Attachment J: Modifications to Altered Facilities

Please Note: Paragraph 38 of the Settlement Agreement requires that within nine months of the effective date of this Agreement, the County provide signage as necessary to comply with 28 C.F.R. ' 35.163(b), after having surveyed all facilities that are the subject of this Agreement for the purpose of identifying those that have multiple entrances not all of which are accessible.

In order to ensure that the following spaces and elements in County facilities, for which construction was commenced after January 26, 1992, are readily accessible to and usable by persons with disabilities, the County will take the following actions:

1. Within 48 months of the effective date of this Agreement, the City will complete the following modifications to Ironwood Park, 119 East 24^th Avenue:

a. Parking (Altered): Although the parking lot has a total of 35 parking spaces, including 2 spaces designated as reserved for persons with disabilities, there is no Avan-accessible@ space designated as reserved for persons with disabilities, and there are no vertical signs at the spaces. On the shortest accessible route to the accessible entrance, provide one van accessible space designated as reserved for people with disabilities and one Astandard@ space designated as reserved for persons with disabilities. Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide. At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility. Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant. Standards '' 4.1.2(5), 4.1.6(1)(b), 4.6, 4.30.7(1).

b. Accessible Route from Parking to Pavilion: There is no curb cut or built up curb ramp from the accessible parking to the sidewalk. Provide a curb ramp that is at least 36 inches wide, has a maximum slope of 1:12, is located so that it cannot be obstructed by parked vehicles, and has a stable, firm, and slip-resistant surface with a detectable warning extending the full width and depth of the ramp. If the curb ramp is located where pedestrians must walk across it, provide either flared sides (with a maximum slope of 1:10) or handrails or guardrails to protect against cross traffic. Standards ' 4.3.8, 4.7, Fig. 12.

c. Accessible Route to Playground Equipment: There is no accessible route to the playground equipment. Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public. The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%). Standards '' 4.3, 4.5, Fig. 7.

d. None of the play equipment is usable by children with disabilities. Ensure program access by providing at least one piece of play equipment that is on an accessible route and has a transfer platform to enable children who use wheelchairs to use it. 28 C.F.R. '35.149; 35.150.

e. Accessible Route to Tennis and Basketball Courts: The sidewalk is inaccessible because there are large bunches of grass and weeds growing in the cracks. Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public. The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%). Standards '' 4.3, 4.5, Fig. 7.

f. Accessible Route to Picnic Shelter: There is no accessible route to the shelter slab from the sidewalk because there is only grass and no paved route connecting the elements. Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public. The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%). Standards '' 4.3, 4.5, Fig. 7.

g. Accessible Route to Baseball Field and Seating: There is no accessible route to the baseball field or seating area because there is only grass and no paved area connecting the sidewalk to these elements. Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public. The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%). Standards '' 4.3, 4.5, Fig. 7.

h. Entrances

i. The building is inaccessible because there is no accessible directional signage at the inaccessible entrances. Provide accessible directional signage with the International Symbol of Accessibility at inaccessible entrances directing users to the accessible entrance, and provide accessible signage with the International Symbol of Accessibility at the permanent accessible entrance. Standards '' 4.1.3(8)(d), 4.1.3(16)(b), 4.1.6(1)(b), 4.13, 4.30.

ii. The unbeveled threshold at the door is greater than 2 inch high. Provide a door with a threshold no greater than 3 inch, or between 3 inch and 2 inch and beveled with a slope no greater than 1:2. Standards '' 4.13.8, 4.5.2.

i. Longer Entrance Ramp: The ramp lacks edge protection, the bottom landing is obstructed by sand, and the ramp lacks handrails. Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides. Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface. Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings. Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces. Standards '' 4.3.8, 4.8.

j. Unisex Single-User Toilet Room (Altered)

i. The toilet room sign is mounted on the door. Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards '' 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

ii. The pressure required to open the door is 9 pounds of force. Provide a door that requires no more than 5 pounds of force to open. Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

iii. The door, which is accessed through a front approach, has inadequate maneuvering clearances on the latch/pull side of the door. On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door. Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.6, Fig. 25(a).

iv. No accessible mirror has been provided. Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor. Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.6.

k. Drinking Fountain (Altered)

i. Although a lower drinking fountain is provided, there is no drinking fountain provided for people who have difficulty bending or stooping. For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping. This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people. Standards '' 4.1.3(10)(a), 4.1.6(1)(b).

ii. The drinking fountain is a protruding object. Provide a high drinking fountain at this location such that its bottom leading edges measure no more than 27 inches above the finished floor or protrude no more than 4 inches into the walkway. Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

l. Kitchen

i. The door is 26 2 inches wide. Provide a door with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop. Standards ' 4.13.5, Fig. 24.

ii. The door hardware is not usable with one hand without tight grasping, pinching or twisting of the wrist. Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate. Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs. Standards ' 4.13.9.

iii. The door, which is accessed through a front approach, has only 11 inches maneuvering clearance on the latch/pull side. On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door. Standards ' 4.13.6, Fig. 25(a).

