Attachment K: Program Access in Existing Facilities

 

Please Note: Paragraph 37 of the Agreement requires that within fourteen months of the effective date of this Agreement, the City will provide signage as necessary to comply with 28 C.F.R. ' 35.163(b), after having surveyed all facilities that are the subject of this Agreement for the purpose of identifying those that have multiple entrances not all of which are accessible.

 

1.                  The technical requirements and, where appropriate, the scoping requirements of the Standards are used as a guide for determining whether a program or activity held in an existing facility is Areadily accessible to and usable by@ people with disabilities and for determining what changes are necessary to make this program or activity accessible if it continues to be provided in the existing facility in question.  See 28 C.F.R. '' 35.150(b)(1), 35.151.

 

2.                  In order to ensure that each of the City=s programs, services, and activities operating at a facility that is the subject of this Agreement, when viewed in its entirety, are readily accessible to and usable by people with disabilities, the City will take the following actions:

 

3.                  The City will make the following modifications to the Albany Branch Library located at 1250 Albany Avenue, within 5 years of the effective date of this Agreement, unless a shorter time period is indicated:                                

 

A.                Community Room located on the Lower Level

 

i.                     Within six months, the City will implement and report to the Department its plan to provide program access to the Community Room for persons with disabilities.  The plan may include allowing activities, events, meetings, and/or business involving people with disabilities that would normally be held in the Community Room to instead be held at an alternate accessible location.  28 C.F.R. 35.149, 35.150.

 

B.                 Unisex Single-User Toilet Room

 

i.                     No accessible toilet room sign has been provided.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 


ii.                   The entrance to the toilet room is inaccessible because there is 35 inches of clear floor space between the two doors.  Provide an accessible entrance, such that the space between any two doors in series is at least 48 inches plus the width of any door swinging into the space.  Provide doors in a series that swing either in the same direction or away from the space between the doors.  Standards ' 4.13.7, Fig. 26.

 

iii.                  The doors are inaccessible because they have a clear opening width of 29 2 inches and have knob hardware.  Provide doors with clear openings at least 32 inches wide when measured from the face of the door to the opposite stop when the door is opened 90 degrees and with hardware usable with one hand and without tight grasping, pinching, or twisting of the wrist.  Lever-operated, push-type, and U-shaped handles are acceptable designs.  Standards '' 4.13.5, 4.13.9.

 

iv.                 There is insufficient turning space within the toilet room.  Provide an unobstructed turning space at least 60 inches in diameter or a T-shaped space complying with Fig. 3(b).  Standards '' 4.22.3, 4.2.3, Fig. 3.

 

v.                   No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards ' 4.19.6.

 

vi.                 The lavatory is inaccessible because it has twist type controls.  Provide a lavatory with a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards '' 4.19.5, 4.27.4.

 

vii.                The lavatory is inaccessible because the hot water pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.

 

viii.              The toilet room door swings into the required clear floor space at the lavatory.  Provide the required clear floor space at any accessible fixture.  Standards ' 4.22.2.

 

ix.                 The toilet is inaccessible because there is insufficient clear floor space.  Provide clear floor space at the toilet that complies with Fig. 28.  Standards ' 4.16.2, Fig. 28.

 

x.                   The toilet is inaccessible because the flush control is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.16.5, 4.27.4.


 

xi.                 No grab bars have been provided.  Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall, and a side grab bar that is at least 42 inches in overall length, with the far end mounted at least 54 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Provide grab bars that are mounted 33 to 36 inches above the finished floor; with a diameter between 13 and 12 inches; with 12 inches between the grab bars and the wall; and at least 12 inches between the grab bars and any other object, such as a toilet paper dispenser or a toilet seat cover dispenser.  Standards '' 4.16.4, 4.26.2, Fig. 29.

 

4.                  The City is in the midst of evaluating the renovation and/or future use of a number of facilities, including the Anderson Recreation Center and Indoor Pool located at 2621 Main Street.  The City shall either make the modifications to the above facility within the designated time-frames or, alternatively, within 18 months, submit to the Department for review and approval a plan for ensuring that all of the programs offered in the above facility, when considered in their entirety, are made accessible to persons with disabilities.  In instances where the City chooses to address access issues through the renovation of the facility, the construction of a new facility, or the relocation of programs to another facility, and such actions are not expected to be completed within the next 12 months, the plan shall specify the actions the City will take to provide access to the programs for persons with disabilities during the time period prior to completion of such actions, including the dates by which such actions will be taken.

 

The City will make the following modifications to the Anderson Recreation Center and Indoor Pool located at 2621 Main Street, within 9 years of the effective date of this Agreement:                                                      

 

A.                Parking

 

i.                     Although the parking lot has up to 25 parking spaces, no parking designated as reserved for people with disabilities has been provided.  On the upper lot near the accessible route to main entrance, provide one van accessible space designated as reserved for people with disabilities.  In the rear of the building near the exterior ramp to the indoor basketball courts, provide one van accessible space designated as reserved for people with disabilities.  Van accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  All spaces designated as reserved for people with disabilities shall have vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  Van accessible spaces shall have an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).


 

B.                 Exterior Ramp to Basketball Courts

 

i.                     The ramp is inaccessible because there is no level landing at the bottom of the ramp.  Provide a ramp with level landings at least as wide as the ramp and 60 inches long at the bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides.  Provide handrails that extend at least 12 inches beyond the bottom of the ramp parallel with the ground surface.  Provide handrails that are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Provide a ramp and approaches that are designed so that water will not accumulate on walking surfaces.  Standards '' 4.3.8, 4.8.

 

C.                Drinking Fountain

 

i.                     The wall-mounted drinking fountain on the first floor is inaccessible because it does not provide sufficient knee or toe clearance.  Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Provide fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  Additionally, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards '' 4.15, 4.27.4, Fig. 27.

 

D.                Public Telephone

 


v.                   The telephone is inaccessible because it is mounted in a booth that is 22 inches wide.  Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards.  Standards '' 4.31, 4.30.7(2).

 

E.                 Men=s Toilet Room

 

i.                     The men=s toilet room is inaccessible because no accessible toilet room sign has been provided.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

ii.                   The toilet paper dispenser in the designated accessible stall is inaccessible because it is mounted above the side grab bar.  Provide a toilet paper dispenser that is mounted with its top at least 12 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards ' 4.17.3, Fig. 30(d).

 

F.                 Women=s Toilet Room

 

vii.                The women=s toilet room is inaccessible because no accessible toilet room sign has been provided.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

viii.              The toilet paper dispenser in the designated accessible stall is inaccessible because it is mounted above the side grab bar.  Provide a toilet paper dispenser that is mounted with its top at least 12 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards ' 4.17.3, Fig. 30(d).

 

ix.                 The toilet in the designated accessible stall is inaccessible because the flush control is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.16.5, 4.17.2, 4.27.4.


 

G.                Accessible Route

 

i.                     The route from the side of the of building (where designated accessible parking is to be installed) to the pool entrance doors is inaccessible because a fence protrudes into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4. 

 

H.                Women=s/Girls= Locker Room

 

i.                     No accessible locker room sign has been provided.  Provide a locker room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

ii.                   The path of travel into the room is inaccessible because the wall-mounted air dryers are not detectable to a blind person using a cane.  Provide an accessible route into the room such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.4.

 

iii.                  No accessible coat hook has been provided in either the designated accessible stall or the changing area.  Provide a coat hook in each of these locations at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

iv.                 The designated accessible stall door swings into the required clear floor space at the toilet.  Provide the required clear floor space at any accessible fixture.  Standards ' 4.22.2.

 


v.                   The toilet paper dispenser in the designated accessible stall is inaccessible because it is mounted above the grab bar.  Provide a toilet paper dispenser that is mounted within reach, with its top at least 12 inches under the side grab bar, and centered at least 19 inches above the finished floor.  Standards ' 4.16.6, Fig. 29(b).

 

vi.                 No rear grab bar has been provided in the designated accessible stall.  Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall; mounted 33 to 36 inches above the finished floor; with a diameter between 13 and 12 inches; with 12 inches between the grab bar and the wall; and at least 12 inches between the grab bar and any other object, such as a toilet seat cover dispenser.  Standards '' 4.16.4, 4.26.2, Fig. 29.

 

vii.                No accessible shower has been provided.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Provide a shower that has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards ' 4.21, Figs. 35, 36, 37.

 

viii.              The bench is inaccessible because it is 9 2 inches wide and is not fixed to the wall.  Provide a 24 inch by 48 inch bench fixed to the wall along the bench=s longer dimension.  Provide a bench that has sufficient structural strength and is mounted with its surface between 17 inches and 19 inches above the finished floor.  Provide clear floor space alongside the bench to allow a person using a wheelchair to make a parallel transfer onto the bench.  Standards '' 4.35.4, 4.26.3.

 

IX.              Men=s/Boys= Locker Room

 

i.                     No accessible locker room sign has been provided.  Provide a locker room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 


ii.                   The urinal is inaccessible because its flush control is 48 inches above the finished floor.  Provide a urinal with a flush control height of 44 inches or less above the finished floor.  Standards '' 4.18.2, 4.18.3, 4.18.4.

 

iii.                  No accessible coat hook has been provided in the changing area.  Provide a coat hook in each of these locations at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

iv.                 No standard accessible toilet stall has been provided.  Provide a Astandard@ accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall=s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

 

v.                   No accessible shower has been provided.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Provide a shower that has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards ' 4.21, Figs. 35, 36, 37.

 

vi.                 The bench is inaccessible because it is 9 2 inches wide and is not fixed to the wall.  Provide a 24 inch by 48 inch bench fixed to the wall along the bench=s longer dimension.  Provide a bench that has sufficient structural strength and is mounted with its surface between 17 inches and 19 inches above the finished floor.  Provide clear floor space alongside the bench to allow a person using a wheelchair to make a parallel transfer onto the bench.  Standards '' 4.35.4, 4.26.3.

 


5.                  The City is in the midst of evaluating the renovation and/or future use of a number of facilities, including the Blue Hills Recreation Center located at 9 Lebanon Street.  The City shall either make the modifications to the above facility within the designated time-frames or, alternatively, within 18 months, submit to the Department for review and approval a plan for ensuring that all of the programs offered in the above facility, when considered in their entirety, are made accessible to persons with disabilities.  In instances where the City chooses to address access issues through the renovation of the facility, the construction of a new facility, or the relocation of programs to another facility, and such actions are not expected to be completed within the next 12 months, the plan shall specify the actions the City will take to provide access to the programs for persons with disabilities during the time period prior to completion of such actions, including the dates by which such actions will be taken.

 

The City will make the following modifications to the Blue Hills Recreation Center             located at 9 Lebanon Street, within 9 years of the effective date of this Agreement:                        

A.                Parking

 

i.                     The upper and lower parking lots have no parking designated as reserved for use by people with disabilities  On the shortest accessible route to the accessible entrance, provide at least one van accessible space a minimum of 96 inches wide, served by access aisles at least 96 inches wide, with vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles, and with an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Standards '' 4.1.2(5)(b), 4.6, 4.30.7(1).

 

B.                 Exterior and Interior Entrance Doors

 

i.                     The exterior entrance door to the upper and lower levels and the interior doors throughout the lower level are inaccessible because they have knob hardware.  Provide doors throughout the Center with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

C.                Directional Signage

 

i.                     There is no signage directing people with disabilities to the accessible entrance to the lower level recreation room or to the upper level recreation room.  Provide accessible directional signage with the International Symbol of Accessibility at the parking lots= entrances indicating the location of the lower and first level accessible entrances.  Standards '' 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

 

D.                Drinking Fountains

 

i.                     All of the drinking fountains provided are inaccessible because they have twist type controls.  Provide drinking fountains with controls mounted on or near the front edge that are operable with one hand, that require 5 lbf or less to operate, and that can be operated without tight grasping, pinching, or twisting of the wrist.  Standards '' 4.15.4, 4.27.4.

