SETTLEMENT AGREEMENT BETWEEN

THE CITY OF SAVANNAH, GEORGIA

BACKGROUND

A. SCOPE OF THE INVESTIGATION

The United States Department of Justice (“Department”) initiated this matter as a compliance review of the City of Savannah, Georgia (“City”) under Title II of the Americans with Disabilities Act of 1990 (“ADA”), 42 U.S.C. §§ 12131-12134, and the Department’s implementing regulation, 28 C.F.R. Part 35. Because the City receives financial assistance from the Department of Justice, the review was also conducted under the authority of the Rehabilitation Act of 1973, 29 U.S.C. § 794, and the Department’s implementing regulation, 28 C.F.R. Part 42, Subpart G.

The review was conducted by the Disability Rights Section (“DRS”) of the Department’s Civil Rights Division and focused on the City’s compliance with the following provisions of Title II:

28 C.F.R. § 35.105, which requires public entities to conduct self-evaluations of their programs, policies, practices and services by July 26, 1992, and make modifications necessary to comply with the Department’s Title II regulations;

28 C.F.R. § 35.106, which requires public entities to notify applicants, participants, beneficiaries, and other interested persons of their rights and the City’s obligations under Title II and the Department’s regulations;

28 C.F.R. § 35.107(a), which requires public entities to designate a responsible employee to coordinate their efforts to comply with Title II and carry out the City’s ADA responsibilities;

28 C.F.R. § 35.107(b), which requires public entities to establish a grievance procedure for resolving complaints of violations of Title II;

28 C.F.R. § 35.150, which requires public entities to operate each program, service, and activity so that, when viewed in their entirety, they are readily accessible to and usable by individuals with disabilities, by:

delivering services, programs, or activities in alternate ways, such as by redesigning equipment, reassigning services, assigning aides, and undertaking home visits; and

making physical changes to buildings, in accordance with the Department’s Title II regulation, 28 C.F.R. § 35.151, and the ADA Standards for Accessible Design (“Standards”) or the Uniform Federal Accessibility Standards (“UFAS”);

28 C.F.R. § 35.151, which requires public entities to ensure that facilities which newly constructed or for which alteration began after January 26, 1992, are readily accessible to and usable by people with disabilities, in accordance with: 1) the Department’s Title II regulation; and 2) the Standards or UFAS;

28 C.F.R. § 35.160, which requires public entities to ensure that communications with applicants, participants, and members of the public with disabilities are as effective as communications with others, including furnishing auxiliary aids and services when necessary;

28 C.F.R. § 35.161, which requires public entities to communicate through use of a teletypewriter (TTY), or other equally effective telecommunications system, with individuals who have hearing or speech impairments;

28 C.F.R. § 35.162, which requires public entities to provide direct access via TTY or computer to telephone emergency services, including 911 services, for persons who use TTY’s and computer modems;

28 C.F.R. § 35.163(a), which requires public entities to provide information for interested persons with disabilities concerning the existence and location of the City’s accessible services, activities, and facilities; and

28 C.F.R. § 35.163(b), which requires public entities to provide signage at all inaccessible entrances to each of its facilities, directing users to an accessible entrance or to information about accessible facilities.

The Department limited its program access review to those of the City’s programs, services, and activities that are provided in the following facilities: City Hall, the City Hospitality Center, the Visitor’s Center at the Savannah Exposition Properties, the Gamble Building, the Broughton Municipal Building, Fire Department Headquarters and certain specified substations, Police Headquarters and precincts, the Recorder’s Court located in the Chatham County Courthouse Judicial Center, the Civic Center, the Bonaventure Cemetery, City parking facilities, and various parks, athletic complexes, swimming pools and community centers throughout the City.

Those facilities not subject to this program access review are subject to this Agreement only as set forth herein. This Agreement does not however, limit the responsibility of the City to operate the programs and services offered in those facilities in a manner compliant with Title II, nor does it in any way limit the rights of the Department to investigate these programs and services in the future or subject them to other enforcement activities if the Department believes such action is warranted.

The parties to this Agreement are the United States of America and the City of Savannah, Georgia. In order to avoid the burdens and expenses of an investigation and possible litigation, the parties hereby agree as follows:

B. JURISDICTION

1. The ADA applies to the City because it is a “public entity” as defined by Title II. 42 U.S.C. § 12131(1); 28 C.F.R. § 35.104.

2. The Department is authorized under 28 C.F.R. Part 35, Subpart F, to determine whether the City is in compliance with Title II of the ADA and the Department’s regulation implementing Title II, to issue findings and, where appropriate, to negotiate and secure a voluntary compliance agreement to bring the City into compliance with Title II. Furthermore, the Attorney General is authorized, under 42 U.S.C. § 12133, to bring a civil action enforcing Title II of the ADA should the Department fail to secure voluntary compliance.

3. The Department is also authorized under 28 C.F.R. Part 42, Subpart G, to determine whether City is in compliance with section 504 of the Rehabilitation Act of 1973, and its relevant implementing regulations, to issue findings, and, where appropriate to negotiate and secure voluntary compliance agreements to bring the City into compliance with the Rehabilitation Act. Furthermore, the Attorney General is authorized, under 29 U.S.C. § 794 and 28 C.F.R. §§ 42.530 and 42.108-110, to suspend or terminate financial assistance to the City should the Department fail to secure voluntary compliance pursuant to Subpart G or to bring a civil suit to enforce the Rehabilitation Act.

REMEDIAL ACTION

4. In consideration of the terms of this Agreement as set forth below, the Attorney General agrees to refrain from undertaking further investigation or from filing civil suit in this matter.

5. The Parties agree that the technical requirements and, where appropriate, the scoping requirements of the ADA Standards for Accessible Design (“Standards”) are used as a guide for determining whether a program or activity held in an existing facility is “readily accessible to and usable by” persons with disabilities, and for determining what changes are necessary to make this program or activity accessible if it continues to be provided in the existing facility in question. See 28 C.F.R. §§ 35.150(b)(1), 35.151. The Standards appear at 28 C.F.R. Part 36, Appendix A.

A. ASSISTIVE LISTENING SYSTEMS

6. In order to provide effective communication during City Council meetings the City agrees to do the following within 180 days of the effective date of this Agreement:

a. Purchase and install (if necessary) an assistive listening system for use by people with hearing impairments participating in or attending City Council meetings. This includes a transmitting unit and corresponding receiver units equal to no less than 4 percent of the capacity of the rooms where City Council meetings are held.

b. Establish and implement a policy regarding the use of the assistive listening system and the assistive listening receivers that requires: 1) That they be available for use at all City Council meetings; 2) That they be provided to members of the public at no charge and that only a minimal deposit or the provisions of valid current identification be required to obtain a receiver. Under no circumstances will proof of disability be required in order to obtain the receiver; 3) That the City Council use the assistive listening system at all meetings where a person with a hearing impairment has requested its use; 4) That the City accept requests for the use of the assistive listening system during City Council meetings up to the start of any City Council meeting.

c. Establish a maintenance schedule or contract with a provider of maintenance to ensure that the assistive listening system and the assistive listening system receivers are kept in working order.

d. Provide training to employees on the use and maintenance of the assistive listening system as well as the policies adopted by the City regarding the use of the system and provision of receivers during City Council meetings.

7. In order to provide effective communication at the Civic Center’s Martin Luther King, Jr. Arena during events held there the City agrees to do the following within 180 days of the effective date of this Agreement:

a. Purchase and install (if necessary) an assistive listening system for use by people with hearing impairments attending events at the Civic Center’s Martin Luther King, Jr. Arena. This includes a transmitting unit and corresponding receiver units equal to no less than 4 percent of the capacity of the Arena.

b. Establish and implement a policy regarding the use of the assistive listening system and the assistive listening receivers that requires: 1) That they be available for use at all events held at the Arena; 2) That the receivers be provided to members of the public at no charge and that only a minimal deposit or the provisions of valid current identification be required to obtain a receiver. Under no circumstances will proof of disability be required in order to obtain the receiver; 3) That the City require that the assistive listening system be used during all events where amplified sound is used; 4) That the assistive listening system receivers be available for use throughout events held at the Arena; and 5) That signage indicating the availability of assistive listening devices be posted at ticket counters and other places in order to inform people with hearing impairments of their availability.

c. Establish a maintenance schedule or contract with a provider of maintenance to ensure that the assistive listening system and the assistive listening system receivers are kept in working order.

d. Provide training to employees on the use and maintenance of the assistive listening system as well as the policies adopted by the City regarding the use of the system and provision of receivers during events held at the Arena.

8. In order to provide effective communication at the William L. Grayson Stadium at Daffin Park during events held there the City agrees to do the following within 180 days of the effective date of this Agreement:

a. Purchase and install (if necessary) an assistive listening system for use by people with hearing impairments attending events at the William L. Grayson Stadium at Daffin Park. This includes a transmitting unit and corresponding receiver units equal to no less than 4 percent of the capacity of the Stadium.

b. Establish and implement a policy regarding the use of the assistive listening system and the assistive listening receivers that requires: 1) That they be available for use at all events held at the Stadium; 2) That the receivers be provided to members of the public at no charge and that only a minimal deposit or the provisions of valid current identification be required to obtain a receiver. Under no circumstances will proof of disability be required in order to obtain the receiver; 3) That the City require that the assistive listening system be used during all events where amplified sound is used; 4) That the assistive listening system receivers be available for use throughout events held at the Stadium; and 5) That signage indicating the availability of assistive listening devices be posted at ticket counters and other places in order to inform people with hearing impairments of their availability.

c. Establish a maintenance schedule or contract with a provider of maintenance to ensure that the assistive listening system and the assistive listening system receivers are kept in working order.

d. Provide training to employees on the use and maintenance of the assistive listening system as well as the policies adopted by the City regarding the use of the system and provision of receivers during events held at the Stadium.

9. The City agrees that within 180 days of the effective date of this Agreement all letters sent to the public from every City office will have the City’s TTY telephone number printed on the letterhead.

