order counter is a protruding object that is not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

d.                  Randolph Clubhouse Counters

 

i.                     The outdoor counter at the Randolph Clubhouse is 42 inches in height above the ground.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the ground.  Standards '' 7.2(1), 4.3.

 

ii.                   The inside counter at the Randolph Clubhouse is 41 inches in height above the finished floor.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the ground.  Standards '' 7.2(1), 4.3.

 

e.                  North Snack Shop Picnic Tables:  There is insufficient knee clearance for a person using a wheelchair to sit at the picnic table.  Provide at least one picnic table on an accessible route such that there is knee space at the table at least 27 inches high, 30 inches wide, and 19 inches deep, and such that the height of the top of the table is between 28 inches and 34 inches above the ground.  Standards '' 4.32.3, 4.32.4.

 

f.                    Women=s Toilet Room with Stalls Next to Clubhouse

 

i.                     The signage is mounted on the door.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.


 

ii.                   The pressure required to open the door is 11 pounds.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

iii.                  Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards '' 4.28.1, 4.28.3.

 

iv.                 The paper towel dispenser is a protruding object that is not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

v.                   Toilet Stall for Persons with Disabilities

 

(1)               The toilet centerline measures 20 inches from the side wall.  Provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards ' 4.17.3, Fig. 30.                       

 

(2)               The toilet flush control is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.16.5, 4.17.2, 4.27.4.

 

(3)               The rear grab bar has a closer end 12 inches from the side wall.  Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall; mounted 33 to 36 inches above the finished floor; with a diameter between 13 and 12 inches; with 12 inches between the grab bar and the wall; and at least 12 inches between the grab bar and any other object, such as a toilet seat cover dispenser.  Standards '' 4.17.6, 4.26.2, Fig. 30.

 

g.                  Men=s Toilet Room with Stalls Next to Clubhouse

(3)               No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 


(4)               The rear grab bar has a closer end 12 inches to the side wall.  Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall; mounted 33 to 36 inches above the finished floor; with a diameter between 13 and 12 inches; with 12 inches between the grab bar and the wall; and at least 12 inches between the grab bar and any other object, such as a toilet seat cover dispenser.  Standards '' 4.17.6, 4.26.2, Fig. 30.

 

(5)               The toilet seat cover dispenser is mounted at 47 inches above the finished floor and requires a forward reach over the toilet.  Provide a toilet seat cover dispenser such that it complies with Fig. 5 for a forward reach or with Fig. 6 for a side reach and such that it is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach, respectively, by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

h.                  Women=s Toilet Room with Stalls Next to Banquet Room

 

i.                     The signage is mounted on the door.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

v.                   Toilet Stall for Persons with Disabilities

 

(1)               The toilet seat cover dispenser is mounted at 48 inches above the finished floor and requires a forward reach over the toilet.  Provide a toilet seat cover dispenser such that it complies with Fig. 5 for a forward reach or with Fig. 6 for a side reach and such that it is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach, respectively, by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

(1)               The toilet seat cover dispenser is mounted at 48 inches above the finished floor behind the toilet.  Provide a toilet seat cover dispenser such that it complies with Fig. 5 for a forward reach or with Fig. 6 for a side reach and such that it is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach, respectively, by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

(2)               The top of the seat is 20 inches above the finished floor.  Provide a toilet with a seat that measures 17 to 19 inches above the finished floor.  Standards '' 4.16.3, 4.17.2, Fig. 30(d).

 

(3)               The toilet flush control is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.16.5, 4.17.2, 4.27.4.                       

 


(4)               The rear grab bar has a closer end 12 inches to the side wall.  Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall; mounted 33 to 36 inches above the finished floor; with a diameter between 13 and 12 inches; with 12 inches between the grab bar and the wall; and at least 12 inches between the grab bar and any other object, such as a toilet seat cover dispenser.  Standards '' 4.17.6, 4.26.2, Fig. 30.

 

j.                    Telephone Outside of Clubhouse:  The telephone outside of the Clubhouse is inaccessible because no forward reach is possible, due to the phone=s height and the location of the books, and no side reach is possible due to the placement of the vending machine.  Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards.  Standards '' 4.31, 4.30.7(2).

 

k.                  Locker Rooms:  Both the men=s and women=s locker rooms contain a number of inaccessible elements and are not accessible to people with disabilities.  Provide an accessible locker room such that all of the room=s elements, including signage, door, door hardware, clear floor space, water closet, stall size and arrangement, stall door, urinal (if provided), grab bars, lavatory, mirror, controls, dispensers, lockers, fitting rooms (if provided) and showers (if provided), comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.18, 4.19, 4.23, 4.26, 4.27, 4.30, 4.35, Figs. 30, 35, 36, 37. 

 

 

6.                  Within 36 months of the effective date of this Agreement, the City will complete the following modifications to the parking lots at the Tucson Convention Center, located at 260 South Church Avenue:

 


a.                  Parking Lot A:  Although the parking lot has a total of 383 including 25 spaces designated as reserved for persons with disabilities, all except 2 accessible spaces have access aisles that are 51 inches in width, the vertical sign for 1 accessible space is obstructed by a tree, another access aisle has a tree planter protruding into the aisle width, and several are placed near stairs rather than near an accessible route to an accessible entrance.  On the shortest accessible route to the accessible entrance, provide 1 van accessible space and 7 standard space designated as reserved for people with disabilities.  Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

b.                  Parking Lot C

 

i.                     Although there are 3 van accessible parking spaces provided, 2 of the access aisles are 64 inches wide and the third is only 60 inches wide.  Provide designated van accessible parking spaces that are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  Standards '' 4.1.2(5)(b), 4.6.3, Fig.9.

 

ii.                   Although there are 12 Astandard@ spaces designated as reserved for people with disabilities, 2 of the spaces are missing vertical signage with the International Symbol of Accessibility, 1 of the spaces has a vertical sign that can be obstructed by a parked vehicle, 1 of the spaces is only 64 inches wide, and 5 of the spaces are between 87 to 93 inches wide; and, in the South Lot, the built-up curb ramp protrudes into the access aisle of several of the spaces.  On the shortest accessible route to the accessible entrance, provide 1 van accessible space and 6 standard spaces designated as reserved for people with disabilities.  Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

 

7.                  Within 36 months of the effective date of this Agreement, the City will complete the following modifications to the outdoor plazas and walkways at the Tucson Convention Center, located at 260 South Church Avenue:


 

a.                  Outdoor Round Drinking Fountain Near Service Drive and Meeting Rooms

 

i.                     The drinking fountain is inaccessible.  Provide a fountain that has a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet, and that otherwise complies with the Standards.  Standards '' 4.15, 4.27.4, Fig. 27.

