Attachment J: Modifications to Altered Facilities

 

Please Note: Paragraph 37 of the Settlement Agreement requires that within three months of the effective date of this Agreement, the City provide signage as necessary to comply with 28 C.F.R. ' 35.163(b), after having surveyed all facilities that are the subject of this Agreement for the purpose of identifying those that have multiple entrances not all of which are accessible.

 

In order to ensure that the following spaces and elements in City facilities, for which alterations commenced after January 26, 1992, are readily accessible to and usable by persons with disabilities, the City will take the following actions:

 

1.                  Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the City Court, located at 103 East Alameda:

 

a.                  Accessible Route

 

i.                     The route between the bus stop and the building entrance takes users into traffic, as there is no curb cut at the bus stop.  Provide a curb ramp that is at least 36 inches wide, has a maximum slope of 1:12, is located so that it cannot be obstructed by parked vehicles, and has a stable, firm, and slip-resistant surface with a detectable warning extending the full width and depth of the ramp.  If the curb ramp is located where pedestrians must walk across it, provide either flared sides (with a maximum slope of 1:10) or handrails or guardrails to protect against cross traffic.  Standards ' 4.3.8, 4.7, Fig. 12.

 

ii.                   The rope barricades in the lobby are protruding objects that would not be detectable to a blind person who uses a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 


b.                  Signage:  Many of the permanent room signs throughout the facility -- including those for the courtrooms and offices -- are not accessible.  Wherever permanent room signs are provided, provide permanent room signage with upper case, sans serif or simple serif type letters and numerals, meeting the requirements of the Standards for character height, raised characters, finish and contrast, accompanied by Grade 2 Braille; mounted on the wall adjacent to the latch side of the door or on the nearest adjacent wall at a height of 60 inches above the finished floor to the centerline of the sign; and located so that a person may approach within 3 inches of the signage without encountering protruding objects or standing within the swing of a door.  Standards '' 4.1.2(7), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

c.                  Elevator

 

i.                     After reopening due to an obstruction, the elevator doors remain open only 4 seconds.  Provide doors that open and close automatically with a reopening device that will stop and reopen the car door and hoistway door automatically if the door becomes obstructed by an object or person.  Ensure that the device is capable of completing these operations without requiring contact for obstructions passing through the opening at heights of 5 inches and 29 inches above the finished floor; that door reopening devices remain effective for at least 20 seconds, after which the doors may close; that the minimum time from notification that a car is answering a call until the doors of that car start to close is 5 seconds; and that the minimum time for elevator doors to remain fully open in response to a car call is 3 seconds.  Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.6, 4.10.7, 4.10.8, Figs. 20, 21.

 

ii.                   The door to the emergency communications requires tight grasping or pinching.  Provide a two-way communication system such that it does not require voice communication, the highest operable part is a maximum of 48 inches above the finished floor of the car, and it is identified by a raised symbol and lettering located adjacent to the device.  If the system uses a handset, ensure that the length of the cord from the panel to the handset is at least 29 inches.  If the system is located in a closed compartment, ensure that the compartment door hardware operates without tight grasping, pinching or twisting of the wrist.  Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.14.

 

d.                  Counters

 

i.                     The security counter is 40 inches high and no equivalent facilitation is provided for people who use wheelchairs.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards '' 4.1.1(2), 4.1.6(1)(b), 7.2(2), 4.1.3(1), 4.3.


 

ii.                   The public service counter in room 104 is 40 inches high and no equivalent facilitation is provided for people who use wheelchairs.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards '' 4.1.1(2), 4.1.6(1)(b), 7.2(2), 4.1.3(1), 4.3.

 

iii.                  The counter in the 3rd floor Judicial Receptionist=s office is 42 inches high and no equivalent facilitation is provided for people who use wheelchairs.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards '' 4.1.1(2), 4.1.6(1)(b), 7.2(2), 4.1.3(1), 4.3.

 

e.                  Accessible Route  

 

i.                     Many of the fixed counters throughout the facility are protruding objects that are not cane-detectable.  At each such location, provide an accessible route such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

 

ii.                   The drinking fountains on the 2nd, 3rd, 4th, 5th, and 6th floors protrude into the main walkway and would not be detectable to a blind person using a cane.  Provide accessible routes at each of these locations such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

 

f.                    Drinking Fountains


 

i.                     The drinking fountain on the 4th floor does not direct the water in a trajectory at least 4 inches high and the controls require more than 5 pounds of force to operate.  Provide at least one drinking fountain on this floor with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Ensure that fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  Standards '' 4.1.3(10), 4.1.6(1)(b), 4.15, 4.27.4, Fig. 27.     

 

ii.                   On the 2nd, 3rd, 4th, 5th, and 6th floors, no fountains are provided for persons who have difficulty bending or stooping.  For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.    Standards '' 4.1.3(10)(a), 4.1.6(1)(b).

 

g.                  Courtrooms:  There is no signage informing the public of the availability of an assistive listening system.  Provide an assistive listening system with the appropriate number of receivers as specified by 4.1.3(19)(b), and provide accessible signage indicating the availability of the assistive listening system.  Standards '' 4.1.3(19)(b), 4.1.6(1)(b), 4.30.

 

h.                  Courtroom #3

 

i.                     The door to the court, which is accessed through a front approach, has only 82 inches of clearance on the pull/latch side.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.6, Fig. 25(a).

 


ii.                   The door to the courtroom is obstructed and there is only 24 inches of clear opening width.  Provide a door with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop, and free of all obstructions.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.5, Fig. 24.

 

i.                    City Prosecutors= Office Conference Room

 

i.                     The entry door uses knob hardware.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.9.

 

ii.                   The route within the conference room is restricted to 30-1/2 inches between the pillar and the table.  Provide an accessible route to all areas of this conference room with a minimum clear width of 36 inches, except at doors, where the width may decrease to 32 inches.  Standards '' 4.1.3(1), 4.1.6(1)(b), 4.3.3, 4.13.5.

 

j.                    Coat Racks in Jury Rooms, 3rd Floor 

 

i.                     The coat racks are inaccessible.  In each jury room, provide a coat hook or rack at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.1.3(12)(a), 4.1.6(1)(b), 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

ii.                   The coat racks are protruding objects that are not cane-detectable.  In each jury room, provide an accessible route such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

 

k.                  First Floor Toilet Rooms with Stalls

 

i.                     Women=s Toilet Room

 

(1)            Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards '' 4.1.3(14), 4.1.6(1)(b), 4.28.1, 4.28.3.

 


(2)               The seat cover dispenser in the women=s toilet room is mounted 50 inches high over an obstruction.  Provide a seat cover dispenser such that the controls comply with Fig. 5 for a forward reach or with Fig. 6 for a side reach and such that it is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach, respectively, by a person using a wheelchair.  Standards '' 4.1.3(13), 4.1.6(1)(b), 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

(3)               The paper towel dispenser protrudes into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at these locations such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

 

(4)               No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.1.3(12)(a), 4.1.6(1)(b), 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

(5)               The toilet paper dispenser in the designated accessible stall in the women=s toilet room is mounted on the rear wall.  Provide a toilet paper dispenser that is mounted with its top at least 12 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.3, Fig. 30(d).

 

ii.                   Men=s Toilet Room

 

(1)            Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards '' 4.1.3(14), 4.1.6(1)(b), 4.28.1, 4.28.3.

 


(2)               The paper towel dispensers protrudes into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at these locations such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

 

(3)               Toilet Stall for People with Disabilities

 

(a)            The toilet stall is not properly configured to provide sufficient maneuvering space for persons who use wheelchairs.  Provide clear floor space that complies with Fig. 30 at the toilet.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.3, Fig. 30.

 

(b)               The flush control on the toilet in the designated accessible stall in the men=s toilet room is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.5, 4.17.2, 4.27.4.

 

(c)                No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.1.3(12)(a), 4.1.6(1)(b), 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

(d)               The toilet paper dispenser is mounted more than 36 inches from the rear wall.  Provide a toilet paper dispenser that is mounted with its top at least 12 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.3, Fig. 30(d).

 

l.                    Third Floor Unisex Single-User Toilet Room Serving Jury Assembly Area

 


i.                     The entry door uses knob hardware.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.9.

 

ii.                   The paper towel dispenser is mounted with its controls 57 inches above the finished floor.  Provide a paper towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.1.3(13), 4.1.6(1)(b), 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

iii.                  The flush control on the toilet is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.5, 4.17.2, 4.27.4.

 

m.                Fifth Floor Toilet Rooms with Stalls

 

i.                     Women=s Toilet Room with Stalls

 

(1)            The door has round knob-style hardware.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.9.

