Attachment K: Program Access in Existing Facilities

 

Please Note: Paragraph 38 of the Agreement requires that within three months of the effective date of this Agreement, the city will provide signage as necessary to comply with 28 C.F.R. ' 35.163(b), after having surveyed all facilities that are the subject of this Agreement for the purpose of identifying those that have multiple entrances not all of which are accessible.

                                                                             

1.                  The technical requirements and, where appropriate, the scoping requirements of the Standards are used as a guide for determining whether a program or activity held in an existing facility is Areadily accessible to and usable by@ persons with disabilities and for determining what changes are necessary to make this program or activity accessible if it continues to be provided in the existing facility in question.  See 28 C.F.R. '' 35.150(b)(1), 35.151.

 

2.                  In order to ensure that each of the City programs, services, and activities operating at a facility that is the subject of this Agreement, when viewed in its entirety, are readily accessible to and usable by persons with mobility impairments, the City will take the following actions:

 

3.                  Aetna Park Pavilion, located at 4265 East 11th Avenue, has numerous barriers to access for persons with disabilities.  Within 48 months of the effective date of this Agreement, the City will post signs at Aetna Park Pavilion and will otherwise inform the public (including an informational posting on its website) that it is providing equivalent accessible facilities and recreation programs at Glen Ryan Park, located nearby this facility.                   

 

4.                  Within 24 months of the effective date of this Agreement, the City will complete the following modifications to the Ark Shelter:

 


a.                   Entrance Ramp:  The entrance ramp is inaccessible because there is an abrupt 2 to 4 inch high edge at the bottom of the ramp, and the handrails are 28 inches above the walking surface.  Provide a ramp that is at least 36 inches wide and has a slope not exceeding 1:12 and a cross slope not exceeding 1:50.  Provide level landings at the top and bottom of the ramp that are at least as wide as the ramp and at least 60 inches long.  If the ramp changes direction, provide a level landing measuring at least 60 inches by 60 inches at the change in direction.  On both sides of the ramp, provide handrails between 13 inches and 12 inches in diameter with a continuous gripping surface.  Ensure that the handrails extend at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface, that they are mounted between 34 inches and 38 inches above the ramp surface, that they will not rotate within their fittings, and that they have ends that are rounded or return smoothly to floor, wall, or post.  Provide edge protection that is at least 2 inches high at the ramp=s drop off sides.  Ensure that the ramp and its level landing at the top and bottom are designed and maintained so that water does not accumulate on walking surfaces.  Standards '' 4.3.8, 4.8.

 

b.                  The building has three floors, and there is no accessible route to the meeting and laundry rooms in the basement level.  Establish a procedure for providing access to programs in upper and lower levels of the facility or install ramps, platform lifts, or an elevator in compliance with the Standards.  Any procedure shall not require lifting or carrying persons with mobility impairments or require them to traverse unnecessary or extreme distances.  Standards '' 4.33.5, 4.3.8, 4.8, 4.11.

 

c.                   Signage:  Permanent room signs do not have raised and Braille characters and are not mounted 60 inches above the finished floor on the latch side of the door.  Provide permanent room signage with upper case, sans serif or simple serif type letters and numerals, meeting the requirements of the Standards for character height, raised characters, finish and contrast, accompanied by Grade 2 Braille; mounted on the wall adjacent to the latch side of the door or on the nearest adjacent wall at a height of 60 inches above the finished floor to the centerline of the sign; and located so that a person may approach within 3 inches of the signage without encountering protruding objects or standing within the swing of a door.  Standards '' 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

d.                  Designated Accessible Apartment #104

 

i.                     The sign to the apartment lacks the International Symbol of Accessibility.  Provide permanent room signage with upper case, sans serif or simple serif type letters and numerals, meeting the requirements of the Standards for character height, raised characters, finish and contrast, accompanied by Grade 2 Braille; mounted on the wall adjacent to the latch side of the door or on the nearest adjacent wall at a height of 60 inches above the finished floor to the centerline of the sign; and located so that a person may approach within 3 inches of the signage without encountering protruding objects or standing within the swing of a door.  Standards '' 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

ii.                   The maneuvering space on the pull side of door is obstructed by a photocopy machine, leaving only 13 inches of maneuvering clearance on the pull side.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards ' 4.13.6, Fig. 25(a).


 

iii.                  The route to the kitchen sink is inaccessible because it is only 24 inches wide between the counter and refrigerator.  Provide an accessible route to the kitchen sink with a minimum clear width of 36 inches, except at doors, where the width may decrease to 32 inches.  Standards '' 4.3.3, 4.13.5.

 

iv.                 The entrance door to the toilet room, a sliding door accessed through a front approach, is inaccessible because the door recesses into the wall, and the outer latch requires tight pinching.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.   Standards ' 4.13.6, Fig. 25(d).

 

v.                   No accessible mirror is provided in the toilet room.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards ' 4.19.6. 

 

vi.                 The lavatory in the toilet room is inaccessible because faucet operation requires twisting of the wrist.  Provide a lavatory with a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards '' 4.19.5, 4.27.4.

 

vii.                The lavatory in the toilet room is inaccessible because the hot water pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.

 

viii.              The toilet centerline is 30 inches from the side wall.  Provide side and rear grab bars to ensure that the toilet centerline measures 18 inches from the side grab bar.  Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall, and a side grab bar that is at least 42 inches in overall length, with the far end mounted at least 54 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Ensure that the grab bars are mounted 33 to 36 inches above the finished floor; with a diameter between 13 and 12 inches; with 12 inches between the grab bars and the wall; and at least 12 inches between the grab bars and any other object, such as a toilet paper dispenser or a toilet seat cover dispenser.  Standards '' 4.16.2, 4.16.4, 4.26.2, Fig. 28, 29.


 

e.                   Playground

 

i.                     There is no accessible route to the playground.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

ii.                   None of the play equipment is usable by children with disabilities.  Ensure program access by providing at least one piece of play equipment that is on an accessible route and has a transfer platform to enable children who use wheelchairs to use it.

 

 

5.                  Within 60 months of the effective date of this Agreement, the City will complete the following modifications to the Borman Square Park, 750 Madison Street:

 

a.                   Parking:  Although the parking lot has a total of 30 to 40 parking spaces, the spaces are not demarcated, and there are no spaces designated as reserved for persons with disabilities.  On the shortest accessible route to the accessible entrance, provide 1 van accessible space and 1 standard space designated as reserved for people with disabilities.  Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 


b.                  Accessible Route From the Parking Lot to Pavilion Building:  No curb cut or built-up curb ramp is provided to the sidewalk adjacent to the parking lot.  Provide a curb ramp that is at least 36 inches wide, has a maximum slope of 1:12, is located so that it cannot be obstructed by parked vehicles, and has a stable, firm, and slip-resistant surface with a detectable warning extending the full width and depth of the ramp.  If the curb ramp is located where pedestrians must walk across it, provide either flared sides (with a maximum slope of 1:10) or handrails or guardrails to protect against cross traffic.  Standards ' 4.3.8, 4.7, Fig. 12.           

 

c.                   Accessible Route to Basketball Court:  The route to the basketball court is inaccessible because the only route is via stairs.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

d.                  Ramp to Pavilion Entrance:  The ramp is inaccessible because it does not have handrails.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface and 12 inches from the wall, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards ' 4.8.5.

 

e.                   Drinking fountain:  Although one drinking fountain is provided, it is not accessible because the spout height is 45 inches above the finished floor, and the water flow is 3 2 inches from the front edge of the fountain.  Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Ensure that fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.   Standards '' 4.15, 4.27.4, Fig. 27.