 

ii.                   The drinking fountain is a protruding object that is not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

b.                  Outdoor Telephone Near Music Hall:  The outdoor telephone near the Music Hall has no volume control mechanism.  Provide an accessible telephone that is hearing aid compatible and has a volume control mechanism.  Standards '' 4.31, 4.30.7(2).

 

c.                  Outdoor Pay Telephone Near Ticket Counters:  The phone is mounted with its bottom leading edge at 30 inches above the ground surface and protrudes 12 inches into the walkway.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

d.                  The route by the North Exhibit Hall is inaccessible because the ticket counters protrude such that they are not detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

e.                  Ramps

 


i.                     Ramp Between Music Hall and Meeting Rooms, Nearest Music Hall:   The slope of the ramp is greater than 1:12.  Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces.  Standards '' 4.3.8, 4.8.

 

ii.                   Ramp Northeast of Music Hall:  The slope of the ramp is greater than 1:12.  Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces.  Standards '' 4.3.8, 4.8.

 

iii.                  Curved Ramp North of Music Hall:  The slope of the ramp is greater than 1:11, the total rise is 60 inches, and there is no level landing.  Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; with level landings measuring at least 60 inches by 60 inches when the ramp changes direction; and edge protection that is at least 2 inches high at the drop off sides.  Provide handrails that are between 13 inches and 12 inches in diameter such that the inside handrail is continuous and both handrails have a continuous gripping surface along both sides of the ramp extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface; the handrails do not rotate within their fittings; and both handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post.  Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces.  Standards '' 4.3.8, 4.8.


 

f.                   Sidewalk East of the Ticket Counters, Along Church Street:  The sidewalk east of the ticket counters and arena along Church Street is inaccessible because there are abrupt 2 to 3 inch edges in the sidewalk. Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

 

8.                  Within 36 months of the effective date of this Agreement, the City will complete the following modifications to the Leo Rich Theater at the Tucson Convention Center, located at 260 South Church Avenue:

 

a.                  Front Lobby Telephone: The highest operable part is 58 inches above the finished floor.  Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards.  Standards '' 4.31, 4.30.7(2).

 


b.                  Exterior Ramp:  The handrail alternates between being right up against the wall with no clearance and being 2 inches away from the wall.  On both sides of the ramp, provide handrails between 13 inches and 12 inches in diameter with a continuous gripping surface.  Ensure that the handrails extend at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface, that they are mounted between 34 inches and 38 inches above the ramp surface, that they will not rotate within their fittings, that they have ends that are rounded or return smoothly to floor, wall, or post, and that the clear space between the handrail and the wall is 1 2 inches.  Provide edge protection that is at least 2 inches high at the ramp=s drop off sides.  Standards '' 4.3.8, 4.8.

 

c.                  Theater Area:  There is no signage informing the public of the availability of an assistive listening system.  Provide accessible signage indicating the availability of the assistive listening system.  Standards '' 4.1.3(19)(b), 4.30.

 

d.                  Women=s Dressing Room

 

i.                     The entrance door has knob hardware.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

ii.                   There is inadequate maneuvering clearance on the latch/ pull side of the door, which requires a forward approach.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards ' 4.13.6, Fig. 25(a).

 

iii.                  There is inadequate maneuvering clearance on the latch/ push side of the door, which requires a forward approach.  On the push side of the door, provide maneuvering clearance at least 48 inches deep and provide a minimum of 12 inches of maneuvering clearance on the latch side of the door, or remove the closer or the latch.  Standards ' 4.13.6, Fig. 25(a).

 

iv.                 No accessible shower stalls are provided in the women=s dressing room.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards ' 4.21, Figs. 35, 36, 37.

 

e.                  Men=s Dressing Room

 


i.                     The entrance door has knob hardware.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.           

 

ii.                   There is inadequate maneuvering clearance on the latch/ pull side of the door, which requires a forward approach.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards ' 4.13.6, Fig. 25(a).

 

iii.                  There is inadequate maneuvering clearance on the latch/ push side of the door, which requires a forward approach.  On the push side of the door, provide maneuvering clearance at least 48 inches deep and provide a minimum of 12 inches of maneuvering clearance on the latch side of the door, or remove the closer or the latch.  Standards ' 4.13.6, Fig. 25(a).

 

iv.                 No accessible shower stalls are provided in the men=s dressing room.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards ' 4.21, Figs. 35, 36, 37.

 

f.                    Backstage Drinking Fountain:  The drinking fountain has a spout that is 42 inches above the finished floor.  Provide a fountain that has a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet, and that otherwise complies with the Standards.  Standards '' 4.15, 4.27.4, Fig. 27.

 

g.                  Men=s Lobby Toilet Room with Stalls

 


i.                     The signage has a centerline height of 64 inches and it is placed several feet from the door, where a blind person would be unlikely to find it.  Provide permanent room signage with upper case, sans serif or simple serif type letters and numerals, meeting the requirements of the Standards for character height, raised characters, finish and contrast, accompanied by Grade 2 Braille; mounted on the wall adjacent to the latch side of the door or on the nearest adjacent wall at a height of 60 inches above the finished floor to the centerline of the sign; and located so that a person may approach within 3 inches of the signage without encountering protruding objects or standing within the swing of a door.  Standards '' 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

ii.                   Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards '' 4.28.1, 4.28.3.

 

iii.                  The towel dispenser controls are mounted at 60 inches above the finished floor.  Provide a towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

iv.                 In the toilet stall for people with disabilities, the flush control is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.16.5, 4.17.2, 4.27.4.

 

h.                  Women=s Lobby Toilet Room with Stalls

iii.                  The towel dispenser controls are mounted at 68 inches above the finished floor.  Provide a towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

iv.                 In the toilet stall for persons with disabilities, no accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

v.                   Although there are 6 stalls, no ambulatory stall is provided.  Provide at least one stall that is exactly 36 inches wide with an outward swinging, self-closing door and parallel grab bars complying with Fig 30(d).  Standards '' 4.22.4, Fig. 30(d).           

 

i.                   Backstage Toilet Rooms with Stalls:  The toilet rooms contain a number of inaccessible and is not accessible to people with disabilities.  Provide an accessible toilet room such that all of the room=s elements, including signage, door, door hardware, clear floor space, water closet, stall size and arrangement, stall door, urinal (if provided), grab bars, lavatory, mirror, controls, and dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.18, 4.19, 4.26, 4.27, 4.30, Fig. 30.