 

(2)               No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.6.

 

(3)               The paper towel dispenser is a protruding object that is not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

 


(4)               The feminine products dispenser requires tight grasping, pinching or twisting of the wrist to operate.  Provide feminine products dispenser with mechanical controls, if any, that can be operated with 5 lbf or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards '' 4.1.3(13), 4.1.6(1)(b), 4.27.4.

 

(5)               The lavatory has twist-type hardware.  Provide a lavatory with a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.5, 4.27.4.

 

 

(6)               The lavatory hot water and drain pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.4.

 

ii.                   Men=s Toilet Room

 

(1)               No accessible mirror is provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.6.

 

(2)               The lavatory has twist-style hardware.  Provide a lavatory with a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.5, 4.27.4.

 

(3)               In the toilet stall for persons with disabilities, the flush control is on the closed side of the stall  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.5, 4.17.2, 4.27.4.

 

n.            Third Floor Toilet Rooms with Stalls (altered elements; alterations standard applies)


i.            Women=s Toilet Room

 

(1)            The interior entry door to the women=s toilet room requires 10 pounds of force to open.  Provide a door that requires no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

 

(2)               The toilet seat cover dispenser in the women=s toilet room is mounted 52 inches high and requires a forward reach over the toilet.  Provide a toilet seat cover dispenser such that the controls comply with Fig. 5 for a forward reach or with Fig. 6 for a side reach and such that it is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach, respectively, by a person using a wheelchair.  Standards '' 4.1.3(13), 4.1.6(1)(b), 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

(3)               The paper towel dispensers protrude into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at these locations such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

 

(4)               The lavatory has insufficient knee and toe clearances.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.2, Fig. 31.

 

(5)               The lavatory has twist-type hardware.    Provide a lavatory with a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.5, 4.27.4.

 

(6)               Toilet Stall for Persons with Disabilities

 


(a)            The toilet flush control is on the closed side of the stall and is mounted too high.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.5, 4.17.2, 4.27.4.

 

(b)               No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.1.3(12)(a), 4.1.6(1)(b), 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

ii.                   Men=s Toilet Room

 

(1)               The signage is not properly placed.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

(2)               The paper towel dispensers protrude into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at these locations such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

 

(3)               The lavatory hot water and drain pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.4.

 


(4)               The lavatory has twist-type hardware.  Provide a lavatory with a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).    Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.5, 4.27.4.

 

 

2.                  Within 6 months of the effective date of this Agreement, the City will complete the following modifications to the City Hall, located at 3202 East Second Street:

 

a.            Inaccessible Toilet Rooms: Many of the inaccessible toilet rooms lack directional signage directing people with disabilities to the accessible toilet rooms on the 1st and 10th floors.  At each inaccessible toilet room, provide accessible directional signage with the International Symbol of Accessibility at inaccessible toilet rooms indicating the location of the nearest accessible toilet room, and provide accessible signage with the International Symbol of Accessibility at all accessible toilet rooms.  Standards '' 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

 

b.                  Alarms:  Although the facility contains an emergency alarm system, there are no visual alarms provided.  Provide visual alarm devices in toilet rooms and any other general usage areas (e.g., meeting rooms), hallways, lobbies, and any other area for common use.  Such devices shall be integrated into the facility alarm system and shall meet the requirements of the Standards for lamp type, color, pulse duration, intensity, and flash rate.  Visual alarm appliances shall be placed 80 inches above the highest floor level within the space or 6 inches below the ceiling, whichever is lower.  Visual alarm appliances shall be located such that no place in any room or space, including common corridors or hallways, required to have a visual alarm appliance shall be more than 50 feet from the signal.  In large rooms and spaces exceeding 100 feet across, without obstructions 6 feet above the finished floor, devices may be placed around the perimeter, spaced a maximum of 100 feet apart, in lieu of suspending appliances from the ceiling.  Standards '' 4.1.3(14), 4.1.6(1)(b), 4.28.3.

 


c.                  Rear Entrance Ramp:  The ramp has a slope of up to 9.1%, one of the handrails does not extend the full length of the ramp, and there is more than 12 inches between the handrails and the walls.  Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface and 12 inches from the wall, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces.  Standards '' 4.1.2(1), 4.1.2(2), 4.1.6(1)(b), 4.3.8, 4.8.

 

d.                  Elevator:  After reopening due to an obstruction, the elevator doors remain open only 5 seconds.  Provide doors that open and close automatically with a reopening device that will stop and reopen the car door and hoistway door automatically if the door becomes obstructed by an object or person.  Ensure that the device is capable of completing these operations without requiring contact for obstructions passing through the opening at heights of 5 inches and 29 inches above the finished floor; that door reopening devices remain effective for at least 20 seconds, after which the doors may close; that the minimum time from notification that a car is answering a call until the doors of that car start to close is 5 seconds; and that the minimum time for elevator doors to remain fully open in response to a car call is 3 seconds.  Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.6, 4.10.7, 4.10.8, Figs. 20, 21.

 

e.                  Offices & Counters

 

i.                     The counter in the 6th floor West Procurement Office is too high.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards '' 4.1.1(2), 4.1.6(1)(b), 7.2(2), 4.1.3(1), 4.3.

 

ii.                   The clear opening width of the door to the 6th floor West Procurement Office is only 26: inches wide.    Provide a door with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.5, Fig. 24.

 

iii.                  The door into the interior 3rd floor Office of Economic Development requires 10 pounds of force to open.  Provide a door that requires no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

 


iv.                 The main reception counter and the interior office counter in the 3rd floor Office of Economic Development are both 40 inches high.  Provide a counter in each area on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards '' 4.1.1(2), 4.1.6(1)(b), 7.2(2), 4.1.3(1), 4.3.

 

v.                   The thumb-latch door hardware for the Trade Office requires tight grasping or pinching.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.9.

 

vi.                 The tops of the reception counters for the 3rd floor U.S. Export Assistance Center, the Office of Economic Development, and the Trade Office all protrude into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at these locations such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

 

f.                    First Floor Toilet Rooms with Stalls

 

i.            Women=s Toilet Room

 

(1)            The toilet room sign is mounted on the door.  Provide a toilet room sign with raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 


(2)               The door requires 12 pounds of force to open.  Provide a door that requires no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

 

(3)               No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.6.

 

(4)               The toilet seat cover dispenser is mounted 552 inches high and requires a forward reach over the toilet.  Provide a toilet seat cover dispenser such that the controls comply with Fig. 5 for a forward reach or with Fig. 6 for a side reach and such that it is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach, respectively, by a person using a wheelchair.  Standards '' 4.1.3(13), 4.1.6(1)(b), 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

(5)               The feminine products dispenser is mounted 542 inches high over the trash can and requires a forward reach.  Provide a feminine products dispenser such that the controls comply with Fig. 5 for a forward reach or with Fig. 6 for a side reach and such that it is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach, respectively, by a person using a wheelchair.  Standards '' 4.1.3(13), 4.1.6(1)(b), 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

(6)               The lavatory hot water and drain pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.4.

 

(7)               Toilet Stall for Persons with Disabilities

 

(a)                The toilet centerline is 20 inches from the wall.  In each accessible stall, provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.3, Fig. 30.

 


(b)               No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.1.3(12)(a), 4.1.6(1)(b), 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

(c)                The toilet paper dispenser is mounted on the rear wall.  Provide a toilet paper dispenser that is mounted with its top at least 12 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.3, Fig. 30(d).

 

(d)               The side grab bar is only 36 inches long and the far end is only 41 inches from the rear wall.   Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.6, Figs. 30(a), (d).

 

a.                   Men=s

(5)               Toilet Stall for Persons with Disabilities

(b)               The flush control is mounted on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.5, 4.17.2, 4.27.4.

 

(c)                No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.1.3(12)(a), 4.1.6(1)(b), 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

g.            Tenth Floor Toilet Rooms with Stalls

3.                  Within 6 months of the effective date of this Agreement, the City will complete the following modifications to the Fire Department Headquarters, located at 265 South Church Avenue:

 

a.                  Exterior Ramp (altered; alterations standard applies):  The slope and cross-slope of the ramp exceed the maximum allowable slope and cross-slope and the right-hand handrail (facing the facility) does not extend at the bottom of the ramp.  Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces.  Standards '' 4.3.8, 4.8.