 

f.                    Women=s Toilet Room with Stalls:  The women=s toilet room contains a number of inaccessible elements and is not accessible to people with disabilities.  Provide an accessible toilet room such that all of the room=s elements, including signage, door, door hardware, clear floor space, water closet, stall size and arrangement, stall door, urinal (if provided), grab bars, lavatory, mirror, controls, and dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.18, 4.19, 4.26, 4.27, 4.30, Fig. 30. (The door is 27 inches wide; the opening pressure of the door is 6 pounds; there are only 4 inches of maneuvering clearance on the pull side of the door; there is inadequate turning space in the room; the bottom edge of the lavatory apron is 27 2 inches above the finished floor; the hot pipes on the lavatory are not protected against contact; the lavatory hardware requires twisting of the wrist; and there are no stalls accessible to wheelchair users.)

 

g.                   Men=s Toilet Room with Stalls: The men=s toilet room contains a number of inaccessible elements and is not accessible to people with disabilities.  Provide an accessible toilet room such that all of the room=s elements, including signage, door, door hardware, clear floor space, water closet, stall size and arrangement, stall door, urinal (if provided), grab bars, lavatory, mirror, controls, and dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.18, 4.19, 4.26, 4.27, 4.30, Fig. 30.  (The door is 27 inches wide;  there are only 7 inches of maneuvering clearance on the pull side of the door; the bottom edge of the lavatory apron is 26 inches above the finished floor; the hot pipes on the lavatory are not protected against contact; the lavatory hardware requires twisting of the wrist; and there are no stalls accessible to wheelchair users)

 

h.                   Women=s Locker Room:  The locker room contains a number of inaccessible elements and is not accessible to people with disabilities.  Provide an accessible locker room such that all of the room=s elements, including signage, door, door hardware, clear floor space, water closet, stall size and arrangement, stall door, urinal (if provided), grab bars, lavatory, mirror, controls, and dispensers, showers, dressing rooms or areas, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.18, 4.19, 4.21, 4.23, 4.26, 4.27, 4.30, Fig. 30, Fig. 35, Fig. 36, Fig. 37.  (There are only 6 inches of maneuvering clearance on the pull side of the entrance door; the mirror is mounted at 46 inches above the finished floor; there is inadequate knee and toe clearance at the lavatory; there is inadequate clear floor space centered on the lavatory; there are no stalls accessible to wheelchair users; there are no showers accessible to wheelchairs users; and the locker room benches are only 10 inches in width and do not have sufficient clear floor space to approach or use.)

 


i.                     Men=s Locker Room:  The locker room contains a number of inaccessible elements and is not accessible to people with disabilities.  Provide an accessible locker room such that all of the room=s elements, including signage, door, door hardware, clear floor space, water closet, stall size and arrangement, stall door, urinal (if provided), grab bars, lavatory, mirror, controls, and dispensers, showers, dressing rooms or areas, comply with the Standards.   '' 4.13, 4.16, 4.17, 4.18, 4.19, 4.21, 4.23, 4.26, 4.27, 4.30, Fig. 30, Fig. 35, Fig. 36, Fig. 37.      (There are only 6 2 inches of maneuvering clearance on the pull side of the entrance door; there is inadequate knee and toe clearance at the lavatory; there is inadequate clear floor space centered on the lavatory; there are no stalls accessible to wheelchair users; there are no showers accessible to wheelchairs users; and the locker room benches are only 9 2 inches in width and do not have sufficient clear floor space to approach or use.)

 

 

6.                  Within 60 months of the effective date of this Agreement, the City will complete the following modifications to the Brunswick Center Park, 775 Clark Road:

 

g.                   Parking Next to Building:  Although there are 54 parking spaces, there is no van accessible space, the two spaces lack an access aisle, and the vertical signage is low and may be obstructed by parked cars.  On the shortest accessible route to the accessible entrance, provide one van accessible space and one standard space designated as reserved for people with disabilities.  Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

b.                  Exterior Entrances

 

i.                     There is no signage directing the public to or designating accessible entrances.  Provide accessible directional signage with the International Symbol of Accessibility at inaccessible entrances directing users to the accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances.  Standards '' 4.1.3(8)(d), 4.13, 4.30.                    

 


ii.                   The entrance width is 30 2 inches. Provide a designated accessible entrance with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop.  Standards ' 4.13.5, Fig. 24.

 

c.                   Drinking Fountain:  The drinking fountain near the front entrance is inaccessible because the spout is 46 inches above the finished floor.  Provide a fountain that has a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet, and that otherwise complies with the Standards.  Standards '' 4.15, 4.27.4, Fig. 27.

 

d.         Women=s Locker Room

 

i.                     The sign to the locker room is 66 inches above the finished floor, is not mounted on the latch side of the door, and lacks raised and Braille characters.  Provide a toilet room sign with raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

ii.                   The entrance door to the women=s locker room is inaccessible because it is 29 inches wide.   Provide a door with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop.  Standards ' 4.13.5, Fig. 24.

 

iii.                  The locker room entrance door, which is accessed through a front approach, has inadequate maneuvering clearance on the pull side.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards ' 4.13.6, Fig. 25(a).            

 

iv.                 No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards ' 4.19.6.

 


v.                   The air dryer is mounted at 45 inches above the finished floor, extends 9 inches into the path of travel, and is therefore a protruding object that a blind person using a cane would be unable to detect.  Provide an air dryer  such that its bottom leading edges measure no more than 27 inches above the finished floor or protrude no more than 4 inches into the walkway.  Standards ' 4.4.

 

vi.                 The lavatory pipes are not covered or configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.

 

vii.                The toilet stall is configured as an alternate configuration stall, with partitions 36 inches wide and parallel side grab bars, but no rear grab bar.  Provide a Astandard@ accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall=s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

 

viii.              No accessible shower is provided.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards ' 4.21, Figs. 35, 36, 37.

 

e.                   Men=s Locker Room

 

i.                     The sign to the locker room is 66 inches above the finished floor, is not mounted on the latch side of the door, and lacks raised and Braille characters.  Provide a toilet room sign with raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.                    

 

ii.                   The locker room entrance door is inaccessible because it has an opening width of only 29 inches.  Provide a door with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop.  Standards ' 4.13.5, Fig. 24.


 

iii.                  The pressure required to open the door is 10 pounds of force.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

iv.                 The entrance door, which is accessed from the latch side of the door, is has only 10 inches maneuvering clearance.  On the pull side of the door, provide a path of travel at least 48 inches wide for a side approach and at least 24 inches of clear maneuvering space adjacent to the latch side of the door.  Standards ' 4.13.6, Fig. 25(c).

 

v.                   No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards ' 4.19.6.

 

vi.                 The bottom leading edge of the air dryer is 54 inches above the finished floor, extends 9 inches into the path of travel, and is therefore a protruding object that cannot be detected by a blind person using a cane.  Provide an air dryer such that its bottom leading edges measure no more than 27 inches above the finished floor or protrude no more than 4 inches into the walkway.  Standards ' 4.4.

 

vii.                The lavatory pipes are not covered or configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.         

 

viii.              The toilet stall is configured as an alternate configuration stall, with partitions 36 inches wide and parallel side grab bars, but no rear grab bar.  Provide a Astandard@ accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall=s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

 


ix.                 No accessible shower is provided.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards ' 4.21, Figs. 35, 36, 37.

 

f.                    Tennis Court Parking:  Although there are six parking spaces, none are designated as reserved for persons with disabilities.  On the shortest accessible route to the accessible entrance, provide one van accessible space designated as reserved for people with disabilities.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

g.                   Accessible Route from Tennis Parking Tennis Courts

 

i.                     There is no accessible route to the tennis courts because there is a 3 inch rise surrounding them.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 


ii.                   The route from the tennis court parking to the tennis courts is inaccessible because the slope of the flared sides of the curb ramp exceed 1:10.  Provide a curb ramp that is at least 36 inches wide, has a maximum slope of 1:12, is located so that it cannot be obstructed by parked vehicles, and has a stable, firm, and slip-resistant surface with a detectable warning extending the full width and depth of the ramp.  If the curb ramp is located where pedestrians must walk across it, provide either flared sides (with a maximum slope of 1:10) or handrails or guardrails to protect against cross traffic.  Standards ' 4.3.8, 4.7, Fig. 12.

