ATTACHMENT J: Modifications to Altered Facilities

Please Note: Paragraph 48 of the Settlement Agreement requires that within three months of the effective date of this Agreement, the City provide signage as necessary to comply with 28 C.F.R. § 35.163(b), after having surveyed all facilities that are the subject of this Agreement for the purpose of identifying those that have multiple entrances not all of which are accessible.

The chart below lists the facilities surveyed by the Department, the access issues identified during the survey, and the actions required to correct the access issues. Required actions are listed using an alphanumeric code. The key to the alphanumeric codes is provided in Attachment M to this Agreement.

In order to ensure that the following spaces and elements in City facilities, in which alterations occurred after January 26, 1992, are readily accessible to and usable by persons with disabilities, the City will take the actions referenced by the alphanumeric code and described in detail in Attachment M to this Settlement Agreement within the time period specified below, which time period will begin to run on the effective date of this Agreement.

Parking: The L.C. Walker Arena has two lots (one on the East side and one on the West side). The East lot has 134 parking spaces, and is inaccessible because there are no van-accessible parking spaces and several designated accessible parking spaces lack appropriate vertical signage. This lot requires 1 of the accessible spaces to be a van accessible space, and appropriate vertical signage at each designated accessible parking space. The West lot has a total of 175 parking spaces, is inaccessible because there are no van accessible parking spaces, and several access aisles have widths of 48 inches and 49 inches. This lot requires 1 of the accessible spaces to be a van accessible space. The City will develop, and submit for approval by the Department, a plan for the accessible parking to be on the shortest accessible route to an accessible entrance, with a minimum of 8 accessible parking spaces, and not less than 2 of them shall be van accessible and have appropriate signage. Each parking lot serving the Arena that does not have accessible parking will also have signage directing individuals with disabilities to the accessible parking. The plan shall be developed and submitted for Department approval early enough so that the plan can be implemented, and accessible parking spaces provided, by the specified completion date.