 

 

9.                  Within 36 months of the effective date of this Agreement, the City will complete the following modifications to the Music Hall at the Tucson Convention Center, located at 260 South Church Avenue:

 

a.                  AMusic Hall@ Sign:  The post-mounted AMusic Hall@ sign on the plaza is a protruding object that is not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

b.                  First Floor Unisex Single User Toilet Room B Near the Back Entrance

 


i.                     Although the facility contains an emergency alarm system, there is no visual alarm provided in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards '' 4.28.1, 4.28.3.

 

ii.                   The toilet flush control is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.5, 4.27.4.

 

iii.                  The side grab bar at the toilet is mounted with the far end 48 inches from the rear wall.  Provide a side grab bar that is at least 42 inches in overall length, with the far end mounted at least 54 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.4, Fig. 29(b).

 

iv.                 The shelf by the automatic door opener protrudes into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at these locations such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

 

c.                  Auditorium

 

i.                     The auditorium, containing 2277 seats, has only 12 wheelchair seating locations.  Provide at least 24 wheelchair seating areas, each with a minimum clear ground or floor space of 66 inches wide by 48 inches deep for forward or rear access, or 66 inches wide by 60 inches deep for side access.  Ensure that the ground or floor at all wheelchair locations is level, firm, stable, and slip resistant; that wheelchair seating areas are an integral part of the fixed seating plan and are located so as to provide people with physical disabilities a choice of lines of sight comparable to those available for members of the general public; that wheelchair seating areas adjoin an accessible route that also serves as a means of egress in case of emergency; and that at least one fixed companion seat is provided next to each wheelchair seating area.  Standards '' 4.1.3(19)(a), 4.1.6(1)(b), 4.5, 4.33.

 


ii.                   There is no signage informing the public of the availability of an assistive listening system.  Provide accessible signage indicating the availability of the assistive listening system.  Standards '' 4.1.3(19)(b), 4.1.6(1)(b), 4.30.

 

iii.                  The assistive listening system is only equipped with 20 receivers.  Provide receivers for use by the general public and signage indicating their availability.  Standards '' 4.30, 4.33.

 

d.                  Backstage Areas

 

i.                     Telephone

 

(1)               The telephone provided backstage is inaccessible because the highest operable part is 65 inches above the finished floor and there is no volume control mechanism provided.  Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that are hearing aid compatible and have a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; and with a cord of at least 29 inches long from the telephone to the handset.  Standards ' 4.31.

 

(2)               The telephone is mounted with its bottom leading edge at 37 inches above the finished floor and protrudes 13 inches into the walkway.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 


ii.                   Drinking Fountain:  There is no accessible drinking fountain provided in the backstage areas.  Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Ensure that fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.   Standards '' 4.15, 4.27.4, Fig. 27.

 

iii.                  Door Hardware:  The doors throughout the backstage areas are inaccessible because they have knob hardware.  Provide doors with hardware that is easy to grasp with one hand and that do not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

iv.                 Green Room Entrance:  The entrance doors to the Green Room are inaccessible because there are only 9 inches of maneuvering clearance on the pull side of the door, which is accessed through a front approach.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards ' 4.13.6, Fig. 25(a).

 

v.                   Ramp from Lower Level Backstage to Orchestra Pit

 

(1)               The ramp is inaccessible because the slope exceeds 1:12, the cross slope exceeds 1:50, the handrails are only 32 inches above the finished floor at the bottom and 31 inches high at the top, there are no handrail extensions, and there are 2 inches of space between the wall and the handrail.  Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces.  Standards '' 4.3.8, 4.8.


 

vi.                 Men=s and Women=s Chorus Dressing Rooms

 

(1)               Both the men=s and women=s chorus dressing rooms include a number of inaccessible elements.  For each gender, or as a single-user unisex room, provide an accessible dressing room available to performers with disabilities, such that all of the dressing room elements, including the entrance, dressing area, lavatory, toilet, shower, and other elements comply with the Standards.  Standards '' 4.19.2, 4.19.3, 4.19.4, 4.19.5, 4.27.4, 4.13, 4.16, 4.17, 4.21, 4.26, 4.27, Fig. 30, 31, 32, 35, 36, 37.

 

vii.                Men=s and Women=s Toilet Rooms with Stalls

 

(1)               Both the men=s and women=s toilet rooms contain a number of inaccessible elements.  For each gender, or as a single-user unisex room, provide an accessible toilet room such that the room elements, including the entrance, lavatory, mirror, water closet, size and arrangement, toe clearances, grab bars, controls,  dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.26, 4.27, 4.19.2, 4.19.3, 4.19.4, 4.19.5, 4.27.4, Figs. 30, 31, 32.

 

e.                  Women=s Main Lobby Toilet Room with Stalls

 

i.                     The entrance door to the toilet room requires 15 pounds of force to open.  Provide a door that requires no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

 

ii.                   Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards '' 4.28.1, 4.28.3.

 

iii.                  The paper towel dispensers protrude into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at these locations such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

 

iv.                 Toilet Stall for Wheelchair Users


 

(1)               The far end of the side grab bar in the designated accessible stall is 48 inches from the wall.  Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.6, Figs. 30(a), (d).

 

(2)               The flush control is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.5, 4.17.2, 4.27.4.

 

v.                   Toilet Stall for Ambulatory People with Disabilities

 

(1)               The far ends of the side grab bars in the ambulatory stalls in the women=s toilet room are each 48 inches from the rear wall.  Provide side grab bars that are at least 42 inches in overall length, with the far end mounted at least 54 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, Fig. 30(d).

 

(2)               The ambulatory stall is not deep enough.  Provide at least one stall that is 66 inches (if a wall-mounted toilet) or 69 inches (if floor-mounted toilet) long, exactly 36 inches wide with an outward swinging, self-closing door and parallel grab bars complying with Fig 30(d).  Standards '' 4.22.4, Fig. 30(d).

 

f.                    Men=s Main Lobby Toilet Room with Stalls

 

i.                     The entrance door to the toilet room requires 15 pounds of force to open.  Provide a door that requires no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

iii.                  No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.6.


 

iv.                 The lavatory in the men=s toilet room has twist type hardware.  Provide a lavatory with a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.5, 4.27.4.

 

v.                   Toilet Stall for Wheelchair Users

 

vi.                 The toilet seat in the designated accessible stall in the men=s toilet room is 21 inches high.  Provide a toilet with a seat that measures 17 to 19 inches above the finished floor.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.3, 4.17.2, Fig. 30(d).

 

(1)               The far end of the side grab bar is 48 inches from the wall.  Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.6, Figs. 30(a), (d).