2. Within 36 months of the effective date of this Agreement, the City will complete the following modifications to the Genesis Convention Center, 1 Genesis Center Plaza:

a. Front Outdoor Parking Lot and Accessible Route to Entrance

i. Although the parking lot has a total of 71 parking spaces, there are no parking spaces designated as reserved for people with disabilities that have vertical signage, and no van accessible space. On the shortest accessible route to the accessible entrance, provide 1 van accessible space and 2 standard spaces designated as reserved for people with disabilities. Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide. Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide. At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility. Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant. Standards '' 4.1.2(5), 4.6, 4.30.7(1).

ii. At the front outdoor parking lot, ensure that there is an accessible route from the designated accessible parking spaces to the main entrance of the Genesis Convention Center. Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public. The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%). Standards '' 4.3, 4.5, Fig. 7.

b. Entrances

i. Accessible directional signage has not been provided to identify accessible entrances and to direct the general public from inaccessible entrances to accessible ones. Provide accessible directional signage with the International Symbol of Accessibility at inaccessible entrances directing users to the accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances. Standards '' 4.1.3(8)(d), 4.13, 4.30.

ii. The pressure required to open the interior vestibule door at the main entrance is 7 pounds of force. Provide a door that requires no more than 5 pounds of force to open. Standards ' 4.13.11(2)(b).

c. Signage: The permanent room signs are not mounted at 60 inches above the finished floor and are not mounted on latch side of the door. Provide permanent room signage with upper case, sans serif or simple serif type letters and numerals, meeting the requirements of the Standards for character height, raised characters, finish and contrast, accompanied by Grade 2 Braille; mounted on the wall adjacent to the latch side of the door or on the nearest adjacent wall at a height of 60 inches above the finished floor to the centerline of the sign; and located so that a person may approach within 3 inches of the signage without encountering protruding objects or standing within the swing of a door. Standards '' 4.30.1, 4.30.4, 4.30.5, 4.30.6.

d. Alarms: Visual and audible alarms are not provided in all of the common-use areas, alarms are not appropriately placed every 50 feet, and there are no visual alarms on the south side of building. Provide visual alarm devices in toilet rooms and any other general usage areas (e.g., meeting rooms), hallways, lobbies, and any other area for common use. Such devices shall be integrated into the facility alarm system and shall meet the requirements of the Standards for lamp type, color, pulse duration, intensity, and flash rate. Visual alarm appliances shall be placed 80 inches above the highest floor level within the space or 6 inches below the ceiling, whichever is lower. Visual alarm appliances shall be located such that no place in any room or space, including common corridors or hallways, required to have a visual alarm appliance shall be more than 50 feet from the signal. In large rooms and spaces exceeding 100 feet across, without obstructions 6 feet above the finished floor, devices may be placed around the perimeter, spaced a maximum of 100 feet apart, in lieu of suspending appliances from the ceiling. Standards ' 4.28.3.

e. Telephones

i. First Floor Telephones

(1) The telephones on the first floor lack signage. Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards. Standards '' 4.31, 4.30.7(2).

(2) The telephones are not detectable to a blind person using a cane because they protrude into the path of travel. Provide a telephone at this location such that its bottom leading edges measure no more than 27 inches above the finished floor or protrude no more than 4 inches into the walkway. Standards ' 4.4.is a protruding object.

ii. Second Floor Telephones: The telephone nearest the elevator has inadequate clear floor space, the counter is 27 inches high, the knee space is 26 inches, and the telephone does not have the required signage. Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards. Standards '' 4.31, 4.30.7(2).

f. Locker Rooms

i. Unisex Locker Room #1 B First Level, Northeast side (Altered)

(1) Locker room #1 does not have accessible signage. Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards '' 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

(2) The door hardware is not usable with one hand without tight grasping, pinching or twisting of the wrist because it is a knob. Provide a door with hardware usable with one hand and without tight grasping, pinching, or twisting of the wrist. Lever-operated, push-type, and U-shaped handles are acceptable designs. Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.2, 4.13.9.

(3) The pressure required to open the first outer door is 15 pounds of force. Provide a door that requires no more than 5 pounds of force to open. Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

(4) The pressure required to open the second inner door is 12 pounds of force. Provide a door that requires no more than 5 pounds of force to open. Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

(5) The paper towel dispenser requires tight grasping, pinching or twisting of the wrist to operate. Provide a paper towel dispenser with mechanical controls, if any, that can be operated with 5 lbf or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs). Standards '' 4.1.3(13), 4.1.6(1)(b), 4.27.4.

(6) The bottom edge of the lavatory apron is 28 inches above the finished floor. Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31. Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.2, Fig. 31.

(7) The flush control of the toilet in the standard accessible stall is on the closed side. Provide a flush control mounted on the Aopen@ side of the toilet=s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device. Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.5, 4.17.2, 4.27.4.