 

h.         Accessible Route to Basketball Court:  No accessible route is provided because there is no paved or level route to the court.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

i.                     Baseball Field

 

i.                     Drinking Fountain:  The fountain is not detectable to a blind person using a cane.  Provide a high drinking fountain at this location such that its bottom leading edges measure no more than 27 inches above the finished floor or protrude no more than 4 inches into the walkway.  Standards ' 4.4.fountain is a protruding object.    

 

ii.                   Concessions Counter:  The concessions counter is 40 inches above the ground surface.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor.  Standards '' 7.2(1), 4.3.

 

iii.                  Seating:  No designated wheelchair seating is provided.  Provide the required number of designated wheelchair seating areas, in compliance with Table 4.1.3(19)(a) in the Standards, each with a minimum clear ground or floor space of 66 inches wide by 48 inches deep for forward or rear access, or 66 inches wide by 60 inches deep for side access.  Ensure that the ground or floor at all wheelchair locations is level, firm, stable, and slip resistant; that wheelchair seating areas are an integral part of the fixed seating plan and are located so as to provide people with physical disabilities a choice of admission prices and lines of sight comparable to those available for members of the general public; that wheelchair seating areas adjoin an accessible route that also serves as a means of egress in case of emergency; and that at least one fixed companion seat is provided next to each wheelchair seating area.  Standards '' 4.1.3(19)(a), 4.5, 4.33.

 


j.                    Children=s Play Area

 

i.                     There is no accessible route to the playground.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

ii.                   None of the play equipment is usable by children with disabilities.  Ensure program access by providing at least one piece of play equipment that is on an accessible route and has a transfer platform to enable children who use wheelchairs to use it.

 

k.         Picnic Shelters:  No accessible route is provided to the picnic shelters.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

7.                  Carolina Park, located at 1395 Carolina Street, has numerous barriers to access for persons with disabilities.  Within 72 months of the effective date of this Agreement, the City will post signs at Carolina Park and will otherwise inform the public (including an informational posting on its website) that it is providing equivalent accessible facilities and recreation programs at Washington Park, located nearby this facility.

 

 


8.                  Within 12 months of the effective date of this Agreement, the City will complete the following modifications to City Hall, 401 Broadway:

 

a.                   Ramp to Accessible Entrance:  The handrails are less than 36 inches above the ground surface, lack extensions that comply with the standards and there are 2 inches between the handrails and the wall.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards '' 4.1.2(1), 4.1.2(2), 4.1.6(1)(b), 4.8.5.

 

b.                  Exterior Entrances:  The inaccessible entrances lack signage directing persons with disabilities to the accessible entrance.  Provide accessible directional signage with the International Symbol of Accessibility at inaccessible entrances directing users to the accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances.  Standards '' 4.1.3(8)(d), 4.1.3(16)(b), 4.1.6(1)(b), 4.13, 4.30.

 

c.                   Signage:  The permanent room signs do not have raised and/or Braille characters, are not mounted at 60 inches above the finished floor, and are not mounted on latch side of door.  Provide permanent room signage with upper case, sans serif or simple serif type letters and numerals, meeting the requirements of the Standards for character height, raised characters, finish and contrast, accompanied by Grade 2 Braille; mounted on the wall adjacent to the latch side of the door or on the nearest adjacent wall at a height of 60 inches above the finished floor to the centerline of the sign; and located so that a person may approach within 3 inches of the signage without encountering protruding objects or standing within the swing of a door.  Standards '' 4.1.2(7), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

d.                  Offices and Counters

 

i.                     Main information counter, First Level:  The counter is 41inches above the finished floor and no equivalent facilitation is provided. Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards '' 4.1.1(2), 4.1.6(1)(b), 7.2(2), 4.1.3(1), 4.3.


 

ii.                   Human Resources, Room 105

 

(1)               The pressure required to open the door is 16 pounds of force.  Provide a door that requires no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

 

(2)               The door has knob hardware which requires tight grasping, pinching or twisting of the wrist to operate.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.9.

 

(3)               The door, which is accessed through a front approach, has a moveable obstruction encroaching on the maneuvering space on the latch/pull side.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.6, Fig. 25(a).

 

iii.                  Finance Department:  The counter is 43 inches above the finished floor and equivalent facilitation is not provided. Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards '' 4.1.1(2), 4.1.6(1)(b), 7.2(2), 4.1.3(1), 4.3.

 

iv.                 Common Council Offices, Second Floor:  The door has knob hardware which is not usable with one hand without tight grasping, pinching or twisting of the wrist.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.9.

 


v.                   Zoning Department, Room 304:  The counter is 44 inches above the finished floor and equivalent facilitation is not provided. Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards '' 4.1.1(2), 4.1.6(1)(b), 7.2(2), 4.1.3(1), 4.3.

 

vi.                 Building Department, Room 307:  The counter is 43 inches above the finished floor and equivalent facilitation is not provided. Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards '' 4.1.1(2), 4.1.6(1)(b), 7.2(2), 4.1.3(1), 4.3.

 

e.                   Drinking Fountains: The first floor fountain near the Finance Department office and the third floor drinking fountain are not detectable to a blind person using a cane.  At each location, provide a high drinking fountain at this location such that its bottom leading edges measure no more than 27 inches above the finished floor or protrude no more than 4 inches into the walkway.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

 

f.                    Elevator

 

i.                     No audible signals are provided.  Ensure that audible signals sound once for the up direction and twice for the down direction or have verbal annunciators that say Aup@ or Adown.@ Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.4, Fig. 20.

 

ii.                   No hoistway signage is provided.  Provide signage at hoistway entrances with raised and Braille floor designations on both jambs such that the centerline of the characters is 60 inches above the finished floor and the characters are 2 inches high.  Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.5, Fig. 20.

 


iii.                  The elevator doors remain open for less than 5 seconds after notification before doors begin to close and they do not remain fully open for a minimum of 3 seconds after a car call.  Provide doors that open and close automatically with a reopening device that will stop and reopen the car door and hoistway door automatically if the door becomes obstructed by an object or person.  Ensure that the device is capable of completing these operations without requiring contact for obstructions passing through the opening at heights of 5 inches and 29 inches above the finished floor; that door reopening devices remain effective for at least 20 seconds, after which the doors may close; that the minimum time from notification that a car is answering a call until the doors of that car start to close is 5 seconds; and that the minimum time for elevator doors to remain fully open in response to a car call is 3 seconds.  Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.6, 4.10.7, 4.10.8, Figs. 20, 21.

 

iv.                 The elevator control buttons do not have Braille or raised characters and the main entry floor button is not designated by raised star.  Provide car control buttons that are at least : inch in their smallest dimension and are raised or flush and that are designated by Braille and by raised standard alphabet characters for letters, arabic characters for numerals, or standard symbols.  Ensure that the call button for the main entry floor is designated by a raised star at the left of the floor designation; that all raised designations for control buttons are placed immediately to the left of the buttons to which they apply; that floor buttons are provided with visual indicators to show when each call is registered and are extinguished when each call is answered; that all floor buttons are no higher than 54 inches above the finished floor for a side approach and no more than 48 inches above the finished floor for a front approach; and that emergency controls, including the emergency alarm and emergency stop, are grouped at the bottom of the panel and have their centerlines no less than 35 inches above the finished floor.  Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.12, Fig. 23.

 

v.                   Emergency control panels are not grouped at the bottom; they are grouped at a height of 60 inches above the finished floor.  Provide emergency controls, including the emergency alarm and emergency stop, grouped at the bottom of the panel with their centerlines no less than 35 inches above the finished floor.  Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.12, Fig. 23.

