ATTACHMENT J: Modifications to Altered Facilities 

Please Note: Paragraph 55 of the Settlement Agreement requires that within three months of the effective date of this Agreement, the City provide signage as necessary to comply with 28 C.F.R. § 35.163(b), after having surveyed all facilities that are the subject of this Agreement for the purpose of identifying those that have multiple entrances not all of which are accessible.

The chart below lists the facilities surveyed by the Department, the access issues identified during the survey, and the actions required to correct the access issues. Required actions are listed using an alphanumeric code. The key to the alphanumeric codes is provided in Attachment M to this Agreement.

In order to ensure that the following spaces and elements in the City´s facilities in which alterations occurred after January 26, 1992, are readily accessible to and usable by persons with disabilities, the City will take the actions referenced by the alphanumeric code and described in detail in Attachment M to this Settlement Agreement within the time period specified below, which time period will begin to run on the effective date of this Agreement.

The parking areas, with a total of 495 parking spaces, are inaccessible because the covered van parking space and several other spaces lack vertical signage, the access aisle for the outdoor designated accessible space has a slope of 4.8% along one side, one of the designated accessible spaces is 91 inches wide, and the standard accessible parking spaces have access aisles ranging from 51 to 52 inches wide. 3.1.c. The designated accessible parking is inaccessible because it is not dispersed among the accessible facility entrances as there is no accessible parking by the west end of the building. P2 24 months
3.2. Garage Routes    
3.2.a. The underside of the stairs in the East side of the parking garage is an overhead hazard that is not detectable to blind persons using a cane. AR7 24 months
3.2.b. The fire alarm in the East side of the parking garage protrudes into the walkway and is not detectable to blind persons using a cane. AR8 24 months
3.3. Parking Canopies    
3.3.a. The route from the visitor´s center to the tour bus area is inaccessible because the curb ramp on the side closest to the visitor center has an abrupt 1 inch high step at the bottom and a slope of 10%. AR5 24 months
3.3.b. The route from the visitor´s center to the tour bus area is inaccessible because the curb ramp on the side closest to the tour buses has flared sides with slopes of 20.1% and 13.7%. AR5 24 months
3.4. Entrances    
3.4.a. The building does not have directional signage posted at inaccessible entrances and does not have the International Symbol of Accessibility posted at accessible entrances. D16 24 months
3.4.b. The West side entrance door by the bus loading area is inaccessible because there is a ¾ inch high step onto the carpet in front of the door. AR1 24 months
3.5. Interior Doors: The doors to the Dunkin Donuts and the Toilet Rooms are inaccessible because they require 10 to 15 pounds of force to open. D2 24 months
3.6. Main Lobby: The end of the visitor´s brochure counter protrudes into the walkway and is not detectable to blind persons using a cane. AR8 24 months
3.7. Drinking Fountains by Dunkin Donuts: Although a designated accessible drinking fountain is provided, there is no drinking fountain provided for people who have difficulty bending or stooping. DF3 24 months
3.8. Courtesy Telephone for Tours/Hotels: The telephone is inaccessible because it is not hearing aid compatible, it does not have volume control signage, and it provides inadequate knee space. TT1 24 months
3.9. Pay Telephone by Dunkin Donuts: The telephone is inaccessible because its highest operable part is 55½ inches above the finished floor. TT1 24 months
3.10. Women´s Toilet Room with Stalls near Dunkin Donuts    
3.10.a. The toilet room sign is mounted 65 inches above the finished floor on the hinge side of the door and has no raised or Braille characters. TR18 24 months
3.10.b. Although there are 13 toilet stalls, no ambulatory stall has been provided. ST1 24 months
3.11. Men´s Toilet Room with Stalls near Dunkin Donuts    
3.11.a. The toilet room sign is mounted 64 inches above the finished floor and has no raised or Braille characters. D26 24 months
3.11.b. The urinal is inaccessible because the rim is 18 inches above the finished floor. TR20 24 months
3.12. Elevator: The elevator is inaccessible because the car control buttons do not have Braille characters, and the call button for the main entry floor is not designated by a raised star. E4 24 months
4. Parks and Recreation Cottage Office    
4.1. Entrance    
4.1.a. The door is inaccessible because there is a 1½ inch high threshold. D22 12 months
4.1.b. The push side of the door, which is accessed through a front approach and which has both a closer and a latch, is inaccessible because it has only 3½ inches of clear space on the latch side. D7 12 months

5.1. Men´s Off-Season Toilet Room with Stalls    
5.1.a. The toilet room sign is mounted on the door and has no raised or Braille characters. TR18 30 months

6.1. Bleachers: The route to the bleachers is inaccessible because grass is not firm, stable and slip resistant. AR1 24 months
6.2. Concessions: The concession counters are inaccessible because they are 42 and 39½ inches above the finished floor. C5 24 months
6.3. Playground: There is no accessible route to the playground equipment or to the swings because the sand and the grass are not firm, stable, and slip resistant. AR1 24 months
6.4. Toilet Rooms - General: Many of the toilet rooms were locked and could not be surveyed. ST14 24 months
6.5. Ramp to Picnic Pavilion Toilet Rooms: The ramp is inaccessible because it does not have edge protection at the drop off sides. R1 24 months
6.6. Picnic Pavilion Women´s Toilet Room with Stalls