 

vii.                Toilet Stall for Ambulatory People with Disabilities

 

(1)               The far ends of the side grab bars are 48 inches from the rear wall; the toilet is not centered; and the toilet stall is not long enough.  Provide at least one stall that is 66 inches (if a wall-mounted toilet) or 69 inches (if floor-mounted toilet) long, exactly 36 inches wide with an outward swinging, self-closing door and parallel grab bars complying with Fig 30(d).  Standards '' 4.22.4, Fig. 30(d)           

 


g.                  Ramp to Side Entrance, Door #239-5 (Provides access to freight elevator level):  The ramp is inaccessible because the slope exceeds 1:12, there is no edge protection, and no handrails are provided.  Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces.  Standards '' 4.3.8, 4.8.

 

h.                  Ramp to Rear Entrance (Provides access to freight elevator level):  The ramp is inaccessible because the slope exceeds 1:12, the cross slope exceeds 1:50,  and no handrails are provided.  Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces.  Standards '' 4.3.8, 4.8.

 

i.                    Rear Entrance at Freight Dock:  The rear entrance is inaccessible because the door hardware has a thumb latch.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

 

10.              Within 36 months of the effective date of this Agreement, the City will complete the following modifications to the North Exhibit Hall and Meeting Rooms at the Tucson Convention Center, located at 260 South Church Avenue:

 

a.                  Coconino, Apache, Gila, Graham, and Greenley Rooms

 

i.                     The entrance doors to these rooms require 10 pounds of force to open.  For each room, provide a door that requires no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

 

ii.                   There is no assistive listening system available for these rooms.  Provide a permanently installed assistive listening system (ALS) or a portable ALS with an adequate number of electrical outlets or other supplementary wiring necessary to support a portable assistive listening system.  Also provide receivers equal in number to 4% of the total number of seats, but no less than 2, for use by the general public, and provide signage indicating their availability.  Standards '' 4.1.3(19)(b), 4.1.6(1)(b), 4.30, 4.33.

 


b.                  Telephone:  The telephone across from the Apache meeting room has its highest operable part 56 inches above the finished floor and does not have volume control.  Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards.  Standards '' 4.1.3(17), 4.1.6(1)(b), 4.31, 4.30.7(2).

 

c.                  Apache Toilet Rooms with Stalls

 

i.                     Women=s Toilet Room

 

(1)               The women=s toilet room sign is not mounted on the latch side of the door.  Provide a toilet room sign with raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

(2)               The entrance door to the women=s toilet room is 29 inches wide.  Provide a door with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.5, Fig. 24.

 

(3)               The entrance to the women=s toilet room contains a vestibule that is 46 inches deep.  Provide an accessible entrance to the women=s toilet room such that the space between any two doors in series is at least 48 inches plus the width of any door swinging into the space.  Ensure that doors in series swing either in the same direction or away from the space between the doors.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.7, Fig. 26.

 

(4)               The pressure required to open the doors to the women=s toilet room is 15 pounds.  Provide doors that require no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b)


 

(5)               The door to the women=s toilet room, which is accessed through a front approach, has only 5 inches of clear space on the pull side.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.6, Fig. 25(a).

 

(6)               Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards '' 4.28.1, 4.28.3.

 

(7)               The lavatory for wheelchair users is a protruding object that is not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

(8)               No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.6.

 

(9)               Toilet Stall for Persons with Disabilities

 

(a)                The toilet centerline is 21 inches from the side wall.  In each accessible stall, provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.3, Fig. 30.

 

(b)               No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.1.3(12)(a), 4.1.6(1)(b), 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 


(c)                The far end of the side grab bar is 48 inches from the rear wall.  Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.6, Figs. 30(a), (d).

 

ii.                   Men=s Toilet Room

 

(1)               Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards '' 4.28.1, 4.28.3.

 

(2)               The paper towel dispenser is mounted with its controls at 63 inches above the finished floor.  Provide a paper towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.1.3(13), 4.1.6(1)(b), 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

(3)               The lavatory for wheelchair users and the shelf near one of the paper towel dispensers are protruding objects that are not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

(4)               Toilet Stall for Persons with Disabilities

 

(a)                No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.1.3(12)(a), 4.1.6(1)(b), 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 


(b)               The toilet seat is 22 inches above the finished floor.  Provide a toilet with a seat that measures 17 to 19 inches above the finished floor.  Standards '' 4.16.3, 4.17.2, Fig. 30(d).

 

(c)                The far end of the side grab bar is 48 inches from the rear wall.  Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.6, Figs. 30(a), (d).           

 

d.                  Staircase Banisters:  On the main level of the facility, the ends of the staircase banisters are mounted with the bottom leading edge at 28 inches above the finished floor and protrude into the walkway such that they would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 


e.                  North Exhibit Hall Elevator:  The elevator is inaccessible because the hall call buttons do not have visual signals indicating that a call has registered or been answered, the hall lanterns do not provide audible or visual signals, the doors remain open for only 6 seconds after being obstructed, the main entry floor call button is not designated by a raised star, the centerline of the emergency controls is only 27 inches above the car floor, and although emergency communications are provided, in a test the operator could not state the location of the caller.  Provide hall (lobby) call buttons with visual signals indicating when each call is registered and when each call is answered.  Ensure that the call buttons are centered at 42 inches above the finished floor, a minimum of : inch in the smallest dimension, with the button designating the up direction on top; that the call buttons are raised or flush; and that objects mounted beneath hall call buttons do not project into the elevator lobby more than 4 inches.  Provide doors that open and close automatically with a reopening device that will stop and reopen the car door and hoistway door automatically if the door becomes obstructed by an object or person.  Ensure that the device is capable of completing these operations without requiring contact for obstructions passing through the opening at heights of 5 inches and 29 inches above the finished floor; that door reopening devices remain effective for at least 20 seconds, after which the doors may close; that the minimum time from notification that a car is answering a call until the doors of that car start to close is 5 seconds; and that the minimum time for elevator doors to remain fully open in response to a car call is 3 seconds.  Provide a two-way communication system such that it does not require voice communication, the highest operable part is a maximum of 48 inches above the finished floor of the car, and it is identified by a raised symbol and lettering located adjacent to the device.  If the system uses a handset, ensure that the length of the cord from the panel to the handset is at least 29 inches.  If the system is located in a closed compartment, ensure that the compartment door hardware operates without tight grasping, pinching or twisting of the wrist. Standards '' 4.10.3 4.10.6, 4.10.7, 4.10.8, 4.10.14 Fig. 20, 21.