 


vi.                 The car position indicators do not ring as the car passes or stops on floors.  Provide visual car position indicators above the car control panel or over the door to show the position of the elevator in the hoistway.  Ensure that indicators emit an audible and visual signal as the car passes or stops at a floor served by the elevator, with the corresponding floor designation being illuminated; and that numerals are a minimum of 2 inch high.  Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.13.

 

g.                   Council Chambers

 

i.                     The door entrance is 28 inches wide.  Provide a door with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.5, Fig. 24.

 

ii.                   The pressure required to open the door exceeds five pounds of force.  Provide a door that requires no more than 5 pounds of force to open.  Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

 

iii.                  Wheelchair seating is only provided in the aisle between the assembly benches in the path of travel.  Provide wheelchair seating areas, each with a minimum clear ground or floor space of 66 inches wide by 48 inches deep for forward or rear access, or 66 inches wide by 60 inches deep for side access.  Ensure that the ground or floor at all wheelchair locations is level, firm, stable, and slip resistant; that wheelchair seating areas are an integral part of the fixed seating plan and are located so as to provide people with physical disabilities a choice of lines of sight comparable to those available for members of the general public; that wheelchair seating areas adjoin an accessible route that also serves as a means of egress in case of emergency; and that at least one fixed companion seat is provided next to each wheelchair seating area.  Standards '' 4.1.3(19)(a), 4.1.6(1)(b), 4.5, 4.33.

 

iv.                 There is no signage informing the public of the availability of an assistive listening system.  Provide accessible signage indicating the availability of the assistive listening system.  28 C.F.R. 35.160; Standards '' 4.1.3(19)(b), 4.1.6(1)(b), 4.30.

 

h.                   Basement Women=s Toilet Room with Stalls (Existing)

 


i.          There is no signage directing people with disabilities to the accessible toilet rooms.  Provide accessible directional signage with the International Symbol of Accessibility at inaccessible toilet rooms indicating the location of the nearest accessible toilet room, and provide accessible signage with the International Symbol of Accessibility at all accessible toilet rooms.  Standards '' 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

 

i.                     Second Floor Women=s Toilet Room with Stalls

 

i.                     The toilet room sign is mounted on the door.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

ii.                   The pressure required to open the door is 7 pounds of force.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

iii.                  The entrance door to the toilet room, which is accessed through a front approach, is inaccessible because it has only 9 inches maneuvering clearance on the latch/pull side of the door.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards ' 4.13.6, Fig. 25(a).

 

iv.                 The light switch is more than 54 inches above the finished floor.  Provide a light switch with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

v.                   The seat cover dispenser is 62 inches above the finished floor.  Provide a seat cover dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 


vi.                 The paper towel dispenser requires tight grasping, pinching or twisting of the wrist to operate.  Provide a paper towel dispenser with mechanical controls, if any, that can be operated with 5 lbf or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards ' 4.27.4.

 

vii.                The sanitary napkin dispenser is 40 inches above the finished floor, extends more than 7 inches into the path of travel and is, therefore, a protruding object that a blind person using a cane would not be able to detect.  Provide a sanitary napkin dispenser such that its bottom leading edges measure no more than 27 inches above the finished floor or protrude no more than 4 inches into the walkway.  Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

 

viii.              The hot water pipes of the lavatory are not covered or configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.

 

ix.                 The clear floor space in the standard accessible toilet stall is 54 inches deep.  Provide a toilet stall that is at least 60 inches wide and at least 56 inches deep for a wall-mounted toilet or at least 59 inches deep for a floor-mounted toilet, such that the centerline of the toilet is exactly 18 inches from the near side wall or partition, and there is at least 9 inches of toe clearance above the floor at the front partition if the stall is no more than 60 inches deep.  Standards ' 4.17, Fig. 30.

 

x.                   The toilet centerline is 19 inches from the side wall.  Provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards ' 4.17.3, Fig. 30.

 

xi.                 The toilet paper dispenser is mounted above the grab bar and its distance from the rear wall is 45 inches.  Provide a toilet paper dispenser that is mounted with its top at least 12 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.   Standards ' 4.17.3, Fig. 30(d).

 

xii.                The farther end of the side grab bar is 40 inches from the rear wall, and it is mounted 32 2 above the finished floor.  Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall; mounted 33 to 36 inches above the finished floor; with a diameter between 13 and 12 inches; with 12 inches between the grab bar and the wall; and at least 12 inches between the grab bar and any other object, such as the toilet paper dispenser.   Standards ' 4.17.6, Figs. 30(a), (d).

 


xiii.              The rear grab bar is mounted 32 inches above the finished floor. Provide a rear grab bar that is mounted between 33 and 36 inches above the finished floor.  Standards ' 4.17.6, Fig. 30.

 

j.                    Second Floor Men=s Toilet Room with Stalls

 

i.                     The toilet room sign is mounted on the door.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

ii.                   The pressure required to open the door is 14 pounds of force.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).

 

iii.                  The entrance door to the toilet room, which is accessed through a front approach, is inaccessible because it has only 8 inches maneuvering clearance on the latch/pull side of the door.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards ' 4.13.6, Fig. 25(a).

 

iv.                 The paper towel dispenser requires tight grasping, pinching or twisting of the wrist to operate.  Provide a paper towel dispenser with mechanical controls, if any, that can be operated with 5 lbf or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards ' 4.27.4.

 

v.                   The hot water pipes of the lavatory are not covered or configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.

 


vi.                 The clear floor space in the standard accessible toilet stall is 60 inches by 54 inches.  Provide a toilet stall that is at least 60 inches wide and at least 56 inches deep for a wall-mounted toilet or at least 59 inches deep for a floor-mounted toilet, such that the centerline of the toilet is exactly 18 inches from the near side wall or partition, and there is at least 9 inches of toe clearance above the floor at the front partition if the stall is no more than 60 inches deep.  Standards ' 4.17, Fig. 30.

 

vii.                No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

viii.              The toilet paper dispenser is mounted above the grab bar and is 46 inches from the rear wall.  Provide a toilet paper dispenser that is mounted with its top at least 12 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards ' 4.17.3, Fig. 30(d).

 

ix.                 The farther end of the side grab bar is 40 inches from the rear wall, and it is mounted 32 above the finished floor.  Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall; mounted 33 to 36 inches above the finished floor; with a diameter between 13 and 12 inches; with 12 inches between the grab bar and the wall; and at least 12 inches between the grab bar and any other object, such as the toilet paper dispenser.   Standards ' 4.17.6, Figs. 30(a), (d).

9.                  Within 24 months of the effective date of this Agreement, the City will complete the following modifications to the Fire Department Headquarters, 200 East 5th Avenue:

 

j.                    Parking:  Although there are 22 parking spaces, none are designated as reserved for persons with disabilities.  On the shortest accessible route to the accessible entrance, provide one van accessible space designated as reserved for people with disabilities.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

k.                  Fire Prevention and Other Services at This Location:  Provide program access to the programs and services at this location by developing procedures for serving people with disabilities.  Submit a copy of these procedures to the Department for approval.

 

10.              Within 24 months of the effective date of this Agreement, the City will complete the following modifications to Fire Station No. 8, 2800 West 5th Avenue:

 


k.                  Parking:  Although there are approximately 25 parking spaces, the parking area is gravel, there is no demarcation, and there are no spaces designated for people with disabilities.  On the shortest accessible route to the accessible entrance, provide one van accessible space designated as reserved for people with disabilities.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

l.                     The route to the entrance is gravel and is not firm, stable or slip-resistant.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

 

11.              Within 24 months of the effective date of this Agreement, the City will complete the following modifications to Fire Station No. 9, 761 Clark Road:

 

a.                   Parking:  Although there are approximately 5 parking spaces, there are no pavement markings and no spaces designated for people with disabilities.  On the shortest accessible route to the accessible entrance, provide one van accessible space designated as reserved for people with disabilities.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

b.                  Accessible Route

 

i.                     There is a bench which extends into the sidewalk, narrowing the route to the second (garage) entrance from the parking lot to 17 inches.  Provide an accessible route from parking to the second entrance with a minimum clear width of 36 inches, except at doors, where the width may decrease to 32 inches.  Standards '' 4.3.3, 4.13.5.