 


ii.                   The lower drinking fountain located on the upper level has a spout that is 38 inches above the finished floor.  Provide a fountain at this location that has a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet, and that otherwise complies with the Standards.  Standards '' 4.15, 4.27.4, Fig. 27.

 

iii.                  Although a drinking fountain accessible to people who use wheelchairs is provided on the lower level, there is no drinking fountain provided for people who have difficulty bending or stooping.  Provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards ' 4.1.3(10)(a).

 

E.                 Men=s Toilet Room located on the Upper Level

 

i.                     No accessible toilet room sign has been provided.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

ii.                   The path of travel in the toilet room is inaccessible because the wall-mounted air dryer is not detectable to a blind person using a cane.  Provide an accessible route in the toilet room such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.4.

 

iii.                  There is no accessible stall provided.  Provide a Astandard@ accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall=s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

 

F.             Women=s Toilet Room located on the Upper Level

 


i.                     No accessible toilet room sign has been provided.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

ii.                   The door is inaccessible because it has knob hardware.  Provide a door with hardware that is easy to gr`asp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

iii.                  The path of travel in the toilet room is inaccessible because the wall-mounted air dryer is not detectable to a blind person using a cane.  Provide an accessible route in the toilet room such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.4.

 

iv.                 The toilet in the designated accessible stall is inaccessible because its centerline is 29 2 inches from the side wall.  Provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards ' 4.17.3, Fig. 30.

 

v.                   The toilet in the designated accessible stall is inaccessible because the flush control is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.16.5, 4.17.2, 4.27.4.

 


vi.                 The side grab bar in the designated accessible stall is inaccessible because it is mounted on the wrong side of the stall and has a space between the grab bar and the wall that is greater than 1 2 inches, and no rear grab bar has been provided.  Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall, and a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 54 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Provide grab bars that are mounted 33 to 36 inches above the finished floor; with a diameter between 13 and 12 inches; with 12 inches between the grab bar and the wall; and at least 12 inches between the grab bar and any other object, such as a toilet seat cover dispenser or a toilet paper dispenser.  Standards '' 4.17.6, 4.26.2, Fig. 30.

 

G.                Unisex Single-User Toilet Room located on the Lower Level

 

i.                     No accessible toilet room sign has been provided.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

ii.                   The door is inaccessible because it has knob hardware.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

iii.                  The urinal is inaccessible because its rim is 20 inches above the finished floor.  Provide a urinal with an elongated rim mounted 17 inches or less above the finished floor, a clear floor space of at least 30 inches wide and 48 inches deep centered on the urinal, and a flush control height of 44 inches or less above the finished floor.  Standards '' 4.18.2, 4.18.3, 4.18.4.

iv.                 The toilet is inaccessible because the flush control is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.16.5, 4.27.4.

 

v.                   The toilet paper dispenser is inaccessible because it is mounted above the grab bar.  Provide a toilet paper dispenser that is mounted within reach, with its top at least 12 inches under the side grab bar, and centered at least 19 inches above the finished floor.  Standards ' 4.16.6, Fig. 29(b).

 

vi.                 No rear grab bar has been provided.  Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall; mounted 33 to 36 inches above the finished floor; with a diameter between 13 and 12 inches; with 12 inches between the grab bar and the wall; and at least 12 inches between the grab bar and any other object, such as a toilet seat cover dispenser.  Standards '' 4.16.4, 4.26.2, Fig. 29.

 


6.                  The City is in the midst of evaluating the renovation and/or future use of a number of facilities, including the City Hall located at 550 Main Street.  The City shall either make the modifications to the above facility within the designated time-frames or, alternatively, within 18 months, submit to the Department for review and approval a plan for ensuring that all of the programs offered in the above facility, when considered in their entirety, are made accessible to persons with disabilities.  In instances where the City chooses to address access issues through the renovation of the facility, the construction of a new facility, or the relocation of programs to another facility, and such actions are not expected to be completed within the next 12 months, the plan shall specify the actions the City will take to provide access to the programs for persons with disabilities during the time period prior to completion of such actions, including the dates by which such actions will be taken.

 

The City will make the following modifications to the City Hall located at 550 Main Street, within 7 years of the effective date of this Agreement:                              

 

A.                Parking

 

i.                     The parking space reserved for people with disabilities (which is closest to the parking lot=s entrance) is inaccessible because it is not 96 inches wide.  Provide designated accessible parking spaces that are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Provide van accessible spaces that are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  Standards '' 4.1.2(5), 4.6.3, Fig.9.

 

ii.                   The signage designating parking as reserved for people with disabilities is too low.  At each space designated as reserved for people with disabilities, provide a vertical sign with the International Symbol of Accessibility located such that it cannot be obstructed by vehicles parked in the space.  Standards '' 4.6.4, 4.30.7(1).

 

iii.                  The van accessible parking reserved for people with disabilities lacks the required signage.  At van accessible spaces, provide a AVan-Accessible@ sign located below the International Symbol of Accessibility such that the sign cannot be obstructed by vehicles parked in the space.  Standards '' 4.6.4, 4.30.7(1).

 

A.                Accessible Route

 


i.                     The route from the main entrance to the designated accessible back entrance is inaccessible because sections of the sidewalk and parking lot have changes in level that exceed 2 inch.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

B.                 Designated Accessible Entrance (Prospect Street)

 

i.                     The entrance door is inaccessible because it has an opening width of only 30 inches.  Provide a designated accessible entrance with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop.  Standards ' 4.13.5, Fig. 24.

 

C.                Alarms

 

i.                     Although the facility contains an emergency alarm system, the alarm system is inaccessible because it does not have visual indicators.  Provide visual alarm devices in toilet rooms and any other general usage areas (e.g., meeting rooms), hallways, lobbies, and any other area for common use.  Such devices shall be integrated into the facility alarm system and shall meet the requirements of the Standards for lamp type, color, pulse duration, intensity, and flash rate.  Visual alarm appliances shall be placed 80 inches above the highest floor level within the space or 6 inches below the ceiling, whichever is lower.  Visual alarm appliances shall be located such that no place in any room or space, including common corridors or hallways, required to have a visual alarm appliance shall be more than 50 feet from the signal.  In large rooms and spaces exceeding 100 feet across, without obstructions 6 feet above the finished floor, devices may be placed around the perimeter, spaced a maximum of 100 feet apart, in lieu of suspending appliances from the ceiling.  Standards ' 4.28.3.

 

D.                Drinking Fountain Located on the Ground Level

 


i.                     No accessible drinking fountain has been provided.  Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Provide fountain controls that are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  Additionally, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards '' 4.15, 4.27.4, Fig. 27.

 

E.                 Directional Signage

 

i.                     There is no signage at the inaccessible toilet rooms directing people with disabilities to the accessible toilet rooms located on the ground level.  Provide accessible directional signage with the International Symbol of Accessibility at inaccessible toilet rooms indicating the location of the nearest accessible toilet rooms, and provide accessible signage with the International Symbol of Accessibility at all accessible toilet rooms.  Standards '' 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

 

F.                 Women=s Single-User Toilet Room located on the Ground Level

 

i.                     The toilet room sign is inaccessible because it is mounted on the door.  Provide a toilet room sign that is mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

ii.                   The toilet room door swings into the required clear floor space at the lavatory.  Ensure that no door swings into the required clear floor space at any accessible fixture.  Standards ' 4.22.2.

 

iii.                  The toilet paper dispenser is inaccessible because it is mounted above the side grab bar.  Provide a toilet paper dispenser that is mounted within reach, with its top at least 12 inches under the side grab bar, and centered at least 19 inches above the finished floor.  Standards ' 4.16.6, Fig. 29(b).

 

iv.                 The toilet is inaccessible because the flush control is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.16.5, 4.27.4.

 


v.                   The rear grab bar at the toilet is inaccessible because it is 26 inches long and is mounted 7 inches from the wall.  Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall; mounted 33 to 36 inches above the finished floor; with a diameter between 13 and 12 inches; with 12 inches between the grab bar and the wall; and at least 12 inches between the grab bar and any other object, such as a toilet seat cover dispenser.  Standards '' 4.16.4, 4.26.2, Fig. 29.

 

G.                Men=s Single-User Toilet Room located on the Ground Level

 

i.                     The toilet room sign is inaccessible because it is mounted on the door.  Provide a toilet room sign that is mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

ii.                   The door is inaccessible because the pressure required to open the door is 11 pounds.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

iii.                  The lavatory is inaccessible because its rim is 41 2 inches above the finished floor.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31.  Standards ' 4.19.2, Fig. 31.

 

iv.                 The urinal is inaccessible because its rim is 21 inches above the finished floor.  Provide a urinal with an elongated rim mounted 17 inches or less above the finished floor, a clear floor space of at least 30 inches wide and 48 inches deep centered on the urinal, and a flush control height of 44 inches or less above the finished floor.  Standards '' 4.18.2, 4.18.3, 4.18.4.

v.                   The toilet paper dispenser is inaccessible because it is mounted above the side grab bar.  Provide a toilet paper dispenser that is mounted within reach, with its top at least 12 inches under the side grab bar, and centered at least 19 inches above the finished floor.  Standards ' 4.16.6, Fig. 29(b).

 

vi.                 The toilet is inaccessible because the flush control is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.16.5, 4.27.4.

 

vii.                The toilet is inaccessible because the fixed second side grab bar obstructs the toilet=s clear floor space.  Provide clear floor space at the toilet that complies with Fig. 28.  Standards ' 4.16.2, Fig. 28.


 

viii.              The rear grab bar at the toilet is inaccessible because it is 26 inches long and is mounted 7 inches from the wall.  Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall; mounted 33 to 36 inches above the finished floor; with a diameter between 13 and 12 inches; with 12 inches between the grab bar and the wall; and at least 12 inches between the grab bar and any other object, such as a toilet seat cover dispenser.  Standards '' 4.16.4, 4.26.2, Fig. 29.

 

I.                   Elevator Designated for People with Disabilities (East, back, right)

 

i.                     The elevator is inaccessible because the hall lanterns signal twice for up, not down.  Provide hall lanterns at each hoistway entrance that emit audible signals that sound once for the up direction and twice for the down direction or have verbal annunciators that say Aup@ or Adown;@ and that visible signals are mounted so that their centerline is at least 72 inches above the lobby floor, they are at least 22 inches in the smallest dimension, and they are visible from the vicinity of the hall call button.  Lanterns located in cars, visible from the vicinity of hall call buttons, and conforming to the above requirements, are acceptable.  Standards ' 4.10.4, Fig. 20.

 

ii.                   The elevator is inaccessible because the hoistway signage is centered at 57 inches above the finished floor.  Provide signage at hoistway entrances with raised and Braille floor designations on both jambs such that the centerline of the characters is 60 inches above the finished floor and the characters are 2 inches high.  Standards ' 4.10.5, Fig. 20.

 

iii.                  The elevator is inaccessible because the doors only remain open for 10 seconds after they have been obstructed.  Provide door reopening devices that remain effective for at least 20 seconds, after which the doors may close; that the minimum time from notification that a car is answering a call until the doors of that car start to close is 5 seconds; and that the minimum time for elevator doors to remain fully open in response to a car call is 3 seconds.  Standards '' 4.10.6, 4.10.7, 4.10.8, Figs. 20, 21.

 

J.                   Offices and Counters

 

i.                     Interior Office Signage

 


a.                   Most of the signage provided is inaccessible because the signs= characters are not centered at 60 inches above the finished floor and/or the signs are not mounted on the nearest adjacent wall to the latch side of the office door.  Provide permanent room signage with upper case, sans serif or simple serif type letters and numerals, meeting the requirements of the Standards for character height, raised characters, finish and contrast, accompanied by Grade 2 Braille; mounted on the wall adjacent to the latch side of the door or on the nearest adjacent wall at a height of 60 inches above the finished floor to the centerline of the sign; and located so that a person may approach within 3 inches of the signage without encountering protruding objects or standing within the swing of a door.  Standards '' 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

ii.                   Human Relations Office (Rm 5)

 

a.                   The signage and the door are inaccessible because they are obstructed by the free standing lamp.  Provide signage that is located so that a person may approach within 3 inches of the signage without encountering protruding objects.  Provide a door that has a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards '' 4.30.6, 4.13.6, Fig. 25(a).