 


b.                  Reception Counter (existing): The reception counter is a protruding object that is not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

c.                  Elevator (altered; alterations standard applies)

 

i.                     The elevator does not automatically reopen without contact for obstructions passing through the opening of heights of 5 inches to 29 inches above the finished floor, and the doors stay open 7 seconds after reopening in response to an obstruction.  Provide doors that open and close automatically with a reopening device that will stop and reopen the car door and hoistway door automatically if the door becomes obstructed by an object or person.  Ensure that the device is capable of completing these operations without requiring contact for obstructions passing through the opening at heights of 5 inches and 29 inches above the finished floor; that door reopening devices remain effective for at least 20 seconds, after which the doors may close; that the minimum time from notification that a car is answering a call until the doors of that car start to close is 5 seconds; and that the minimum time for elevator doors to remain fully open in response to a car call is 3 seconds.  Standards '' 4.10.6, 4.10.7, 4.10.8, Figs. 20, 21.

 

ii.                   Although emergency communications are provided, the system requires voice communication and the door to the emergency communications equipment requires tight grasping or pinching.  Provide a two-way communication system such that it does not require voice communication, the highest operable part is a maximum of 48 inches above the finished floor of the car, and it is identified by a raised symbol and lettering located adjacent to the device.  If the system uses a handset, ensure that the length of the cord from the panel to the handset is at least 29 inches.  If the system is located in a closed compartment, ensure that the compartment door hardware operates without tight grasping, pinching or twisting of the wrist.  Standards ' 4.10.14.

 

d.                  Drinking Fountain B Second Floor (existing; program access standard applies)

 

i.                     The drinking fountain has a spout that is 42 inches above the finished floor.  Provide a fountain that has a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet, and that otherwise complies with the Standards.  Standards '' 4.15, 4.27.4, Fig. 27.  Alternatively, provide a cup dispenser.

 


ii.                   The existing drinking fountain is a protruding object.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

e.                  Conference Room B Second Floor:  The conference room is inaccessible to people with hearing impairments because no permanent or portable assistive listening system is available.  Provide a permanently installed assistive listening system (ALS) or a portable ALS with an adequate number of electrical outlets or other supplementary wiring necessary to support a portable assistive listening system.  Also provide the number of receivers for use by the general public in accordance with Standards ' 4.1.3 (19)(b) and signage indicating their availability.  Standards ''  4.1.3 (19)(b), 4.30, 4.33.

 

f.                    Unisex Single-User Toilet Room B Second Floor

 

i.                     The signage provided is mounted on the toilet room door.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

ii.                   Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards '' 4.28.1, 4.28.3.

 

iii.                  There is inadequate distance between the toilet centerline and the edge of the lavatory.  Provide a toilet with at least 18 inches between the toilet centerline and the edge of the lavatory.  Standards '' 4.16.2; Fig. 28.

 

iv.                 The toilet centerline measures 19 inches from the side wall.  Provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards ' 4.16.2, Fig. 28.

 

v.                   The rear grab bar at the toilet is 24 inches in length.  Provide a rear grab bar that is at least 36 inches in overall length with the closer end no more than 6 inches from the side wall.  Standards ' 4.16.4, Fig. 29.

 

 


4.                  Within 6 months of the effective date of this Agreement, the City will complete the following modifications to the Mission Library Branch, located at 3770 South Mission Road.

 

a.                  Parking:  Two of the designated accessible parking spaces have no vertical signage.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Standards '' 4.1.2(5), 4.1.6(1)(b), 4.6.4, 4.30.7(1).

 

b.                  Stacks:  The spaces between the book stacks are between 312 and 33 inches wide.  Provide at least 36 inches of clear width between all stacks and provide a clear width of 42 inches between stacks where possible.  Standards '' 4.1.6(1)(b), 8.5, Fig. 56.

 

c.                  Copy Room Entrance:  The door to the Copy Room has a round door knob.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.9.

 

d.                  Unisex Single-User Toilet Room (altered element):  The centerline of the toilet is 17 inches from the wall.  Provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.3, Fig. 30.

 

e.                  Telephone:  The telephone is not hearing aid compatible.  Provide an accessible telephone that is hearing aid compatible and has a volume control mechanism.  Standards '' 4.1.3(17), 4.1.6(1)(b), 4.31, 4.30.7(2).

 

f.                    Meeting Rooms

 

i.                     The entrances to the meeting rooms near the lobby toilet rooms have almost no maneuvering clearance on the pull or push sides of the doors.  On the pull side of the doors, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the doors.  On the push side of the doors, provide maneuvering clearance at least 48 inches deep and provide a minimum of 12 inches of maneuvering clearance on the latch side of the doors, or remove the closers or the latches.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.6, Fig. 25(a).

 


ii.                   The doors have round doorknobs.   For each, provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.9.

 

g.                  Drinking Fountain

 

i.                     The drinking fountain=s spout is 372 inches above the finished floor.  Provide a fountain that has a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet, and that otherwise complies with the Standards.  Alternatively, provide a cup dispenser.  Standards '' 4.1.3(10), 4.1.6(1)(b), 4.15, 4.27.4, Fig. 27. 

 

ii.                   The drinking fountain protrudes into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

 

 

5.                  Within 18 months of the effective date of this Agreement, the City will complete the following modifications to the Police Department Headquarters, located at 270 South Stone Avenue:

 

a.                  Parking:  The van accessible parking space has a 92 inch wide access aisle, and the other parking spaces reserved for people with disabilities have 58 inch wide access aisles.  Provide designated accessible parking spaces that are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Provide van accessible spaces that are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  Standards '' 4.1.2(5), 4.1.6(1)(b), 4.6.3, Fig.9.

 

b.                  Ramp to Public Entrance:  The ramp does not have handrail extensions at the bottom.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface and 12 inches from the wall, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards '' 4.1.2(1), 4.1.2(2), 4.1.6(1)(b), 4.8.5.

i.                     After reopening due to an obstruction, the elevator doors remain open only 10 seconds.  Provide doors that open and close automatically with a reopening device that will stop and reopen the car door and hoistway door automatically if the door becomes obstructed by an object or person.  Ensure that the device is capable of completing these operations without requiring contact for obstructions passing through the opening at heights of 5 inches and 29 inches above the finished floor; that door reopening devices remain effective for at least 20 seconds, after which the doors may close; that the minimum time from notification that a car is answering a call until the doors of that car start to close is 5 seconds; and that the minimum time for elevator doors to remain fully open in response to a car call is 3 seconds.  Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.6, 4.10.7, 4.10.8, Figs. 20, 21.

 

ii.                   The door to access the emergency communications requires pinching to open.  Provide a two-way communication system such that it does not require voice communication, the highest operable part is a maximum of 48 inches above the finished floor of the car, and it is identified by a raised symbol and lettering located adjacent to the device.  If the system uses a handset, ensure that the length of the cord from the panel to the handset is at least 29 inches.  If the system is located in a closed compartment, ensure that the compartment door hardware operates without tight grasping, pinching or twisting of the wrist.  Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.14.

 

d.                  Drinking Fountains

 


i.                     The 2nd floor drinking fountain spout is 37 inches high, the water flow is 42 inches from the front of the fountain, and there is no fountain provided for people with difficulty bending or stooping.  Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Ensure that fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  Additionally, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards '' 4.1.3(10), 4.1.6(1)(b), 4.15, 4.27.4, Fig. 27.

 

ii.                   The higher of the 1st floor drinking fountains protrudes into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

 

iii.                  The 3rd floor drinking fountain is not accessible to persons who use wheelchairs.  Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Ensure that fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards '' 4.15, 4.27.4, Fig. 27.

ii.                   Men=s Toilet Room

 

(1)               No accessible coat hook has been provided in the toilet stall for persons with disabilities.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.1.3(12)(a), 4.1.6(1)(b), 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

(2)               The toilet paper dispenser in the men=s designated accessible stall is too low.  Provide a toilet paper dispenser that is mounted with its top at least 12 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.3, Fig. 30(d).

 

f.                    Second Floor Toilet Rooms with Stalls (Existing; Program access standard applies)

 

i.                     Women=s Toilet Room

 

(1)               The toilet room sign is mounted on the door and does not have raised characters or Braille.  Provide a toilet room sign with raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

(2)               The door to the women=s toilet room requires 10 pounds of force to open.  Provide a door that requires no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).


 

(3)               The door to the women=s toilet room, which is accessed through a front approach, has only 14 inches of clearance on the pull side.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.6, Fig. 25(a).