(8) No accessible coat hook has been provided. Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards '' 4.1.3(12)(a), 4.1.6(1)(b), 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

(9) The shower in Locker Room #1 is inaccessible because the shower seat is not mounted on the wall adjacent to controls, and the shower controls are on the side wall. Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening. Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable. Standards '' 4.1.3(11), 4.1.6(1)(b), 4.21, Figs. 35, 36, 37.

(10) No accessible towel hook has been provided by the shower stall. Provide a towel hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards '' 4.1.3(12)(a), 4.1.6(1)(b), 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

(11) No lockers are provided. Provide one locker with mechanical controls, if any, that can be operated with 5 pounds of force or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs). Standards '' 4.1.3(13), 4.1.6(1)(b), 4.27.4, 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6, Fig. 4.

ii. Unisex Locker Room #2 B First Level, Northwest side (Altered)

(1) Locker room #2 does not have accessible signage. Provide a toilet room sign with raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards '' 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7..

(2) The paper towel dispenser requires tight grasping, pinching or twisting of the wrist to operate. Provide a paper towel dispenser with mechanical controls, if any, that can be operated with 5 lbf or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs). Standards '' 4.1.3(13), 4.1.6(1)(b), 4.27.4.

(3) The paper towel dispenser protrudes into the path of travel and would not be detectable to a blind person using a cane. Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles. Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor. Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

(4) The hot water pipes at the lavatory are not covered or configured to protect against contact. Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact. Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.4.

iii. Unisex Locker Room #3B First Level, Northwest Side (Altered)

(1) Locker room #3 does not have accessible signage. Provide a toilet room sign with raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards '' 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7..

(5) The lockers are inaccessible because the controls are mounted at 652 inches above the finished floor and require tight grasping, pinching, or twisting of the wrist. Provide one locker with mechanical controls, if any, that can be operated with 5 pounds of force or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs). Standards '' 4.1.3(13), 4.1.6(1)(b), 4.27.4, 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6, Fig. 4.

g. Men=s Lounge Toilet Room with Stalls (Altered)

i. The toilet room sign lacks the International Symbol of Accessibility, the sign is mounted on the door, and the centerline of the sign is at 67 inches above the finished floor. Provide a toilet room sign with raised and Braille characters. The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards '' 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

ii. The pressure required to open the door is 13 pounds of force. Provide a door that requires no more than 5 pounds of force to open. Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

iii. The paper towel dispenser requires tight grasping, pinching or twisting of the wrist to operate. Provide a paper towel dispenser with mechanical controls, if any, that can be operated with 5 lbf or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs). Standards '' 4.1.3(13), 4.1.6(1)(b), 4.27.4.

Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards '' 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

ii. The pressure required to open the door is 13 pounds of force. Provide a door that requires no more than 5 pounds of force to open. Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

iii. Although the facility contains an emergency alarm system, there is no visual alarm device in the toilet room. Provide visual alarm devices in toilet rooms and any other general usage areas (e.g., meeting rooms), hallways, lobbies, and any other area for common use. Such devices shall be integrated into the facility alarm system and shall meet the requirements of the Standards for lamp type, color, pulse duration, intensity, and flash rate. Visual alarm appliances shall be placed 80 inches above the highest floor level within the space or 6 inches below the ceiling, whichever is lower. l. Existing Inaccessible Toilet Rooms: The existing inaccessible toilet rooms do not have signage directing persons with disabilities to the accessible toilet rooms. Provide accessible directional signage with the International Symbol of Accessibility at inaccessible toilet rooms indicating the location of the nearest accessible toilet room, and provide accessible signage with the International Symbol of Accessibility at all accessible toilet rooms. Standards '' 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

m. Elevators

i. North Elevator

(1) The visual signals on hall call buttons do not indicate when a call has registered and do not indicate when a call is answered. Provide hall (lobby) call buttons with visual signals indicating when each call is registered and when each call is answered. Ensure that the call buttons are centered at 42 inches above the finished floor, a minimum of : inch in the smallest dimension, with the button designating the up direction on top; that the call buttons are raised or flush; and that objects mounted beneath hall call buttons do not project into the elevator lobby more than 4 inches. Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.3, Fig. 20.

(2) The hall lanterns do not provide audible and visual signals for arrival, are not centered at least 72 inches above the finished floor, and are not visible from the area of the a hall call buttons. Provide hall lanterns at each hoistway entrance that emit a visible and audible signal indicating which car is answering a call. Ensure that audible signals sound once for the up direction and twice for the down direction or have verbal annunciators that say Aup@ or Adown;@ and that visible signals are mounted so that their centerline is at least 72 inches above the lobby floor, they are at least 22 inches in the smallest dimension, and they are visible from the vicinity of the hall call button. Lanterns located in cars, visible from the vicinity of hall call buttons, and conforming to the above requirements, are acceptable. Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.4, Fig. 20.

(3) Hoistway signage is not provided. Provide signage at hoistway entrances with raised and Braille floor designations on both jambs such that the centerline of the characters is 60 inches above the finished floor and the characters are 2 inches high. Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.5, Fig. 20.