B. POLICIES AND PROCEDURES

10. Within 30 days of the effective date of this Agreement, the City will distribute the attached Notice (Attachment A) to all agency heads; publish the Notice on its Internet Home Page, and post copies in conspicuous locations in its public buildings. The City will refresh the posted copies, and update the ADA Coordinator information contained in the Notice, as necessary, for the life of the Agreement. The City will provide copies of this Notice to any person upon request.

11. The City will report to the Department within 180 days of the effective date of this Agreement the actions it has taken to comply with Paragraph 10.

12. Within one year of the effective date of this Agreement, the City will develop a method for providing information for interested persons with disabilities concerning the existence and location of the City’s accessible programs, services, and activities and submit its proposal to the Department in writing. The City will modify the proposal as needed to obtain the Department’s approval. The proposal, as approved by the Department, will be implemented no later than 18 months from the effective date of the Agreement.

C. PHYSICAL ALTERATIONS

In order to ensure that the following facilities, for which construction commenced after January 26, 1992, are readily accessible to and usable by individuals with disabilities, the City will take the following actions.

13. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the City of Savannah’s Hospitality Center:

a. Men’s and Women’s Toilet Rooms

(1) The toilet rooms do not have the required signage. Install signage on the wall adjacent to the latch side of each door positioned so that the centerline of each sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. The signage should have raised and Braille characters and letters and all other attributes required by the Standards. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The centerline of the toilet in the designated accessible stall is located 21 inches from the side wall in each toilet room. Remount each toilet so that its centerline is exactly 18 inches from the side wall. Standards §§ 4.1.3(11), 4.22.4, 4.17.3 & Fig. 30.

(3) The toilet paper dispenser in the designated accessible stall is located 44 inches from the back wall. Remount the toilet paper dispenser so that it is below the side grab bar and its farthest edge is no more than 36 inches from the back wall with its centerline no less than 19 inches above the finish floor. Standards §§ 4.1.3(11), 4.22.4, 4.17.3 & Fig. 30(d).

14. Within 24 months of the effective date of this Agreement, the City will complete the following modifications to the Daffin Park Tennis Court Facility:

a. Accessible Route

(1) There is no accessible route from the street to the Tennis Court Facility. Establish an accessible route from the street to the Tennis Court Facility that is firm, stable, and slip resistant. Standards §§ 4.1.2(1), 4.3, 4.5.

b. Men’s and Women’s Shower Rooms

(1) The shower rooms do not have the required signage. Install signage on the wall adjacent to the latch side of each door positioned so that the centerline of each sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. The signage should have raised and Braille characters and letters and all other attributes required by the Standards. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) Each shower room door has knob hardware. Replace the door knobs with hardware that does not require tight grasping, pinching, or twisting of the wrist to operate. Standards §§ 4.1.3(7), 4.23.2, 4.13.9.

(3) The accessible stalls in the men’s and women’s shower rooms are less than 60 inches wide. Modify each shower room to provide a “standard” accessible toilet stall at least 60 inches wide and 59 inches deep (56 inches if the toilet is wall mounted) arranged so that all of the stall’s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls and dispensers comply with the Standards. Standards §§ 4.1.3(11), 4.2.5, 4.2.6, 4.16, 4.17 & Fig. 30(a), 4.23.4, 4.23.7, 4.26, 4.27.

(4) The rear grab bars in the designated accessible stalls are less than 36 inches long. Provide a rear grab bar in each accessible stall that is at least 36 inches long mounted between 33 and 36 inches above the finish floor, so that the end closer to the side wall is mounted no more than 6 inches from the side wall. Standards §§ 4.1.3(11), 4.23.4, 4.17.6 & Fig. 30(a).

(5) The side grab bar in each shower room’s accessible stall extends less than 52 inches form the back wall. Provide a side grab bar in each designated accessible stall that is at least 40 inches long, mounted so that the end nearest the back wall is no more than 12 inches from the wall, and the end farthest from the back wall is located at least 52 inches from the back wall. Standards §§ 4.1.3(11), 4.23.4, 4.17.6 & Fig. 30(d) 4.26.

(6) The centerline of the toilet in each of the designated accessible stalls is 20 1/2 inches from the side wall. Remount the toilet in each stall so that its centerline is exactly 18 inches from the side wall. Standards §§ 4.1.3(11), 4.23.4, 4.17.3 & Fig. 30(a).

(7) The toilet paper dispenser in each of the designated accessible stalls is located more than 36 inches from the back wall. Remount the toilet paper dispensers so that they are below the side grab bar with their centerline no less than 19 inches above the finish floor and their farthest edges are no more than 36 inches from the back wall. Standards §§ 4.1.3(11), 4.23.4, 4.17.3 & Fig. 30(d).

(8) The distance between the privacy screens at the designated “accessible” men’s shower room urinal is less than 30 inches. Remove the privacy screens so that there is a clear floor space of at least 30 inches by 48 inches in front of the urinal. Standards §§ 4.1.3(11), 4.23.5, 4.18.3.

(9) The lavatories in each of the shower rooms have twist-type faucets. Replace the twist-type faucet controls at the designated accessible lavatory with controls that are operable with one hand and do not require tight grasping, pinching or twisting of the wrist to operate. Standards §§ 4.1.3(11), 4.23.6, 4.19.5, 4.27.4.

(10) The door coat hook in the designated accessible stall in each toilet room is located 67 inches above the finish floor. Provide a hook that is no more than 54 inches above the finish floor for a side reach or, if that is not available, 48 inches above the finish floor for a front reach. Standards §§ 4.1.3(12)(a), 4.25.3, 4.2.5, 4.2.6.

(11) The shower stall in the each shower room has a 4 1/2 inch curb and no seat has been provided. Alter the stall so that the curb is no higher than 1/2 inch, provide a seat that is 17-19 inches above the finish floor and extends the full depth of the stall. Standards §§ 4.1.3(11), 4.23.8, 4.21.7, 4.21.3, 4.21.4 & Figs. 35(a), 36.

15. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the Eastside Golden Age Center:

a. Parking

(1) There is no signage designating the van-accessible parking space. Install signage designating the space as “van-accessible” that is mounted below the International Symbol of Accessibility in a location that cannot be obscured by a vehicle parked in the space. Standards §§ 4.1.2(5)(b), 4.6.4, 4.30.7.

(2) The curb ramp extends into the access aisle of the accessible parking space. Alter the access aisle so that it is level, with surface slopes not exceeding 1:50 in any direction. Provide a curb ramp complying with the Standards in a location that will not intrude upon the accessible parking spaces or access aisles. Standards §§ 4.1.2(1), 4.1.2(5)(b), 4.6.3, 4.7, 4.3.8, 4.5.2.

b. Men’s and Women’s Toilet Rooms

(1) The toilet rooms do not have the required signage. Install signage, using raised and Brailled characters and letters, on the wall adjacent to the latch side of each door so that the centerline of each sign is 60 inches above the finish floor and there are no protruding objects within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The toilet paper dispenser in the designated accessible stall in the men’s toilet room is located more than 36 inches from the back wall. Remount the dispenser so that it is below the side grab bar with its farthest edge no more than 36 inches from the back wall, and its centerline is no less than 19 inches above the finish floor. Standards §§ 4.1.3(11), 4.22.4, 4.17.3 & Fig. 30(d).

16. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to Eastside Community Center:

a. Men’s and Women’s Toilet Rooms

(1) The toilet rooms do not have the required signage. Install signage, using raised and Brailled characters and letters, on the wall adjacent to the latch side of each door so that the centerline of each sign is 60 inches above the finish floor and there are no protruding objects within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The toilet paper dispenser in each designated accessible stall is located above the side grab bar. Remount the dispenser so that is below the side grab bar with its centerline no less than 19 inches above the finish floor and its farthest edge is no more than 36 inches from the back wall. Standards §§ 4.1.3(11), 4.22.4, 4.17.3 & Fig. 30(d).

17. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the Bowles Ford Park Picnic Facility:

a. Parking

(1) None of the accessible parking spaces is “van-accessible”. Provide a van-accessible parking space that is 96 inches wide with a 96 inch wide access aisle and install a sign designating the space as “van-accessible” mounted below the International Symbol of Accessibility in a location that cannot be obscured by a vehicle parked in the space. Standards §§ 4.1.2(5), 4.6, 4.30.7.

b. Picnic Area

(1) None of the picnic tables is accessible to persons who use wheelchairs. Provide picnic tables within the shelter in a number equal to 5 percent of the total, but not less than one, that have an eating surface between 28 and 34 inches above the finish floor and provides sufficient knee clearance to be used by persons who use wheelchairs. Standards §§ 4.1.3(18), 4.32.

In order to ensure that the following spaces in City facilities, for which alterations commenced after January 26, 1992, are readily accessible to and usable by individuals with disabilities, the City will take the following actions:

18. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the City Hall:

a. Accessible Route

(1) There is no signage at either the inaccessible entrance to the building on West Bay Street, or the accessible entrance on the basement level at the rear of the building. Install signage at the inaccessible front entrance of the building directing persons with disabilities to the accessible entrance; install signage using the International Symbol of Accessibility to designate the rear, basement entrance as accessible. Standards §§ 4.1.2(7)(c), 4.1.3(8)(d), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

b. Third Floor Men’s and Women’s Toilet Rooms

(1) The men’s and women’s toilet rooms are not accessible given its elements, size and arrangement. Install signage directing individuals to the accessible unisex toilet room in the facility using raised and Brailled characters, on the wall adjacent to the latch side of each door so that the centerline of the sign is 60 inches above the ground and there are no protruding objects to within 3 inches of the signage. Standards
§§ 4.1.3(16), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

c. Basement Level Men’s and Women’s Toilet Rooms

(1) The men’s and women’s toilet rooms are not accessible given its elements, size and arrangement. Install signage directing individuals to the accessible unisex toilet room in the facility using raised and Brailled characters, on the wall adjacent to the latch side of each door so that the centerline of the sign is 60 inches above the ground and there are no protruding objects to within 3 inches of the signage. Standards
§§ 4.1.3(16), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

d. Basement Level Unisex Toilet Room

(1) The toilet room does not have the required signage. Install signage, using raised and Brailled characters and letters, on the wall adjacent to the latch side of the door so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The toilet room door has knob hardware. Replace the door knob with hardware that is easy to grasp and does not require tight grasping, pinching, or twisting of the wrist to operate. Standards §§ 4.1.3(11), 4.22.2, 4.13.9.