 

iii.                  Personnel Office (Rm 3)

 

a.                   The door is inaccessible because it is obstructed by a section of the wall mounted counter.  Provide a door that has a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards ' 4.13.6, Fig. 25(a).

 

iv.                 Purchasing and Pre-Audit Office (Rm 100)

 

a.                   The door is inaccessible because the pressure required to open the door is 17 pounds.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

v.                   Management and Budget Office (Rm 108)

 

a.                   The door is inaccessible because the pressure required to open the door is 12 pounds.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 


b.                  The reception counter is inaccessible because it is 43 inches above the finished floor.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main desk, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards '' 7.2(2), 4.3.

 

vi.                 Assessor Office (Rm 106)

 

a.                   The door is inaccessible because the pressure required to open the door is 12 pounds.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

vii.                Town and City Clerk Office (Rm 105)

 

a.                   The door is inaccessible because the pressure required to open the door is 15 pounds.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

b.                  The reception counter is inaccessible because it is 42 inches above the finished floor.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards '' 7.2(2), 4.3.

 

c.                   The record stacks are inaccessible because the highest reach required is 74 inches above the finished floor.  Provide stacks with a minimum of 36 inches of clear width between units and with reach ranges of between 18 inches and 54 inches (maximum height of 48 inches is preferred) above the finished floor, or provide equivalent facilitation.  Equivalent facilitation may be provided in the form of a sign with the International Symbol of Accessibility indicating that assistance is available upon request, or by other means.   Standards '' 4.2.5, 4.2.6, Figs. 5, 6.

 

viii.              Tax Collector Office (Rm 103)

 

a.                   The route to the office is inaccessible because the width between the queuing rope/pole and wall is 26 inches.  Provide an accessible route to the office with a minimum clear width of 36 inches, except at doors, where the width may decrease to 32 inches.  Standards '' 4.3.3, 4.13.5.

 

ix.                 Office of the Mayor (Rm 200)

 


a.                   The door is inaccessible because the pressure required to open the door is 15 pounds.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

b.                  The reception desk is inaccessible because it is 43 inches above the finished floor.  Provide a desk on an accessible route such that a portion of the desk is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary desk or counter with a maximum height of 36 inches in close proximity to the main desk, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main desk, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards '' 7.2(2), 4.3.

 

x.                   Office of the Mayor - Communications, Community Initiatives, Legislative Affairs, and Conference Room (Rm 210)

 

a.                   The door to the office and to the conference room are inaccessible because the pressure required to open the doors is greater than 5 pounds.  Provide doors that require no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

b.                  The reception counter is inaccessible because it is 42 inches above the finished floor.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards '' 7.2(2), 4.3.

 

c.                   The conference room table is inaccessible because its apron is 25 2 inches above the finished floor.  Provide a table that has clear floor space that is 30 inches wide and 48 inches deep, knee clearance at least 27 inches high, 30 inches wide, and 19 inches deep, and a writing surface between 28 and 34 inches above the finished floor.  Standards '' 4.2.4.1, 4.32.

 

xi.                 Court of Common Council Office (Rm 208)

 

a.                   The door is inaccessible because the pressure required to open the door is 17 pounds.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 


b.                  The reception desk is inaccessible because it is 43 inches above the finished floor.  Provide a desk on an accessible route such that a portion of the desk is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary desk or counter with a maximum height of 36 inches in close proximity to the main desk, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main desk, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards '' 7.2(2), 4.3.

 

xii.                Council Chambers (Rm 206)

 

a.                   The ramp is inaccessible because it does not have handrails.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Provide handrails that are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards ' 4.8.5.

 

xiii.              Office of the Mayor - Constituent Services (Rm 203)

 

a.                   The door is inaccessible because the pressure required to open the door is 10 pounds.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

b.                  The door, which is accessed through a front approach, is inaccessible because it has 4 inches of latch side maneuvering clearance on the pull side of the door.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards ' 4.13.6, Fig. 25(a).

 


7.                  The City is in the midst of evaluating the renovation and/or future use of a number of facilities, including the City Hall Annex located at 525 Main Street.  The City shall either make the modifications to the above facility within the designated time-frames or, alternatively, within 18 months, submit to the Department for review and approval a plan for ensuring that all of the programs offered in the above facility, when considered in their entirety, are made accessible to persons with disabilities.  In instances where the City chooses to address access issues through the renovation of the facility, the construction of a new facility, or the relocation of programs to another facility, and such actions are not expected to be completed within the next 12 months, the plan shall specify the actions the City will take to provide access to the programs for persons with disabilities during the time period prior to completion of such actions, including the dates by which such actions will be taken.

 

The City will make the following modifications to the City Hall Annex located at 525 Main Street, within 6 years of the effective date of this Agreement:      

 

A.                Entrance Doors

 

i.                     The main entrance is inaccessible because each leaf of the exterior and interior double doors has an opening width of 27 inches and there is 27 inches of clear floor space between the doors in series.  Provide a designated accessible entrance that has at least one active leaf with a minimum clear opening width of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop; that has a minimum space between two hinged or pivoted doors of 48 inches plus the width of any door swinging into the space, with doors swinging in either the same direction or away from the space between the doors; that has either an automatic door operator or clear and level maneuvering clearance that complies fully with Fig. 25; and that has a threshold not exceeding 2 inch in height and beveled with a slope no greater than 1:2.  Provide hardware and operating devices that have shapes that are easy to grasp with one hand and do not require tight grasping, pinching or twisting of the wrist to operate; and that they are mounted no higher than 48 inches above the finished floor.  Standards ' 4.13, Figs. 24, 25, 26.

 

ii.                   The interior entrance doors are inaccessible because the pressure required to open the doors is 17 pounds.  Provide doors that require no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

A.                Interior Signage

 

i.                    The signage provided is inaccessible because the room number signs do not have raised and Braille characters.  Provide permanent room signage with upper case, sans serif or simple serif type letters and numerals, meeting the requirements of the Standards for character height, raised characters, finish and contrast, accompanied by Grade 2 Braille; mounted on the wall adjacent to the latch side of the door or on the nearest adjacent wall at a height of 60 inches above the finished floor to the centerline of the sign; and located so that a person may approach within 3 inches of the signage without encountering protruding objects or standing within the swing of a door.  Standards '' 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

B.                 Drinking Fountain

 


i.                     Although a drinking fountain is provided, there is no accessible drinking fountain.  Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Provide fountain controls that are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  Additionally, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards '' 4.15, 4.27.4, Fig. 27.

 

C.                Elevator

 

i.                     The elevator is inaccessible because the hall call buttons do not have visual signals, and they are not raised or centered at 42 inches above the finished floor.  Provide hall call buttons with visual signals indicating when each call is registered and when each call is answered.  Provide hall call buttons that are centered at 42 inches above the finished floor, a minimum of : inch in the smallest dimension, with the button designating the up direction on top; that the call buttons are raised or flush; and that objects mounted beneath hall call buttons do not project into the elevator lobby more than 4 inches.  Standards ' 4.10.3, Fig. 20.

 

ii.                   The elevator is inaccessible because no hall lanterns have been provided.  Provide hall lanterns at each hoistway entrance that emit a visible and audible signal indicating which car is answering a call.  Provide audible signals that sound once for the up direction and twice for the down direction or have verbal annunciators that say Aup@ or Adown;@ and that visible signals are mounted so that their centerline is at least 72 inches above the lobby floor, they are at least 22 inches in the smallest dimension, and they are visible from the vicinity of the hall call button.  Lanterns located in cars, visible from the vicinity of hall call buttons, and conforming to the above requirements, are acceptable.  Standards ' 4.10.4, Fig. 20.

 

iii.                  The elevator is inaccessible because some of the entrances do not have hoistway signage.  Provide signage at hoistway entrances with raised and Braille floor designations on both jambs such that the centerline of the characters is 60 inches above the finished floor and the characters are 2 inches high.  Standards ' 4.10.5, Fig. 20.


 

iv.                 The elevator is inaccessible because the doors only remain open for 8 seconds after they have been obstructed.  Provide door reopening devices that remain effective for at least 20 seconds, after which the doors may close; that the minimum time from notification that a car is answering a call until the doors of that car start to close is 5 seconds; and that the minimum time for elevator doors to remain fully open in response to a car call is 3 seconds.  Standards '' 4.10.6, 4.10.7, 4.10.8, Figs. 20, 21.

 

v.                   The elevator is inaccessible because the main entry floor is not designated by a raised star.  Provide a call button for the main entry floor that is designated by a raised star at the left of the floor designation.  Standards ' 4.10.12, Fig. 23.

 

vi.                 The elevator is inaccessible because the emergency controls are grouped at the top of the panel.  Provide emergency controls, including the emergency alarm and emergency stop, grouped at the bottom of the panel with their centerlines no less than 35 inches above the finished floor.  Standards ' 4.10.12, Fig. 23.

 

vii.                The elevator is inaccessible because the car position indicators do not have audible signals.  Provide visual car position indicators above the car control panel or over the door to show the position of the elevator in the hoistway.  Provide indicators that emit an audible and visual signal as the car passes or stops at a floor served by the elevator, with the corresponding floor designation being illuminated; and that numerals are a minimum of 2 inch high.  Standards ' 4.10.13.

 

D.                Men=s Toilet Room located on the Second Floor

 

i.                     No accessible toilet room sign has been provided.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

ii.                   The door is inaccessible because the pressure required to open the door is 25 pounds.  Provide a door that require no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 


iii.                  The door is inaccessible because it has knob hardware.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

iv.                 The door, which is accessed through a front approach, has 11 inches of maneuvering clearance on the latch side of the door.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards ' 4.13.6, Fig. 25(a).

 

v.                   The route to the designated accessible stall is inaccessible because it is only 29 inches wide.  Provide an accessible route to the toilet room with required minimum width, passing space, head room, surface textures, slopes, and changes in level.  Standards '' 4.3.1, 4.3.2, 4.3.3, 4.3.4, 4.3.5, 4.3.6, 4.3.7, 4.3.8.

 

vi.                 Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards '' 4.28.1, 4.28.3.

 

vii.                The path of travel in the toilet room is inaccessible because the wall-mounted paper towel dispenser is not detectable to a blind person using a cane.  Provide an accessible route in the toilet room such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.4.

 

viii.              No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards ' 4.19.6.

 

ix.                The urinal is inaccessible because its rim is 25 inches above the finished floor, and the flush control is 53 inches above the finished floor.  Provide a urinal with an elongated rim mounted 17 inches or less above the finished floor, a clear floor space of at least 30 inches wide and 48 inches deep centered on the urinal, and a flush control height of 44 inches or less above the finished floor.  Standards '' 4.18.2, 4.18.3, 4.18.4.

 

x.                   There is no accessible stall provided.  Provide a Astandard@ accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall=s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.


 

E.                 Women=s Toilet Room located on the Fourth Floor

b.                  The doors for rooms B-1 and B-8 are inaccessible because they have knob hardware.  Provide doors with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

c.                   The door for room B-1, which is accessed through a front approach, has 7 inches of latch side maneuvering clearance on the pull side of the door.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards ' 4.13.6, Fig. 25(a).

 


iii.                  Public Works Department (Rm 203)

 

a.                   The door is inaccessible because the pressure required to open the door is 10 pounds.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

b.                  The door is inaccessible because it has knob hardware.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

c.                   The reception counter with a public use computer is inaccessible because it is 40 2 inches above the finished floor.  Provide a lowered portion of the counter with a public use computer on an accessible route such that the lowered portion is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.  Equivalent facilitation may be provided in the form of an auxiliary table nearby.  Standards '' 7.2(2), 4.3.

 

iv.                 Public Works Conference Room located on the Second Floor (Rm 202)

 

a.                   The door is inaccessible because the pressure required to open the door is 9 pounds.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

vi.                 Facilities Division of Public Works (Rm 402)

 

a.                   The door is inaccessible because it has knob hardware.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

b.                  The door, which is accessed through a front approach, has 6 inches of pull side maneuvering clearance on the latch side of the door.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards ' 4.13.6, Fig. 25(a).