(4) The car control buttons do not have Braille and/or raised characters, floor buttons do not go out to indicate call answered, floor buttons do not have visual indicator to register call, and the main entry floor is not designated by a raised star. Provide car control buttons that are at least : inch in their smallest dimension and are raised or flush and that are designated by Braille and by raised standard alphabet characters for letters, arabic characters for numerals, or standard symbols. Ensure that the call button for the main entry floor is designated by a raised star at the left of the floor designation; that all raised designations for control buttons are placed immediately to the left of the buttons to which they apply; that floor buttons are provided with visual indicators to show when each call is registered and are extinguished when each call is answered; that all floor buttons are no higher than 54 inches above the finished floor for a side approach and no more than 48 inches above the finished floor for a front approach; and that emergency controls, including the emergency alarm and emergency stop, are grouped at the bottom of the panel and have their centerlines no less than 35 inches above the finished floor. Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.12, Fig. 23.

(5) The car position indicators do not illuminate as the car passes or stops on floors. Provide visual car position indicators above the car control panel or over the door to show the position of the elevator in the hoistway. Ensure that indicators emit an audible and visual signal as the car passes or stops at a floor served by the elevator, with the corresponding floor designation being illuminated; and that numerals are a minimum of 2 inch high. Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.13.

ii. South Elevator

(1) The visual signals on hall call buttons do not indicate when a call registered and do not indicate when a call answered. Provide hall (lobby) call buttons with visual signals indicating when each call is registered and when each call is answered. n. First and Second Floor Drinking Fountains: Although a lowered drinking fountains are provided on both floors, there are no drinking fountains provided for people who have difficulty bending or stooping. For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping. This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people. Standards '' 4.1.3(10)(a), 4.1.6(1)(b).

o. Stadium/Arena (floor is altered)

i. There is no accessible route to the court, which is raised 2 - 4 inches above the finished floor. Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public. The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%). Standards '' 4.3, 4.5, Fig. 7.

ii. There are too few wheelchair seating areas in this 6,000 seat stadium. Provide 61 wheelchair seating areas, each with a minimum clear ground or floor space of 66 inches wide by 48 inches deep for forward or rear access, or 66 inches wide by 60 inches deep for side access. Ensure that the ground or floor at all wheelchair locations is level, firm, stable, and slip resistant; that wheelchair seating areas are an integral part of the fixed seating plan and are located so as to provide people with physical disabilities a choice of admission prices and lines of sight comparable to those available for members of the general public; that wheelchair seating areas adjoin an accessible route that also serves as a means of egress in case of emergency; and that at least one fixed companion seat is provided next to each wheelchair seating area. Standards '' 4.1.3(19)(a), 4.5, 4.33.

iii. There is no signage indicating availability of an assistive listening system. Provide accessible signage indicating the availability of the assistive listening system. 28 C.F.R. 35.160; Standards '' 4.1.3(19)(b), 4.1.6(1)(b), 4.30.

3. Within 12 months of the effective date of this Agreement, the City will complete the following modifications to the Metro Center, 100 West 4th Avenue:

a. Parking

i. Front Parking Lot: In this 179 space parking lot, there is an inadequate number of spaces designated as reserved for people with disabilities, the van accessible space lacks the International symbol of access, standard accessible space #3 has a 52 inch access aisle and the sign can be obstructed by parked cars, and standard accessible space #4 has a 48 inch access aisle and lacks signage. On the shortest accessible route to the accessible entrance, provide one van accessible space and five standard spaces designated as reserved for people with disabilities. Standard accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 60 inches wide. Van accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 96 inches wide. All spaces designated as reserved for people with disabilities shall have vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. Van accessible spaces shall have an additional AVan-Accessible@ sign located below the International Symbol of Accessibility. Standards '' 4.1.2(5), 4.1.6(1)(b), 4.6, 4.30.7(1).

ii. Rear Parking Lot: Although there are 47 spaces with 2 designated as reserved for persons with disabilities, there is no designated Avan-accessible@ space. On the shortest accessible route to the accessible entrance, provide one van accessible space designated as reserved for people with disabilities. Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide. At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility. Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant. Standards '' 4.1.2(5), 4.1.6(1)(b), 4.6, 4.30.7(1).

iii. Parking Garage Shared with Genesis Convention Center: In this 246 space parking lot, which includes 13 spaces that are reserved for persons with disabilities, there is no designated Avan-accessible@ parking space, the vertical signs at the designated accessible spaces are too low and can be obstructed by parked vehicles, none of the designated accessible parking spaces have access aisles, and none of the designated accessible parking spaces are level. On the shortest accessible route to the accessible entrance, provide 1 van accessible space and 6 standard spaces designated as reserved for people with disabilities. Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide. Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide. At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility. Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant. b. Entrances and Exits to Parking Garage

i. The entrance/exit door from the parking garage to the skybridge has door hardware that requires tight grasping, pinching or twisting of the wrist. Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate. Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs. Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.9.

ii. The exit from the 1^st floor garage to the street does not have signage directing the public to the accessible exit. Provide accessible directional signage with the International Symbol of Accessibility at inaccessible entrances directing users to the accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances. Standards '' 4.1.3(8)(d), 4.1.3(16)(b), 4.1.6(1)(b), 4.13, 4.30.