(5)               The saloon style swinging doors in the women=s toilet room are each 16 inches wide, providing a combined clear opening width of less than 32 inches.  Provide a door at this location that has at least one active leaf with a clear opening at least 32 inches wide when measured from the face of the door to the middle edge of the other door when one door is opened 90 degrees and that has hardware usable with one hand and without tight grasping, pinching, or twisting of the wrist OR provide an automatic door opener that opens both doors simultaneously.  If a door closer is provided, it must be set so that the sweep period of the active leaf will, from an open position of 70 degrees, take 3 seconds to move to a point 3 inches from the latch, measured to the leading edge of the door.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13, Figs. 24, 25.

h.                  First Floor Meeting Room: Although there is a new public address system, there is no assistive listening system provided.  Provide a permanently installed assistive listening system (ALS) or a portable ALS with an adequate number of electrical outlets or other supplementary wiring necessary to support a portable assistive listening system.  Also provide receivers equal in number to 4% of the total number of seats, but no less than 2, for use by the general public, and signage indicating their availability.  Standards '' 4.1.3(19)(b), 4.1.6(1)(b), 4.30, 4.33.

 

 

6.                  Within 18 months of the effective date of this Agreement, the City will complete the following modifications to the Reid Park Zoo, located at 1100 South Randolph Way:

 

a.                  Parking:  Although 6 of the 183 parking spaces have been designated as reserved for persons with disabilities, there are no Avan-accessible@ spaces.  On the shortest accessible route to the accessible entrance, provide at least 1 van accessible space designated as reserved for people with disabilities.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 


b.                  Drinking Fountains

 

i.                     Front Plaza (altered; alterations standards apply)

 

(1)               Stone and Concrete Floor-Mounted Fountain

 

(a)                The fountain requires 10 pounds of force to operate.  Provide a drinking fountain with controls mounted on or near the front edge that are operable with one hand, that require 5 lbf or less to operate, and that can be operated without tight grasping, pinching, or twisting of the wrist.  Standards '' 4.1.3(10), 4.15.4, 4.27.4.

 

(b)               The knee space height is 22 inches above the finished floor.  Provide a drinking fountain with clear knee space between the bottom of the apron and the finished floor or ground of at least 27 inches high, 30 inches wide, and 17 to 19 inches deep; and a minimum clear floor space of 30 inches by 48 inches to allow a person in a wheelchair to approach the unit facing forward; or extend the concrete pad to enable users to make a parallel approach.  Standards '' 4.1.3(10), 4.15.5(1), Figs. 27(a), (b).

 

(2)               The lower metal wall-mounted fountain at the entrance is a protruding object that is not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

ii.                   Zebra Area

 


(1)               The water flow height is 1 inch and there is no fountain that is accessible to persons who have difficulty bending or stooping.  Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Ensure that fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  Additionally, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards '' 4.1.3(10), 4.1.6(1)(b), 4.15, 4.27.4, Fig. 27.

iii.                  Giraffe Area

 

(1)               There is no lower fountain that is accessible to persons who use wheelchairs.  Provide a fountain that has a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet, and that otherwise complies with the Standards.  Standards '' 4.1.3(10), 4.15, 4.27.4, Fig. 27.

 

(2)               The fountain is not detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

c.                  Ramps

 


i.                     Ramp Near Tigers:  The ramp only has a handrail on one side.  Provide handrails that are between 13 inches and 12 inches in diameter such that the inside handrail is continuous and both handrails have a continuous gripping surface along both sides of the ramp extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface; the handrails do not rotate within their fittings; and both handrails are mounted between 34 inches and 38 inches above the ramp surface and 12 inches from the wall, with ends rounded or returned smoothly to the floor, wall, or post.  Standards '' 4.1.2(1), 4.1.2(2), 4.1.6(1)(b), 4.3.8, 4.8.5.

 

ii.                   Ramp Near Polar Bears:  The ramp only has a handrail on one side.  Provide handrails that are between 13 inches and 12 inches in diameter such that the inside handrail is continuous and both handrails have a continuous gripping surface along both sides of the ramp extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface; the handrails do not rotate within their fittings; and both handrails are mounted between 34 inches and 38 inches above the ramp surface and 12 inches from the wall, with ends rounded or returned smoothly to the floor, wall, or post.  Standards '' 4.1.2(1), 4.1.2(2), 4.1.6(1)(b), 4.3.8, 4.8.5.

 

d.                  Counter at Jungle Shop:  The counter is 38 inches above the finished floor and no equivalent facilitation is provided.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor.  Standards '' 4.1.1(2), 4.1.6(1)(b), 7.2(1), 4.1.3(1), 4.3.

 

e.                  Brazil Grille Tables:  None of the picnic tables at the Brazil Grille is accessible to persons who use wheelchairs, as fixed benches prevent a person who uses a wheelchair from approaching.  Provide at least one picnic table on an accessible route such that there is knee space at the table at least 27 inches high, 30 inches wide, and 19 inches deep, and such that the height of the top of the table is between 28 inches and 34 inches above the ground.  Standards '' 4.1.3(18), 4.1.6(1)(b), 4.32.3, 4.32.4.

 

f.                    Safari Café Counter:  The condiment counter at the Safari Café is a protruding object that would not be detectable to a blind person who uses a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

iii.                  Giraffe Area Men=s Toilet Room (existing element; program access standard applies)

7.                  Within 18 months of the effective date of this Agreement, the City will complete the following modifications to the Santa Cruz Police Substation, located at 4410 South Park Avenue:

 

a.                  Parking

 

i.                     Public Parking Lot (altered element):  The pavement markings for the spaces designated as reserved for persons with disabilities are not clear.  On the shortest accessible route to the accessible entrance, provide 1 van accessible space designated as reserved for people with disabilities.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.1.6(1)(b), 4.6, 4.30.7(1).

 


ii.                   Employee Parking Lot (altered):  Although there are 150 parking spaces provided for employees, there are no spaces designated as reserved for persons with disabilities.  On the shortest accessible route to the accessible entrance, provide 1 van accessible space and 4 standard spaces designated as reserved for people with disabilities.  Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.1.6(1)(b), 4.6, 4.30.7(1).

 

b.                  Visual Alarms:  Although there is an audible alarm system and some visual alarm appliances, not all corridors, meeting rooms, toilet rooms and lobbies have visual alarms.  Provide visual alarm devices in toilet rooms and any other general usage areas (e.g., meeting rooms), hallways, lobbies, and any other area for common use.  Such devices shall be integrated into the facility alarm system and shall meet the requirements of the Standards for lamp type, color, pulse duration, intensity, and flash rate.  Visual alarm appliances shall be placed 80 inches above the highest floor level within the space or 6 inches below the ceiling, whichever is lower.  Visual alarm appliances shall be located such that no place in any room or space, including common corridors or hallways, required to have a visual alarm appliance shall be more than 50 feet from the signal.  In large rooms and spaces exceeding 100 feet across, without obstructions 6 feet above the finished floor, devices may be placed around the perimeter, spaced a maximum of 100 feet apart, in lieu of suspending appliances from the ceiling.  Standards '' 4.1.3(14), 4.1.6(1)(b), 4.28.3.

 

c.                  Locker Rooms

 

i.                     Women=s Locker Room (altered element)

 

(1)               Both entrance doors to the locker room are inaccessible because they require 15 pounds of force to operate.  Provide a door that requires no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

 

(2)               Entrance door #40:

 


(a)                The door has knob hardware.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.9.

 

(b)               On the pull side, which is accessed through a front approach, there are only 2 inches of maneuvering clearance.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.6, Fig. 25(a).

 

(c)                On the push side, which is accessed through a hinge approach, there are only 2 inches of maneuvering clearance.  On the push side of the door, provide a clear maneuvering space at least 54 inches wide, measured from the latch side, and at least 42 inches deep.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.6, Fig. 25(b).

 

(3)               There is no accessible route in the locker area because the space on either side of the bench to the lockers is 25 inches at the widest point.  Provide an accessible route in the locker area with a minimum clear width of 36 inches, except at doors, where the width may decrease to 32 inches.  Standards '' 4.1.3(1), 4.1.6(1)(b), 4.3.3, 4.13.5.

 

 

(4)               The lavatory is inaccessible because the bottom edge of the apron is 27 2 inches above the finished floor and the hot pipes and drain are not protected against contact.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; knee and toe clearances that comply with Fig. 31; hot water and drain pipes covered or otherwise configured to protect against contact; clear floor space at least 30 inches wide and 48 inches deep centered on the lavatory; and a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.2, 4.19.3, 4.19.4, 4.19.5, 4.27.4, Figs. 31, 32.

 

(5)               Toilet Stall for Persons with Disabilities

 


(a)                The seat cover dispenser is inaccessible because it is mounted over the toilet.  Provide a seat cover dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.1.3(13), 4.1.6(1)(b), 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6, Fig. 4.

 

(b)               The toilet seat height is 16 inches above the finished floor.  Provide a toilet with a seat that measures 17 to 19 inches above the finished floor.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.3, 4.17.2, Fig. 30(d).           