(3) There is insufficient clear floor space at the water closet because of the placement of the wooden privacy screen. Remove the wooden privacy screen so that clear floor space that is at least 48 inches wide is provided. Standards §§ 4.1.3(11), 4.22.4, 4.16.2, Fig. 28.

(4) The height of the toilet is 15 1/2 inches above the finish floor to the top of the seat. Reposition or provide a toilet mounted with a seat between 17 and 19 inches above the finish floor. Standards §§ 4.1.3(11), 4.22.4, 4.16.3 & Fig. 29(b).

(5) The centerline of the toilet is 25 inches from the side wall. Remount the toilet so that the centerline is exactly 18 inches from the side wall. Standards §§ 4.1.3(11), 4.22.4, 4.16.2 & Fig. 28.

(6) The rear grab bar is not compliant. Provide a rear grab bar that is at least 36 inches long mounted between 33 and 36 inches above the finish floor with its edge nearest the side wall no more than 6 inches from the side wall. Standards §§ 4.1.3(11), 4.22.4, 4.16.4 & Fig.29(a), 4.26.

(7) The side grab bar is not compliant. Install a grab bar that is at least 42 inches long, mounted 33 to 36 inches above the finish floor so that the end nearest the back wall is no more than 12 inches from the back wall, and the end farthest from the back wall at least 52 inches from the wall. Standards §§ 4.1.3(11), 4.22.4, 4.16.4 & Fig. 29(b), 4.26.

(8) The toilet paper dispenser is installed above the grab bar. Remount the toilet paper dispenser so that its farthest edge is no more than 36 inches from the back wall, it is below the grab bar, and its centerline is at least 19 inches above the finish floor. Standards §§ 4.1.6(1)(b), 4.1.3(11), 4.22.4, 4.16.6 & Fig. 29(b).

e. Basement Level Drinking Fountain

(1) The spout outlet height of the drinking fountain is 42 inches above the finish floor. Provide a fountain with a spout no more than 36 inches above the finish floor that is accessible to a person in a wheelchair and a spout that is accessible to persons who have difficulty bending and stooping. Standards §§ 4.1.3(10)(a), 4.15.

19. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the Gamble Building:

a. Accessible Route

(1) There is no directional signage indicating an accessible route from West Bay Street to the accessible walking bridge leading to the front of the building. Install a sign indicating the accessible route from the sidewalk on West Bay Street to the walking bridge leading to the building entrance, the County Library, and the Housing and Economic Development Offices. Install signage using the International Symbol of Accessibility to designate the accessible entrances at these facilities. Standards §§ 4.1.2(7)(c), 4.1.3(8)(d), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

b. Elevator

(1) The elevator hoistway entrances do not provide raised and Brailled floor designations on both jambs. Provide floor designation signage on the elevator hoistway entrances on each floor that have raised and Braille characters and letters mounted so that the centerline of the characters is 60 inches above the finish floor. Standards §§ 4.1.3(5), 4.10.5, 4.30.4.

c. Third Floor Men’s and Women’s Toilet Rooms

(1) The men’s and women’s toilet rooms are not accessible given its elements, size and arrangement. Install signage directing individuals to the accessible unisex toilet room in the facility using raised and Brailled characters, on the wall adjacent to the latch side of each door so that the centerline of the sign is 60 inches above the ground and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

d. Second Floor Men’s and Women’s Toilet Rooms

(1) The men’s and women’s toilet rooms are not accessible given its elements, size and arrangement. Install signage directing individuals to the accessible unisex toilet room in the facility using raised and Brailled characters, on the wall adjacent to the latch side of each door so that the centerline of the sign is 60 inches above the ground and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

e. Third Floor Unisex Toilet Room

(1) The toilet room does not have the required signage. Install signage, using raised and Brailled characters and letters, on the wall adjacent to the latch side of each door, mounted so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The toilet room door has knob hardware. Replace the door knob with hardware that is easy to grasp with one hand and does not require tight grasping, pinching, or twisting of the wrist to operate. Standards §§ 4.1.3(11), 4.22.2, 4.13.9.

(3) No rear grab bar is provided at the toilet. Provide a rear grab bar that is at least 36 inches long mounted between 33 and 36 inches above the finish floor, so that the end closer to the side wall is no more than 6 inches from the side wall. Standards §§ 4.1.3(11), 4.22.4, 4.16.4 & Fig.29(a).

(4) The side grab bar is not compliant. Provide a side grab bar that is at least 42 inches long, mounted between 33 and 36 inches above the finish floor. The end of the grab bar nearest the back wall is to be no more than 12 inches from the back wall, and the end farthest from the back wall is to be at least 52 inches from the wall. Standards §§ 4.1.3(11), 4.22.4, 4.16.4 & Fig. 29(b).

(5) The toilet paper dispenser is above the grab bar. Remount the toilet paper dispenser so that it is below the grab bar with its centerline at least 19 inches above the finish floor and its farthest edge no more than 36 inches from the back wall. Standards §§ 4.1.3(11), 4.22.4, 4.16.6 & Fig. 29(b).

(6) The flush control of the toilet in the unisex toilet room is located on the closed side of the toilet area. Relocate the flush control on the toilet so it is located on the side of the toilet facing the open (wide) side of the toilet area. §§ 4.1.3(11), 4.22.4, 4.16.5.

20. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to Broughton Municipal Building:

a. Accessible Route

(1) There is no accessible route from Abercorn Street to the building. Provide accessible routes from the accessible parking spaces to the accessible entrances of the building that are firm, stable, and slip resistant. Standards §§ 4.1.2(1), 4.3, 4.5.

b. Basement Level Men’s and Women’s Toilet Rooms

(1) The men’s and women’s toilet rooms are not accessible given its elements, size and arrangement. Install signage directing individuals to the accessible unisex toilet room in the facility using raised and Brailled characters, on the wall adjacent to the latch side of each door so that the centerline of the sign is 60 inches above the ground and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

c. Second Floor Unisex Toilet Room

(1) The toilet room does not have the required signage. Install signage with raised and Brailled characters and letters, on the wall adjacent to the latch side of the toilet room door mounted so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The toilet room door has knob hardware. Install door hardware that is easy to grasp with one hand and does not require tight grasping, pinching, or twisting of the wrist to operate. Standards §§ 4.1.3(11), 4.22.2, 4.13.9.

(3) The door to the toilet room, which opens into the room, lacks the 18 inch minimum maneuvering clearance on the pull-side of the door because there is another wall perpendicular to the latch. Reverse the door so that it swings outward, or provide a power assisted door opener. Standards
§§ 4.1.3(7)(b), 4.1.3(11), 4.22.2, 4.13.6 & Fig. 25(a).

(4) There is no rear grab bar at the toilet area. Provide a rear grab bar that is at least 36 inches long mounted between 33 and 36 inches above the finish floor, so that the end closer to the side wall is no more than 6 inches from the side wall. Standards §§ 4.1.3(11), 4.22.4, 4.16.4 & Fig.29(a).

(5) The side grab bar is not compliant. Provide a side grab bar that is at least 42 inches long, mounted between 33 and 36 inches above the finish floor. The end of the grab bar nearest the back wall is to be no more than 12 inches from the back wall, and the end farthest from the back wall is to be at least 52 inches from the wall. Standards §§ 4.1.3(11), 4.22.4, 4.16.4 & Fig. 29(b).

(6) The hot water and drain pipes beneath the lavatory in the toilet room are not insulated or configured to protect against contact. Insulate the hot water and drain pipes to protect against contact in a manner consistent with the Standards. Standards §§ 4.1.3(11), 4.22.6, 4.19.4.

(7) The centerline of the toilet is located 13 inches from the side wall. Remount the toilet so that its centerline is exactly 18 inches from the side wall. Standards §§ 4.1.3(11), 4.22.4, 4.16.2 & Fig. 28.

(8) The lavatory in the unisex toilet room has twist-type faucets. Replace the faucet controls with controls that are operable with one hand and do not require tight grasping, pinching, or twisting of the wrist to operate. Standards §§ 4.1.3(11), 4.22.6, 4.19.5, 4.27.4.

(9) The mirror in the toilet room is mounted so that the bottom edge of the reflecting surface is 46 inches above the finish floor. Provide a mirror that is mounted so that the bottom edge of its reflecting surface is no more than 40 inches above the finish floor. Standards §§ 4.1.3(11), 4.22.6, 4.19.6 & Fig. 31.

21. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to Recorder’s Court located in the Chatham County Courthouse Judicial Center:

a. Men’s and Women’s Toilet Rooms

(1) The men’s and women’s toilet rooms do not have the required signage. Install signage, using raised and Brailled characters and letters, on the wall adjacent to the latch side of each door mounted so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The designated accessible stall in the men’s and women’s toilet rooms is 39 1/2 inches wide. In each toilet room provide a “standard” accessible toilet stall at least 60 inches wide and 59 inches deep (56 inches if the toilet is wall mounted) configured so that all of the stall’s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls and dispensers comply with the Standards. Standards §§ 4.1.3(11), 4.13, 4.16, 4.17 & Fig. 30(a), 4.22, 4.26, 4.27.

(3) The door for the designated accessible stall in each toilet room have latch hardware that requires tight grasping, pinching, or twisting of the wrist to operate. Replace the latch hardware with hardware that is operable with one hand and does not require tight grasping, pinching, or twisting of the wrist to operate. Standards §§ 4.1.3(11), 4.22.4, 4.17.5, 4.13.9.

(4) The toilet paper dispenser in each designated accessible stall is located 40 inches from the finish floor and is 44 inches from the back wall. Remount the dispenser so that it is below the side grab bar with its centerline no less than 19 inches above the finish floor and its farthest edge no more than 36 inches from the back wall. Standards §§ 4.1.3(11), 4.22.4, 4.17.3 & Fig. 30(d).

(5) There is no accessible urinal in the men’s toilet room. Provide an accessible urinal with an elongated rim that is mounted no higher than 17 inches above the finish floor. Standards §§ 4.1.3(11), 4.22.5, 4.18.