 

ii.                   The route to the second entrance is inaccessible because water and ice pools and forms in front of the entrance.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

c.                   Entrances:  There is a 1 inch threshold at each entrance.  Provide a door with a threshold no greater than 3 inch, or between 3 inch and 2 inch and beveled with a slope no greater than 1:2.  Standards '' 4.13.8, 4.5.2.

 

 

12.              Within 24 months of the effective date of this Agreement, the City will complete the following modifications to Fire Station No. 11, 8010 Indian Boundary:

 

a.                   Parking:  Although there are 20 parking spaces, there are no pavement markings and no space designated for people with disabilities.  On the shortest accessible route to the accessible entrance, provide one van accessible space designated as reserved for people with disabilities.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

 

13.              Within 24 months of the effective date of this Agreement, the City will complete the following modifications to Fire Station No. 13, 6012 West 26th Avenue:

 


a.                   Parking:  Although there are 28 parking spaces, including 2 spaces designated as reserved for persons with disabilities, there is no van accessible parking space and no vertical signage for the accessible spaces.  On the shortest accessible route to the accessible entrance, provide one van accessible space and one standard space designated as reserved for people with disabilities.  Standard accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Van accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  All spaces designated as reserved for people with disabilities shall have vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  Van accessible spaces shall have an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

b.                  Accessible Route: The curb cut is placed too close to the entrance, so there is not a level approach, the curb cut has a primary slope that is too steep, and the slope of the flared sides of the curb cut are too steep.  Provide a curb ramp that is at least 36 inches wide, has a maximum slope of 1:12, is located so that it cannot be obstructed by parked vehicles, and has a stable, firm, and slip-resistant surface with a detectable warning extending the full width and depth of the ramp.  If the curb ramp is located where pedestrians must walk across it, provide either flared sides (with a maximum slope of 1:10) or handrails or guardrails to protect against cross traffic.  Standards ' 4.3.8, 4.7, Fig. 12.

 

 

14.              Within 48 months of the effective date of this Agreement, the City will complete the following modifications to the Glen Ryan Park Pavilion, 4220 East 6th Avenue:

 

a.                   Accessible Route:  The route from the on-street parking to the entrances is not accessible because the surface is not firm, stable, or slip-resistant, the sidewalk is in disrepair, resulting in 3 inch edge in one area, and there is no curb cut or built-up curb ramp from the on-street parking onto the sidewalk adjacent to the pavilion.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.


 

b.                  Entrances: Although there are two exterior entrances, neither is accessible because they do not have level approaches, the thresholds are greater than 2 inch and are not beveled, and the door hardware requires tight grasping, pinching or twisting of the wrist to operate.  Provide a designated accessible entrance that has a minimum clear opening width of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop; that has either an automatic door operator or clear and level maneuvering clearance that complies fully with Fig. 25; and that has a threshold not exceeding 2 inch in height and beveled with a slope no greater than 1:2.  Ensure that all hardware and operating devices have shapes that are easy to grasp with one hand and do not require tight grasping, pinching or twisting of the wrist to operate; and that they are mounted no higher than 48 inches above the finished floor.  Standards ' 4.13, Figs. 24, 25.

 

 

15.              Within 48 months of the effective date of this Agreement, the City will complete the following modifications to Hatcher Park Pavilion, 21st Avenue and Missouri Street:

 

a.                   Parking:  Although there are approximately 50 parking spaces, the parking area lacks demarcation and there are no spaces designated as reserved for persons with disabilities.  On the shortest accessible route to the accessible entrance, provide one van accessible space and one standard space designated as reserved for people with disabilities.  Standard accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Van accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  All spaces designated as reserved for people with disabilities shall have vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  Van accessible spaces shall have an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 


b.                  Accessible Route:  There is no accessible route from the parking area to the sidewalk.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

16.              Within 72 months of the effective date of this Agreement, the City will complete the following modifications to Howe Park, 39th Avenue and Vermont Street:

 

q.                  Parking:  Although the parking area has approximately 30 to 40 spaces, the parking area lacks demarcation and there are no spaces designated as reserved for persons with disabilities.  On the shortest accessible route to the accessible entrance, provide one van accessible space and one standard space designated as reserved for people with disabilities.  Standard accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Van accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  All spaces designated as reserved for people with disabilities shall have vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  Van accessible spaces shall have an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

r.                    Accessible Route

 

i.                     The sidewalk is not level, firm, stable or slip resistant due to general disrepair and large clumps of grass growing in cracks in the concrete.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.                    

 


ii.                   The accessible route lacks curb cuts or built-up curb ramps.  Provide a curb ramp that is at least 36 inches wide, has a maximum slope of 1:12, is located so that it cannot be obstructed by parked vehicles, and has a stable, firm, and slip-resistant surface with a detectable warning extending the full width and depth of the ramp.  If the curb ramp is located where pedestrians must walk across it, provide either flared sides (with a maximum slope of 1:10) or handrails or guardrails to protect against cross traffic.  Standards ' 4.3.8, 4.7, Fig. 12.   

 

c.                   Entrances

 

i.                     Door hardware at both doors requires tight grasping, pinching or twisting of the wrist to operate.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

ii.                   The door thresholds are 1 inch high.  Provide a door with a threshold no greater than 3 inch, or between 3 inch and 2 inch and beveled with a slope no greater than 1:2.  Standards '' 4.13.8, 4.5.2.

 

 

17.              Within 72 months of the effective date of this Agreement, the City will complete the following modifications to the Hudson Campbell Fitness Center and Parks Department, 455 Massachusetts:  

 

r.                    Parking:  Although there are 26 parking spaces, including 2 spaces designated as reserved for persons with disabilities, there is no space designated as van accessible, no vertical signs with the International Symbol of Accessibility at the designated accessible spaces, pavement markings are faint, and the designated spaces are not on the shortest accessible route to the building.  On the shortest accessible route to the accessible entrance, provide one van accessible space and one standard space designated as reserved for people with disabilities.  Standard accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Van accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  All spaces designated as reserved for people with disabilities shall have vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  Van accessible spaces shall have an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

s.                   Ramp to Entrance and Entrance Doors

 


i.                     The landing at the top of the ramp is not level, and it lacks handrails.  Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces.  Standards '' 4.3.8, 4.8.

 

ii.                   The automatic door openers provided do not work and, thus, the entrance is not accessible.  Provide a designated accessible entrance that has a minimum clear opening width of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop; that has either an automatic door operator or clear and level maneuvering clearance that complies fully with Fig. 25; and that has a threshold not exceeding 2 inch in height and beveled with a slope no greater than 1:2.  Ensure that all hardware and operating devices have shapes that are easy to grasp with one hand and do not require tight grasping, pinching or twisting of the wrist to operate; and that they are mounted no higher than 48 inches above the finished floor.  Standards ' 4.13, Figs. 24, 25.

 

c.                   Telephones:  The telephone counter is 37 inches above the finished floor, its highest operable part is 58 inches above the finished floor, and the telephones lack volume control and signage.  Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards.  Standards '' 4.31, 4.30.7(2).

 

d.                  Drinking Fountains

 


i.                     Main Lobby Drinking Fountain:  The spout height is 38 inches above the finished floor and the  water height is 2 inches above the finished floor.  Provide at least one  drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Ensure that fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards '' 4.15, 4.27.4, Fig. 27.