 

8.                  The Colt Park Administration Building located at 25 Stonington Street is currently not occupied; however, the City agrees prior to reoccupation it will make the following modifications to the facility:

 

A.                Parking

 

i.                     Although the parking lot has a total of 16 parking spaces, none are van accessible.  On the shortest accessible route to the accessible entrance, provide at least one van accessible space a minimum of 96 inches wide, served by access aisles at least 96 inches wide, with vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles, and with an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Standards '' 4.1.2(5)(b), 4.6, 4.30.7(1).

 

A.                Accessible Route

 


i.                     The route from parking lot to the entrance door is inaccessible.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

B.                 Exterior Entrance

 

i.                     The main entrance is inaccessible because only 27 inches of clear floor space is provided between the doors in series, the doors have knob hardware, and there is a 9 inch change in level at the threshold to the exterior door.  Provide a designated accessible entrance that has a minimum space between two hinged or pivoted doors of 48 inches plus the width of any door swinging into the space, with doors swinging in either the same direction or away from the space between the doors; that has either an automatic door operator or clear and level maneuvering clearance that complies fully with Fig. 25; and that has a threshold not exceeding 2 inch in height and beveled with a slope no greater than 1:2.  Provide hardware and operating devices that have shapes that are easy to grasp with one hand and do not require tight grasping, pinching or twisting of the wrist to operate; and that they are mounted no higher than 48 inches above the finished floor.  Standards ' 4.13, Figs. 24, 25, 26.

 

C.                Reception Counter

 

i.                     The reception counter is inaccessible because it is 43 inches above the finished floor.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards '' 7.2(2), 4.3.

 


9.                  The City is in the midst of evaluating the renovation and/or future use of a number of facilities, including the Dillon Stadium located at 250 Huyshope Avenue.  The City shall either make the modifications to the above facility within the designated time-frames or, alternatively, within 18 months, submit to the Department for review and approval a plan for ensuring that all of the programs offered in the above facility, when considered in their entirety, are made accessible to persons with disabilities.  In instances where the City chooses to address access issues through the renovation of the facility, the construction of a new facility, or the relocation of programs to another facility, and such actions are not expected to be completed within the next 12 months, the plan shall specify the actions the City will take to provide access to the programs for persons with disabilities during the time period prior to completion of such actions, including the dates by which such actions will be taken.

 

The City will make the following modifications to the Dillon Stadium located at 250 Huyshope Avenue, within 9 years of the effective date of this Agreement:

 

A.                Parking

 

i.                     The parking lot has no spaces reserved for use by people with disabilities.  On the shortest accessible route to the stadium, provide at least one van accessible space and at least one standard space designated as reserved for people with disabilities.  Standard accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Van accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  All spaces designated as reserved for people with disabilities shall have vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  Van accessible spaces shall have an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

A.                Stadium Seating

 

i.                     The stadium is inaccessible because it does not have any wheelchair and companion seating locations.  Provide the required number of wheelchair seating areas, each with a minimum clear ground or floor space of 66 inches wide by 48 inches deep for forward or rear access, or 66 inches wide by 60 inches deep for side access.  Ensure that the ground or floor at all wheelchair locations is level, firm, stable, and slip resistant; that wheelchair seating areas are an integral part of the fixed seating plan and are located so as to provide people with physical disabilities a choice of admission prices and lines of sight comparable to those available for members of the general public; that wheelchair seating areas adjoin an accessible route that also serves as a means of egress in case of emergency; and that at least one fixed companion seat is provided next to each wheelchair seating area.  Standards '' 4.1.3(19)(a), 4.5, 4.33.

 

B.                 Concession Stand

 


i.                     The picnic tables are inaccessible.  Provide at least one picnic table on an accessible route such that there is knee space at the table at least 27 inches high, 30 inches wide, and 19 inches deep, and such that the height of the top of the table is between 28 inches and 34 inches above the ground.  Standards '' 4.32.3, 4.32.4.

 

C.                Women=s Toilet Room in the Locker Room Facility

 

i.                     No accessible toilet room sign has been provided.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

ii.                   The door is inaccessible because it has a clear opening width of 30 inches.  Provide a door with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop.  Standards ' 4.13.5, Fig. 24.

 

iii.                  The door is inaccessible because it has knob hardware.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

iv.                 The door is inaccessible because it has an 8 inch threshold.  Provide a door with a threshold no greater than 3 inch, or between 3 inch and 2 inch and beveled with a slope no greater than 1:2.  Standards '' 4.13.8, 4.5.2.

 

v.                   The paper towel dispenser is inaccessible because it is mounted at 53 inches above the finished floor and over the lavatory.  Provide a paper towel dispenser so that it complies with Fig. 5 for a forward reach or with Fig. 6 for a side reach and such that it is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach, respectively, by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 


vi.                 The lavatory is inaccessible because its apron is 25 inches above the finished floor, its hot water pipes are not covered, it has twist type hardware, and there is insufficient knee and toe clearance.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; knee and toe clearances that comply with Fig. 31; hot water and drain pipes covered or otherwise configured to protect against contact; clear floor space at least 30 inches wide and 48 inches deep centered on the lavatory; and a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards '' 4.19.2, 4.19.3, 4.19.4, 4.19.5, 4.27.4, Figs. 31, 32.

 

vii.                There is no accessible stall provided.  Provide a Astandard@ accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall=s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

 

D.                Men=s Toilet Room in the Locker Room Facility

 

i.                     No accessible toilet room sign has been provided.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

viii.              The showers in each shower room are inaccessible.  Provide a shower in each room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Provide shower grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards ' 4.21, Figs. 35, 36, 37.

 

ix.                 Although a drinking fountain is provided in the changing area, there is no accessible drinking fountain.  Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Provide fountain controls that are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  Additionally, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards '' 4.15, 4.27.4, Fig. 27.

 

x.                   The bench in the changing area is inaccessible.  Provide a 24 inch by 48 inch bench fixed to the wall along the bench=s longer dimension.  Provide a bench that has sufficient structural strength and is mounted with its surface between 17 inches and 19 inches above the finished floor.  Provide clear floor space alongside the bench to allow a person using a wheelchair to make a parallel transfer onto the bench.  Standards '' 4.35.4, 4.26.3.

 


10.              The City is in the midst of evaluating the relocation of the Fire Headquarters located at 275 Pearl Street as part of the City=s Capital Improvement Program.  Within 18 months of the effective date of this Agreement, the City will submit to the Department for review and approval a plan for ensuring that all of the programs offered in the above facility, when considered in their entirety, are made accessible to persons with disabilities.  In instances where the City chooses to address access issues through the renovation of the facility, the construction of a new facility, or the relocation of programs to another facility, and such actions are not expected to be completed within the next 12 months, the plan shall specify the actions the City will take to provide access to the programs for persons with disabilities during the time period prior to completion of such actions, including the dates by which such actions will be taken.  If the City chooses to retain use and operation of this facility at the time of the completion of the Capital Improvement Program, then the City will make the following modifications to the above facility within 2 years of the completion of the Public Safety Complex. 

 

A.                Exterior Entrance

 

i.                     The entrance is inaccessible because it has a 6 inch step, knob hardware, and does not have sufficient maneuvering clearances.  Provide a designated accessible entrance that has a minimum clear opening width of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop; that has either an automatic door operator or clear and level maneuvering clearance that complies fully with Fig. 25; and that has a threshold not exceeding 2 inch in height and beveled with a slope no greater than 1:2.  Provide hardware and operating devices that have shapes that are easy to grasp with one hand and do not require tight grasping, pinching or twisting of the wrist to operate; and that they are mounted no higher than 48 inches above the finished floor.  Standards ' 4.13, Figs. 24, 25.

 

B.                 Public Telephone

 

i.                     The public telephone on the first floor is inaccessible because it is not hearing aid compatible and lacks required signage.  Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; and that is hearing aid compatible.  Standards '' 4.31, 4.30.7(2).

 

C.                Interior Entrance Doors

 

i.                     The doors to the offices are inaccessible because knob hardware is used.  Provide a door to each office with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

D.                Drinking Fountain

 


i.                     The wall-mounted drinking fountain on the second floor is inaccessible because its spout is 38 inches above the finished floor, and it does not provide sufficient knee or toe clearance.  Provide a drinking fountain with clear knee space between the bottom of the apron and the finished floor or ground of at least 27 inches high, 30 inches wide, and 17 to 19 inches deep; and a minimum clear floor space of 30 inches by 48 inches to allow a person in a wheelchair to approach the unit facing forward.  Also, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards '' 4.1.3(10)(a), 4.15.5(1), Figs. 27(a), (b). 

 

B.                 Unisex Toilet Room located on the First Floor

11.              The City will make the following modifications to the Fire Station - Engine Co. 1 located at 197 Main Street, within 18 months of the effective date of this Agreement:

 

A.                The exterior entrance door is inaccessible because it has knob hardware and it does not have maneuvering clearance on the latch side of the door.  Provide a designated accessible entrance that has a minimum clear opening width of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop; that has either an automatic door operator or clear and level maneuvering clearance that complies fully with Fig. 25.  Provide hardware and operating devices that have shapes that are easy to grasp with one hand and do not require tight grasping, pinching or twisting of the wrist to operate; and that they are mounted no higher than 48 inches above the finished floor.  Standards ' 4.13, Figs. 24, 25.

 

12.              The City will make the following modifications to the Fire Station - Engine Co. 2 located at 1515 Main Street, within 18 months of the effective date of this Agreement:

 

A.                Exterior Entrance Door

 

i.                     The entrance door has a threshold that exceeds 2 inch in height, has knob hardware, and lacks accessible signage.  Provide at least one designated accessible entrance that has a minimum clear opening width of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop; that has either an automatic door operator or clear and level maneuvering clearance that complies fully with Fig. 25; and that has a threshold not exceeding 2 inch in height and beveled with a slope no greater than 1:2.  Provide hardware and operating devices that have shapes that are easy to grasp with one hand and do not require tight grasping, pinching or twisting of the wrist to operate; and that they are mounted no higher than 48 inches above the finished floor.  Standards ' 4.13, Figs. 24, 25.  Provide accessible directional signage with the International Symbol of Accessibility at inaccessible entrances directing users to the accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances.  Standards '' 4.1.3(8)(d), 4.13, 4.30.

14.              The City will make the following modifications to the Fire Station - Engine Co. 7 located at 181 Clark Street, within 18 months of the effective date of this Agreement:

 

A.                The exterior entrance door is inaccessible because there is a 5 inch change in level at the threshold to the door.  Provide an accessible door with a threshold that is no greater than 3 inch, or is no greater than 2 inch and is beveled with a slope no greater than 1:2.  Standards '' 4.13.8, 4.5.2.

 

15.              The City will make the following modifications to the Fire Station - Engine Co. 8 located at 721 Park Street, within 18 months of the effective date of this Agreement:

19.              The City will make the following modifications to the Fire Station - Engine Co. 14 located at 25 Blue Hills Avenue, within 18 months of the effective date of this Agreement:

i.                     The entrance door is inaccessible because there is a 5 2 inch change in level at the threshold to the door.  Provide an accessible door with a threshold that is no greater than 3 inch, or is no greater than 2 inch and is beveled with a slope no greater than 1:2.  Standards '' 4.13.8, 4.5.2.

 

ii.                   The entrance door is inaccessible because it has knob hardware.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

B.                 Call Button

 

i.                     The call button is inaccessible because it is mounted at 62 inches above the finished floor.  Provide a call button a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

21.              The City will make the following modifications to the Fire Station - Engine Co. 16 located at 636 Blue Hills Avenue, within 18 months of the effective date of this Agreement:

 

A.                Accessible Route

    


i.                     The route from the sidewalk to the main entrance door is inaccessible because the route has changes in level that exceed 2 inch.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

B.                 Exterior Entrance Door

 

i.                     The entrance door is inaccessible because there is a 5 inch change in level at the threshold to the door.  Provide an accessible door with a threshold that is no greater than 3 inch, or is no greater than 2 inch and is beveled with a slope no greater than 1:2.  Standards '' 4.13.8, 4.5.2.