 

(c)                The toilet is inaccessible because its centerline measures 16 2 inches from the side wall.  Provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.3, Fig. 30.

 

(d)               The toilet paper dispenser is 41 inches from the rear wall.  Provide a toilet paper dispenser that is mounted with its top at least 12 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.3, Fig. 30(d).

 

(6)               The transfer shower stall is inaccessible because the transfer seat does not extend the full depth of the stall and there are no grab bars.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.21, Figs. 35, 36, 37.

 


(7)               No accessible bench is provided in the locker area.  Provide a 24 inch by 48 inch bench fixed to the wall along the bench=s longer dimension.  Ensure that the bench has sufficient structural strength and is mounted with its surface between 17 inches and 19 inches above the finished floor.  Provide clear floor space alongside the bench to allow a person using a wheelchair to make a parallel transfer onto the bench.  Standards '' 4.1.3(21), 4.1.6(1)(b), 4.35.4, 4.26.3.

 

(8)               The lockers are inaccessible because they require tight grasping or pinching to operate.  Provide a locker with mechanical controls, if any, that can be operated with 5 lbf or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards '' 4.1.3(13), 4.1.6(1)(b), 4.27.4.

 

ii.                   Men=s Locker Room (altered element)

 

(1)               Entrance door #150 is inaccessible because it requires 15 pounds of force to open.  Provide a door that requires no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

 

(2)               Entrance door #35

 

(a)                The door requires 12 pounds of force to open.  Provide a door that requires no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

(7)               Showers (existing element)

 


(a)                Although there are 5 gang-style showers, no accessible shower is provided.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards ' 4.21, Figs. 35, 36, 37.

d.                  Holding Cells (existing element):  The holding cells are not accessible because the doors are 26 inches wide, and there are no accessible toilets or lavatories provided.  Provide at least one cell with all elements, including door width, and toilet, lavatory, mirror, and desk (if provided) that are accessible to persons with disabilities.

 

e.                  Interview Room #134 (altered element):  There is no clear floor space for a wheelchair because the door swings into the room and there is fixed seating; the combination of these restricts the clear maneuvering space within the room so that a person who uses a wheelchair cannot enter.  Provide an accessible route within the room with a minimum clear width of 36 inches, except at doors, where the width may decrease to 32 inches.  Standards '' 4.1.3(1), 4.1.6(1)(b), 4.3.3, 4.13.5.

 

f.                   Unisex Single-User Toilet Room (altered element)

 

i.                     The entrance door is inaccessible because the pressure required to open the door is 15 pounds.  Provide a door that requires no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).           

 

ii.                   The door swings into the required clear floor space at the lavatory.  Ensure that no door swings into the required clear floor space at any accessible fixture.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.2.

(3)               The door, which is accessed through a front approach, has only 5 2 inches of maneuvering clearance on the pull side.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards ' 4.13.6, Fig. 25(a).

 

(4)               No accessible mirror is provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards ' 4.19.6.

 

(5)               In the toilet stall for persons with disabilities, the seat cover dispenser is inaccessible because it is mounted over the toilet.  Provide a seat cover dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.1.3(13), 4.1.6(1)(b), 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6, Fig. 4.

 


(6)               The lavatory is inaccessible because the bottom edge of the apron is 28 inches above the finished floor, and the hot pipes and drain are not protected against contact.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; knee and toe clearances that comply with Fig. 31; hot water and drain pipes covered or otherwise configured to protect against contact; clear floor space at least 30 inches wide and 48 inches deep centered on the lavatory; and a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards '' 4.19.2, 4.19.3, 4.19.4, 4.19.5, 4.27.4, Figs. 31, 32.

 

(7)               The lavatory protrudes into the walkway and would not be detectable by a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

(8)               Although one toilet stall has some elements for persons with disabilities, there is no stall that is accessible to persons who use wheelchairs.  Provide a Astandard@ accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall=s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

 

ii.                   Men=s Toilet Room

 

(1)               No accessible toilet room sign is provided.  Provide a toilet room sign with raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 


(2)               The entrance door is inaccessible because it requires 14 pounds of force to open; and, the pull side, which is accessed through a front approach, has only 5 3/4 inches of maneuvering clearance.  Provide a door that requires no more than 5 pounds of force to open. On the pull side of the door, provide a path of travel at least 60 inches wide when the approach is a side approach from the hinge side and there is a minimum of 36 inches to the latch side of the door, OR provide a path of travel between 54 inches and 59 inches wide when the approach is a side approach from the hinge side and there is a minimum of 42 inches to the latch side of the door.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.6, Fig. 25(b), 4.13.11(2)(b).

 

(3)               No accessible mirror is provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards ' 4.19.6.

h.                  Lobby Drinking Fountain (existing)

 


i.                     Although an accessible drinking fountain is provided, there is no drinking fountain provided for people who have difficulty bending or stooping.  For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards ' 4.1.3(10)(a).

 

 

8.                  Within 18 months of the effective date of this Agreement, the City will complete the following modifications to the Temple of Music and Art [historic site], located at 330 South Scott Avenue:

 

a.                  Entrance Ramp:  The ramp to the left of the main plaza entrance has a slope of 9.1%, it does not have handrails on both sides, and the existing handrail is mounted 3 inches from the wall.  Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.    Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface and 12 inches from the wall, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces.    Standards '' 4.1.2(1), 4.1.2(2), 4.1.6(1)(b), 4.3.8, 4.8.

 

b.                  Drinking Fountains

 

i.                     The first floor drinking fountain does not have water flow within 3 inches of the front of the fountain, the spout is not located at the front of the fountain, and it has controls that require 10 pounds of force to operate.  Provide at least one drinking fountain on each floor with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Ensure that fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  Standards '' 4.1.3(10), 4.1.6(1)(b), 4.15, 4.27.4, Fig. 27.

 


ii.                   The first and second floor interior drinking fountains and the fountains at the art gallery and dressing rooms each protrude into the main walkway and would not be detectable to a blind person using a cane.  At each of these locations, provide an accessible route such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

 

c.                  Upper Level Toilet Rooms with Stalls:  There is no accessible directional signage directing people with disabilities to the accessible lower level toilet rooms.  Provide accessible directional signage with the International Symbol of Accessibility at inaccessible toilet rooms indicating the location of the nearest accessible toilet room, and provide accessible signage with the International Symbol of Accessibility at all accessible toilet rooms.  Standards '' 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

 

d.                  Lobby Toilet Rooms with Stalls (altered)

 

i.                     Women=s Toilet Room

 

(1)               The toilet room sign is mounted 52 inches above the finished floor.  Provide a toilet room sign with raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

(2)               The door to the toilet room provides only 29 inches of clear opening width.   Provide a door with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.5, Fig. 24.

 

(3)               The soap dispenser requires 2 hands for operation.   Provide a soap dispenser with mechanical controls, if any, that can be operated with 5 lbf or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards ' 4.27.4.

 

(4)               Although there are 7 toilet stalls in the women=s toilet room, there is no toilet stall for ambulatory people with disabilities.  Provide at least one stall that is exactly 36 inches wide with a toilet 18 inches from each wall or partition, an outward swinging, self-closing door, and parallel grab bars complying with Fig 30(d).  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, Fig. 30(d).


 

(5)               Toilet Stall for Wheelchair Users

 

(a)                The toilet centerline is 20 inches from the side wall.  Provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.3, Fig. 30.

 

(b)               The rear grab bar is 32 inches long.  Provide a rear grab bar that is at least 36 inches in overall length with the closer end no more than 6 inches from the side wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.6, Fig. 30.

 

ii.                   Men=s Toilet Room

(5)               Toilet Stall for People with Disabilities

 

(a)                The toilet flush control is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.5, 4.17.2, 4.27.4.           

 

(b)               The toilet centerline is 20 inches from the side wall.  Provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.3, Fig. 30.

 

(c)                The rear grab bar is 32 inches long.  Provide a rear grab bar that is at least 36 inches in overall length with the closer end no more than 6 inches from the side wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.6, Fig. 30.

 

a.                  Elevator

 

i.                     After reopening due to an obstruction, the elevator doors remain open only 4 seconds.  Provide doors that open and close automatically with a reopening device that will stop and reopen the car door and hoistway door automatically if the door becomes obstructed by an object or person.  Ensure that the device is capable of completing these operations without requiring contact for obstructions passing through the opening at heights of 5 inches and 29 inches above the finished floor; that door reopening devices remain effective for at least 20 seconds, after which the doors may close; that the minimum time from notification that a car is answering a call until the doors of that car start to close is 5 seconds; and that the minimum time for elevator doors to remain fully open in response to a car call is 3 seconds.  Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.6, 4.10.7, 4.10.8, Figs. 20, 21.