(6) The soap dispenser in each toilet room is mounted so that the control is 56 inches above the finish floor. Reposition the dispenser so that its highest operable part is within the reach ranges of a person who uses a wheelchair. Standards §§ 4.1.3(11), 4.22.7, 4.27.3, 4.2.5, 4.2.6.

(7) The mirror in each toilet room is mounted so that the bottom of the reflecting surface is 46 inches above the finish floor. Provide a mirror in each toilet room mounted so that the bottom of its reflecting surface is no more than 40 inches above the finish floor. Standards §§ 4.1.3(11), 4.19.6, 4.22.6 & Fig. 31.

(8) The door coat hook in the designated accessible stall is 68 1/2 inches above the finish floor. Provide a hook that is no more than 54 inches above the finish floor for a side approach or 48 inches above the finish floor if sufficient clear floor space for a side approach is not available. Standards §§ 4.1.3(12)(a), 4.25.3, 4.2.5, 4.2.6.

(9) The bottom of the paper towel dispenser in each toilet room is 61 inches above the finish floor. Remount both dispensers so that their highest operable parts are within the reach ranges of a person who uses a wheelchair (48 inches for front approach, 54 inches for side approach). Standards §§ 4.1.3(11), 4.22.7, 4.27.3, 4.2.5, 4.2.6.

22. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the Blackshear Basketball Complex:

a. Parking

(1) The designated accessible parking space is not served by an adjacent access aisle or identified as van-accessible. Re-stripe the parking lot to provide at least one van-accessible parking space 96 inches wide with an adjacent access aisle that is at least 96 inches wide and install a sign designating the space as “van-accessible” mounted below the symbol of accessibility in a location that cannot be obscured by a vehicle parking in the space. Standards §§ 4.1.2(5), 4.6.3 & Fig. 9, 4.6.4.

b. Men’s and Women’s Outdoor Toilet Rooms

(1) The men’s and women’s outdoor toilet rooms do not have the required signage. Install signage, using raised and Brailled characters and letters, on the walls adjacent to the latch side of each door mounted so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The designated accessible stall in the men’s toilet room is 39 inches wide and the designated accessible stall in the women’s toilet rooms is 35 1/2 inches wide. In each toilet room provide a “standard” accessible toilet stall at least 60 inches wide and 59 inches deep (56 inches if the toilet is wall mounted), configured so that all of the stall’s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls and dispensers comply with the Standards. Standards §§ 4.1.3(11), 4.13, 4.16, 4.17 & Fig. 30(a), 4.22, 4.26, 4.27.

(3) The designated accessible stall in each toilet room has no rear grab bar. Provide a rear grab bar that is at least 36 inches long mounted between 33 and 36 inches above the finish floor, so that the end closer to the side wall is no more than 6 inches from the side wall. Standards §§ § 4.1.3(11), 4.22.4, 4.17.6 & Fig.30(a).

(4) The toilet paper dispenser in the designated accessible stall in each toilet room is located more than 36 inches from the back wall. Reposition the dispenser so that it is below the grab bar with its centerline no less than 19 inches above the finish floor and its farthest edge is no more than 36 inches from the back wall. Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.17.3 & Fig. 30(d), 4.22.

(5) The lavatories in each of the toilet room have twist-type faucets. Replace them with controls that are operable with one hand and do not require tight grasping, pinching, or twisting of the wrist to operate. Standards §§ 4.1.3(11), 4.22.6, 4.19.5, 4.27.4.

23. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the Civic Center’s Auditorium:

a. Parking

(1) There are no signs designating van accessible parking spaces in the south side parking lot. Install signage designating the space as “van-accessible” mounted below the symbol of accessibility in a location that cannot be obscured by a vehicle parked in the space. Standards §§ 4.1.2(5)(b), 4.6.4, 4.30.7.

b. Accessible Route

(1) The inside handrail for the entrance ramp on the Montgomery Street side of the building is not continuous and does not extend beyond the top or bottom of the ramp segment. Provide handrails that are continuous and extend at least 12 inches beyond the top and bottom of the ramp segment parallel to the floor surface. Standards §§ 4.1.2(1), 4.3.7, 4.8.5(2), 4.26.

c. Lobby/Balcony/Upper Level Men’s and Women’s Toilet Rooms

(1) The door coat hook in the designated accessible stall in each toilet room is located 64 1/2 inches above the finish floor. Provide a hook that is no more than 54 inches above the finish floor for a side approach or, if a side approach is not available, 48 inches above the finish floor for a front approach. Standards §§ 4.1.3(12)(a), 4.25.3, 4.2.5, 4.2.6.

d. Accessible Dressing Room

(1) The accessible dressing room is required to have signage. Install signage, using raised and Brailled characters and letters, on the wall adjacent to the latch side of each door mounted so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

24. Within 24 months of the effective date of this Agreement, the City will complete the following modifications to the Daffin Park William L. Grayson Stadium:

a. Parking

(1) There are no signs designating van-accessible parking spaces in the parking lot. At each van-accessible parking space install signage designating the space as “van-accessible” that is mounted below the symbol of accessibility in a location that cannot be obscured by a vehicle parked in the space. Standards §§ 4.1.2(5)(b), 4.6.4, 4.30.7.

b. Accessible Route

(1) There is no signage informing individuals with disabilities of the accessible route from the Grayson Stadium entrance to the ramp leading to the spectator seating area. Provide signage indicating the accessible route from the entrance to the seating area. Standards §§ 4.1.3(16)(b), 4.30.1, 4.30.2, 4.30.3, 4.30.5.

c. Service Counters

(1) The top of the service counters throughout Grayson Stadium serving ticket transactions, concessions, condiments, and souvenirs are more than 36 inches above the finish floor. Modify the counters so that a portion of each counter is at least 36 inches wide and is no more than 36 inches high; or provide auxiliary counters at least 36 inches in length with a maximum height of 36 inches. Standards § 7.2.

(2) The aisles leading to the service counters for concessions at the entrance of Grayson Stadium are 32 1/2 inches wide during straight segments and 34 1/2 inches wide at each turn. Provide accessible routes to the service counters for concessions that are at least 42 inches wide at straight segments and at least 48 inches wide at each turn in compliance with the Standards. Standards §§ 4.3.1(1), 4.3.3, 7.2 & Fig. 7(b).

d. Spectator Seating

(1) The accessible seating area does not provide space adequate for wheelchair seating and does not provide individuals seated in wheelchairs with lines of sight comparable to those afforded to members of the general public. Provide at least two wheelchair seating areas that afford spectators in wheelchairs with lines of sight over standing spectators. These seats should be at least 32 inches wide and 60 inches deep, be an integral part of the fixed seating plan, and adjoin an accessible route. In addition, upon request, provide a corresponding companion seat next to each wheelchair seating location. Standards §§ 4.1.3(19)(a), 4.33.3.

(2) The designated seats with no armrests, or with removable or folding armrests, are not identified by a sign or marker. Each seat without armrests or with folding or removable armrests shall be identified by a sign or marker and signage notifying patrons of the availability of such seating shall be posted in accordance with the Standards. Standards § 4.1.3(19)(a).

e. Picnic Area

(1) The picnic tables in the picnic area are inaccessible to persons who use wheelchairs because they do not provide sufficient knee clearance. Provide an eating surface with sufficient knee clearance to be used by persons with disabilities who use wheelchairs. Standards §§ 4.1.3(18), 4.32.3, 4.32.4.

f. Men’s and Women’s Toilet Rooms at Front Entrance

(1) The men’s and women’s toilet rooms are not accessible given its elements, size and arrangement. Install signage directing individuals to the accessible unisex toilet room in the facility using raised and Brailled characters, on the wall adjacent to the latch side of each door so that the centerline of the sign is 60 inches above the ground and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

g. Men’s and Women’s Toilet Rooms at Souvenir Service Counter

(1) The men’s and women’s toilet rooms are inaccessible. Renovate each toilet room, or provide at least one unisex toilet room, so that the space and elements, including the room identification signage, entry door, door hardware, clear floor space, turning space, accessible route, toilet stall (if applicable) and the stall’s elements including size and arrangement, water closet, grab bars, urinal (if provided), lavatory, mirror, controls and dispensers comply with the Standards. Standards §§ 4.1.3(11), 4.2, 4.3, 4.13, 4.16 & Figs. 28, 29, 4.17 & Fig. 30(a), 4.18, 4.19 & Figs. 31, 32, 4.22, 4.26, 4.27, 4.30.

h. Existing Unisex Toilet Room

(1) The unisex toilet room does not have the required signage. Install signage, using raised and Brailled characters and letters, on the wall adjacent to the latch side of the door mounted so that the centerline of each sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The rear grab bar in the designated accessible stalls is 31 1/2 inches long. Provide a rear grab bar that is at least 36 inches long mounted between 33 and 36 inches above the finish floor, so that the end closer to the side wall is no more than 6 inches from the side wall. Standards §§ 4.1.3(11), 4.22.4, 4.16.4 & Fig.29(a).

(3) The side grab bar in the toilet room is located 14 1/2 inches from the back wall. Provide a side grab bar that is at least 42 inches long, mounted between 33 and 36 inches above the finish floor. The end of the grab bar nearest the back wall is to be no more than 12 inches from the back wall, and the end farthest from the back wall is to be at least 52 inches from the wall. Standards §§ 4.1.3(11), 4.22.4, 4.16.4 & Fig. 29(b).

25. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the Daffin Park Leisure Services Activities Building:

a. Parking

(1) The designated accessible parking space does not have the correct signage. Install signage, using the International Symbol of Accessibility in a location that cannot be obscured by a vehicle parked in the space. Standards §§ 4.1.2(5)(a), 4.1.2(5)(b), 4.6.4, 4.30.7.

b. Playground Equipment

(1) There is no accessible route to the playground equipment because the surface of the ground on which it is situated is not stable, firm and slip-resistant. Replace the playground surface with one that is firm, stable, and slip-resistant. Standards §§ 4.1.2, 4.3, 4.5.1.

c. Men’s and Women’s Public Outdoor Toilet Rooms

(1) The men’s and women’s toilet rooms are not accessible given its elements, size and arrangement. Install signage directing individuals to the accessible indoor toilet rooms in the facility using raised and Brailled characters, on the wall adjacent to the latch side of each door so that the centerline of the sign is 60 inches above the ground and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

d. Men’s and Women’s Indoor Toilet Rooms

(1) The men’s and women’s toilet rooms do not have the required signage. Install signage, using raised and Brailled characters and letters, on the walls adjacent to the latch side of each door mounted so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The toilet room doors have knob hardware. Install door hardware that is operable with one hand and does not require tight grasping, pinching, or twisting of the wrist to operate. Standards §§ 4.1.3(11), 4.22.2, 4.13.9, 4.27.4.

(3) The rear grab bar in the designated accessible stall in the women’s toilet room is less than 36 inches long. Provide a rear grab bar in the accessible stall that is at least 36 inches long mounted between 33 and 36 inches above the finish floor, so that the end closer to the side wall is no more than 6 inches from the side wall. Standards §§ 4.1.3(11), 4.22.4, 4.17.6 & Fig. 30(a).

(4) The toilet paper dispenser in the designated accessible stall in each toilet room is located 46 inches from the finish floor. Provide a dispenser that is located below the grab bar with its centerline no less than 19 inches above the finish floor, and its farthest edge no more than 36 inches from the back wall. Standards §§ 4.1.3(11), 4.22.4, 4.16.6, 4.17.3 & Fig. 30(d).

(5) The lavatory in each toilet room has twist-type faucet controls. Replace the faucet controls with controls that are operable with one hand and do not require tight grasping, pinching or twisting of the wrist to operate. Standards §§ 4.1.3(11), 4.22.6, 4.19.5, 4.27.4.

(6) The door coat hook in the designated accessible stall in each toilet room is located 63 1/2 inches above the finish floor. Provide a coat hook that is no more than 54 inches above the finish floor for a side approach or, if that is not available, 48 inches above the finish floor for a front approach. Standards §§ 4.1.3(12)(a), 4.25.3, 4.2.5, 4.2.6.

26. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the Bonaventure Cemetery:

a. Parking

(1) The designated accessible parking area is not striped, and there is no sign designating a space as reserved for persons with disabilities. Provide a van-accessible parking space that is 96 inches wide with a 96 inch wide access aisle and install a sign designating the space as “van-accessible” mounted below the International Symbol of Accessibility in a location that cannot be obscured by a vehicle parked in the space. Standards §§ 4.1.2(5), 4.6, 4.30.7.

b. Accessible Route

(1) The inaccessible front entrance has no signage directing individuals to the accessible side entrance. Post a sign at the inaccessible front entrance directing individuals to the accessible side entrance. Standards §§ 4.1.3(8)(d), 4.30.1, 4.30.2, 4.30.3, 4.30.5.

(2) The gripping surface of the handrails on the ramps leading to the building from the parking lot are 3 1/2 inches in width and do not extend beyond the top and bottom of the ramps. Provide handrails for the ramps that have gripping surfaces between 1 1/4 and 1 1/2 inches in diameter width, extend at least 12 inches beyond the top and bottom of each ramp parallel to the ground surfaces and comply with all other provisions of the Standards. Standards §§ 4.1.2, 4.3.2, 4.3.7, 4.3.8, 4.5.2, 4.8.1, 4.8.5, 4.26.1, 4.26.2 & Fig. 39.

c. Office Entrance

(1) The side entrance door to the office has knob hardware. Install door hardware that is operable with one hand and does not require tight grasping, pinching, or twisting of the wrist to operate. Standards §§ 4.1.3(7), 4.13.9.

(2) The threshold at the side entrance has a 2 inch abrupt change in level. Modify the threshold or landing so that the change in level is no more than _ inch, leveled with a slope no greater than 1:2 or install a compliant ramp. Standards §§ 4.1.2(2), 4.3.7, 4.3.8, 4.5.2, 4.8.

d. Unisex Toilet at Side Entrance

(1) The unisex toilet room does not have the required signage. Install signage, using raised and Brailled characters and letters, on the walls adjacent to the latch side of the door, mounted so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The threshold at the toilet room entrance has a 2 1/2 inch abrupt change in level. Modify the threshold or landing so that the change in level is no more than 1/2 inch, leveled with a slope no greater than 1:2 or install a compliant ramp. Standards §§ 4.1.2(2), 4.3.7, 4.3.8, 4.5.2, 4.8.

(3) The rear grab bar in the toilet room is 29 inches long. Provide a rear grab bar that is at least 36 inches long mounted between 33 and 36 inches above the finish floor, so that the end closer to the side wall is no more than 6 inches from that wall. Standards §§ 4.1.3(11), 4.22.4, 4.16.4 & Fig.29(a).

(4) The lavatory in the toilet room has twist-type faucet controls. Replace the faucet controls with controls that are operable with one hand and do not require tight grasping, pinching or twisting of the wrist to operate. Standards §§ 4.1.3(11), 4.22.6, 4.19.5, 4.27.4.

(5) The mirror in the toilet room is mounted so that the bottom edge of the reflecting surface is 49 1/2 inches above the finish floor. Provide a mirror that is mounted so that the bottom edge of the reflecting surface is no more than 40 inches above the finish floor. Standards §§ 4.1.3(11), 4.22.6, 4.19.6 & Fig. 31.

e. Outdoor Unisex Toilet Room

(1) The outdoor unisex toilet room is not accessible given its elements, size and arrangement. Install signage directing individuals to the accessible unisex toilet room at the side entrance of the building using raised and Brailled characters, on the wall adjacent to the latch side of each door so that the centerline of the sign is 60 inches above the ground and there are no protruding objects to within 3 inches of the signage. Standards

27. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to John S. Delaware Recreation Center:

a. Accessible Route

(1) There is no inside handrail for the interior entrance ramp of the building. Install an inside handrail that is between 34 and 38 inches high. Standards §§ 4.1.3(1), 4.3.7, 4.3.8, 4.5.2, 4.8.1, 4.8.5, 4.26 & Fig. 31.

b. Men’s and Women’s Toilet Rooms

(1) The men’s and women’s toilet rooms are not accessible given its elements, size and arrangement. Install signage directing individuals to the accessible toilet rooms in the dressing rooms of the facility using raised and Brailled characters, on the wall adjacent to the latch side of each door so that the centerline of the sign is 60 inches above the ground and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

c. Men’s and Women’s Dressing Rooms

(1) The dressing rooms do not have the required signage. Install signage, using raised and Brailled characters and letters, on the walls adjacent to the latch side of the door mounted so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The designated accessible stall in each of the toilet rooms is 39 inches wide. Provide a “standard” accessible toilet stall at least 60 inches wide and 59 inches deep (56 inches if the toilet is wall mounted) configured so that all of the stall’s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls and dispensers comply with the Standards. Standards §§ 4.1.3(11), 4.13, 4.16, 4.17 & Fig. 30(a), 4.22, 4.26, 4.27.

(3) The shower stall in each dressing room has a fixed shower head and no seat has been provided. Provide a shower spray unit with a hose at least 60 inches long or a fixed shower head at 48 inches above the finish floor that has controls which do not require tight grasping, pinching or twisting of the wrist to operate. Standards §§ 4.1.3(11), 4.23.8, 4.21.5, 4.21.6, 4.27.4. Provide a seat that is 17-19 inches above the finish floor and extends the full depth of the stall. Standards §§ 4.1.3(11), 4.23.8, 4.21.3, 4.21.4, 4.21.5, 4.21.6 & Figs. 35(a), 36. Provide grab bars compliant with all relevant provisions of the Standards. Standards §§ 4.1.3(11), 4.21.4 & Fig. 37, 4.26.

28. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the W.W. Law Community Center:

a. Parking

(1) There are no van-accessible parking spaces. Provide a van-accessible parking space that is 96 inches wide with a 96 inch wide access aisle and install a sign designating the space as “van-accessible” mounted below the International Symbol of Accessibility in a location that cannot be obscured by a vehicle parked in the space. Standards §§ 4.1.2(5), 4.6, 4.30.7.

b. Interior Doors

(1) The interior doors in the Community Center have knob hardware. Replace the knob hardware with door hardware that is operable with one hand and does not require tight grasping, pinching, or twisting of the wrist to operate. Standards §§ 4.1.6(1)(b), 4.1.3(7), 4.13.9.

c. Men’s and Women’s Toilet Rooms

(1) The toilet rooms do not have the required signage. Install signage, using raised and Brailled characters and letters, on the walls adjacent to the latch side of each door mounted so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The designated accessible stall in each of the toilet rooms is not compliant. Provide a “standard” accessible toilet stall at least 60 inches wide and 59 inches deep (56 inches if the toilet is wall mounted) configured so that all of the stall’s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls and dispensers comply with the Standards. Standards §§ 4.1.3(11), 4.13, 4.16, 4.17 & Fig. 30(a), 4.22, 4.26, 4.27.

(3) The lavatory in each of the toilet rooms has twist-type faucet controls. Replace the faucet controls with controls that are operable with one hand and do not require tight grasping, pinching or twisting of the wrist to operate. Standards §§ 4.1.3(11), 4.22.6, 4.19.5, 4.27.4.

(4) The height of the lavatory in each room is not compliant. Reposition or provide a lavatory that has a clearance of at least 29 inches above the finish floor to the bottom of the apron and a knee clearance that is at least 27 inches above the finish floor at a depth of 8 inches and 9 inches above the finish floor at a depth of 17 inches and complies with all other provisions of the Standards. Standards §§ 4.1.3(11), 4.22.6, 4.19.2 & Fig. 31.

29. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the Forsythe Park Facility:

a. Parking

(1) There are no designated accessible parking spaces provided. Establish designated accessible parking spaces located on the shortest accessible route to the accessible entrance of the building, including at least one van-accessible space that is 96 inches wide with a 96 inch wide access aisle and install a sign designating the space as “van-accessible” mounted below the International Symbol of Accessibility in a location that cannot be obscured by a vehicle parked in the space. Standards §§ 4.1.2(5), 4.6, 4.30.7.

b. Men’s and Women’s Toilet Rooms

(1) The toilet rooms do not have the required signage. Install signage, using raised and Brailled characters and letters, on the walls adjacent to the latch side of each door, mounted so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The designated accessible stall in each of the toilet rooms has no rear grab bar. Provide a rear grab bar in the accessible stall that is at least 36 inches long mounted between 33 and 36 inches above the finish floor, so that the end closer to the side wall is no more than 6 inches from that wall. Standards §§ 4.1.3(11), 4.22.4, 4.17.6 & Fig.30(a).

(3) The toilet paper dispenser in the designated accessible stall in each toilet room is not compliant. Provide a toilet paper dispenser in each designated accessible stall that is located below the grab bar with its centerline no less than 19 inches above the finish floor and its farthest edge no more than 36 inches from the back wall. Standards §§ 4.1.3(11), 4.22.4, 4.16.6, 4.17.3 & Fig. 30(d).

(4) The mirror in each toilet room is mounted so that the bottom edge of the reflecting surface is 53 inches above the finish floor. Provide a mirror in each toilet room that is mounted so that the bottom edge of its reflecting surface is no higher than 40 inches above the finish floor. Standards §§ 4.1.3(11), 4.22.6, 4.19.6 & Fig. 31.

(5) The door coat hook in the designated accessible stall in each of the toilet rooms is located 65 inches above the finish floor. Provide a coat hook in each of the designated accessible stalls that is no more than 54 inches above the finish floor for a side approach or, if a side approach is not available, 48 inches above the finish floor for a front approach. Standards §§ 4.1.3(12)(a), 4.25.3, 4.2.5, 4.2.6.

30. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the Bowles Ford Park Swimming Pool Facility:

a. Men’s and Women’s Shower Rooms

(1) There is no signage at the inaccessible men’s and women’s shower rooms directing users to the accessible unisex shower room. Install signs at each of the inaccessible shower rooms and in conspicuous places directing users to the location of the accessible unisex shower room. These signs should comply with all relevant provisions of the Standards. Standards §§ 4.1.3(16)(b), 4.30.1, 4.30.2, 4.30.3, 4.30.5.

b. Unisex Shower Room

(1) The unisex shower room does not have the required signage. Install signage, using raised and Brailled characters and letters, on the walls adjacent to the latch side of the door, mounted so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

31. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to Carver Heights Community Center:

a. Accessible Route

(1) The inaccessible front entrance has no signage directing individuals with disabilities to the accessible rear entrance. Post a sign indicating the location of the accessible entrance. Standards §§ 4.1.3(8), 4.30.1, 4.30.2, 4.30.3, 4.30.5.

b. Men’s and Women’s Toilet Rooms

(1) The toilet rooms do not have the required signage. Install signage, using raised and Brailled characters and letters, on the walls adjacent to the latch side of each door, mounted so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The toilet paper dispenser in the designated accessible stall in each toilet room is located less than 19 inches from the finish floor to the centerline of the dispenser. Provide a toilet paper dispenser in each designated accessible toilet stall that is located below the grab bar with its centerline no less than 19 inches above the finish floor, and its farthest edge no more than 36 inches from the back wall. Standards §§ 4.1.3(11), 4.22.4, 4.16.6, 4.17.3 & Fig. 30(d).

(3) The door coat hook in the designated accessible stall in each of the toilet rooms is located 63 1/2 inches above the finish floor. Provide a coat hook in each designated accessible toilet stall that is no more than 54 inches above the finish floor for a side approach or, if a side approach is not available, 48 inches above the finish floor for a front approach. Standards §§ 4.1.3(12)(a), 4.25.3, 4.2.5, 4.2.6.

(4) The toilet flush control in the women’s designated accessible stall is on the closed, or narrow, side of the toilet stall. Modify or replace the toilet so that the flush control is on the open, or wide side of the toilet stall. Standards §§ 4.1.3(11), 4.22.4, 4.17.2, 4.16.5, 4.27.4.

32. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to Tremont Community Center:

a. Accessible Route

(1) The handrails on the exterior ramp to the entrance do not extend at least 12 inches parallel to the ground surface at the top and bottom of the ramp segment; the handrails attached to the building at the upper ramp segment do not continue for the length of the ramp; the ends of the handrails are not rounded and do not return smoothly to the ground or post. Modify the handrails so that they extend 12 inches at the top and bottom of each ramp segment parallel with the ground. Modify the handrails for the upper ramp segment so as to provide continuous handrails and modify the ends of the handrails so that the ends are rounded or returned to the floor or wall, and otherwise comply with the Standards. Standards §§ 4.1.2(1), 4.3.7, 4.8.5, 4.26 & Fig. 39, 4.3.8, 4.5.2, 4.8.1.

b. Men’s and Women’s Toilet Rooms

(1) The toilet rooms do not have the required signage. Install signage, using raised and Brailled characters and letters, on the walls adjacent to the latch side of each door, mounted so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The designated accessible stall in the men’s toilet room is 39 1/2 inches wide and in the women’s toilet room is 37 inches wide. Provide a “standard” accessible toilet stall at least 60 inches wide and 59 inches deep (56 inches if the toilet is wall mounted) in each toilet room configured so that all of the stall’s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls and dispensers comply with the Standards. 33. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to A.E. Paulsen Complex:

a. Men’s and Women’s Toilet Rooms

(1) The toilet rooms do not have the required signage. Install signage, using raised and Brailled characters and letters, on the walls adjacent to the latch side of each door, mounted so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The lavatory in each of the toilet rooms has twist-type faucet controls. Replace the faucet controls with controls that are operable with one hand and do not require tight grasping, pinching or twisting of the wrist to operate. Standards §§ 4.1.3(11), 4.22.6, 4.19.5, 4.27.4.

(3) The door coat hook in the designated accessible stall in each of the toilet rooms is located 60 inches above the finish floor. Provide a coat hook in each designated accessible stall that is no more than 54 inches above the finish floor for a side approach or, if a side approach is not available, 48 inches above the finish floor for a front approach. Standards §§ 4.1.3(12)(a), 4.25.3, 4.2.5, 4.2.6.

34. Within 24 months of the effective date of this Agreement, the City will complete the following modifications to Guy Minnick Ballfields:

a. Men’s and Women’s Toilet Rooms

(1) The toilet rooms do not have the required signage. Install signage, using raised and Brailled characters and letters, on the walls adjacent to the latch side of each door, mounted so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The designated accessible stall in the men’s toilet room is 42 1/2 inches wide. Provide a “standard” accessible toilet stall at least 60 inches wide and 59 inches deep (56 inches if the toilet is wall mounted) configured so that all of the stall’s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls and dispensers comply with the Standards. Standards §§ 4.1.3(11), 4.13, 4.16, 4.17 & Fig. 30(a), 4.22, 4.26, 4.27.

(3) The door coat hook in the designated accessible stall in each of the toilet rooms is located 60 inches above the finish floor. Provide a coat hook in each designated accessible toilet stall that is no more than 54 inches above the finish floor for a side approach or, if a side approach is not available, 48 inches above the finish floor for a front approach. Standards §§ 4.1.3(12)(a), 4.25.3, 4.2.5, 4.2.6.

35. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the Visitor’s Center at the Savannah Exposition Properties:

a. Accessible Route

(1) There is no directional signage at the inaccessible front entrance to the building on Martin Luther King, Jr. Boulevard. There is no signage at the accessible lower level side entrance adjacent to the parking lot indicating that it is an accessible entrance. Install signage at the inaccessible front entrance directing persons to the accessible entrance. Install signage using the International Symbol of Accessibility to designate the side museum entrance and the Cole Building entrance as accessible entrances. Standards §§ 4.1.2(7)(c), 4.1.8(d), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

b. Parking

(1) There is no signage designating the van-accessible parking space. Install signage designating the space as “van-accessible” that is mounted below the International Symbol of Accessibility in a location that cannot be obscured by a vehicle parked in the space. Standards §§ 4.1.2(5)(b), 4.6.4, 4.30.7.

(2) The curb ramps extend into the accessible parking spaces’ access aisles. Alter the access aisles so that they are level, with surface slopes not exceeding 1:50 in any direction. Provide a curb ramp(s) complying with the Standards in a location(s) that will not intrude upon the accessible parking spaces or access aisles. Standards §§ 4.1.2(5)(a), 4.6.3, 4.7.

c. Upper Level Men’s and Women’s Toilet Rooms

(1) The men’s and women’s toilet rooms are not accessible given its elements, size and arrangement. Install signage directing individuals to the accessible toilet rooms in the facility using raised and Brailled characters, on the wall adjacent to the latch side of each door so that the centerline of the sign is 60 inches above the ground and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

d. Lower Level Men’s and Women’s Toilet Rooms

(1) The toilet rooms do not have the required signage. Install signage, using raised and Brailled characters and letters, on the walls adjacent to the latch side of each door mounted so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The designated accessible stall in each of the toilet rooms is not compliant. Provide a “standard” accessible toilet stall at least 60 inches wide and 59 inches deep (56 inches if the toilet is wall mounted) configured so that all of the stall’s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls and dispensers comply with the Standards. Standards §§ 4.1.3(11), 4.13, 4.16, 4.17 & Fig. 30(a), 4.22, 4.26, 4.27.

(3) The lavatory in each of the toilet rooms has twist-type faucet controls. Replace the faucet controls with controls that are operable with one hand and do not require tight grasping, pinching or twisting of the wrist to operate. Standards §§ 4.1.3(11), 4.22.6, 4.19.5, 4.27.4.

In order to ensure that each of the City’s programs, services, and activities operating at a facility that is the subject of this Agreement, when viewed in its entirety, is readily accessible to and usable by persons with mobility impairments, the City will take the following actions.

36. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the Fire Department Headquarters:

a. Access to Services

(1) The push button to operate the intercom used to gain access to the Fire Department Headquarters from the side entrance door is mounted outside of accessible reach ranges. Remount the control so that the button is no more than 48 inches above the finish floor if a forward approach is provided or no more than 54 inches above the finish floor if a side approach is provided, and provide sufficient clear ground space. Standards §§ 4.27.3, 4.2.5, 4.2.6.