 

ii.                   The entrance door, which is accessed through a front approach, is inaccessible because it does not have maneuvering clearance on the pull side of the door.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards ' 4.13.6, Fig. 25(a).

 

C.                Call Button

 

i.                     The call button is inaccessible because it is mounted at 62 inches above the finished floor.  Provide a call button a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

D.                Emergency Phone

 


i.                     The emergency phone is not accessible because it is not on an accessible route and is mounted more than 54 inches above the finished floor.  Provide an emergency phone with mechanical controls, if any, that can be operated with 5 lbf or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Provide controls that are a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that it is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.27.4, 4.2.4, 4.2.5, 4.2.6.

 

22.              The City will make the following modifications to the Goodwin Park Pond House located at Hubbard Road and South Street, within 3 years of the effective date of this Agreement:

 

A.              Passenger Loading Zone

 

1.                  The passenger loading zone is inaccessible because it lacks an access aisle adjacent and parallel to the vehicle pull-up space.  Provide a passenger loading zone on an accessible route such that the loading zone has a vertical clearance of at least 114 inches, has an access aisle at least 60 inches wide and 20 feet long adjacent and parallel to the vehicle pull-up space, and has a surface that is firm, stable, slip-resistant, and level with no more than a 1:50 slope in all directions.  Standards ' 4.6.6.

 

B.              Directional Signage

 

i.                     There is no signage directing people with disabilities to the designated accessible entrance to the Pond House and toilet rooms.  Provide accessible directional signage with the International Symbol of Accessibility at the inaccessible toilet room entrances indicating the location of the nearest accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all accessible toilet rooms.  Standards '' 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30

 

C.                Designated Accessible Exterior Entrance Door

 

i.                     The door is inaccessible because it has knob hardware.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

D.                Men=s Toilet Room

 

i.                     No accessible toilet room sign has been provided.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 


ii.                   No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards ' 4.19.6.

 

iii.                  No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

iv.                 The toilet paper dispenser is inaccessible because it is mounted on the stall door.  Provide a toilet paper dispenser that is mounted with its top at least 12 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards ' 4.17.3, Fig. 30(d).

 

E.                 Women=s Toilet Room

 

i.                     No accessible toilet room sign has been provided.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

iv.                 No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 


v.                   The toilet is inaccessible because the flush control is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.16.5, 4.27.4.

 

vi.                 The toilet paper dispenser is inaccessible because it is mounted on the stall door.  Provide a toilet paper dispenser that is mounted with its top at least 12 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards ' 4.17.3, Fig. 30(d).

 

23.              The City will make the following modifications to the Goodwin Park Golf Course located at 1192 Maple Avenue, within 7 years of the effective date of this Agreement:

 

A.                Parking

 

i.                     The Club House parking lot is inaccessible because the standard parking spaces reserved for use by persons with disabilities have access aisles that are 36 inches wide.  At each standard accessible space, provide an access aisle at least 60 inches wide.  At each van accessible space, provide an access aisles at least 96 inches wide.  Provide access aisles that are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6.3, Fig. 9.

 

ii.                   The van accessible parking space reserved for people with disabilities in the Club House parking lot lacks the required signage.  At van accessible spaces, provide a AVan-Accessible@ sign located below the International Symbol of Accessibility such that the sign cannot be obstructed by vehicles parked in the space.  Standards '' 4.6.4, 4.30.7(1).

 

iii.                  Although the driving range parking lot has a total of 58 parking spaces, none are designated as reserved for people with disabilities.  On the shortest accessible route to the accessible entrance, provide one van accessible space and two standard spaces designated as reserved for people with disabilities.  Standard accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Van accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  All spaces designated as reserved for people with disabilities shall have vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  Van accessible spaces shall have an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).


 

A.                Accessible Route

 

i.                     The route from the driving range parking lot and the Club House to the driving range platforms is inaccessible.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

B.                 Counters

 

i.                     The pro-shop cashier counter is inaccessible because it is 42 inches above the finished floor.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor.  Standards '' 7.2(1), 4.3.

 

ii.                   The snack bar counter is inaccessible because it is 41 2 inches above the finished floor.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor.  Standards '' 7.2(1), 4.3.

 

C.                Picnic Table

 

i.                     The picnic tables are inaccessible.  Provide at least one picnic table on an accessible route such that there is knee space at the table at least 27 inches high, 30 inches wide, and 19 inches deep, and such that the height of the top of the table is between 28 inches and 34 inches above the ground.  Standards '' 4.32.3, 4.32.4.

 

D.                Drinking Fountain

 


i.                     The wall-mounted drinking fountain is inaccessible because its apron is 24 inches above the finished floor.  Provide a drinking fountain with clear knee space between the bottom of the apron and the finished floor or ground of at least 27 inches high, 30 inches wide, and 17 to 19 inches deep; and a minimum clear floor space of 30 inches by 48 inches to allow a person in a wheelchair to approach the unit facing forward.  Additionally, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards '' 4.15, 4.27.4, Fig. 27(a), (b).

 

E.                 Women=s Toilet Room

 

i.                     The toilet room sign is inaccessible because it is mounted on the door.  Provide a toilet room sign that is mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

ii.                   Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards '' 4.28.1, 4.28.3.

 

iii.                  The seat cover dispenser in the designated accessible stall is inaccessible because it is mounted at 55 2 inches above the finished floor.  Provide a seat cover dispenser a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

iv.                 The lavatory is inaccessible because its apron is 27 inches above the finished floor.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31.  Standards ' 4.19.2, Fig. 31.

 

v.                   The toilet in the designated accessible stall is inaccessible because the flush control is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.16.5, 4.17.2, 4.27.4.

ii.                   The route to the toilet room is inaccessible because it has an abrupt 1 inch change in level along the route.  Provide an accessible route to the toilet room with required minimum width, passing space, head room, surface textures, slopes, and changes in level.  Standards '' 4.3.1, 4.3.2, 4.3.3, 4.3.4, 4.3.5, 4.3.6, 4.3.7, 4.3.8.

 

iii.                  Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards '' 4.28.1, 4.28.3.

 

iv.                 The lavatory is inaccessible because its apron is 27 inches above the finished floor.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31.  Standards ' 4.19.2, Fig. 31.

 

v.                   The toilet paper dispenser in the designated accessible stall is inaccessible because it is mounted above the grab bar.  Provide a toilet paper dispenser that is mounted with its top at least 12 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards ' 4.17.3, Fig. 30(d).

 

H.                Golf Carts

 


i.                     Although the City has golf carts for public use at this facility, none are accessible to persons who use wheelchairs.  The next time that golf carts are purchased, the City will acquire at least one accessible golf cart to provide program accessibility.  The City will implement policies to ensure the accessible cart=s availability to persons with disabilities.  These will include, for example, allowing persons with disabilities to reserve it or use it without reservations; renting out the accessible golf cart to non-disabled users only when all other carts are in use; charging the same for the use of the accessible cart as others; and maintaining it in good condition.  The accessible cart may be used by non-disabled golfers when consistent with the policies set out above.  28 C.F.R. ' 36. 202(b).

 

24.              The City will make the following modifications to the Horse Stables located at the Keney Service Yard, within 5 years of the effective date of this Agreement:

 

Y.                Parking

 

xxvi.          The parking lot has no spaces designated as reserved for people with disabilities has been provided.  On the shortest accessible route to the accessible entrance, provide at least one van accessible space a minimum of 96 inches wide, served by access aisles at least 96 inches wide, with vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles, and with an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Standards '' 4.1.2(5)(b), 4.6, 4.30.7(1).

 

B.                 Accessible Route

 

i.                     The route from the meeting room to the office and toilet rooms is inaccessible because there is a 5 inch change in level.  Provide an accessible route to the toilet room with required minimum width, passing space, head room, surface textures, slopes, and changes in level.  Standards '' 4.3.1, 4.3.2, 4.3.3, 4.3.4, 4.3.5, 4.3.6, 4.3.7, 4.3.8.

v.            The urinal is inaccessible because its rim is 25 2 inches above the finished floor.  Provide a urinal with an elongated rim mounted 17 inches or less above the finished floor, a clear floor space of at least 30 inches wide and 48 inches deep centered on the urinal, and a flush control height of 44 inches or less above the finished floor.  Standards '' 4.18.2, 4.18.3, 4.18.4.

vi.                 There is no accessible stall provided.  Provide a Astandard@ accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall=s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

 

D.                Women=s Toilet Room

iii.                  The lavatory is inaccessible because there is insufficient knee and toe clearance.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31.  Standards ' 4.19.2, Fig. 31.

 

iv.                 The lavatory is inaccessible because it has twist type controls.  Provide a lavatory with a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards '' 4.19.5, 4.27.4.

 

v.                   There is no accessible stall provided.  Provide a Astandard@ accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall=s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

 

E.                 Drinking Fountain

 

i.                     The free standing drinking fountain is inaccessible to people who use wheelchairs.  Provide at least a drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Provide fountain controls that are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  Additionally, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards '' 4.15, 4.27.4, Fig. 27.

 


25.              The City is in the midst of evaluating the renovation and/or future use of a number of facilities, including the Hyland Recreation and Day Care Center located at 35 New Britain Avenue.  The City shall either make the modifications to the above facility within the designated time-frames or, alternatively, within 18 months, submit to the Department for review and approval a plan for ensuring that all of the programs offered in the above facility, when considered in their entirety, are made accessible to persons with disabilities.  In instances where the City chooses to address access issues through the renovation of the facility, the construction of a new facility, or the relocation of programs to another facility, and such actions are not expected to be completed within the next 12 months, the plan shall specify the actions the City will take to provide access to the programs for persons with disabilities during the time period prior to completion of such actions, including the dates by which such actions will be taken.

 

The City will make the following modifications to the Hyland Recreation and Day Care Center located at 35 New Britain Avenue, within 9 years of the effective date of this Agreement:

 

A.                Parking

 

i.                     The space designated as reserved for people with disabilities lacks an access aisle and is not designated as van accessible.  On the shortest accessible route to the accessible entrance, provide at least one van accessible space a minimum of 96 inches wide, served by access aisles at least 96 inches wide, with vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles, and with an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Standards '' 4.1.2(5)(b), 4.6, 4.30.7(1).

 

A.                Accessible Routes

 

i.                     Many of the designated accessible routes to the Center and the amenities on the site have abrupt changes in level that exceed 2 inch.  Provide at least one accessible route within the boundary of this site connecting the designated accessible parking, the designated accessible entrances, and the park=s fields and playground equipment that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

B.                 Directional Signage

 


i.                     There is no signage directing people with disabilities to the accessible entrance to the Day Care Center and the accessible lower level entrance to the Recreation Center.  Provide accessible directional signage with the International Symbol of Accessibility at the parking lot=s entrance and at the inaccessible entrance indicating the location of the accessible entrances, and provide accessible signage with the International Symbol of Accessibility at all accessible entrances.  Standards '' 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

 

C.                Exterior Ramp

 

i.                     The ramp at the Day Care Center is inaccessible because there is a 1 inch change in level at the bottom landing of the ramp.  Provide a ramp with a bottom level landing so that there are no level changes in excess of 2 inch vertically.  Standards '' 4.3, 4.5.2, Fig. 7.

 

D.                Exterior Entrance

 

i.                     The entrance door to the lower level is inaccessible because there is a slope greater than 1:2 within the door=s required maneuvering clearance.  Provide a door so that the floor or ground area within the required clearances is level and clear.  Standards ' 4.13.6, Fig. 25.