 

ii.                   Locker Room Area Drinking Fountain:  The spout is not located in the front of the unit and it is more than 36 inches above the finished floor.  Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Ensure that fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards '' 4.15, 4.27.4, Fig. 27.

 


iii.                  Second Level Drinking Fountain:  The spout is not located in the front of the unit, and it is more than 36 inches above the finished floor.  Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Ensure that fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards '' 4.15, 4.27.4, Fig. 27.

 

e.                   Parks Department Offices

 

i.                     Room 131:  The door is inaccessible because the pressure required to open the door is 16 pounds of force and the hardware requires tight grasping, pinching and turning of the wrist to operate.  Provide a door that requires no more than 5 pounds of force to open.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards '' 4.13.9, 4.13.11(2)(b).

 

ii.                   Room 133:  The door is inaccessible because the pressure required to open the door is 9 pounds of force and the hardware requires tight grasping, pinching and turning of the wrist to operate.  Provide a door that requires no more than 5 pounds of force to open.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards '' 4.13.9, 4.13.11(2)(b).

 

iii.                  Room 128:  The door is inaccessible because the pressure required to open the door is 11 pounds of force and the hardware requires tight grasping, pinching and turning of the wrist to operate.  Provide a door that requires no more than 5 pounds of force to open.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards '' 4.13.9, 4.13.11(2)(b)..  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).


 

f.                    Elevator

 

i.                     There is no visual signal on hall call buttons and they are neither raised nor flush.  Provide hall (lobby) call buttons with visual signals indicating when each call is registered and when each call is answered.  Ensure that the call buttons are centered at 42 inches above the finished floor, a minimum of : inch in the smallest dimension, with the button designating the up direction on top; that the call buttons are raised or flush; and that objects mounted beneath hall call buttons do not project into the elevator lobby more than 4 inches.  Standards ' 4.10.3, Fig. 20.

 

ii.                   No hall lanterns are provided.  Provide hall lanterns at each hoistway entrance that emit a visible and audible signal indicating which car is answering a call.  Ensure that audible signals sound once for the up direction and twice for the down direction or have verbal annunciators that say Aup@ or Adown;@ and that visible signals are mounted so that their centerline is at least 72 inches above the lobby floor, they are at least 22 inches in the smallest dimension, and they are visible from the vicinity of the hall call button.  Lanterns located in cars, visible from the vicinity of hall call buttons, and conforming to the above requirements, are acceptable.  Standards ' 4.10.4, Fig. 20.

 

iii.                  The elevator door does not automatically reopen if obstructed with contact, nor does it automatically reopen for an obstruction without contact.  Provide doors that open and close automatically with a reopening device that will stop and reopen the car door and hoistway door automatically if the door becomes obstructed by an object or person.  Ensure that the device is capable of completing these operations without requiring contact for obstructions passing through the opening at heights of 5 inches and 29 inches above the finished floor; that door reopening devices remain effective for at least 20 seconds, after which the doors may close; that the minimum time from notification that a car is answering a call until the doors of that car start to close is 5 seconds; and that the minimum time for elevator doors to remain fully open in response to a car call is 3 seconds.  Standards '' 4.10.6, 4.10.7, 4.10.8, Figs. 20, 21.                

 


g.                   Ramp Inside Building to Lower Level: The surface of the ramp is not firm, stable and slip-resistant; and the handrails are 42 inches above the finished floor, lack extensions that are rounded or returned smoothly to the floor, and have a diameter of 22 inches.  Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces.  Standards '' 4.3.8, 4.8.

xii.                No accessible shower is provided.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards ' 4.21, Figs. 35, 36, 37.

 

xiii.              The bench in the men=s locker room is inaccessible because it is not attached to the wall.  Provide a 24 inch by 48 inch bench fixed to the wall along the bench=s longer dimension.  Ensure that the bench has sufficient structural strength and is mounted with its surface between 17 inches and 19 inches above the finished floor.  Provide clear floor space alongside the bench to allow a person using a wheelchair to make a parallel transfer onto the bench.  Standards '' 4.35.4, 4.26.3.

vii.                There is inadequate clear floor space in the standard accessible stall.  Provide a toilet stall that is at least 60 inches wide and at least 56 inches deep for a wall-mounted toilet or at least 59 inches deep for a floor-mounted toilet, such that the centerline of the toilet is exactly 18 inches from the near side wall or partition, and there is at least 9 inches of toe clearance above the floor at the front partition if the stall is no more than 60 inches deep.  Standards ' 4.17, Fig. 30.

 

viii.              No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

ix.                 The toilet paper dispenser is on the wall opposite the side grab bar.  Provide a toilet paper dispenser that is mounted with its top at least 12 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards ' 4.17.3, Fig. 30(d).


 

x.                   No rear grab bar is provided.  Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall; mounted 33 to 36 inches above the finished floor; with a diameter between 13 and 12 inches; with 12 inches between the grab bar and the wall; and at least 12 inches between the grab bar and any other object, such as a toilet seat cover dispenser.  Standards '' 4.17.6, 4.26.2, Fig. 30.         

 

xi.                 The hardware in the standard accessible stall requires tight grasping, pinching, or twisting of the wrist to operate.  Provide a stall door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

xii.                No accessible shower is provided.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards ' 4.21, Figs. 35, 36, 37.

 

xiii.              The door into the sauna room is 27 inches wide.  Provide a door with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop.  Standards ' 4.13.5, Fig. 24.

 

xiv.              The bench in the women=s locker room is inaccessible because it is 12 inches wide and is not attached to the wall.  Provide a 24 inch by 48 inch bench fixed to the wall along the bench=s longer dimension.  Ensure that the bench has sufficient structural strength and is mounted with its surface between 17 inches and 19 inches above the finished floor.  Provide clear floor space alongside the bench to allow a person using a wheelchair to make a parallel transfer onto the bench.  Standards '' 4.35.4, 4.26.3.

 


xv.               The lockers are inaccessible because their hardware requires tight grasping.  Provide a locker with controls that can be operated with 5 lbf or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards ' 4.27.4.

 

 

18.              Jackson Park Pavilion, located at 350 Jackson Street, has numerous barriers to access for persons with disabilities.  Within 60 months of the effective date of this Agreement, the City will post signs at Jackson Park Pavilion and will otherwise inform the public (including an informational posting on its website) that it is providing equivalent accessible facilities and recreation programs at Borman Square Park, located nearby this facility.

 

 

19.              Within 84 months of the effective date of this Agreement, the City will complete the following modifications to Marquette Park Pavilion, 1 North Grand Boulevard:

 

t.                    Parking:  Although there are 103 parking spaces, including 2 designated as reserved for people with disabilities, there is no van accessible space, no access aisles at the designated accessible parking spaces, the pavement markings are extremely faint, and the gravel surface is not firm, stable and slip resistant.  On the shortest accessible route to the accessible entrance, provide one van accessible space and four standard space designated as reserved for people with disabilities.  Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 


u.                   Accessible Route from Parking to the Designated Accessible Entrance:  The gravel route to the entrance is inaccessible because it is not firm, stable, and slip resistant.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

v.                   Entrances:  The building is inaccessible because directional signage is not provided at inaccessible entrances, and the accessible entrance is not designated by a sign.  Provide accessible directional signage with the International Symbol of Accessibility at inaccessible entrances directing users to the accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances.  Standards '' 4.1.3(8)(d), 4.13, 4.30.

 

w.                 Access Between Levels:  There is no accessible route to the lower level, which can be accessed only via stairs.  Establish a procedure for providing access to programs in upper and lower levels of the facility or install ramps, platform lifts, or an elevator in compliance with the Standards.  Any procedure shall not require lifting or carrying persons with mobility impairments or require them to traverse unnecessary or extreme distances.  Standards '' 4.33.5, 4.3.8, 4.8, 4.11.

 

x.                   Telephone:  The knee space is 26 inches above the finished floor, the highest operable part is 55 inches above the finished floor, there is no volume control, and no signage.  Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards.  Standards '' 4.31, 4.30.7(2).

