ATTACHMENT I: Program Access in Existing Facilities
Paragraph 42 of the Settlement Agreement
requires that within six months of the effective date of this Agreement, the
City will request in writing that each of the owners and operators of the
facilities listed in Attachment I, ensure that their programs, services, and
activities are accessible to persons with disabilities in compliance with 28
C.F.R. § Part 35. The
“Completion Date” is to be calculated from the effective date of this
Agreement. The City will
simultaneously send a courtesy copy to the Department.
The technical requirements and, where
appropriate, the scoping requirements of the Standards are used as a guide
for determining whether a program or activity held in an existing facility is
“readily accessible to and usable by” persons with disabilities and for
determining what changes are necessary to make this program or activity
accessible if it continues to be provided in the existing facility in
questions. See 28 C.F.R. §§
35.150(b)(1), 35.151.
The chart below lists the facilities
surveyed and gives an alphanumeric code for the required remedial
action. The key to these codes
is found in Attachment J to this Agreement.