 

E.                 Interior Stairs

 

i.                     The stairs are inaccessible because they do not have handrails on both sides of the stairs.  Provide handrails on both sides of the stairs such that the inside handrail on switchbacks or doglegs is continuous; handrails that are not continuous beyond the top and bottom of the stairs extend at least 12 inches beyond the top riser and at least 12 inches plus the width of one tread beyond the bottom riser; there is a clear space between the handrails and the wall of 12 inches; gripping surfaces are uninterrupted by newel posts, other construction elements, or obstructions; the handrails are mounted between 34 and 38 inches above stair nosings; the ends of the handrails are either rounded or returned smoothly to the floor, wall, or post; and the handrails do not rotate within their fittings.  Standards ' 4.9.

 

F.                 Classrooms located on the Second Floor

 

i.                     The route that connects the recreation room on the lower level and the classrooms on the second floor is inaccessible because it can only be accessed by stairs.  Provide an accessible elevator, or provide equivalent facilitation, which may include allowing people with disabilities to participate in the activities and services offered at the Recreation Center on the lower level or at an alternate accessible location. 28 C.F.R. 35.149, 35.150; Standards 4.10.


 

G.                Interior Doors to the Toilet Rooms located on the Lower Level

 

i.                     The doors are inaccessible because they have a clear opening width of 27 inches.  Provide doors with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop.  Standards ' 4.13.5, Fig. 24.

 

H.                Men=s Toilet Room located on the Lower Level

 

i.                     No accessible toilet room sign has been provided.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

ii.                   The door, which is accessed through a front approach, has no push side maneuvering clearance on the latch side of the door.  On the push side of the door, provide maneuvering clearance at least 48 inches deep and provide a minimum of 12 inches of maneuvering clearance on the latch side of the door, or remove the closer or the latch.  Standards ' 4.13.6, Fig. 25(a).

 

iii.                  The route into the toilet room is inaccessible because the entry ways have an opening width of 30 inches.  Provide an accessible route within the boundary of this room connecting all of the elements, with the required minimum width, passing space, head room, surface textures, slopes, and changes in level.  Standards '' 4.3.1, 4.3.2, 4.3.3, 4.3.4, 4.3.5, 4.3.6, 4.3.7, 4.3.8.

 

iv.                 There is insufficient turning space within the toilet room.  Provide an unobstructed turning space at least 60 inches in diameter or a T-shaped space complying with Fig. 3(b).  Standards '' 4.22.3, 4.2.3, Fig. 3.

 

v.                   The urinal is inaccessible because its rim is 24 inches above the finished floor, and the flush control is 54 inches above the finished floor.  Provide a urinal with an elongated rim mounted 17 inches or less above the finished floor, a clear floor space of at least 30 inches wide and 48 inches deep centered on the urinal, and a flush control height of 44 inches or less above the finished floor.  Standards '' 4.18.2, 4.18.3, 4.18.4.

 


vi.                 There is no accessible stall provided.  Provide a Astandard@ accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall=s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

 

I.                   Women=s Toilet Room located on the Lower Level

 

i.                     No accessible toilet room sign has been provided.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

ii.                   The door, which is accessed through a front approach, has no push side maneuvering clearance on the latch side of the door.  On the push side of the door, provide maneuvering clearance at least 48 inches deep and provide a minimum of 12 inches of maneuvering clearance on the latch side of the door, or remove the closer or the latch.  Standards ' 4.13.6, Fig. 25(a).

 

iii.                  The route into the toilet room is inaccessible because the entrance ways have an opening width of 31 inches.  Provide an accessible route within the boundary of this room connecting all of the elements, with the required minimum width, passing space, head room, surface textures, slopes, and changes in level.  Standards '' 4.3.1, 4.3.2, 4.3.3, 4.3.4, 4.3.5, 4.3.6, 4.3.7, 4.3.8.

 

iv.                 There is insufficient turning space within the toilet room.  Provide an unobstructed turning space at least 60 inches in diameter or a T-shaped space complying with Fig. 3(b).  Standards '' 4.22.3, 4.2.3, Fig. 3.

 

v.                   There is no accessible stall provided.  Provide a Astandard@ accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall=s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

 

26.              The City will make the following modifications to the Keney Park Golf Course located at 280 Tower Avenue, within 9 years of the effective date of this Agreement:

 

A.                Parking

 


i.                     Although the parking lot has a total of 95 parking spaces, only one is designated as reserved for people with disabilities.  On the shortest accessible route to the accessible entrance, provide at least one van accessible space and a total of three standard spaces designated as reserved for people with disabilities.  Standard accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Van accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  All spaces designated as reserved for people with disabilities shall have vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  Van accessible spaces shall have an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

A.                Accessible Routes

 

i.                     The route from the parking lot to the front entrance of the Club House is inaccessible because the curb ramp does not have a stable, firm, and slip-resistant surface.  Provide a curb ramp at this locations that is at least 36 inches wide, has a maximum slope of 1:12, is located so that it cannot be obstructed by parked vehicles, and has a stable, firm, and slip-resistant surface.  If the curb ramp is located where pedestrians must walk across it, provide either flared sides (with a maximum slope of 1:10) or handrails or guardrails to protect against cross traffic.  Standards ' 4.3.8, 4.7, Fig. 12.

 

ii.                   The route to the front exterior entrance door is inaccessible because there is an abrupt 1 inch change in level.  Provide an accessible route to the front entrance door with required minimum width, passing space, head room, surface textures, slopes, and changes in level.  Standards '' 4.3.1, 4.3.2, 4.3.3, 4.3.4, 4.3.5, 4.3.6, 4.3.7, 4.3.8.

 

iii.                  The route from the front exterior entrance to the back exterior entrance is inaccessible because there is a drainage hole blocking the curb ramp.  Provide a curb ramp at this location that is at least 36 inches wide, has a maximum slope of 1:12, is located so that it cannot be obstructed by parked vehicles, and has a stable, firm, and slip-resistant surface with a detectable warning extending the full width and depth of the ramp.  If the curb ramp is located where pedestrians must walk across it, provide either flared sides (with a maximum slope of 1:10) or handrails or guardrails to protect against cross traffic.  Standards ' 4.3.8, 4.7, Fig. 12.

 

B.                 Exterior Entrance Door (Front)

 


i.                     The front entrance is inaccessible because the automatic doors do not have an accessible control button.  Provide hardware and operating devices that have shapes that are easy to grasp with one hand and do not require tight grasping, pinching or twisting of the wrist to operate; and that they are mounted no higher than 48 inches above the finished floor.  Standards ' 4.13, Figs. 24, 25.

 

C.                Counters

 

i.                     The pro-shop cashier counter is inaccessible because it is 40 2 inches above the finished floor.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor.  Standards '' 7.2(1), 4.3.

 

ii.                   The snack bar counter is inaccessible because it is 42 2 inches above the finished floor.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor.  Standards '' 7.2(1), 4.3.

 

D.                Exterior Ramps

 

i.                     The ramp at the front entrance is inaccessible because the inside handrail does not have 12 inch extensions beyond the top and bottom of the ramp.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Provide handrails that are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards ' 4.8.5.

 

ii.                   The ramp at the back entrance is inaccessible because the handrails do not have 12 inch extensions beyond the top and bottom of the ramp.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Provide handrails that are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards ' 4.8.5.

 

E.                 Men=s Locker Room located on the Lower Level

 


i.                     There is no signage directing people with disabilities to the accessible entrance to the locker room located in the back of the Club House.  Provide accessible directional signage with the International Symbol of Accessibility at the inaccessible entrance indicating the location of the accessible entrance to the locker room, and provide accessible signage with the International Symbol of Accessibility at the accessible locker room.  Standards '' 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

 

ii.                   The exterior and interior doors are inaccessible because they have knob hardware.  Provide doors with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

iii.                  The paper towel dispenser is inaccessible because the controls are mounted at 58 2 inches above the finished floor.  Provide a paper towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

iv.                 No accessible urinal has been provided.  Provide a urinal with an elongated rim mounted 17 inches or less above the finished floor, a clear floor space of at least 30 inches wide and 48 inches deep centered on the urinal, and a flush control height of 44 inches or less above the finished floor.  Standards '' 4.18.2, 4.18.3, 4.18.4.

 

v.                   The toilet in the designated accessible stall is inaccessible because the flush control is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.16.5, 4.17.2, 4.27.4.

 

vi.                 The route in the locker room/changing area is inaccessible because it has a clear opening width of 26 inches.  Provide an accessible route in the locker room with required minimum width, passing space, head room, surface textures, slopes, and changes in level.  Standards '' 4.3.1, 4.3.2, 4.3.3, 4.3.4, 4.3.5, 4.3.6, 4.3.7, 4.3.8.

 

vii.                The bench is inaccessible because it is only 9 inches wide and is not fixed to the wall.  Provide a 24 inch by 48 inch bench fixed to the wall along the bench=s longer dimension.  Provide a bench that has sufficient structural strength and is mounted with its surface between 17 inches and 19 inches above the finished floor.  Provide clear floor space alongside the bench to allow a person using a wheelchair to make a parallel transfer onto the bench.  Standards '' 4.35.4, 4.26.3.

 


viii.              The locker are inaccessible because they require twisting and tight grasping to open.  Provide at least one locker with mechanical controls, if any, that can be operated with 5 lbf or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards ' 4.27.4.

 

F.                 Women=s Locker Room located on the Lower Level

 

i.                     There is no signage directing people with disabilities to the accessible entrance to the locker room located in the back of the Club House.  Provide accessible directional signage with the International Symbol of Accessibility at the inaccessible entrance indicating the location of the accessible entrance to the locker room, and provide accessible signage with the International Symbol of Accessibility at the accessible locker and toilet room.  Standards '' 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

 

ii.                   The exterior and interior doors are inaccessible because they have knob hardware.  Provide doors with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

iii.                  The exterior entrance door, which is exited through a front approach, has no push side maneuvering clearance on the latch side of the door.  On the push side of the door, provide maneuvering clearance at least 48 inches deep and provide a minimum of 12 inches of maneuvering clearance on the latch side of the door, or remove the closer or the latch.  Standards ' 4.13.6, Fig. 25(a).

 

iv.                 No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards ' 4.19.6.

 

v.                   The soap dispenser is inaccessible because the controls are mounted at 51 inches above the finished floor and over the lavatory.  Provide a soap dispenser such that the controls comply with Fig. 5 for a forward reach or with Fig. 6 for a side reach and such that it is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach, respectively, by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 


vi.                 The paper towel dispenser is inaccessible because the controls are mounted at 54 2 inches above the finished floor.  Provide a paper towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

vii.                The lavatory is inaccessible because the hot water pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.

 

G.                Drinking Fountain

 

i.                     Although a drinking fountain is provided in the women=s locker room, there is no accessible drinking fountain because its spout is 41 inches above the finished floor and it does not have knee and toe clearance.  Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Provide fountain controls that are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  Additionally, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards '' 4.15, 4.27.4, Fig. 27.

 

I.                   Golf Carts

 

i.                     Although the City has golf carts for public use at this facility, none are accessible to persons who use wheelchairs.  The next time that golf carts are purchased, the City will acquire at least one accessible golf cart to provide program accessibility.  The City will implement policies to ensure the accessible cart=s availability to persons with disabilities.  These will include, for example, allowing persons with disabilities to reserve it or use it without reservations; renting out the accessible golf cart to non-disabled users only when all other carts are in use; charging the same for the use of the accessible cart as others; and maintaining it in good condition.  The accessible cart may be used by non-disabled golfers when consistent with the policies set out above.  28 C.F.R. ' 36. 202(b).

 


27.              The City will make the following modifications to the Keney Park Pond House located at 323 Edgewood Street, within 3 years of the effective date of this Agreement:      

 

BB.            Parking

 

i.                     Although the parking lot has a total of 48 parking spaces, none are van accessible.  On the shortest accessible route to the accessible entrance, provide at least one van accessible space a minimum of 96 inches wide, served by access aisles at least 96 inches wide, with vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles, and with an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Standards '' 4.1.2(5)(b), 4.6, 4.30.7(1).

 

ii.                   The parking lot is inaccessible because the designated accessible parking spaces have access aisles that are 27 inches wide.  At each standard accessible space, provide an access aisle at least 60 inches wide.  At each van accessible space, provide an access aisles at least 96 inches wide.  Provide access aisles that are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6.3, Fig. 9.