 

y.                   Elevator

 


i.                     There is no visual signal on the hall call button to indicate when a call is answered and no audible hall signal.  Provide hall (lobby) call buttons with visual signals indicating when each call is registered and when each call is answered.  Ensure that the call buttons are centered at 42 inches above the finished floor, a minimum of : inch in the smallest dimension, with the button designating the up direction on top; that the call buttons are raised or flush; and that objects mounted beneath hall call buttons do not project into the elevator lobby more than 4 inches.  Standards ' 4.10.3, Fig. 20.

 

ii.                   The second floor elevator lobby lacks hall lanterns.  Provide hall lanterns at each hoistway entrance that emit a visible and audible signal indicating which car is answering a call.  Ensure that audible signals sound once for the up direction and twice for the down direction or have verbal annunciators that say Aup@ or Adown;@ and that visible signals are mounted so that their centerline is at least 72 inches above the lobby floor, they are at least 22 inches in the smallest dimension, and they are visible from the vicinity of the hall call button.  Lanterns located in cars, visible from the vicinity of hall call buttons, and conforming to the above requirements, are acceptable.  Standards ' 4.10.4, Fig. 20.

 

iii.                  There is no hoistway signage.  Provide signage at hoistway entrances with raised and Braille floor designations on both jambs such that the centerline of the characters is 60 inches above the finished floor and the characters are 2 inches high.  Standards ' 4.10.5, Fig. 20.

 

iv.                 The elevator doors do not automatically reopen without contact if obstructed, do not stay open at least 20 seconds after obstruction, do not remain open for 5 seconds after hall call notification, and do not remain fully open for a minimum of 3 seconds.  Provide doors that open and close automatically with a reopening device that will stop and reopen the car door and hoistway door automatically if the door becomes obstructed by an object or person.  Ensure that the device is capable of completing these operations without requiring contact for obstructions passing through the opening at heights of 5 inches and 29 inches above the finished floor; that door reopening devices remain effective for at least 20 seconds, after which the doors may close; that the minimum time from notification that a car is answering a call until the doors of that car start to close is 5 seconds; and that the minimum time for elevator doors to remain fully open in response to a car call is 3 seconds.  Standards '' 4.10.6, 4.10.7, 4.10.8, Figs. 20, 21.

 

v.                   The emergency control buttons are not grouped at the bottom of the panel.  Provide emergency controls, including the emergency alarm and emergency stop, grouped at the bottom of the panel with their centerlines no less than 35 inches above the finished floor.  Standards ' 4.10.12, Fig. 23.

 


vi.                 The car position indicators do not illuminate or ring.  Provide visual car position indicators above the car control panel or over the door to show the position of the elevator in the hoistway.  Ensure that indicators emit an audible and visual signal as the car passes or stops at a floor served by the elevator, with the corresponding floor designation being illuminated; and that numerals are a minimum of 2 inch high.  Standards ' 4.10.13.

 

g.                   Drinking Fountains:  Although 2 drinking fountains are provided for people who have trouble bending or stooping (spout height is 40 inches above the finished floor), there is no fountain that is accessible to persons who use wheelchairs.  Provide a fountain that has a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet, and that otherwise complies with the Standards.  Standards '' 4.15, 4.27.4, Fig. 27.

 

h.                   Women=s Toilet Room with Stalls

 

i.                     The toilet room lacks an accessible sign.  Provide a toilet room sign with raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.        

 

ii.                   The entrance to the toilet room is 29 inches wide, and the the path of travel into the room is too narrow.  Provide a door with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop.  Provide an accessible route to the toilet room with required minimum width, passing space, head room, surface textures, slopes, and changes in level.  Standards '' 4.13.5, Fig. 24, 4.3.1, 4.3.2, 4.3.3, 4.3.4, 4.3.5, 4.3.6, 4.3.7, 4.3.8.        

 

iii.                  The bottom edge of the lavatory apron is 27 inches above the floor.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31.  Standards ' 4.19.2, Fig. 31.

 

iv.                 The lavatory pipes are not covered or configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.                     

 


v.                   There is inadequate clear floor space centered on lavatory.  Provide a lavatory with clear floor space at least 30 inches wide and 48 inches deep centered on the lavatory.  Standards ' 4.19.3, Fig. 32.

 

vi.                 The toilet stall is configured as an alternate configuration stall, with partitions 40 inches wide and parallel side grab bars, but no rear grab bar.  Provide a Astandard@ accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall=s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

 

i.                     Men=s Toilet Room with Stalls

 

i.                     The toilet room lacks an accessible sign.  Provide a toilet room sign with raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

ii.                   The entrance to the toilet room is 29 inches wide, and the width of the path of travel into the room is not compliant.  Provide a door with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop.  Provide an accessible route to the toilet room with required minimum width, passing space, head room, surface textures, slopes, and changes in level.  Standards '' 4.13.5, Fig. 24, 4.3.1, 4.3.2, 4.3.3, 4.3.4, 4.3.5, 4.3.6, 4.3.7, 4.3.8.  

 

iii.                  The route within the toilet room is inaccessible because the wall-mounted air dryers protrude into the walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards ' 4.4.

 

iv.                 The bottom edge of lavatory apron is 27 inches above the floor.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31.  Standards ' 4.19.2, Fig. 31.


 

v.                   The lavatory pipes are not covered or configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.

 

vi.                 There is no accessible stall provided.  Provide a Astandard@ accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall=s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

 

 

20.              Pachter Park, located at 2243 Whitcomb Street, has numerous barriers to access for persons with disabilities.  Within 36 months of the effective date of this Agreement, the City will post signs at Pachter Park and will otherwise inform the public (including an informational posting on its website) that it is providing equivalent accessible facilities and recreation programs at Tolleston Park, located nearby this facility.

 

 

21.              Within 60 months of the effective date of this Agreement, the City will complete the following modifications to the Pittman Square Park, 340 East 51st Avenue:

 

v.                   Parking:  Although there are approximately 5 spaces, the parking area has no pavement markings and no space designated as reserved for persons with disabilities.  On the shortest accessible route to the accessible entrance, provide one van accessible space designated as reserved for people with disabilities.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).  

 


w.                 Entrance:  The entrance has a 6 inch step, with no alternate accessible entrance.  Provide a designated accessible entrance that has a minimum clear opening width of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop; that has either an automatic door operator or clear and level maneuvering clearance that complies fully with Fig. 25; and that has a threshold not exceeding 2 inch in height and beveled with a slope no greater than 1:2.  Ensure that all hardware and operating devices have shapes that are easy to grasp with one hand and do not require tight grasping, pinching or twisting of the wrist to operate; and that they are mounted no higher than 48 inches above the finished floor.  Standards ' 4.13, Figs. 24, 25.

 

22.              The Rainbow Shelter has numerous barriers to access for persons with disabilities.  Within 12 months of the effective date of this Agreement, the City will develop procedures for providing the services of the shelter to persons with disabilities, and submit them to the Department for approval.

 

23.              Within 60 months of the effective date of this Agreement, the City will complete the following modifications to the South Gleason Golf Course, 3400 Jefferson Street:

 

x.                   North Parking Lot:  Although there are 57 parking spaces, there are no spaces designated as reserved for persons with disabilities.   On the shortest accessible route to the accessible entrance, provide one van accessible space and two standard spaces designated as reserved for people with disabilities.  Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 


y.                   South Parking Lot:  Although there are 67 parking spaces with one designated as reserved for persons with disabilities, the vertical signage can be obstructed by a parked vehicle, the pavement markings are not clear, no access aisle is provided; and there is no van accessible parking space.  On the shortest accessible route to the accessible entrance, provide one van accessible space and two standard spaces designated as reserved for people with disabilities.  Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

z.                   Exterior Entrances

 

i.                     There is no signage at the inaccessible entrance directing people to the  accessible entrance, and there is no signage designating the accessible entrance.  Provide accessible directional signage with the International Symbol of Accessibility at inaccessible entrances directing users to the accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances.  Standards '' 4.1.3(8)(d), 4.13, 4.30.