~~iii.~~ The exit from the 1^st floor garage to the street has a step down to the sidewalk. Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public. i. Metro Building Elevator

(1) There is a moveable trash can that obstructs the hall call buttons. Provide hall (lobby) call buttons with visual signals indicating when each call is registered and when each call is answered. Ensure that the call buttons are centered at 42 inches above the finished floor, a minimum of : inch in the smallest dimension, with the button designating the up direction on top; that the call buttons are raised or flush; and that objects mounted beneath hall call buttons do not project into the elevator lobby more than 4 inches. Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.3, Fig. 20.

(2) The emergency communications door requires tight grasping, pinching or twisting of the wrist to open. Provide a two-way communication system such that it does not require voice communication, the highest operable part is a maximum of 48 inches above the finished floor of the car, and it is identified by a raised symbol and lettering located adjacent to the device. If the system uses a handset, ensure that the length of the cord from the panel to the handset is at least 29 inches. If the system is located in a closed compartment, ensure that the compartment door hardware operates without tight grasping, pinching or twisting of the wrist. Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.14.

ii. Parking Garage Elevator

(1) The elevator lacks hall lanterns. Provide hall lanterns at each hoistway entrance that emit a visible and audible signal indicating which car is answering a call. Ensure that audible signals sound once for the up direction and twice for the down direction or have verbal annunciators that say Aup@ or Adown;@ and that visible signals are mounted so that their centerline is at least 72 inches above the lobby floor, they are at least 22 inches in the smallest dimension, and they are visible from the vicinity of the hall call button. Lanterns located in cars, visible from the vicinity of hall call buttons, and conforming to the above requirements, are acceptable. Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.4, Fig. 20.

(2) The elevator lacks hoistway signage. Provide signage at hoistway entrances with raised and Braille floor designations on both jambs such that the centerline of the characters is 60 inches above the finished floor and the characters are 2 inches high. Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.5, Fig. 20.

(3) The control panel buttons do not have Braille, or raised characters and the main entry floor call button is not designated by a raised star. Provide car control buttons that are at least : inch in their smallest dimension and are raised or flush and that are designated by Braille and by raised standard alphabet characters for letters, arabic characters for numerals, or standard symbols. Ensure that the call button for the main entry floor is designated by a raised star at the left of the floor designation; that all raised designations for control buttons are placed immediately to the left of the buttons to which they apply; that floor buttons are provided with visual indicators to show when each call is registered and are extinguished when each call is answered; that all floor buttons are no higher than 54 inches above the finished floor for a side approach and no more than 48 inches above the finished floor for a front approach; and that emergency controls, including the emergency alarm and emergency stop, are grouped at the bottom of the panel and have their centerlines no less than 35 inches above the finished floor. Standards '' 4.1.3(5), 4.1.6(1)(b), 4.10.12, Fig. 23.

d. Ramp In Skybridge Between Parking Garage and Metro Building: The ramp lacks handrail extensions that are rounded or returned smoothly to the floor and the handrail paint is chipping, resulting in jagged edges. Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides. Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface. Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings. Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces. Standards '' 4.1.2(1), 4.1.2(2), 4.1.6(1)(b), 4.3.8, 4.8.

e. Telephones

i. First Floor Telephones

(1) The lower telephones on the first floor are inaccessible because they do not have a volume control feature, and the TTY signage is obstructed. Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards. Standards '' 4.1.3(17), 4.1.6(1)(b), 4.31, 4.30.7(2).

(2) The lower telephones are inaccessible because the knee space is 25 inches high and 12 inches deep. Provide a telephone that has clear floor space that is 30 inches wide and 48 inches deep, knee clearance at least 27 inches high, 30 inches wide, and 19 inches deep. Standards '' 4.2.4.1, 4.32.

ii. Second Floor Telephones

(1) The telephones lack a volume control feature and lack required signage. Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards. Standards '' 4.1.3(17), 4.1.6(1)(b), 4.31, 4.30.7(2).

f. Drinking Fountains

i. First Floor Drinking Fountain

(1) The water flow is 4 inches from the front edge of the fountain, and there is no drinking fountain provided for people who have difficulty bending or stooping. Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high. Ensure that fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge. Additionally, provide a drinking fountain that is accessible to people who have difficulty bending or stooping. This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people. Standards '' 4.1.3(10), 4.1.6(1)(b), 4.15, 4.27.4, Fig. 27.

(2) The route on the first floor to the elevator is inaccessible because the wall-mounted drinking fountain protrudes into the walkway and would not be detectable to a blind person using a cane. Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles. Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor. Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

ii. Second Floor Drinking Fountains

(1) Although there are two drinking fountains provided on the second floor, neither is accessible because the spout heights are greater than 36 inches above the finished floor, the water height is less than 4 inches, and the water flow at one fountain is greater than 3 inches from the front of the fountain. Provide at least one fountain that has a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet, and that otherwise complies with the Standards. Standards '' 4.1.3(10), 4.1.6(1)(b), 4.15, 4.27.4, Fig. 27.