 


ii.                   The emergency communications are not identified by raised symbol and lettering, they require voice communication, and the door to the compartment requires tight grasping or pinching to open.  Provide a two-way communication system such that it does not require voice communication, the highest operable part is a maximum of 48 inches above the finished floor of the car, and it is identified by a raised symbol and lettering located adjacent to the device.  If the system uses a handset, ensure that the length of the cord from the panel to the handset is at least 29 inches.  If the system is located in a closed compartment, ensure that the compartment door hardware operates without tight grasping, pinching or twisting of the wrist.  Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.14.

 

b.                  Rehearsal Room

 

i.                     The entrance door requires 10 pounds of force to open.  Provide a door that requires no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

 

ii.                   The entrance door has knob hardware.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.9.

 

iii.                  The entrance door, which is accessed through a front approach, has only 2 inches of clear space on both the pull side and the push side.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  On the push side of the door, provide maneuvering clearance at least 48 inches deep and provide a minimum of 12 inches of maneuvering clearance on the latch side of the door, or remove the closer or the latch.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.6, Fig. 25(a).

 

iv.                 The entrance door has a 1 inch threshold.  Provide a door with a threshold no greater than 3 inch, or between 3 inch and 2 inch and beveled with a slope no greater than 1:2.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.8, 4.5.2.

 

c.                  Dressing Room #3 (altered; alterations standard applies; designed for people with disabilities)

 

i.                     The bottom leading edge of the counter is a protruding object that is not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 


ii.                   The transfer shower has a wing wall that extends past the shower stall, blocking a wheelchair user from aligning with the transfer bench in the shower stall.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards ' 4.21, Figs. 35, 36, 37.

 

d.                  Second Level: Art Gallery and AThe Cabaret@:  For each, the double entrance doors are each 26 inches wide and there is no level approach to the door and no automatic opener.  Provide a door at this location that has at least one active leaf with a clear opening at least 32 inches wide when measured from the face of the door to the middle edge of the other door when one door is opened 90 degrees and that has hardware usable with one hand and without tight grasping, pinching, or twisting of the wrist OR provide an automatic door opener that opens both doors simultaneously.  Where no automatic opener is provided, door hardware may be lever-operated, push-type, or a U-shaped handle.  Unless an automatic door operator is provided, there must be clear and level maneuvering clearances at the pull side and the push side of the active leaf as indicated in Fig. 25.  The doors= threshold must be 2 inch or less in height and beveled with a slope of no greater than 1:2.  If a door closer is provided, it must be set so that the sweep period of the active leaf will, from an open position of 70 degrees, take 3 seconds to move to a point 3 inches from the latch, measured to the leading edge of the door.  The active leaf must not take more than 5 pounds of force to open or close.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13, Figs. 24, 25.

 

e.                  AThe Cabaret@:  AThe Cabaret@ has no signage indicating the availability of an assistive listening system.  Provide a permanently installed assistive listening system serving the fixed seating.  Ensure that the seating served by the system is located within a 50 foot viewing distance of the stage or playing area and has a complete view of the stage or playing area.  Provide receivers numbering 4% of total seats (or a minimum of 2) for use by the general public and signage indicating their availability.  Standards '' 4.30, 4.33.

 


f.                    Art Gallery Balcony: All of the doors to the balcony are down 6-inch steps.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have, in the absence of a curb ramp, ramp, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

g.                  Lobby Seating:  The lobby, containing 625 seats, was found to have only 2 accessible wheelchair seating locations (although the literature purports that the lobby has 7 wheelchair seating locations), each 47 inches by 57 inches.  Provide 8 wheelchair seating areas, each with a minimum clear ground or floor space of 66 inches wide by 48 inches deep for forward or rear access, or 66 inches wide by 60 inches deep for side access.  Ensure that the ground or floor at all wheelchair locations is level, firm, stable, and slip resistant; that wheelchair seating areas are an integral part of the fixed seating plan and are located so as to provide people with physical disabilities a choice of lines of sight comparable to those available for members of the general public; that wheelchair seating areas adjoin an accessible route that also serves as a means of egress in case of emergency; and that at least one fixed companion seat is provided next to each wheelchair seating area.  Standards '' 4.1.3(19)(a), 4.1.6(1)(b), 4.5, 4.33.

 

 

9.                  Within 18 months of the effective date of this Agreement, the City will complete the following modifications to the Tucson Children=s Museum, located at 200 South Sixth Avenue:

 

a.                  Entrance:  The accessible route into the building is not clearly marked at the inaccessible entrance.  Provide accessible directional signage with the International Symbol of Accessibility at inaccessible entrances directing users to the accessible entrance.  Standards '' 4.1.3(8)(d), 4.1.3(16)(b), 4.1.6(1)(b), 4.13, 4.30.

 

b.                  Accessible Route:  The cord cover on the floor next to the ticket counter is 1 inch high and is not beveled.  Provide at least one accessible route at this location that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.1.3(1), 4.1.6(1)(b), 4.3, 4.5, Fig. 7.

 

c.                  Exhibits

 


i.                     In the AGreatest Choice on Earth@ exhibit, none of the picnic tables are accessible to persons who use wheelchairs.  Provide at least one picnic table on an accessible route such that there is knee space at the table at least 27 inches high, 30 inches wide, and 19 inches deep, and such that the height of the top of the table is between 28 inches and 34 inches above the ground.  Standards '' 4.32.3, 4.32.4.

 

ii.                   Several of the exhibits and exhibit elements, such as the view boxes and the Zoom Room=s counter, are protruding objects that would not be detectable to a person using a cane.  Provide an accessible route at these locations such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

iii.                  Some exhibits, such as the coral reef archway, are overhead hazards.  Provide an accessible route at this location with a minimum of 80 inches of clear head room throughout.  If the vertical clearance of an area adjoining an accessible route is reduced to less than 80 inches, provide a barrier to warn blind or visually-impaired persons.  Standards ' 4.4.

 

d.                  Ramps

 

i.                     The ramp to the courtyard has no handrails.  Provide handrails that are between 13 inches and 12 inches in diameter such that the inside handrail is continuous and both handrails have a continuous gripping surface along both sides of the ramp extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface; the handrails do not rotate within their fittings; and both handrails are mounted between 34 inches and 38 inches above the ramp surface and 12 inches from the wall, with ends rounded or returned smoothly to the floor, wall, or post.  Standards '' 4.1.2(1), 4.1.2(2), 4.1.6(1)(b), 4.3.8, 4.8.5.

 

ii.                   The entrance ramp on the right side of the building has handrails 302 inches high and inadequate handrail extensions.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface and 12 inches from the wall, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards '' 4.1.2(1), 4.1.2(2), 4.1.6(1)(b), 4.8.5.

 


iii.                  The entrance ramp on the left side of the building has handrails 302 inches high.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface and 12 inches from the wall, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards '' 4.1.2(1), 4.1.2(2), 4.1.6(1)(b), 4.8.5.

e.                  Drinking Fountains

 

i.                     Although accessible drinking fountains are provided, there is no drinking fountain provided for people who have difficulty bending or stooping.  Provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards '' 4.1.3(10)(a), 4.1.6(1)(b).

 

ii.                   The drinking fountain by the Young Explorers room protrudes into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at these locations such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

 

f.                    Main Exhibits Toilet Rooms with Stalls (altered elements; alterations standard applies)

 

i.                     Women=s Toilet Room

 


(1)               The lavatory in the women=s toilet room is 36 inches high to the top of the counter and does not have adequate knee and toe clearances.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.2, Fig. 31.

 

(2)               The soap dispenser controls are at 48-1/2 inches above the finished floor and require a forward reach over the lavatory.  Provide a soap dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6, Fig. 4.

 

(3)               The paper towel dispenser requires tight gripping or pinching to advance the towels.  Provide a paper towel dispenser with mechanical controls, if any, that can be operated with 5 lbf or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards ' 4.27.4.

(5)               The toilet stall for persons with disabilities does not meet the Standards as an Aalternate@ stall and no toilet stall is provided for persons who use wheelchairs.  Provide a Astandard@ accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall=s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.22.7, 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

 

ii.                   Men=s Toilet Room

 


(1)               The paper towel dispenser requires tight grasping and pinching to advance the towels.  Provide a paper towel dispenser with mechanical controls, if any, that can be operated with 5 lbf or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards '' 4.1.3(13), 4.1.6(1)(b), 4.27.4.