 

A.                Picnic Table

 

i.                     The picnic tables are inaccessible.  Provide at least one picnic table on an accessible route such that there is knee space at the table at least 27 inches high, 30 inches wide, and 19 inches deep, and such that the height of the top of the table is between 28 inches and 34 inches above the ground.  Standards '' 4.32.3, 4.32.4.

 

B.                 Directional Signage

 

i.                    There is no signage directing people with disabilities to the designated accessible entrances from the rear inaccessible entrance.  Provide accessible directional signage with the International Symbol of Accessibility at the inaccessible entrance directing users to the accessible entrances, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances.  Standards '' 4.1.3(8)(d), 4.1.3(16)(b), 4.1.6(1)(b), 4.13, 4.30.

 

C.                Accessible Route

 


i.                    The route to the rear entrance ramp is inaccessible because sections of the route have changes in level that exceed 2 inch.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

i.                     The hi-lo drinking fountain is inaccessible because it has twist type controls.  Provide a drinking fountain with controls mounted on or near the front edge that are operable with one hand, that require 5 lbf or less to operate, and that can be operated without tight grasping, pinching, or twisting of the wrist.  Standards '' 4.15.4, 4.27.4.

 

E.                 Men=s and Women=s Toilet Rooms

 

i.                     No accessible toilet room signs have been provided.  Provide a toilet room sign at toilet each room with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

ii.                  The paths of travel into the toilet rooms are inaccessible because the wall-mounted air dryers are not detectable to a blind person using a cane.  Provide an accessible route into each toilet room such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards '' 4.1.2(3), 4.4.

 

iii.                  The lavatories in the toilet rooms are inaccessible because the hot water pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes in each toilet room that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.

 


iv.                 The toilets in the designated accessible stalls are inaccessible because their centerlines are 22 inches from the side wall.  Provide a toilet in each designated accessible stall with a centerline that measures 18 inches from the near side wall.  Standards ' 4.17.3, Fig. 30.

 

v.                   The rear grab bars in the designated accessible stalls are inaccessible because they are 25 inches long.  Provide a rear grab bar in each designated accessible stall that is at least 36 inches in overall length with the closer end no more than 6 inches from the side wall.  Standards ' 4.17.6, Fig. 30.

 

28.              The City will make the following modifications to the McCook Day Care Center located at 36 Coventry Street, within 18 months of the effective date of this Agreement:

 

A.                Exterior Ramp

 

i.                     The ramp is inaccessible because the ends of the handrails are not rounded and do not return smoothly to the floor, wall, or post.  Provide handrails that are between 13 inches and 1 2 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Provide handrails that are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards ' 4.8.5.

 

29.              The City will make the following modifications to the McCook Family Center located at 2 Coventry Street, within 18 months of the effective date of this Agreement:

 

A.                Parking

 

i.                     Although the parking lot has a total of 20 parking spaces, none are van accessible.  On the shortest accessible route to the accessible entrance, provide at least one van accessible space a minimum of 96 inches wide, served by access aisles at least 96 inches wide, with vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles, and with an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Standards '' 4.1.2(5)(b), 4.6, 4.30.7(1).

 

A.                Exterior Entrance

 

iii.                  The entrance door is inaccessible because it has knob hardware.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13, Figs. 24, 25.

 


C.                Exterior Ramp

 

i.                     The ramp is inaccessible because no continuous inside handrail has been provided.  Provide handrails that are between 13 inches and 12 inches in diameter such that the inside handrail is continuous and both handrails have a continuous gripping surface along both sides of the ramp extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface; the handrails do not rotate within their fittings; and both handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post.  Standards ' 4.8.5.                       

 

30.              The City is in the midst of evaluating the renovation and/or future use of a number of facilities, including the McCook Health and Human Services Department located at 2 Holcomb Street.  The City shall either make the modifications to the above facility within the designated time-frames or, alternatively, within 18 months, submit to the Department for review and approval a plan for ensuring that all of the programs offered in the above facility, when considered in their entirety, are made accessible to persons with disabilities.  In instances where the City chooses to address access issues through the renovation of the facility, the construction of a new facility, or the relocation of programs to another facility, and such actions are not expected to be completed within the next 12 months, the plan shall specify the actions the City will take to provide access to the programs for persons with disabilities during the time period prior to completion of such actions, including the dates by which such actions will be taken.

 

The City will make the following modifications to the McCook Health and Human Services Department located at 2 Holcomb Street, within 9 years of the effective date of this Agreement:

 

EE.             Parking

 

i.                     Although the parking lot has a total of 200 parking spaces, none are van accessible.  On the shortest accessible route to the accessible entrance, provide at least one van accessible space a minimum of 96 inches wide, served by access aisles at least 96 inches wide, with vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles, and with an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Standards '' 4.1.2(5)(b), 4.6, 4.30.7(1).

 


ii.                   Although the parking lot has a total of 200 parking spaces, only three spaces are designated as reserved for people with disabilities.  On the shortest accessible route to the accessible entrance, provide a total of six spaces designated as reserved for people with disabilities.  Standard accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  All spaces designated as reserved for people with disabilities shall have vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

iii.                  The existing parking spaces reserved for people with disabilities are inaccessible because the access aisles are 30 inches wide.  At each standard accessible space, provide an access aisle at least 60 inches wide.  At each van accessible space, provide an access aisles at least 96 inches wide.  Provide access aisles that are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6.3, Fig. 9.           

 

A.                Exterior Entrance

 

i.                    There is no signage directing people with disabilities to the designated accessible back entrance from the front inaccessible entrance.  Provide accessible directional signage with the International Symbol of Accessibility at the inaccessible entrance directing users to the accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances.  Standards '' 4.1.3(8)(d), 4.1.3(16)(b), 4.1.6(1)(b), 4.13, 4.30.

 

C.                Reception Counter

 

i.                     The reception counter is inaccessible because it is  42 inches above the finished floor.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards '' 7.2(2), 4.3.

 

D.             Interior Signage

 


i.                    The signage provided is inaccessible because the room number signs do not have raised and Braille characters.  Provide permanent room signage with upper case, sans serif or simple serif type letters and numerals, meeting the requirements of the Standards for character height, raised characters, finish and contrast, accompanied by Grade 2 Braille; mounted on the wall adjacent to the latch side of the door or on the nearest adjacent wall at a height of 60 inches above the finished floor to the centerline of the sign; and located so that a person may approach within 3 inches of the signage without encountering protruding objects or standing within the swing of a door.  Standards '' 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

E.                 Public Telephone           

 

i.                    The telephone on the fourth floor is inaccessible because the coin slot is 60 inches above the finished floor, and the telephone is not detectable to a blind person using a cane.  Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards.  Standards '' 4.31, 4.30.7(2).  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

F.                 Elevators

 

i.                     The elevators are inaccessible because the doors do not remain open for five seconds after notification of a call.  Provide doors that open and close automatically with a reopening device that will stop and reopen the car door and hoistway door automatically if the door becomes obstructed by an object or person.  Provide a device that is capable of completing these operations without requiring contact for obstructions passing through the opening at heights of 5 inches and 29 inches above the finished floor; that door reopening devices remain effective for at least 20 seconds, after which the doors may close; that the minimum time from notification that a car is answering a call until the doors of that car start to close is 5 seconds; and that the minimum time for elevator doors to remain fully open in response to a car call is 3 seconds.  Standards '' 4.10.6, 4.10.7, 4.10.8, Figs. 20, 21.

 

G.            Unisex Toilet Room located on the First Floor

 


i.                     No accessible toilet room sign has been provided.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

ii.                   The toilet is inaccessible because the top of the seat is 16 inches above the finished floor.  Provide a toilet with a seat that measures 17 to 19 inches above the finished floor.  Standards '' 4.16.3, 4.17.2, Fig. 30(d).

 

iii.                  The toilet is inaccessible because its centerline measures 24 2 inches from the side wall.  Provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards ' 4.17.3, Fig. 30.

 

iv.                 No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

v.                   The toilet paper dispenser is inaccessible because it is mounted above the side grab bar.  Provide a toilet paper dispenser that is mounted with its top at least 1 2 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards ' 4.17.3, Fig. 30(d).                       

 

H.            Men=s and Women=s Toilet Rooms located on the First Floor (Office)

 

i.                     No accessible toilet room signs have been provided.  Provide a toilet room sign at toilet each room with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

K.                Drinking Fountains

 

i.                     Although a drinking fountain accessible to people who use wheelchairs is provided on the first floor, there is no drinking fountain provided for people who have difficulty bending or stooping.  Provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards ' 4.1.3(10)(a).

 


ii.            The drinking fountain on the fourth floor is inaccessible because it has a spout that is 42 inches above the finished floor.  Provide a fountain that has a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet, and that otherwise complies with the Standards.  Additionally, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people. Standards '' 4.15, 4.27.4, Fig. 27.

 

31.              The City will make the following modifications to the Metzner Recreation Center and Day Care located at 680 Franklin Street, within 5 years of the effective date of this Agreement:

 

A.                Parking

 

i.                     Although the parking lot has a total of 46 parking spaces, none are van accessible.  On the shortest accessible route to the accessible entrance, provide at least one van accessible space a minimum of 96 inches wide, served by access aisles at least 96 inches wide, with vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles, and with an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Standards '' 4.1.2(5)(b), 4.6, 4.30.7(1).

 

ii.            The parking spaces reserved for people with disabilities are inaccessible because the access aisles are 30 inches wide.  At each standard accessible space, provide an access aisle at least 60 inches wide.  At each van accessible space, provide an access aisles at least 96 inches wide.  Provide access aisles that are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6.3, Fig. 9.

 

B.                 Picnic Table

 

i.                     The picnic tables are inaccessible.  Provide at least one picnic table on an accessible route such that there is knee space at the table at least 27 inches high, 30 inches wide, and 19 inches deep, and such that the height of the top of the table is between 28 inches and 34 inches above the ground.  Standards '' 4.32.3, 4.32.4.

 

C.                Drinking Fountain

 


i.                     Although a drinking fountain accessible to people who use wheelchairs is provided on the first floor, there is no drinking fountain provided for people who have difficulty bending or stooping.  Provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards ' 4.1.3(10)(a).

 

D.                Single-User Toilet Room located on the First Floor (Family)

 

i.                     No accessible toilet room sign has been provided.  Provide a toilet room sign at toilet each room with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.           

 

ii.            The toilet is inaccessible because the flush control is on the closed side.  Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards '' 4.16.5, 4.17.2, 4.27.4.

 

iii.                  The toilet paper dispenser is inaccessible because it is mounted above the side grab bar.  Provide a toilet paper dispenser that is mounted with its top at least 1 2 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards ' 4.17.3, Fig. 30(d).

 


32.              Within 120 days of the effective date of this Agreement, the City will submit to the Department its proposal for providing access to its program of City Parks and Recreational Facilities for persons with disabilities, including persons who use wheelchairs.  The proposal will include, but not be limited to, the City's proposal for addressing the current lack of accessible routes to and accessible elements and features in or at the points of interest located in its parks and recreational facilities, including but not limited to baseball fields, soccer fields, basketball courts, tennis courts, playgrounds, play equipment, picnic areas, shelters, concessions, pools, toilet rooms, and pavilions as well as the provision of accessible toilet rooms and dressing room facilities.  The plan, which is subject to Department approval, shall ensure that the City's program of parks and recreational facilities, when viewed in its entirety, is made accessible to persons with disabilities within the terms of this Agreement, including access to one of each point of interest provided at a park or recreational facility.  Within 18 months of the effective date of this Agreement, the City will report to the Department the steps it has taken and will take to provide access for persons with disabilities to its parks and recreation programs and will submit for Department approval a proposal specifying the additional steps it proposes to take to provide program access, including specific time-frames for implementation.  The City's proposals shall provide for improving program access to its parks during each year in which this Agreement remains in effect until its parks and recreation program, when viewed in its entirety, is accessible to persons with disabilities.