(2) There is no drinking fountain provided on the second floor for people who have difficulty bending or stooping. Provide a drinking fountain that is accessible to people who have difficulty bending or stooping. This can be accommodated by the use of a Ahi-lo@ fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people. Standards '' 4.1.3(10)(a), 4.1.6(1)(b).

g. Ramp to Train Platform: The ramp is inaccessible because the handrails do not extend at least 12 inches beyond the top and bottom of the ramp parallel to the floor surface. Provide handrails that are between 13 inches and 12 inches in diameter such that the inside handrail is continuous and both handrails have a continuous gripping surface along both sides of the ramp extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface; the handrails do not rotate within their fittings; and both handrails are mounted between 34 inches and 38 inches above the ramp surface and 12 inches from the wall, with ends rounded or returned smoothly to the floor, wall, or post. Standards ' 4.8.5.

h. Third Floor Conference Room

i. The door leaf is 29 2 inches wide. Provide a designated accessible entrance that has at least one active leaf with a minimum 32 inch clear opening width with the door open 90 degrees, measured between the face of the door and the opposite stop; that has either an automatic door operator or clear and level maneuvering clearance that complies fully with Fig. 25; and that has a threshold not exceeding 2 inch in height and beveled with a slope no greater than 1:2. Ensure that all hardware and operating devices have shapes that are easy to grasp with one hand and do not require tight grasping, pinching, or twisting of the wrist to operate, and that they are mounted no higher than 48 inches above the finished floor. Standards '' 4.1.3(7)(a), 4.1.6(1)(b), 4.13, Figs. 24, 25.

ii. The pressure required to open the door is 16 pounds of force. Provide a door that requires no more than 5 pounds of force to open. Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

j. Gary Public Transportation Corporation (GPTC) Office on Third Floor: The pressure required to open the door is 14 pounds of force. Provide a door that requires no more than 5 pounds of force to open. Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

k. Second Floor Men=s Toilet Room with Stalls (Altered)

i. The toilet room lacks accessible signage. Provide a toilet room sign with raised and Braille characters. The sign shall be mounted on the wall adjacent to the entrance with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards '' 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

ii. The route within the toilet room is inaccessible because the air dryer protrudes into the path of travel and would not be detectable to a blind person using a cane. Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles. Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor. Standards '' 4.1.2(3), 4.1.6(1)(b), 4.4.

iii. The clear floor space in front of urinal is 26 2 inches wide. Provide a urinal with an elongated rim mounted 17 inches or less above the finished floor, a clear floor space of at least 30 inches wide and 48 inches deep centered on the urinal, and a flush control height of 44 inches or less above the finished floor. Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.5, 4.18.2, 4.18.3, 4.18.4.

iv. No accessible coat hook has been provided. Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards '' 4.1.3(12)(a), 4.1.6(1)(b), 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

v. The toilet paper dispenser is 39 inches from the rear wall. Provide a toilet paper dispenser that is mounted with its top at least 12 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor. Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.3, Fig. 30(d).

l. Second Floor Women=s Toilet Room with Stalls (Altered)

i. The toilet room lacks an accessible sign. Provide a toilet room sign with raised and Braille characters. The sign shall be mounted on the wall adjacent to the entrance with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards '' 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

ii. No accessible mirror has been provided. Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor. Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.6.

iii. The lavatory is inaccessible because the hot water pipes are not insulated or otherwise configured to protect against contact. Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact. Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.4.

iv. The sanitary napkin dispenser requires tight grasping, pinching or twisting of the wrist to operate. Provide a sanitary napkin dispenser with mechanical controls, if any, that can be operated with 5 lbf or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs). Standards '' 4.1.3(13), 4.1.6(1)(b), 4.27.4.

v. No accessible coat hook has been provided. Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards '' 4.1.3(12)(a), 4.1.6(1)(b), 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

vi. The toilet paper dispenser is mounted 1 inch under the grab bar, obstructing the gripping surface of the grab bar. Provide a toilet paper dispenser that is mounted with its top at least 12 inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor. Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.3, Fig. 30(d).

vii. The farther end of the side grab bar is 49 inches from the rear wall. Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall. Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.6, Figs. 30(a), (d).

viii. The rear and side grab bars are mounted at 37 inches above the finished floor. Provide grab bars that are mounted between 33 and 36 inches above the finished floor. Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.6, Fig. 30.