 

ii.                   The rear exterior door is not usable without tight grasping, pinching or twisting of the wrist to operate.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

iii.                  The maneuvering clearance at the rear exterior door is inadequate on the push side.  On the push side of the door, provide maneuvering clearance at least 48 inches deep and provide a minimum of 12 inches of maneuvering clearance on the latch side of the door, or remove the closer or the latch.  Standards ' 4.13.6, Fig. 25(a).

 

iv.                 The rear interior vestibule door hardware is not usable without tight grasping, pinching, and twisting of the wrist to operate.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.

 

v.                   The pressure required to open the rear interior vestibule door is 15 pounds of force.  Provide a door that requires no more than 5 pounds of force to open.  Standards ' 4.13.11(2)(b).                               

 


vi.                 The rear vestibule has less than 48 inches clearance with the door open.  Provide an accessible entrance to the rear entrance, such that the space between any two doors in series is at least 48 inches plus the width of any door swinging into the space.  Ensure that doors in series swing either in the same direction or away from the space between the doors.  Standards ' 4.13.7, Fig. 26.

 

e.                   Telephone in Rear Vestibule:  The door encroaches upon the required clear floor space at the telephone, the highest operable part is 54 inches above the finished floor and requires a forward reach, there is no volume control feature and no signage.  Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards.  Standards '' 4.31, 4.30.7(2).

 

f.                    Cashier Window in Rear Vestibule:  The counter is 43 inches above the finished floor, and equivalent facilitation not provided.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards '' 7.2(2), 4.3.

 

g.                   Suggestion Box:  The suggestion box is 53 inches above the finished floor and is accessed by a front reach only.  Provide a suggestion box with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

h.                   Golf Shop

 

i.                     The passage between the wall and display cases is 26 inches wide for approximately 20 feet.  Provide an accessible route with required minimum width, passing space, head room, surface textures, slopes, and changes in level.  Standards '' 4.3.1, 4.3.2, 4.3.3, 4.3.4, 4.3.5, 4.3.6, 4.3.7, 4.3.8.

 


ii.                   The retail counter is 38 inches above the finished floor.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor.  Standards '' 7.2(1), 4.3.

 

i.                     Stage: The stairs to the stage do not have handrails on both sides.  Provide stairs with closed risers, uniform tread width and riser height, a tread depth of at least 11 inches measured from riser to riser, and nosings, treads, and risers that otherwise comply fully with the Standards.  Provide handrails on both sides of the stairs such that the inside handrail on switchbacks or doglegs is continuous; handrails that are not continuous beyond the top and bottom of the stairs extend at least 12 inches beyond the top riser and at least 12 inches plus the width of one tread beyond the bottom riser; there is a clear space between the handrails and the wall of 12 inches; gripping surfaces are uninterrupted by newel posts, other construction elements, or obstructions; the handrails are mounted between 34 and 38 inches above stair nosings; the ends of the handrails are either rounded or returned smoothly to the floor, wall, or post; and the handrails do not rotate within their fittings.  Standards ' 4.9.

 

k.                  Men=s Toilet Room with Stalls

 

i.                     The toilet room lacks an accessible sign.  Provide a toilet room sign with raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6. 

 

ii.                   No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards ' 4.19.6.

 

iii.                  The lavatory pipes are not protected against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.                     

 

iv.                 There is inadequate clear floor space centered on the lavatory.  Provide a lavatory with clear floor space at least 30 inches wide and 48 inches deep centered on the lavatory.  Standards ' 4.19.3, Fig. 32.

 


v.                   The toilet stall is configured as an alternate configuration stall, with partitions 36 inches wide and parallel side grab bars, but no rear grab bar.  Provide a Astandard@ accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall=s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards '' 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

 

vi.                 No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

l.                     Women=s Toilet Room with Stalls

 

i.                     The toilet room lacks an accessible sign.  Provide a toilet room sign with raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

24.              Within 72 months of the effective date of this Agreement, the City will complete the following modifications to Washington Park, 1400 Pennsylvania Street:

 

a.                   Parking:  Although the parking lot has approximately 60 spaces, including 1 space designated as reserved for persons with disabilities, there are is an inadequate number of spaces designated as reserved for persons with disabilities, the parking spaces are not clearly demarcated, and there is no access aisle at the designated accessible space.  On the shortest accessible route to the accessible entrance, provide one van accessible space and two standard spaces designated as reserved for people with disabilities.  Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards '' 4.1.2(5), 4.6, 4.30.7(1).

 

b.                  Ramp to Entrance:  The ramp is inaccessible because it lacks edge protection, there is no level landing at the top, and no handrails are provided.  Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides.  Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces.  Standards '' 4.3.8, 4.8.


 

c.                   The building is inaccessible because the accessible entrance is not designated and inaccessible entrances do not have directional signage.  Provide accessible directional signage with the International Symbol of Accessibility at inaccessible entrances directing users to the accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances.  Standards '' 4.1.3(8)(d), 4.13, 4.30.

 

d.                  Park Sidewalks:  The concrete along the route is not level, firm, stable, and slip resistant.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

e.                  Women=s Toilet Room with Stalls    

 

i.                     The toilet room lacks an accessible sign.  Provide a toilet room sign with raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards '' 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

ii.                   The soap dispenser is 49 inches above the finished floor and no side reach is possible.  Provide a soap dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 


iii.                  The towel dispenser is 57 inches above the finished floor.  Provide a paper towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards '' 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

iv.                 The paper towel dispenser requires tight grasping, pinching, or turning of the wrist to operate.  Provide a paper towel dispenser with mechanical controls, if any, that can be operated with 5 lbf or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards ' 4.27.4.

 

v.                   The bottom edge of the lavatory apron is 27 2 inches above the finished floor and the knee and toe clearances are inadequate.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31.  Standards ' 4.19.2, Fig. 31.

 

vi.                 The lavatory pipes are not configured or insulated to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards ' 4.19.4.

 

vii.                The lavatory faucet is operable only with twisting of the wrist and tight grasping.  Provide a lavatory with a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards '' 4.19.5, 4.27.4.

25.              Within 24 months of the effective date of this Agreement, the City will complete the following modifications to Westbrook Pavilion, 2678 Waverly Drive:

 

a.                   Accessible Route:  There is no accessible route onto the sidewalk adjacent to the pavilion because there are no curb cuts or built-up curb ramps.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards '' 4.3, 4.5, Fig. 7.

 

b.                  Entrances

 

i.                     There is no signage at the inaccessible entrance directing persons with disabilities to the accessible entrance and no signage at the accessible entrance.  Provide accessible directional signage with the International Symbol of Accessibility at inaccessible entrances directing users to the accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances.  Standards '' 4.1.3(8)(d), 4.13, 4.30.

 

ii.                   The accessible entrance does not have a level approach or automatic door opener.  Provide a door so that the floor or ground area within the required clearances is level and clear.  Standards ' 4.13.6, Fig. 25.


 

iii.                  The accessible entrance door, which is accessed through a front approach, is inaccessible because it has less than 60 inches deep of maneuvering clearance on the latch/pull side of the door.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards ' 4.13.6, Fig. 25(a).

 

iv.                 The unbeveled threshold is more than 2 inch high.  Provide an accessible door with a threshold that is no greater than 3 inch, or is no greater than 2 inch and is beveled with a slope no greater than 1:2.  Standards '' 4.13.8, 4.5.2.

 

v.                   The door hardware requires tight grasping, pinching and twisting of the wrist to operate.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards ' 4.13.9.