 

 

11.              Within 36 months of the effective date of this Agreement, the City will complete the following modifications to the building containing the Arena, Ballrooms, and Exhibition Halls A, B, and C at the Tucson Convention Center, located at 260 South Church Avenue:

 

a.                  Entrance to Arena:  The pressure required to open the inner vestibule doors is 10 pounds.  Provide at least one door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

b.                  Entrance to Exhibition Hall:  The pressure required to open the inner vestibule doors is 25 pounds.  Provide at least one door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

c.                  Arena

 

i.                     There are only 13 assistive listening device receivers for the Arena, which has 7730 seats, and there is no signage indicating their availability.  Provide 100 receivers for use by the general public and signage indicating their availability.  Standards '' 4.30, 4.33.

 


ii.                   The wheelchair seating locations are not an integral part of the seating plan, there are not enough of them, and they are not adequately dispersed.  Provide 78 wheelchair seating areas, each with a minimum clear ground or floor space of 66 inches wide by 48 inches deep for forward or rear access, or 66 inches wide by 60 inches deep for side access.  Ensure that the ground or floor at all wheelchair locations is level, firm, stable, and slip resistant; that wheelchair seating areas are an integral part of the fixed seating plan and are located so as to provide people with physical disabilities a choice of admission prices and lines of sight comparable to those available for members of the general public; that wheelchair seating areas adjoin an accessible route that also serves as a means of egress in case of emergency; and that at least one fixed companion seat is provided next to each wheelchair seating area.  Standards '' 4.1.3(19)(a), 4.5, 4.33.

 

d.                  Exhibition Hall C Entrance: The pressure required to open the door is 16 pounds.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

e.                  Grand Ballroom

 

i.                     The outer vestibule door to the ballroom has an opening width of only 29 2 inches.  Provide a door with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop.  Standards ' 4.13.5, Fig. 24.           

 

ii.                   The pressure required to open the inner vestibule door is 19 pounds.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

iii.                  Inside the ballroom entrance, there is an electrical cord cover that is 3 inches in height.  Provide at least one accessible route that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must, in the absence of a curb ramp or ramp have no changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

iv.                 There is no signage informing the public of the availability of an assistive listening system.  Provide accessible signage indicating the availability of the assistive listening system.  Standards '' 4.1.3(19)(b), 4.30.

 

f.                    Drinking Fountains

 

i.                     Drinking Fountain in Exhibition Hall Vestibule Near Women=s Toilet Room: The fountain is a protruding object that is not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 


ii.                   Drinking Fountain at West End: The taller fountain is a protruding object that is not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

iii.                  Drinking Fountain At Exhibition Hall B Vestibule Area: There is no fountain for persons who have difficulty bending or stooping.  For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards ' 4.1.3(10)(a).

 

iv.                 Drinking Fountains at Southeast Mezzanine, Near Ballroom: The route through the mezzanine near the ballroom is inaccessible because the drinking fountains protrude into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

v.                   Drinking Fountains in Exhibition Halls A, B, and C: The route through Exhibition Halls A, B, and C is inaccessible because the drinking fountains protrude into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 


g.                  Counter in Exhibit Hall C:  The lower auxiliary counter at Exhibit Hall C is a protruding object that is not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

h.                  Telephones

 

i.                     Southwest Grand Lobby Telephone Bank:  The telephones at the southwest side of the grand lobby are inaccessible because the seating adjacent to the telephones impedes approaches to the telephones, and there is only clear floor space of 15 2 inches by 32 inches at each telephone. Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards.  Standards '' 4.31, 4.30.7(2).

 

ii.                   Exhibition Hall C Telephones:  The telephones at Exhibit Hall C do not have a volume control mechanism.  Provide an accessible telephone that is hearing aid compatible and has a volume control mechanism.  Standards '' 4.31, 4.30.7(2).

 

iii.                  Mezzanine Level Telephones outside of Ballrooms:  The telephones at the mezzanine level do not have a volume control mechanism.  Provide an accessible telephone that is hearing aid compatible and has a volume control mechanism.  Standards '' 4.31, 4.30.7(2).

 

i.                    West Galleria Elevator

 


i.                     After the doors open due to an obstruction, they do not stay open at least 20 seconds.  Provide doors that open and close automatically with a reopening device that will stop and reopen the car door and hoistway door automatically if the door becomes obstructed by an object or person.  Ensure that the device is capable of completing these operations without requiring contact for obstructions passing through the opening at heights of 5 inches and 29 inches above the finished floor; that door reopening devices remain effective for at least 20 seconds, after which the doors may close; that the minimum time from notification that a car is answering a call until the doors of that car start to close is 5 seconds; and that the minimum time for elevator doors to remain fully open in response to a car call is 3 seconds.  Standards '' 4.10.6, 4.10.7, 4.10.8, Figs. 20, 21.           

 

ii.                   Although emergency communications are provided, the system is not identified on the compartment door with raised symbols and lettering, and the door requires tight grasping.  Provide a two-way communication system such that it does not require voice communication, the highest operable part is a maximum of 48 inches above the finished floor of the car, and it is identified by a raised symbol and lettering located adjacent to the device.  If the system uses a handset, ensure that the length of the cord from the panel to the handset is at least 29 inches.  If the system is located in a closed compartment, ensure that the compartment door hardware operates without tight grasping, pinching or twisting of the wrist.  Standards ' 4.10.14.

 

j.                    East Galleria Elevator

ii.                   Although emergency communications are provided, the system is not identified on the compartment door with raised symbols and lettering, and the door requires tight grasping.  Provide a two-way communication system such that it does not require voice communication, the highest operable part is a maximum of 48 inches above the finished floor of the car, and it is identified by a raised symbol and lettering located adjacent to the device.  If the system uses a handset, ensure that the length of the cord from the panel to the handset is at least 29 inches.  If the system is located in a closed compartment, ensure that the compartment door hardware operates without tight grasping, pinching or twisting of the wrist.  Standards ' 4.10.14.

 

k.                  Men=s Arena First Floor Toilet Room with Stalls

 

i.                     The toilet room signage provided is inaccessible.  Provide permanent room signage with upper case, sans serif or simple serif type letters and numerals, meeting the requirements of the Standards for character height, raised characters, finish and contrast, accompanied by Grade 2 Braille; mounted on the wall adjacent to the latch side of the door or on the nearest adjacent wall at a height of 60 inches above the finished floor to the centerline of the sign; and located so that a person may approach within 3 inches of the signage without encountering protruding objects or standing within the swing of a door.  Standards '' 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

ii.                   The light switch is inaccessible.  Provide a light switch at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

iii.                  No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards ' 4.19.6.