(2) The designated accessible side entrance door has knob hardware. Replace the door knobs with hardware that is easy to grasp with one hand and does not require tight grasping, pinching, or twisting of the wrist to operate. Standards §§ 4.13.9, 4.1.3(7).

37. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the Police Headquarters:

a. Parking

(1) The signage designating accessible parking spaces can be obscured by parked cars because it is low to the ground. Install signage at each accessible parking space that cannot be obscured by a vehicle parked in the space. Standards § 4.1.2(5), 4.6.4, 4.30.7.

b. Access to Services

(1) There is no accessible route from the sidewalk to the building entrance. Install a ramp to the front entrance with a slope no more than 1:12, handrails, side and edge protection, level landings at the top and bottom of each ramp and that complies with all other relevant provisions of the Standards. Standards § 4.8.

c. Unisex Public Toilet Room

(1) The toilet room door has knob hardware. Replace the door hardware with hardware that is easy to grasp with one hand and does not require tight grasping, pinching or twisting of the wrist to operate. Standards §§ 4.1.3(7), 4.13.9.

(2) The toilet paper dispenser in the toilet room interferes with the use of the side grab bar. Provide a toilet paper dispenser that is located below the grab bar with its centerline no less than 19 inches above the finish floor, and its farthest edge no more than 36 inches from the back wall. Standards §§ 4.1.3(11), 4.22.4, 4.16.6 & Fig. 29(b).

(3) The length of the rear grab bar is less than 36 inches. Provide a rear grab bar in the accessible stall that is at least 36 inches long, mounted between 33 and 36 inches above the finish floor, so that the end closer to the side wall is no more than 6 inches from the side wall. Standards §§ 4.1.3(11), 4.22.4, 4.16.4 & Fig.29(a).

(4) The lavatory in the toilet room does not provide any knee clearance for individuals who use wheelchairs. Provide a lavatory that has a clearance of at least 29 inches above the finish floor to the bottom of the apron, a knee clearance that is at least 27 inches above the finish floor at a depth of 8 inches and 9 inches above the finish floor at a depth of 17 inches and complies with all other provisions of the Standards. Standards §§ 4.1.3(11), 4.22.6, 4.19.2 & Fig. 31.

d. Rear Entrance Drinking Fountain

(1) The spout outlet of the drinking fountain is located 42 inches above the finish floor. Provide an additional drinking fountain with a spout outlet no more than 36 inches above the finish floor, or install cups next to the existing fountain so that they dispense within the reach ranges of persons who use wheelchairs. Standards §§ 4.1.3(10), 4.15 & Fig. 27(a), 4.27.3, 4.2.5, 4.2.6.

38. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the Robinson Street Parking Garage:

a. Parking

(1) There are no directional signs designating the location of accessible parking spaces. Provide directional signage indicating the location of the designated accessible parking spaces. Standards §§ 4.1.2(7), 4.30.1, 4.30.2, 4.30.3, 4.30.5.

(2) There is an inadequate number of reserved accessible parking spaces provided. Provide additional accessible and van-accessible parking spaces that comply with all provisions of the Standards including number of spaces required by section 4.1.2(5). Standards § 4.1.2(5).

39. Within 24 months of the effective date of this Agreement, the City will complete the following modifications to the Civic Center’s Martin Luther King, Jr. Arena:

a. Alarms

(1) The alarm systems in the Arena are not compliant with the Standards. Install audible emergency alarms integrated with visual alarm signal appliances compliant with all relevant provisions of the Standards in each of the following areas: general usage areas including the Arena and meeting rooms, locker rooms, dressing rooms and toilet rooms, in addition to common use areas including hallways and lobbies. Standards §§ 4.1.3(14), 4.28.

b. Men’s and Women’s Toilet Rooms.

(1) The toilet rooms do not have the required signage. Install signage, using raised and Brailled characters and letters, on the walls adjacent to the latch side of each door, mounted so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The designated accessible stall in each of the toilet rooms is 39 inches wide. Provide a “standard” accessible toilet stall at least 60 inches wide and 59 inches deep (56 inches if the toilet is wall mounted) configured so that all of the stall’s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls and dispensers comply with the Standards. Standards §§ 4.1.3(11), 4.13, 4.16, 4.17 & Fig. 30(a), 4.22, 4.26, 4.27.

(3) The rims of the urinals in the men’s toilet room are all 24 1/2 inches above the finish floor. Provide a urinal with an elongated rim no higher than 17 inches above the finish floor, a flush control no higher than 44 inches above the finish floor and adequate clear floor space. Standards §§ 4.1.3(11), 4.22.5, 4.18.2, 4.18.4.

(4) The lavatories in each toilet room have twist-type faucet controls. Replace the faucet controls with controls that are operable with one hand and do not require tight grasping, pinching or twisting of the wrists to operate. Standards §§ 4.1.3(11), 4.22.6, 4.19.5.

(5) The hot water and drain pipes beneath the lavatories in each room are not insulated or configured to protect against contact. Insulate the hot water and drain pipes to protect against direct contact in a manner consistent with the Standards. Standards §§ 4.1.3(11), 4.22.6, 4.19.4.

(6) The paper towel dispenser in each toilet room is mounted so that the bottom is 58 inches above the finish floor. Reposition the dispenser so that its highest operable part is no more than 54 inches above the finish floor if a side approach is provided, 48 inches above the finish floor if a front approach is provided, and lower in accordance with the Standards if it is located above another object. Standards §§ 4.1.3(11), 4.22.7, 4.27.3, 4.2.5, 4.2.6.

(7) The soap dispenser in each room is mounted so that the control is located 52 1/2 inches above the finish floor. Reposition the dispenser so that its highest operable part is no more than 54 inches from the finish floor if a side approach is provided, 48 inches above the finish floor if a front approach is provided, and lower in accordance with the Standards if it is located above another object. c. Locker Rooms

(1) The men’s and women’s locker rooms are not accessible given its elements, size and arrangement. Install signage directing individuals to the accessible unisex dressing room in the facility using raised and Brailled characters, on the wall adjacent to the latch side of each door so that the centerline of the sign is 60 inches above the ground and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

d. Unisex Dressing Room

(1) The unisex dressing room does not have the required signage. Install signage, using raised and Brailled characters and letters, on the walls adjacent to the latch side of each door, mounted so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The entrance door to the dressing room has a clear opening width of 30 inches. Alter the doorway to provide a minimum clear opening width of at least 32 inches measured from the face of the door to the opposite door stop with the door open 90 degrees. Standards §§ 4.1.3(7), 4.13.5 & Fig. 24.

(3) The door of the dressing room has knob hardware. Replace the door knobs with hardware that is easy to grasp with one hand and does not require tight grasping, pinching, or twisting of the wrist to operate. Standards §§ 4.1.3(7), 4.13.9.

(4) The centerline of the toilet in the toilet stall is 25 inches from the side wall. Remount the toilet so that its centerline is exactly 18 inches from the side wall. Standards §§ 4.1.3(11), 4.23.4, 4.17.3 & Fig. 30(a).

(5) There is no rear grab bar at the toilet stall. Provide a rear grab bar that is at least 36 inches long mounted between 33 and 36 inches above the finish floor, so that the end closer to the side wall is no more than 6 inches from the side wall. Standards §§ 4.1.3(11), 4.23.4, 4.17.6 & Fig.30(a).

(6) There is no side grab bar in the toilet stall. Provide a side grab bar that is at least 42 inches long, mounted between 33 and 36 inches above the finish floor. The end of the grab bar nearest the back wall is to be no more than 12 inches from the back wall, and the end farthest from the back wall is to be at least 52 inches from the wall. Standards §§ 4.1.3(11), 4.22.4, 4.17.6 & Fig. 30(d), 4.26.

(7) The shower stall in the dressing room has a 3 inch curb and a fixed shower head. No seat is provided in the stall. Modify the stall so that the curb is no higher than 1/2 inch. Provide a shower spray unit with a hose at least 60 inches long that can be used as a fixed shower head and as a hand-held shower. Provide a seat that is 17-19 inches above the finish floor and extends the full depth of the stall. Provide grab bars compliant with all relevant provisions of the Standards. Standards §§ 4.1.3.(11), 4.21 & Fig. 35, 36, 37, 4.23.8, 4.26.

e. Public Telephone

(1) The public telephones located near the Arena entrance do not comply with section 4.1.3(17) of the Standards. Provide a public telephone that has hearing aid compatibility, volume controls and signage, and that has its highest operable part within the reach ranges specified in the Standards. Standards §§ 4.1.3(17), 4.31.2 through 4.31.8, 4.2.5, 4.2.6.

40. Within 24 months of the effective date of this Agreement, the City will complete the following modifications to Police Precinct #1:

a. Parking

(1) The accessible parking space provided at Police Precinct #1 is not “van-accessible”. Provide a van-accessible parking space that is 96 inches wide with a 96 inch wide access aisle located on the shortest accessible route to the accessible entrance, and install a sign designating the space as “van-accessible” mounted below the International Symbol of Accessibility in a location that cannot be obscured by a vehicle parked in the space. Standards §§ 4.1.2(5), 4.6, 4.30.7.

b. Men’s and Women’s Public Toilet Rooms

(1) The men’s and women’s toilet rooms are inaccessible. Renovate each toilet room, or provide at least one unisex toilet room, so that the space and elements, including the room identification signage, entry door, door hardware, clear floor space, turning space, accessible route, toilet stall (if applicable) and the stall’s elements including size and arrangement, water closet, grab bars, urinal (if provided), lavatory, mirror, controls and dispensers comply with the Standards. Standards §§ 4.1.3(11), 4.2, 4.3, 4.13, 4.16 & Figs. 28, 29, 4.17 & Fig. 30(a), 4.18, 4.19 & Figs. 31, 32, 4.22, 4.26, 4.27, 4.30.

41. Within 24 months of the effective date of this Agreement, the City will complete the following modifications to Police Precinct #2:

b. Accessible Route

(1) There is no accessible route from the parking area to the building. Establish an accessible route from accessible parking to the building. Standards §§ 4.1.2, 4.3, 4.5.