 

33.              The City is in the midst of evaluating the relocation of the Police Headquarters located at 50 Jennings Road as part of the City=s Capital Improvement Program.  Within 18 months of the effective date of this Agreement, the City will submit to the Department for review and approval a plan for ensuring that all of the programs offered in the above facility, when considered in their entirety, are made accessible to persons with disabilities.  In instances where the City chooses to address access issues through the renovation of the facility, the construction of a new facility, or the relocation of programs to another facility, and such actions are not expected to be completed within the next 12 months, the plan shall specify the actions the City will take to provide access to the programs for persons with disabilities during the time period prior to completion of such actions, including the dates by which such actions will be taken.  If the City chooses to retain use and operation of this facility at the time of the completion of the Capital Improvement Program, then the City will make the following modifications to the above facility within 2 years of the completion of the Public Safety Complex. 

 

A.                Passenger Loading Zone

 

i.                     The passenger loading zone is inaccessible because there are no markings to prevent a parked vehicle from blocking the loading zone and curb cut.  Provide a passenger loading zone on an accessible route such that the loading zone has a vertical clearance of at least 114 inches, has an access aisle at least 60 inches wide and 20 feet long adjacent and parallel to the vehicle pull-up space, and has a surface that is firm, stable, slip-resistant, and level with no more than a 1:50 slope in all directions.  Standards ' 4.6.6.

 

B.                 Information Counter

 


i.                     The information counter on the second floor is inaccessible because it is 41 inches above the finished floor.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards '' 7.2(2), 4.3.

 

C.                Drinking Fountain

 

i.                     Although an accessible drinking fountain is provided on the first floor, there is no drinking fountain provided for people who have difficulty bending or stooping.  Provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards ' 4.1.3(10)(a).

 

ii.            Although a drinking fountain accessible to people who have wheelchairs is provided on the second floor, there is no drinking fountain provided for people who have difficulty bending or stooping.  Provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards ' 4.1.3(10)(a).           

 

D.                Elevator

 

i.                     The elevator is inaccessible because no hall lanterns have been provided.  Provide hall lanterns at each hoistway entrance that emit a visible and audible signal indicating which car is answering a call.  Provide audible signals that sound once for the up direction and twice for the down direction or have verbal annunciators that say Aup@ or Adown;@ and that visible signals are mounted so that their centerline is at least 72 inches above the lobby floor, they are at least 22 inches in the smallest dimension, and they are visible from the vicinity of the hall call button.  Lanterns located in cars, visible from the vicinity of hall call buttons, and conforming to the above requirements, are acceptable.  Standards ' 4.10.4, Fig. 20.

 


ii.                   The elevator is inaccessible because the car control buttons do not have raised or Braille characters.  Provide car control buttons that are at least : inch in their smallest dimension and are raised or flush and that are designated by Braille and by raised standard alphabet characters for letters, arabic characters for numerals, or standard symbols.  Provide a call button for the main entry floor that is designated by a raised star at the left of the floor designation; that all raised designations for control buttons are placed immediately to the left of the buttons to which they apply; that floor buttons are provided with visual indicators to show when each call is registered and are extinguished when each call is answered; that all floor buttons are no higher than 54 inches above the finished floor for a side approach and no more than 48 inches above the finished floor for a front approach; and that emergency controls, including the emergency alarm and emergency stop, are grouped at the bottom of the panel and have their centerlines no less than 35 inches above the finished floor.  Standards ' 4.10.12, Fig. 23.

 

E.                 Men=s Toilet Room located on the First Floor

 

i.                     No accessible toilet room sign has been provided.  Provide a toilet room sign at toilet each room with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

ii.                   The door is inaccessible because the pressure required to open the door is 9 pounds.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

iii.                  The soap dispenser is inaccessible because the controls are mounted at 54 inches above the finished floor for a front approach.  Provide a soap dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4,  4.2.5, 4.2.6.

 

iv.                 The lavatory is inaccessible because the hot water pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.

 

v.                   The lavatory is inaccessible because it has twist type controls.  Provide a lavatory with a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards '' 4.19.5, 4.27.4.

 


vi.                 The urinal is inaccessible because its rim is 24 inches above the finished floor and the flush control is 54 inches above the finished floor.  Provide a urinal with an elongated rim mounted 17 inches or less above the finished floor, a clear floor space of at least 30 inches wide and 48 inches deep centered on the urinal, and a flush control height of 44 inches or less above the finished floor.  Standards '' 4.18.2, 4.18.3, 4.18.4.

v.                   The urinal is inaccessible because its rim is 24 inches above the finished floor and the flush control is 54 inches above the finished floor.  Provide a urinal with an elongated rim mounted 17 inches or less above the finished floor, a clear floor space of at least 30 inches wide and 48 inches deep centered on the urinal, and a flush control height of 44 inches or less above the finished floor.  Standards '' 4.18.2, 4.18.3, 4.18.4.

i.                     Visitor Parking

 

a.                   Although the parking lot has a total of 5 parking spaces, none are van accessible.  On the shortest accessible route to the accessible entrance, provide at least one van accessible space a minimum of 96 inches wide, served by access aisles at least 96 inches wide, with vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles, and with an additional AVan-Accessible@ sign  located below the International Symbol of Accessibility.  Standards '' 4.1.2(5)(b), 4.6, 4.30.7(1).

 


b.            The parking spaces reserved for people with disabilities are inaccessible because the access aisles are 30 inches wide.  At each standard accessible space, provide an access aisle at least 60 inches wide.  At each van accessible space, provide an access aisles at least 96 inches wide.  Provide access aisles that are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6.3, Fig. 9.

 

ii.                   Visitor Exterior Entrance

 

a.                   The visitor entrance is inaccessible because there is a 4 inch change in level at the threshold to the door.  Provide an accessible door with a threshold that is no greater than 3 inch, or is no greater than 2 inch and is beveled with a slope no greater than 1:2.  Standards '' 4.13.8, 4.5.2.           

 

iii.            Holding Cell

 

b.                  The cell designated for people with disabilities is inaccessible to people who use wheelchairs.  Provide a door with a minimum clear opening width of at least 32 inches measured from the face of door to the opposite door stop with the door open 90 degrees.  Provide a bed that is mounted 17-19 inches above the finished floor, that has maneuvering space of at least 36 in (915 mm) wide along one side, and that otherwise allows a person using a wheelchair to make a parallel transfer onto the bed.  Also, provide at least one accessible toilet facility within the cell that complies with the Standards and if appropriate, one bathing facility that complies with the Standards.  Privacy screens, if applicable, shall not intrude on the clear floor space required for fixtures and the accessible route.  Standards '' 4.13.5 & Fig. 24, 4.22, 4.23, 4.35.4.

 

iv.            Inmate Telephone

 


a.            The inmate telephone is inaccessible because the coin slot is 60 inches above the finished floor.  Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards.  Standards '' 4.31, 4.30.7(2).

 

b.            Although there are inmate telephones provided, no TTY has been provided.  Provide at least one accessible public TTY with appropriate signage.  Standards '' 4.30.7(3), 4.31.9.

 

34.              The City will make the following modifications to the Pope Park Pool and Bathhouse located at 338 Park Terrace, within 9 years of the effective date of this Agreement:

 

A.                Men=s Locker Room

 

i.                     No accessible locker room sign has been provided.  Provide a locker room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

iv.                 The urinal is inaccessible because its rim is 20 inches above the finished floor and its flush control is 51 inches above the finished floor.  Provide a urinal with an elongated rim mounted 17 inches or less above the finished floor, a clear floor space of at least 30 inches wide and 48 inches deep centered on the urinal, and a flush control height of 44 inches or less above the finished floor.  Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.5, 4.18.2, 4.18.3, 4.18.4.

vii.                No  accessible dressing room has been provided.   Provide at least one accessible dressing room fitted with curtained openings at least 32 inches wide contain either a clear space of 60 inches in diameter, or a AT@ shaped turning space that complies with Fig. 3(b).  Provide a bench 24 inches by 48 inches fixed to the wall along the longer dimension and mounted between 17 and 19 inches above the finished floor to the top of the bench.  If mirrors are provided in dressing rooms of the same use, provide one full-length mirror, measuring at least 18 inches wide by 54 inches high, mounted in a position affording a view to a person on the bench as well as to a person in a standing position.  Standards '' 4.1.3(21), 4.1.6(1)(b), 4.35, 4.30, 4.26.3, 4.2, 4.3, Fig. 3.

 

viii.              The benches lack sufficient width and are not fixed to the wall.  Provide a 24 inch by 48 inch bench fixed to the wall along the bench=s longer dimension.  Provide a bench that has sufficient structural strength and is mounted with its surface between 17 inches and 19 inches above the finished floor.  Provide clear floor space alongside the bench to allow a person using a wheelchair to make a parallel transfer onto the bench.  Standards '' 4.1.3(21), 4.1.6(1)(b), 4.35.4, 4.26.3.

 

C.                Men=s Single-User Toilet Room located in the Men=s Locker Room

35.              The City will make the following modifications to the Public Works Yard located at the 40 Jennings Road, within 3 years of the effective date of this Agreement:

 

A.                Parking

 

i.                     Although the parking lot has a total of 30 parking spaces, none are van accessible.  On the shortest accessible route to the accessible entrance, provide at least one van accessible space a minimum of 96 inches wide, served by access aisles at least 96 inches wide, with vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles, and with an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Standards '' 4.1.2(5)(b), 4.6, 4.30.7(1).

 


ii.            The parking spaces reserved for people with disabilities are inaccessible because the access aisles are 30 inches wide.  At each standard accessible space, provide an access aisle at least 60 inches wide.  At each van accessible space, provide an access aisles at least 96 inches wide.  Provide access aisles that are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6.3, Fig. 9.

 

B.                 Accessible Route

 

i.                     The route from the parking area at the side of the building to the side entrance is inaccessible because there is no curb ramp provided.  Provide a curb ramp that is at least 36 inches wide, has a maximum slope of 1:12, is located so that it cannot be obstructed by parked vehicles, and has a stable, firm, and slip-resistant surface with a detectable warning extending the full width and depth of the ramp.  If the curb ramp is located where pedestrians must walk across it, provide either flared sides (with a maximum slope of 1:10) or handrails or guardrails to protect against cross traffic.  Standards ' 4.3.8, 4.7, Fig. 12.

 

C.                Directional Signage

 

i.                     There is no signage directing people with disabilities at the inaccessible front entrance directing people to the designated accessible side entrance.  Provide accessible directional signage with the International Symbol of Accessibility at the inaccessible entrance directing users to the accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances.  Standards '' 4.1.3(8)(d), 4.1.3(16)(b), 4.1.6(1)(b), 4.13, 4.30.

 

D.                Exterior Entrance Door

 

i.                     The designated accessible side entrance door is inaccessible because it has knob hardware.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13, Figs. 24, 25.

 

ii.                   The designated accessible side entrance door, which is exited through a front approach, has no push side maneuvering clearance on the latch side of the door.  On the push side of the door, provide maneuvering clearance at least 48 inches deep and provide a minimum of 12 inches of maneuvering clearance on the latch side of the door, or remove the closer or the latch.  Standards ' 4.13.6, Fig. 25(a).

 

E.                 Interior Entrance Door

 


i.                     The interior entrance door, which is accessed through a front approach, is inaccessible because there is a vending machine that encroaches on the required maneuvering clearance.  On the push side of the door, provide maneuvering clearance at least 48 inches deep and provide a minimum of 12 inches of maneuvering clearance on the latch side of the door, or remove the closer or the latch.  Standards ' 4.13.6, Fig. 25(a).           

 

37.              The City will make the following modifications to the Rocky Ridge Park located at Zion Street, within 2 years of the effective date of this Agreement:

 

A.                Parking

 

i.                     No parking spaces designated as reserved for people with disabilities have been provided.  On the shortest accessible route to the park, provide one van accessible space designated as reserved for people with disabilities.  Provide van accessible spaces that are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for people with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Provide spaces and access aisles for people with disabilities that are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).