 

iv.                 The soap dispenser controls are mounted at 50 inches above the finished floor and require a forward reach over the lavatory.  Provide a soap dispenser such that the controls comply with Fig. 5 for a forward reach or with Fig. 6 for a side reach and such that it is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach, respectively, by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

v.                   The towel dispenser controls are mounted at 69 inches above the finished floor.  Provide a towel dispenser such that the controls comply with Fig. 5 for a forward reach or with Fig. 6 for a side reach and such that it is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach, respectively, by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 


vi.                 The lavatory for persons with disabilities has the bottom edge of its apron at 27 inches above the finished floor.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31.  Standards ' 4.19.2, Fig. 31.

 

vii.                The lavatory hot water and drain pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.

 

viii.              The lavatory push-type faucets require 21 pounds of force to operate.  Provide a lavatory with a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards '' 4.19.5, 4.27.4.

 

ix.                 Toilet Stall for Wheelchair Users:  The toilet flush control is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.16.5, 4.17.2, 4.27.4.

 

x.                   Toilet Stall for Ambulatory People with Disabilities

 

(1)               The top of the toilet seat is 21 1/4 inches above the finished floor.  Provide a toilet with a seat that measures 17 to 19 inches above the finished floor.  Standards '' 4.16.3, 4.17.2, Fig. 30(d).

 

(2)               The toilet paper dispenser is mounted above the grab bar and interferes with its use.  Provide a side grab bar that has at least 12 inches between the grab bar and any other object, such as the toilet paper dispenser.  Standards '' 4.17.6, 4.26.2, Fig. 39.

 

l.                    Women=s Arena First Floor Toilet Room with Stalls

v.                   The sanitary napkin dispenser controls require pinching and twisting of the wrist.  Provide a sanitary napkin dispenser with mechanical controls, if any, that can be operated with 5 lbf or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards ' 4.27.4.

12.              Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the Water Department Headquarters, located at 310 West Alameda:

 

a.                  Parking:  Although there are 15 parking spaces for Water Department customers, including one space designated as reserved for persons with disabilities, there are no van accessible spaces for customers, and the designated accessible space does not have an access aisle.  On the shortest accessible route to the accessible entrance, provide 1 van accessible space designated as reserved for people with disabilities.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 


b.                  Ramp to Main Entrance:  The ramp handrails do not have at least a 12 inch extension at the bottom parallel with the ground surface.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards ' 4.8.5.

 

c.                  Elevator

 

i.                     After reopening due to an obstruction, the doors stay open for only 4 seconds.  Provide doors that open and close automatically with a reopening device that will stop and reopen the car door and hoistway door automatically if the door becomes obstructed by an object or person.  Ensure that the device is capable of completing these operations without requiring contact for obstructions passing through the opening at heights of 5 inches and 29 inches above the finished floor; that door reopening devices remain effective for at least 20 seconds, after which the doors may close; that the minimum time from notification that a car is answering a call until the doors of that car start to close is 5 seconds; and that the minimum time for elevator doors to remain fully open in response to a car call is 3 seconds.  Standards '' 4.10.6, 4.10.7, 4.10.8, Figs. 20, 21.

 

ii.                   The doors to the emergency communications equipment require tight grasping or pinching.  Provide a two-way communication system such that it does not require voice communication, the highest operable part is a maximum of 48 inches above the finished floor of the car, and it is identified by a raised symbol and lettering located adjacent to the device.  If the system uses a handset, ensure that the length of the cord from the panel to the handset is at least 29 inches.  If the system is located in a closed compartment, ensure that the compartment door hardware operates without tight grasping, pinching or twisting of the wrist.  Standards ' 4.10.14.

 

d.                  Women=s First Floor Toilet Room with Stalls

 


i.                     The toilet room sign is inaccessible.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.                       

 

ii.                   The pressure required to open the door is 11 pounds.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

iii.                  The entrance door to the toilet room on the Apull@ side, which is accessed through a front approach, has only 16 2 inches maneuvering clearance on the pull/latch side of the door.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards ' 4.13.6, Fig. 25(a).           

 

iv.                 Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards '' 4.28.1, 4.28.3.

 

v.                   The vertical roll-style paper towel dispensers protrude 11 inches into the walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

vi.                 The top of the lavatory counter is 36 inches above the finished floor.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31.  Standards '' 4.19.2, Fig. 31.

 

vii.                The lavatory hot water and drain pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.

 

viii.              The toilet stall door swings into the clear floor space required at the lavatory.  Ensure that no door swings into the required clear floor space at any accessible fixture.  Standards ' 4.22.2.

 


ix.                 The sanitary napkin dispenser controls require tight pinching and wrist twisting to operate.  Provide a sanitary napkin dispenser with mechanical controls, if any, that can be operated with 5 lbf or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards ' 4.27.4.

 

x.                   Toilet Stall for Persons with Disabilities

 

(1)               The toilet seat cover dispenser is mounted at 55 2  inches above the finished floor and requires a forward reach.  Provide a toilet seat cover dispenser at a  maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

(2)               The top of the toilet seat is 20 2 inches above the finished floor.  Provide a toilet with a seat that measures 17 to 19 inches above the finished floor.  Standards '' 4.16.3, 4.17.2, Fig. 30(d).

 

(3)               The toilet flush control is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.16.5, 4.17.2, 4.27.4.

 

(4)               The side grab bar is obstructed by the trash receptacle above.  Provide a side grab bar that has at least 12 inches between the grab bar and any other object, such as the toilet paper dispenser.  Standards '' 4.17.6, 4.26.2, Fig. 39.

 

(5)               There is no accessible coat hook.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

e.                  Men=s First Floor Toilet Room with Stalls

(2)               No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

 

13.              Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the Ward 5 Council Office, 4300 South Park Avenue:

 

a.                  Parking:  The parking designated as reserved for persons with disabilities is inaccessible because the access aisle for the van accessible space is only 86 inches wide, there is only 1 vertical sign with the International Symbol of Accessibility shared between 2 parking spaces, the surfaces are not firm and slip resistant because there is a lot of loose gravel, the pavement markings are not clear, and the built-up curb ramp protrudes into the shared access aisle.  On the shortest accessible route to the accessible entrance, provide 1 van accessible space designated as reserved for people with disabilities.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).


 

b.                  Visual Alarms:  Although an emergency alarm system is provided, there are no visual alarm appliances in the building.  Provide visual alarm devices in toilet rooms and any other general usage areas (e.g., meeting rooms), hallways, lobbies, and any other area for common use.  Such devices shall be integrated into the facility alarm system and shall meet the requirements of the Standards for lamp type, color, pulse duration, intensity, and flash rate.  Visual alarm appliances shall be placed 80 inches above the highest floor level within the space or 6 inches below the ceiling, whichever is lower.  Visual alarm appliances shall be located such that no place in any room or space, including common corridors or hallways, required to have a visual alarm appliance shall be more than 50 feet from the signal.  In large rooms and spaces exceeding 100 feet across, without obstructions 6 feet above the finished floor, devices may be placed around the perimeter, spaced a maximum of 100 feet apart, in lieu of suspending appliances from the ceiling.  Standards ' 4.28.3.