 

(2)               Toilet Stall for Persons with Disabilities

 

(a)                In the stall for persons with disabilities, the toilet centerline is 20 inches from the side wall.  Provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.3, Fig. 30.

 

(b)               The toilet paper dispenser interferes with the use of the side grab bar.  Provide a side grab bar that has at least 12 inches between the grab bar and any other object, such as the toilet paper dispenser.  Standards '' 4.17.6, 4.26.2, Fig. 39.

 

g.                  Birthday Party Room Toilet Rooms with Stalls

 

i.                     The toilet room signs are incorrectly mounted and they do not have raised characters or Braille.  For each room, provide a toilet room sign with raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

ii.                   There is no signage directing people with disabilities to the accessible toilet rooms.  Provide accessible directional signage with the International Symbol of Accessibility at inaccessible toilet rooms indicating the location of the nearest accessible toilet room, and provide accessible signage with the International Symbol of Accessibility at all accessible toilet rooms.  Standards '' 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

 

 

10.              Within 18 months of the effective date of this Agreement, the City will complete the following modifications to the Udall Regional Park and Senior Center, located at 7200 East Tanque Verde:

 

a.                  Udall Senior Center Addition (altered element)

 


i.                     Ramp:  The ramp between the Udall Recreation Center and the Senior Center has handrail extensions that are only 8 inches long.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface and 12 inches from the wall, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards '' 4.1.2(1), 4.1.2(2), 4.1.6(1)(b), 4.8.5.                                   

 

ii.                   Drinking Fountain:  The hi fountain of the hi-lo drinking fountain near the toilet rooms is not detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

 

iii.                  Women=s Toilet Room with Stalls: The lavatory counter is a protruding object.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

 

b.                  Udall Park (Existing)

 


i.                     Parking:  Although the parking lot has a total of 135 parking spaces, including 12 designated as reserved for persons with disabilities, there are no van accessible spaces and all of the signs designating the reserved spaces can be obstructed by parked vehicles.  On the shortest accessible route to the accessible entrance, provide 1 van accessible space and 4 other spaces designated as reserved for people with disabilities.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

ii.                   Ballfield

 

(1)               There is no accessible route to the dugout or to the batting cages.  Provide accessible routes within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

(2)               The ballfield drinking fountain is a protruding object that is not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

iii.                  Telephones

 

(1)               Telephone Outside Front Entrance:  The telephone at the front entrance has no volume control mechanism.  Provide an accessible telephone that is hearing aid compatible and has a volume control mechanism.  Standards '' 4.31, 4.30.7(2).

 

(2)               Telephone In Corridor Outside Toilet Rooms

 


(a)                The highest operable part of the telephone is 60 inches above the finished floor and no volume control mechanism is provided.  Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards.  Standards '' 4.31, 4.30.7(2).

 

(b)               The telephone is a protruding object that is not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

iv.                 Drinking Fountains

 

(1)               Drinking Fountain on First Floor near Toilet Rooms: The drinking fountain protrudes into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 


(2)               Drinking Fountain Near Rear Door:  The drinking fountain has a water height of only 2 inches and the control requires 10 pounds of force to operate.  Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Ensure that fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  Standards '' 4.15, 4.27.4, Fig. 27.

 

(3)               Drinking Fountain on the Second Floor Near the Weight Room: The drinking fountain protrudes into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

(4)               Drinking Fountain Near Dance Studio

 

(a)                The water height is only 2 inches and the control requires 18 pounds of force to operate.  Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Ensure that fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  Standards '' 4.15, 4.27.4, Fig. 27.

 

(b)               The drinking fountain protrudes into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 


v.                   Meeting Rooms:  The meeting rooms are inaccessible to people with hearing impairments.  Provide a permanently installed assistive listening system (ALS) or a portable ALS with an adequate number of electrical outlets or other supplementary wiring necessary to support a portable assistive listening system.  Also provide receivers (totaling 4% of seats or a minimum of 2) for use by the general public and signage indicating their availability.  Standards '' 4.30, 4.33.

 

vi.                 Women=s Locker Room

 

(1)               The toilet room sign is not mounted where someone who is blind could find it, it does not include raised and Braille characters, and it does not include the International Symbol of Accessibility.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

(2)               The pressure required to open the door is 12 pounds.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

(3)               The air dryers and dressing counter protrude into the walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

(4)               The lavatory hot water and drain pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.

 

(5)               The toilet stall configuration impedes approach and transfer.  Provide a toilet stall that complies with Fig. 30(a) or (a-1).  Standards ' 4.17.3, Fig. 30.

 


(6)               The designated Atransfer@ shower is inaccessible because users cannot make a parallel approach to the transfer bench, the stall is 39 inches wide by 54 inches deep, the transfer seat does not extend the full depth of the stall, the shower unit may only be used as a handheld unit, is not mounted on a vertical bar, and the hose is not at least 60 inches long.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards ' 4.21, Figs. 35, 36, 37.

 

(7)               None of the dressing stalls are accessible.  Provide at least one accessible dressing room in this area on an accessible route with accessible signage indicating its location.  Ensure that accessible dressing rooms fitted with swinging or sliding doors contain sufficient clear floor space to allow a person using a wheelchair to make a 180-degree turn inside the room and that no door swings into any part of the turning space.  Ensure that private accessible dressing  rooms fitted with curtained openings at least 32 inches wide contain either a clear space of 60 inches in diameter, or a AT@ shaped turning space that complies with Fig. 3(b).  Provide a bench 24 inches by 48 inches fixed to the wall along the longer dimension and mounted between 17 and 19 inches above the finished floor to the top of the bench.  If mirrors are provided in dressing rooms of the same use, provide one full-length mirror, measuring at least 18 inches wide by 54 inches high, mounted in a position affording a view to a person on the bench as well as to a person in a standing position.  Standards '' 4.35, 4.30, 4.26.3, 4.2, 4.3, Fig. 3.

 

vii.                Men=s Locker Room

 

(1)               The toilet room sign is not mounted where someone who is blind could find it, it does not include raised and Braille characters, and it does not include the International Symbol of Accessibility.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

(3)               The dressing counter, air dryers, and lavatory counter are protruding objects that are not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

(4)               The lavatory hot water and drain pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.

 

(5)               The toilet stall configuration impedes approach and transfer.   Provide a toilet stall that complies with Fig. 30(a) or (a-1).  Standards ' 4.17.3, Fig. 30.

 

(6)               The designated Atransfer@ shower is inaccessible because users who use wheelchairs cannot make a parallel approach at the transfer bench, the stall is 39 inches wide by 54 inches deep, the transfer seat does not extend the full depth of the stall, the shower unit may only be used as a handheld unit, is not mounted on a vertical bar, and the hose is not at least 60 inches long.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards ' 4.21, Figs. 35, 36, 37.

 


(7)               The bench in the locker area is 12 inches deep and is not fixed to the wall.  Provide a 24 inch by 48 inch bench fixed to the wall along the bench=s longer dimension.  Ensure that the bench has sufficient structural strength and is mounted with its surface between 17 inches and 19 inches above the finished floor.  Provide clear floor space alongside the bench to allow a person using a wheelchair to make a parallel transfer onto the bench.  Standards '' 4.35.4, 4.26.3.

 

viii.              Elevator

 

(1)               The elevator hoistway signage does not have raised and Braille characters.  Provide signage at hoistway entrances with raised and Braille floor designations on both jambs such that the centerline of the characters is 60 inches above the finished floor and the characters are 2 inches high.  Standards ' 4.10.5, Fig. 20.           

 

(2)               After reopening for an obstruction, the doors remain open for only 3 seconds.  Provide doors that open and close automatically with a reopening device that will stop and reopen the car door and hoistway door automatically if the door becomes obstructed by an object or person.  Ensure that the device is capable of completing these operations without requiring contact for obstructions passing through the opening at heights of 5 inches and 29 inches above the finished floor; that door reopening devices remain effective for at least 20 seconds, after which the doors may close; that the minimum time from notification that a car is answering a call until the doors of that car start to close is 5 seconds; and that the minimum time for elevator doors to remain fully open in response to a car call is 3 seconds.  Standards '' 4.10.6, 4.10.7, 4.10.8, Figs. 20, 21.

 

(3)               Although emergency communications are provided, the response to non-voice communication was inappropriate indicating that voice communication is required for a proper response, and the cord length was less than 29 inches.  Provide a two-way communication system such that it does not require voice communication, the highest operable part is a maximum of 48 inches above the finished floor of the car, and it is identified by a raised symbol and lettering located adjacent to the device.  If the system uses a handset, ensure that the length of the cord from the panel to the handset is at least 29 inches.  If the system is located in a closed compartment, ensure that the compartment door hardware operates without tight grasping, pinching or twisting of the wrist.  Standards ' 4.10.14.