(2) There is an abrupt change of level of 2 1/2 inches at the front entrance of the building and an abrupt change of level of 2 3/4 inches at the rear entrance of the building. Provide an accessible route to these entrances that is stable, firm, and slip-resistant and without abrupt changes in level greater than 1/2 inch or provide a compliant ramp. Standards §§ 4.1.2, 4.3.8, 4.5.1, 4.5.2, 4.8.

c. Men’s and Women’s Public Toilet Rooms

(1) The men’s and women’s toilet rooms are inaccessible. Renovate each toilet room, or provide at least one unisex toilet room, so that the space and elements, including the room identification signage, entry door, door hardware, clear floor space, turning space, accessible route, toilet stall (if applicable) and the stall’s elements including size and arrangement, water closet, grab bars, urinal (if provided), lavatory, mirror, controls and dispensers comply with the Standards. Standards §§ 4.1.3(11), 4.2, 4.3, 4.13, 4.16 & Figs. 28, 29, 4.17 & Fig. 30(a), 4.18, 4.19 & Figs. 31, 32, 4.22, 4.26, 4.27, 4.30.

d. Drinking Fountain

(1) The spout outlet height of the drinking fountain is 40 inches above the finish floor. Provide an additional fountain with a spout height no more than 36 inches above the finish floor, or install cups next to the existing fountain so they dispense within the reach ranges of persons who use wheelchairs. Standards §§ 4.1.3(10), 4.15.2 & Fig. 27(a), 4.27.3, 4.2.5, 4.2.6.

43. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the Daffin Park Bee Road Picnic Area:

a. Picnic Area

(1) None of the picnic tables in the picnic area is accessible to persons who use wheelchairs. Provide picnic tables that have an eating surface with sufficient knee clearance to be used by persons with disabilities who use wheelchairs. Standards §§ 4.1.3(18), 4.32.3, 4.32.4.

44. Within 24 months of the effective date of this Agreement, the City will complete the following modifications to the Daffin Park Youth Baseball Facility:

a. Parking

(1) There are no accessible parking spaces provided. Provide at least one designated accessible parking space. Install signage, using the International Symbol of Accessibility in a location that cannot be obscured by a vehicle parked in the space. Standards §§ 4.1.2(5)(a), 4.1.2(5)(b), 4.6.4, 4.30.7.

b. Accessible Route

(1) There is no accessible route from the street to the baseball field. Establish an accessible route from accessible parking to the baseball field. Standards §§ 4.1.2(1), 4.3, 4.5.

c. Men’s and Women’s Toilet Rooms

(1) The men’s and women’s toilet rooms are inaccessible. Renovate each toilet room, or provide at least one unisex toilet room, so that the space and elements, including the room identification signage, entry door, door hardware, clear floor space, turning space, accessible route, toilet stall (if applicable) and the stall’s elements including size and arrangement, water closet, grab bars, urinal (if provided), lavatory, mirror, controls and dispensers comply with the Standards. Standards §§ 4.1.3(11), 4.2, 4.3, 4.13, 4.16 & Figs. 28, 29, 4.17 & Fig. 30(a), 4.18, 4.19 & Figs. 31, 32, 4.22, 4.26, 4.27, 4.30.

45. Within 24 months of the effective date of this Agreement, the City will complete the following modifications to Schuman Swimming Pool Facility:

a. Accessible Route

(1) There is an abrupt change of level of 4 inches at the entrance to the dressing rooms from the swimming pool. Modify the entrance so that the change in level is no greater than 1/2 inch beveled with a slope no greater than 1:2. Standards §§ 4.1.2, 4.3.8, 4.5.2, 4.7.2, 4.8.

b. Men’s and Women’s Dressing Rooms

(1) The men’s and women’s dressing rooms do not have the required signage. Install signage, using raised and Brailled characters and letters, on the walls adjacent to the latch side of each door, mounted so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. Standards §§ 4.1.3(16)(a), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

(2) The designated accessible stall in the men’s and women’s dressing rooms is not compliant. Provide a “standard” accessible toilet stall at least 60 inches wide and 59 inches deep (56 inches if the toilet is wall mounted) configured so that all of the stall’s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls and dispensers comply with the Standards. Standards §§ 4.1.3(11), 4.13, 4.16, 4.17 & Fig. 30(a), 4.23, 4.26, 4.27.

(3) The top of the toilet seat in each dressing room is 15 inches above the finish floor. Provide a toilet with a seat between 17 and 19 inches above the finish floor. Standards §§ 4.1.3(11), 4.23.4, 4.17.3 & Figs. 30(d).

(4) The shower stall in each dressing room is not compliant given its size and arrangement and has a fixed shower head. No seat is provided in the stall. Modify the stall so that it is no less than 36 inches by 36 inches and that is situated such that the clear floor space outside the shower extends 12 inches beyond the seat wall. Provide a shower spray unit with a hose at least 60 inches long that can be used as a fixed shower head and as a hand-held shower. Provide a seat that is 17-19 inches above the finish floor and extends the full depth of the stall. Provide grab bars compliant with all relevant provisions of the Standards. Standards §§ 4.1.3(11), 4.21 & Fig. 35(a), 36, 37, 4.26.

46. Within 24 months of the effective date of this Agreement, the City will complete the following modifications to the Jenkins Swimming Pool Facility:

a. Accessible Route

(1) There is an abrupt change of level of 4 inches at the front entrance to the building. Modify the front entrance so that the change in level is no greater than 1/2 inch beveled with a slope no greater than 1:2. Standards §§ 4.1.2, 4.3.8, 4.5.2, 4.7.2, 4.8.

(2) There is an abrupt change of level of 4 inches at the entrance to the dressing rooms from the swimming pool. Modify the entrance so that the change in level is no greater than 1/2 inch beveled with a slope no greater than 1:2. Standards §§ 4.1.2, 4.3.8, 4.5.2, 4.7.2, 4.8.

b. Men’s and Women’s Dressing Rooms

(1) The men’s and women’s dressing rooms do not have the required signage. 47. Within 24 months of the effective date of this Agreement, the City will complete the following modifications to Bacon Park Tennis Complex:

a. Access to Services

(1) There is no accessible route from the parking area or public sidewalks to the Bacon Park Tennis Complex. Establish an accessible route from the accessible parking area and public sidewalks to the Bacon Park Tennis Complex. Standards §§ 4.1.2(1), 4.3, 4.5.

b. Men’s and Women’s Dressing Rooms

(1) The men’s and women’s dressing rooms do not have the required signage. Install signage, using raised and Brailled characters and letters, on the walls adjacent to the latch side of each door, mounted so that the centerline of the sign is 60 inches above the finish floor and there are no protruding objects to within 3 inches of the signage. 48. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the River Street Riverwalk Public Dock:

a. Access to Services

(1) There is no accessible route from the parking area or public sidewalks to the River Street Riverwalk Public Dock. Establish an accessible route from the accessible parking area and public sidewalks to the Bacon Park Tennis Complex. Standards §§ 4.1.2(1), 4.3, 4.5.

IMPLEMENTATION AND ENFORCEMENT

49. Except as otherwise specified in this Agreement, at 90 and 180 days after the effective date of this Agreement, and thereafter at yearly anniversaries of the effective date, the City will submit written reports to the Department summarizing the actions the City has taken pursuant to this Agreement. Reports will include photographs, architectural plans, notices published in the newspapers, copies of adopted policies, and proof of efforts to secure funding/assistance for structural renovations.

50. The Department may review compliance with this Agreement at any time. If the Department believes that this Agreement or any portion of it has been violated, it will so notify the City in writing and it will attempt to resolve the issue or issues in good faith. If the Department is unable to reach a satisfactory resolution of the issue or issues raised within 30 days of the date it provides notice to the City, it may institute a civil action in federal district court directly to enforce title II or to enforce the terms of this Agreement, or it may initiate appropriate steps to enforce section 504.

51. Failure by the Department to enforce this entire Agreement or any provision thereof with regard to any deadline or any other provision herein shall not be construed as a waiver of the Department's right to enforce other deadlines and provisions of this Agreement.

52. In the event that the City fails to comply in a timely manner with any requirement of this Agreement without obtaining sufficient advance written agreement from the Department as a temporary modification of the relevant terms of this Agreement, the Department may file suit in an appropriate federal court to enforce the terms of the Agreement, may declare the Agreement null and void and file suit to enforce Title II of the ADA, or may commence proceedings to suspend or terminate its financial assistance to the City.

53. This Agreement is a public document. A copy of this document or any information contained in it may be made available to any person by the City or the Department on request.

54. This Agreement constitutes the entire agreement between the parties on the matters raised herein, and no other statement, promise, or agreement, either written or oral, made by either party or agents of either party, that is not contained in this written Agreement, shall be enforceable. This Agreement does not purport to remedy any other potential violations of the ADA or any other Federal law. This Agreement does not affect the City's continuing responsibility to comply with all aspects of the ADA.

55. This Agreement will remain in effect for three years from the effective date of this Agreement, or until the parties agree that full compliance with this Agreement by the City has been achieved.

56. The effective date of this Agreement is the date of the last signature below.

57. The person signing for the City of Savannah, Georgia represents that he is authorized to bind the City to this Agreement.

UNDER THE

AMERICANS WITH

DISABILITIES ACT

In accordance with the requirements of title II of the Americans with Disabilities Act of 1990, the City of Savannah (City) will not discriminate against qualified individuals with disabilities on the basis of disability in the City’s services, programs, or activities.

The City does not discriminate on the basis of disability in its hiring or employment practices. The City will not ask a job applicant about the existence, nature, or severity of a disability. Applicants may be asked about their ability to perform specific job functions. Medical examinations or inquiries may be made, but only after a conditional offer of employment is made and only if required of all applicants for the position. The City will make reasonable accommodations for the known physical or mental limitations of a qualified applicant or employee with a disability upon request unless the accommodation would cause an undue hardship on the operation of the City’s business. Any employee’s medical records will be retained separate from personnel files and kept confidential. The City will make an individualized assessment of whether a qualified individual with a disability meets selection criteria for employment decisions.