 

c.                  Drinking Fountain by Public Toilet Rooms:  The drinking fountain is inaccessible because the control is mounted on the side and requires twisting of the wrist to operate and there is no access provided for persons who have trouble bending or stooping.  Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Ensure that fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards '' 4.15, 4.27.4, Fig. 27.

 

d.                  Meeting Rooms

 


i.                     The meeting rooms are inaccessible to people with hearing impairments because no assistive listening system is provided.  Provide a permanently installed assistive listening system (ALS) or a portable ALS with an adequate number of electrical outlets or other supplementary wiring necessary to support a portable assistive listening system.  Also provide a minimum of 2 receivers for use by the general public and signage indicating their availability.  Standards '' 4.30, 4.33.

 

ii.                   Meeting Room Off of Lobby: The entrance door is inaccessible because it requires 10 pounds of force to operate.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

e.                  Public Toilet Rooms with Stalls and Showers

 

i.                     Men=s Toilet Room

 

(1)               The toilet room sign mounted on the latch side of the does not have raised and Braille characters.  Provide a toilet room sign with raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

(2)               The entrance door is inaccessible because it requires 12 pounds of force to open.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

(3)               Toilet Stall for People with Disabilities

 

(a)                The toilet centerline is 20 inches from the side wall.  Provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards ' 4.17.3, Fig. 30.

 

(b)               No accessible coat hook is provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 


(c)                The seat cover dispenser is inaccessible because it is mounted at 55 inches above the finished floor and, due to its placement next to the toilet in the stall for persons with disabilities, requires a front reach.  Provide a toilet seat cover dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6, Fig. 4.

 

(d)               The stall door hardware is inaccessible because it requires tight grasping or pinching to operate.   Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

(4)               The transfer shower stall is inaccessible because it is located at the end of a hallway and there is no way for a person who uses a wheelchair to accomplish a parallel approach to the transfer bench. Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards ' 4.21, Figs. 35, 36, 37.

 

(5)               The dressing room bench provided is inaccessible because it is only 14 inches deep and mounted at 15 inches above the finished floor.  Provide a 24 inch by 48 inch bench fixed to the wall along the bench=s longer dimension.  Ensure that the bench has sufficient structural strength and is mounted with its surface between 17 inches and 19 inches above the finished floor.  Provide clear floor space alongside the bench to allow a person using a wheelchair to make a parallel transfer onto the bench.  Standards '' 4.35.4, 4.26.3.

 

ii.                   Women=s Toilet Room

 


(1)               The toilet room sign mounted on the latch side of the door does not have raised and Braille characters.  Provide a toilet room sign with raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(3)               Toilet Stall for People with Disabilities

 

(a)                The toilet centerline is 19 inches from the side wall.  Provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards ' 4.17.3, Fig. 30.

 

(b)               No accessible coat hook is provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

(c)                The toilet flush control is on the Aclosed@ side of the stall.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.16.5, 4.17.2, 4.27.4.

 

(d)               The stall door hardware is inaccessible because it requires tight grasping or pinching to operate.   Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 


(4)               The transfer shower stall is inaccessible because it is located at the end of a hallway and there is no way for a person who uses a wheelchair to accomplish a parallel approach to the transfer bench. Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards ' 4.21, Figs. 35, 36, 37.

 

(5)               The bench provided is inaccessible because it is only 14 inches deep and mounted at 15 inches above the finished floor.  Provide a 24 inch by 48 inch bench fixed to the wall along the bench=s longer dimension.  Ensure that the bench has sufficient structural strength and is mounted with its surface between 17 inches and 19 inches above the finished floor.  Provide clear floor space alongside the bench to allow a person using a wheelchair to make a parallel transfer onto the bench.  Standards '' 4.35.4, 4.26.3.           

 

 

14.              Within 24 months of the effective date of this Agreement, the City will complete the following modifications to the William Clements Center, located at 8155 East Poinciana Drive:

 

a.                  Ramp to the Basketball Courts:  The ramp is inaccessible because the inside handrail does not extend the full length of the ramp.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards '' 4.1.2(1), 4.1.2(2), 4.3.8, 4.8.5.

 


b.                  Signage:  The permanent room signs throughout the facility are not accessible.   Provide permanent room signage with upper case, sans serif or simple serif type letters and numerals, meeting the requirements of the Standards for character height, raised characters, finish and contrast, accompanied by Grade 2 Braille; mounted on the wall adjacent to the latch side of the door or on the nearest adjacent wall at a height of 60 inches above the finished floor to the centerline of the sign; and located so that a person may approach within 3 inches of the signage without encountering protruding objects or standing within the swing of a door.  Standards '' 4.1.2(7), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

c.                  Men=s Lobby Locker Rooms (Toilet Rooms with Stalls/Shower Stall)

 

i.                     The pressure required to open the door is 10 pounds of force.  Provide a door that requires no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.13.11(2)(b).

 

ii.                   The bottom leading edge of the air dryer is more than 27 inches above the finished floor, extends more than 4 inches into the path of travel, and is not detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

iii.                  The side grab bar is inaccessible because the toilet paper dispenser and shelf interfere with its use.  Provide a side grab bar that has at least 12 inches between the grab bar and any other object, such as the toilet paper dispenser.  Standards '' 4.1.3(11), 4.22.4, 4.17.6, 4.26.2, Fig. 39.

 

iv.                 The transfer shower stall is inaccessible because  the transfer seat does not extend the full depth of the stall and it lacks hand-held controls; or, if security is a concern, a shower head mounted at 48 inches above the finished floor. Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards '' 4.1.3(11), 4.21, Figs. 35, 36, 37.

 


v.                   The towel hook provided at the shower is inaccessible.  Provide a towel hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.1.3(12)(a), 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

vi.                 The bench is only 9 2 inches wide and attached to the floor.  Provide a 24 inch by 48 inch bench fixed to the wall along the bench=s longer dimension.  Ensure that the bench has sufficient structural strength and is mounted with its surface between 17 inches and 19 inches above the finished floor.  Provide clear floor space alongside the bench to allow a person using a wheelchair to make a parallel transfer onto the bench.  Standards '' 4.1.3(21), 4.35.4, 4.26.3.