4. Within 24 months of the effective date of this Agreement, the City will complete the following modifications to the Public Safety Building, 555 Polk Street:

a. Parking (Altered): Although the parking lot has a total of 140 parking spaces, including 8 designated as reserved for persons with disabilities, there is no van accessible parking space, and the vertical signage at the accessible parking spaces is too low and can be obstructed by parked vehicles. On the shortest accessible route to the accessible entrance, provide at least 1 van accessible space and 4 standard spaces designated as reserved for people with disabilities. Standard accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 60 inches wide. Van accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 96 inches wide. All spaces designated as reserved for people with disabilities shall have vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. Van accessible spaces shall have an additional AVan-Accessible@ sign located below the International Symbol of Accessibility. Standards '' 4.1.2(5), 4.1.6(1)(b), 4.6, 4.30.7(1).

b. Lobby Telephone (Altered): The coin slot is 57 inches above the finished floor and no signage complying with the Standards is provided. Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards. Standards '' 4.1.3(17), 4.1.6(1)(b), 4.31, 4.30.7(2).

c. First Floor Drinking Fountain (Altered): The route next to the criminal court is inaccessible because the wall-mounted drinking fountains protrude into the main walkway and would not be detectable to a blind person using a cane. Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles. Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor. Standards ' 4.4.

d. Designated Accessible Adult Holding Cell #6 (Altered): The toilet in the holding cell is inaccessible because no grab bars are provided. Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall, and a side grab bar that is at least 42 inches in overall length, with the far end mounted at least 54 inches from the rear wall and the closer end 12 inches or less from the rear wall. Ensure that the grab bars are mounted 33 to 36 inches above the finished floor; with a diameter between 13 and 12 inches; with 12 inches between the grab bars and the wall; and at least 12 inches between the grab bars and any other object, such as a toilet paper dispenser or a toilet seat cover dispenser. Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.4, 4.26.2, Fig. 29.^[1]

e. Designated Accessible Juvenile Holding Cell #2 (Altered): The toilet in the holding cell is inaccessible because no side grab bar is provided. Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall, and a side grab bar that is at least 42 inches in overall length, with the far end mounted at least 54 inches from the rear wall and the closer end 12 inches or less from the rear wall. Ensure that the grab bars are mounted 33 to 36 inches above the finished floor; with a diameter between 13 and 12 inches; with 12 inches between the grab bars and the wall; and at least 12 inches between the grab bars and any other object, such as a toilet paper dispenser or a toilet seat cover dispenser. f. First Floor Community Room (Altered): The pressure required to open the door is 10 pounds of force. Provide a door that requires no more than 5 pounds of force to open. Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

g. Civil Courtroom #1057 (Altered): The courtroom entrance door is inaccessible because the pressure required to open the door is 18 pounds of force. Provide a door that requires no more than 5 pounds of force to open. Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

h. Criminal Courtroom #1069 (Altered)

i. The courtroom entrance door is inaccessible because the pressure required to open the door is 6 pounds of force. Provide a door that requires no more than 5 pounds of force to open. Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

ii. The 14 chairs in the jury box are all fixed to the floor making the jury box inaccessible to persons who use wheelchairs. Provide at least one wheelchair seating area with a minimum clear ground or floor space of 66 inches wide by 48 inches deep for forward or rear access, or 66 inches wide by 60 inches deep for side access. Standards '' 4.1.3(19)(a), 4.1.6(1)(b), 4.5, 4.33.

i. Office #4026 Entrance Door (Altered): The entrance door is inaccessible because the pressure required to open the door is 6 pounds of force. Provide a door that requires no more than 5 pounds of force to open. Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

n. Men=s Basement Level Toilet Room with Stalls B #0057 (Altered): The toilet room is inaccessible and there is no signage directing people with disabilities to the accessible toilet rooms. Provide accessible directional signage with the International Symbol of Accessibility at inaccessible toilet rooms indicating the location of the nearest accessible toilet room, and provide accessible signage with the International Symbol of Accessibility at all accessible toilet rooms. Standards '' 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

o. Women=s Basement Level Toilet Room with Stalls B #0056 (Altered): The toilet room is inaccessible and there is no signage directing people with disabilities to the accessible toilet rooms. Provide accessible directional signage with the International Symbol of Accessibility at inaccessible toilet rooms indicating the location of the nearest accessible toilet room, and provide accessible signage with the International Symbol of Accessibility at all accessible toilet rooms. Standards '' 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

p. First Level Staff Only Single-User Toilet Room B #1127 (Altered)

i. The toilet room sign does not have the International symbol of access and its centerline is 66 inches above the finished floor. Provide a toilet room sign with raised and Braille characters. The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards '' 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

ii. The pressure required to open the door is 9 pounds of force. Provide a door that requires no more than 5 pounds of force to open. Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

iii. The hot water pipes at the lavatory are not covered or configured to protect against contact. Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact. Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.4.

iv. The toilet is inaccessible because its centerline measures 20 inches from the side wall. Provide a toilet with a centerline that measures 18 inches from the near side wall. Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.2, Fig. 28.

q. First Level Staff Only Single-User Toilet Room B #1080 (Altered)

i. The toilet room sign does not have the International Symbol of Accessibility and its centerline is 66 inches above the finished floor. Provide a toilet room sign with raised and Braille characters. The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards '' 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

ii. The pressure required to open the door is 10 pounds of force. Provide a door that requires no more than 5 pounds of force to open. Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

v. The height of the toilet seat is 16 2 above the finished floor. Provide a toilet with a seat that measures 17 to 19 inches above the finished floor. Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.3, Fig. 29(b).