 

ix.                 Men=s Toilet Room with Stalls in Lobby

 


(1)               The toilet room sign is not mounted on the wall on the latch side of the door.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

(2)               The pressure required to open the door using the automatic door button is 10 pounds.  Provide an automatic door opener that requires no more than 5 pounds of force to open.  Standards ' 4.27.4.

 

(3)               The air dryer protrudes into the walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

(3)               The air dryer and sanitary napkin dispenser protrude into the walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.           

 

(4)               The condom dispenser controls are mounted at 88 inches above the finished floor.  Provide a condom dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

(5)               The lavatory hot water and drain pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.

(2)               The entrance door to the toilet room has knob hardware.  Provide a door with hardware usable with one hand and without tight grasping, pinching, or twisting of the wrist.  Lever-operated, push-type, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

(3)               The air dryer controls are mounted at 53 inches above the finished floor and require a forward reach.  Provide an air dryer with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

(4)               The mirror is inaccessible.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards ' 4.19.6.

 

(5)               The top of the lavatory counter is 39 inches above the finished floor.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31.  Standards ' 4.19.2, Fig. 31.

 

(6)               The lavatory is a protruding object that is not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

(7)               There are 4 stalls, but none of them are accessible to persons who use wheelchairs.  Provide a Astandard@ accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall=s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

 

 

11.              Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the Valencia Library Branch, located at 202 West Valencia Road:

 

a.                  Parking

 

i.                     The parking spaces reserved for persons with disabilities are narrower than 96 inches.  Provide designated accessible parking spaces that are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Provide van accessible spaces that are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  Standards '' 4.1.2(5), 4.1.6(1)(b), 4.6.3, Fig.9.

 

ii.                   The signage designating the van accessible parking space is too low.  At each space designated as reserved for persons with disabilities, provide a vertical sign with the International Symbol of Accessibility located such that it cannot be obstructed by vehicles parked in the space.  Standards '' 4.1.2(5), 4.1.6(1)(b), 4.6.4, 4.30.7(1).

 

b.                  Accessible Route:  The route from the parking to the curb cut has a 2 inch break in the pavement.  Provide at least one accessible route to the accessible entrance that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.1.3(1), 4.1.6(1)(b), 4.3, 4.5, Fig. 7.

 


c.                  Drinking Fountain: Although a lower drinking fountain is provided, there is no drinking fountain provided for people who have difficulty bending or stooping.  Provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.    Standards '' 4.1.3(10)(a), 4.1.6(1)(b).

 

d.                  Study Room:  A table encroaches on the door=s required clear opening width.  Provide and maintain a door with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.5, Fig. 24.

 

e.                  Stacks:  The width is 35 inches between stacks 616-629 and 646-690.  Provide at least 36 inches of clear width between all stacks and provide a clear width of 42 inches between stacks where possible.  Standards '' 4.1.6(1)(b), 8.5, Fig. 56.

 

f.                    Main Entrance Toilet Rooms with Stalls

 

i.                     Women=s Toilet Room

(3)               Toilet Stall for Persons with Disabilities

 

(a)                The toilet centerline is 19 inches from the side wall.  Provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.3, Fig. 30.

 

(b)               No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.1.3(12)(a), 4.1.6(1)(b), 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

 

12.              Within 6 months of the effective date of this Agreement, the City will complete the following modifications to the Ward 6 Midtown Council Office, located at 3202 East Second Street:

 


a.                  Parking:  The signage designating parking as reserved for persons with disabilities is too low and the parking reserved for persons with disabilities is not located on the shortest accessible route to the accessible facility entrance.  At each space designated as reserved for persons with disabilities, provide a vertical sign with the International Symbol of Accessibility located such that it cannot be obstructed by vehicles parked in the space.  Provide fully accessible parking that is located on the shortest accessible route to an accessible pedestrian entrance to the facility.  Standards '' 4.1.2(5), 4.1.2(5)(a), 4.1.2(5)(b), 4.1.6(1)(b), 4.6.2, 4.6.4, 4.30.7(1).

 

b.                  Lobby Single User Toilet Rooms

 

i.                     Unisex Toilet RoomB Front Lobby (altered; alterations standards apply)

 

(1)               The door has knob hardware.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.9.

 

(2)               The angles of the walls diminishes the clear floor space at the toilet.  Provide clear floor space at the toilet that complies with Fig. 28.  Standards ' 4.16.2, Fig. 28.

 

(3)               The seat cover dispenser is mounted 55 inches high with a forward reach required over the toilet. Provide a seat cover dispenser such that the controls comply with Fig. 5 for a forward reach or with Fig. 6 for a side reach and such that it is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach, respectively, by a person using a wheelchair.  Standards '' 4.1.3(13), 4.1.6(1)(b), 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

(4)               The toilet seat is 20 inches above the finished floor.  Provide a toilet with a seat that measures 17 to 19 inches above the finished floor.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.3, Fig. 29(b).

 

(5)               The side grab bar at the toilet is mounted with the farther end 47 inches from the rear wall.  Provide a side grab bar that is at least 42 inches in overall length, with the far end mounted at least 54 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.4, Fig. 29(b).

 

(6)               The rear grab bar is 24 inches long with the farther end 30 inches from the side wall.  Provide a rear grab bar that is at least 36 inches in overall length with the closer end no more than 6 inches from the side wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.4, Fig. 29.

 

ii.                   Men=s Toilet RoomB Rear Lobby


 

(1)               The door to the men=s toilet room requires 10 pounds of force to open.  Provide a door that requires no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

 

(2)               The door to the men=s toilet room, which is accessed through a front approach and which has both a closer and a latch, has only 72 inches of clearance on the push side.  On the push side of the door, provide maneuvering clearance at least 48 inches deep and provide a minimum of 12 inches of maneuvering clearance on the latch side of the door, or remove the closer or the latch.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.6, Fig. 25(a).

 

iii.                  Women=s Toilet Room- Rear Lobby

 

(1)               The door to the women=s toilet room, which is accessed through a front approach, has only 62 inches of clearance on the pull side.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.6, Fig. 25(a).

 

(2)               The door requires 13 pounds of force to operate.  Provide a door that requires no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

 

(3)               The toilet centerline is 19 inches from the side wall.  Provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.2, Fig. 28.

 

c.                  East Conference Room

 

i.                     The entrance door requires 10 pounds of force to open.  Provide a door that requires no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

 

ii.                   The entrance door has knob hardware.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.9.

 

 


13.              Within 6 months of the effective date of this Agreement, the City will complete the following modifications to the Wilmot Library Branch, located at 530 North Wilmot:

 

a.                  Curved Interior Ramp:  The ramp has no handrails.  Provide handrails that are between 13 inches and 12 inches in diameter such that both handrails have a continuous gripping surface along both sides of the ramp extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface; the handrails do not rotate within their fittings; and both handrails are mounted between 34 inches and 38 inches above the ramp surface and 12 inches from the wall, with ends rounded or returned smoothly to the floor, wall, or post.  Standards '' 4.1.2(1), 4.1.2(2), 4.1.6(1)(b), 4.3.8, 4.8.5.

 

b.                  Drinking Fountain:  The lower drinking fountain protrudes into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

 

c.                  Front Entrance Telephone

 

i.                     The counter at the telephone is 38 inches above the finished floor, there is insufficient clear floor space at the telephone, and the coin slot is 59 inches above the finished floor.  Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards.  Standards '' 4.1.3(17), 4.1.6(1)(b), 4.31, 4.30.7(2).

 

ii.                   The route to the telephone is 212 inches wide due to the position of the floor-mounted sign.  Provide an accessible route to the telephone with a minimum clear width of 36 inches, except at doors, where the width may decrease to 32 inches.  Standards '' 4.1.3(1), 4.1.6(1)(b), 4.3.3, 4.13.5.

 


d.                  Single User Toilet Room - Unisex

 

i.                     The entry door requires 9 pounds of force to open.  Provide a door that requires no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

 

ii.                   Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards '' 4.1.3(14), 4.1.6(1)(b), 4.28.1, 4.28.3.

 

iii.                  There is inadequate clear floor space at the toilet.  Provide clear floor space at the toilet that complies with Fig. 28.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.2, Fig. 28.

 

iv.                 The flush control on the toilet is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.5, 4.27.4.

 

v.                   The rear grab bar is 24 inches long.  Provide a rear grab bar that is at least 36 inches in overall length with the closer end no more than 6 inches from the side wall.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.4, Fig. 29.