 

d.                  Women=s Lobby Locker Rooms (Toilet Rooms with Stalls/Shower Stall)

 

i.                     The pressure required to open the door is 11 pounds of force.  Provide a door that requires no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.13.11(2)(b).

 

ii.                   The leading edge of the air dryer is more than 27 inches above the finished floor, extends more than 4 inches into the path of travel, and is not detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

iii.                  The side grab bar is inaccessible because the toilet paper dispenser and shelf interfere with its use.  Provide a side grab bar that has at least 12 inches between the grab bar and any other object, such as the toilet paper dispenser.  Standards '' 4.1.3(11), 4.22.4, 4.17.6, 4.26.2, Fig. 39.

 

iv.                 The toilet paper dispenser in the standard accessible toilet stall is mounted above the grab bar.  Provide a toilet paper dispenser that is mounted with its top at least 12 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards '' 4.1.3(11), 4.22.4, 4.17.3, Fig. 30(d).

 


v.                   The transfer shower stall is inaccessible because  the transfer seat does not extend the full depth of the stall and it lacks hand-held controls; or, if security is a concern, a shower head mounted at 48 inches above the finished floor. vi.                 The bench is 9 2 inches wide and attached to the floor.  Provide a 24 inch by 48 inch bench fixed to the wall along the bench=s longer dimension.  Ensure that the bench has sufficient structural strength and is mounted with its surface between 17 inches and 19 inches above the finished floor.  Provide clear floor space alongside the bench to allow a person using a wheelchair to make a parallel transfer onto the bench.  Standards '' 4.1.3(21), 4.35.4, 4.26.3.

 

e.                  Julie Reitan Softball Complex

 

i.                     Accessible Route and Seating

 

(1)               There is no accessible route to the bleachers, dugout or concession stand.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp or ramp, elevator, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.1.3(1), 4.3, 4.5, Fig. 7.

 


(2)               There is no wheelchair seating in the dugouts or designed as an integral part of the bleachers.  Provide the appropriate number of wheelchair seating areas at each location, as demonstrated by Table 4.1.3(19)(a) of the Standards, each with a minimum clear ground or floor space of 66 inches wide by 48 inches deep for forward or rear access, or 66 inches wide by 60 inches deep for side access.  Ensure that the ground or floor at all wheelchair locations is level, firm, stable, and slip resistant; that wheelchair seating areas are an integral part of the fixed seating plan and are located so as to provide people with physical disabilities a choice of admission prices and lines of sight comparable to those available for members of the general public; that wheelchair seating areas adjoin an accessible route that also serves as a means of egress in case of emergency; and that at least one fixed companion seat is provided next to each wheelchair seating area.  Standards '' 4.1.3(19)(a), 4.5, 4.33.

 

ii.                   Counter - Concession Stand:  The counter is 45 2 inches above the finished floor.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor.  Standards '' 4.1.1(2), 7.2(1), 4.1.3(1), 4.3.

 

iii.                  Men=s Toilet Rooms with Stalls

 

(1)               No accessible room sign is provided.  Provide a toilet room sign with raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

(2)               The door to the toilet room, which is accessed through a front approach, is inaccessible because it has only 10 inches of maneuvering clearance on the pull side of the door.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards '' 4.1.3(7)(b), 4.13.6, Fig. 25(a).

 


(3)               Although an audible alarm is provided, no visual alarm is provided.  Provide visual alarm devices in toilet rooms and any other general usage areas (e.g., meeting rooms), hallways, lobbies, and any other area for common use.  Such devices shall be integrated into the facility alarm system and shall meet the requirements of the Standards for lamp type, color, pulse duration, intensity, and flash rate.  Visual alarm appliances shall be placed 80 inches above the highest floor level within the space or 6 inches below the ceiling, whichever is lower.  Visual alarm appliances shall be located such that no place in any room or space, including common corridors or hallways, required to have a visual alarm appliance shall be more than 50 feet from the signal.  In large rooms and spaces exceeding 100 feet across, without obstructions 6 feet above the finished floor, devices may be placed around the perimeter, spaced a maximum of 100 feet apart, in lieu of suspending appliances from the ceiling.  Standards '' 4.1.3(14), 4.28.3.

(5)               The bottom air dryer is more than 27 inches above the finished floor, extends more than 4 inches into the path of travel, and is not detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

(6)               The bottom edge of the apron of the lavatory is 20 inches above the finished floor.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31.  Standards '' 4.1.3(11), 4.22.6, 4.19.2, Fig. 31.

 


(7)               The urinal rim height is 25 inches above the finished floor, the rim is not elongated, and the height of the flush control exceeds 44 inches.  Provide a urinal with an elongated rim mounted 17 inches or less above the finished floor, a clear floor space of at least 30 inches wide and 48 inches deep centered on the urinal, and a flush control height of 44 inches or less above the finished floor.  Standards '' 4.1.3(11), 4.22.5, 4.18.2, 4.18.3, 4.18.4.

 

(8)               There is no accessible toilet stall.  Provide a Astandard@ accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall=s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards '' 4.1.3(11), 4.22.4, 4.22.7, 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30. 

 

iv.                 Women=s Toilet Rooms with Stalls

(6)               There is no accessible toilet stall provided.  Provide a Astandard@ accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall=s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards '' 4.1.3(11), 4.22.4, 4.22.7, 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

i.                     Men=s Locker Rooms

 


(1)               In the transfer shower stall, there is no clear floor space overhang at the transfer seat, and there is neither a hand-held shower head or a shower head mounted at 48 inches above the finished floor.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards '' 4.1.3(11), 4.21, Figs. 35, 36, 37.

 

(2)               The dressing area bench is 9 2 inches wide and is not attached to the wall.  Provide a 24 inch by 48 inch bench fixed to the wall along the bench=s longer dimension.  Ensure that the bench has sufficient structural strength and is mounted with its surface between 17 inches and 19 inches above the finished floor.  Provide clear floor space alongside the bench to allow a person using a wheelchair to make a parallel transfer onto the bench.  Standards '' 4.1.3(21), 4.35.4, 4.26.3.

 

(3)               The route within the locker room is not accessible because the air dryers protrude into the walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

ii.                   Women=s Locker Rooms

 

(1)               There are only 9 inches of  clear floor space overhang at the transfer seat.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards '' 4.1.3(11), 4.21, Figs. 35, 36, 37.

h.                  Drinking Fountain at Softball Complex:  Although an accessible drinking fountain is provided, there is no drinking fountain provided for people who have difficulty bending or stooping.  For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards ' 4.1.3(10)(a).