vi. The toilet centerline is 22 inches from the side wall. Provide a toilet with a centerline that measures 18 inches from the near side wall. Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.2, Fig. 28.

vii. No grab bars are provided. Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall, and a side grab bar that is at least 42 inches in overall length, with the far end mounted at least 54 inches from the rear wall and the closer end 12 inches or less from the rear wall. Ensure that the grab bars are mounted 33 to 36 inches above the finished floor; with a diameter between 13 and 12 inches; with 12 inches between the grab bars and the wall; and at least 12 inches between the grab bars and any other object, such as a toilet paper dispenser or a toilet seat cover dispenser. 5. Within 48 months of the effective date of this Agreement, the City will complete the following modifications to Roosevelt Park, 2145 Harrison Street:

a. Parking: Although the parking lot has a total of 50 parking spaces, there are no parking spaces designated as reserved for persons with disabilities. On the shortest accessible route to the accessible entrance, provide 1 van accessible space and 1 standard space designated as reserved for people with disabilities. Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide. Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide. At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility. Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant. Standards '' 4.1.2(5), 4.6, 4.30.7(1).

b. Accessible Route to Tennis Courts: The route to the tennis court is inaccessible because there is a 5 inch step up to the court surface. Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public. The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%). c. Concessions Counter at Baseball Field: The counter is 47 inches above the ground. Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor. Standards '' 7.2(1), 4.3.

d. Ramp into Swimming Pool (Altered): The ramp at the swimming pool is inaccessible because there is inadequate edge protection, the landing at the top of the ramp is not as wide as the remainder of the ramp, the landing at bottom of ramp is 47 inches by 47 inches, handrails are provided on only one side of the ramp, and there is no handrail extension at top of the ramp. Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides. Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface. Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface and 12 inches from the wall, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings. Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces. Standards '' 4.3.8, 4.8.

e. Exterior Entrance to Pavilion: The entrance is inaccessible because the door width is 30 inches, the approach is not level, the threshold is greater than 2 inch in height, and the door hardware requires tight grasping, pinching or twisting of the wrist to operate. Provide a designated accessible entrance that has a minimum clear opening width of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop; that has either an automatic door operator or clear and level maneuvering clearance that complies fully with Fig. 25; and that has a threshold not exceeding 2 inch in height and beveled with a slope no greater than 1:2. Ensure that all hardware and operating devices have shapes that are easy to grasp with one hand and do not require tight grasping, pinching or twisting of the wrist to operate; and that they are mounted no higher than 48 inches above the finished floor. Standards ' 4.13, Figs. 24, 25.

f. Men=s Toilet Room with Stalls: The men=s toilet room contains a number of inaccessible elements and is not accessible to people with disabilities. Provide an accessible toilet room such that all of the room=s elements, including signage, door, door hardware, clear floor space, water closet, stall size and arrangement, stall door, urinal (if provided), grab bars, lavatory, mirror, controls, and dispensers, comply with the Standards. Standards '' 4.13, 4.16, 4.17, 4.18, 4.19, 4.26, 4.27, 4.30, Fig. 30.

g. Women=s Toilet Room: The women=s toilet room contains a number of inaccessible elements and is not accessible to people with disabilities. Provide an accessible toilet room such that all of the room=s elements, including signage, door, door hardware, clear floor space, water closet, stall size and arrangement, stall door, urinal (if provided), grab bars, lavatory, mirror, controls, and dispensers, comply with the Standards. Standards '' 4.13, 4.16, 4.17, 4.18, 4.19, 4.26, 4.27, 4.30, Fig. 30.

6. Within 36 months of the effective date of this Agreement, the City will complete the following modifications to Tolleston Park Pavilion, 2701 West 15^th Avenue:

a. Parking In Front of Pavilion (Altered): Although there are 55 spaces, including 4 spaces designated as reserved for people with disabilities, there is no van accessible space, parking spaces #1, #3 are 92 inches wide, and there is no vertical signage for parking space #4. On the shortest accessible route to the accessible entrance, provide at least one van accessible space and two standard space designated as reserved for people with disabilities. Standard accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 60 inches wide. Van accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 96 inches wide. All spaces designated as reserved for people with disabilities shall have vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. Van accessible spaces shall have an additional AVan-Accessible@ sign located below the International Symbol of Accessibility. Standards '' 4.1.2(5), 4.1.6(1)(b), 4.6, 4.30.7(1).

b. Parking Near Tennis and Basketball Courts: Although the parking lot has a total of 29 parking spaces, there are no van accessible parking spaces, and none of the designated accessible parking spaces have the required vertical signage. On the shortest accessible route to the accessible entrance, provide 1 van accessible space designated as reserved for people with disabilities. Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide. Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide. At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. At van accessible spaces, provide an additional AVan-Accessible@ sign located below the International Symbol of Accessibility. Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant. Standards '' 4.1.2(5), 4.6, 4.30.7(1).

c. Exterior Entrances: There is no accessible directional signage. Provide accessible directional signage with the International Symbol of Accessibility at inaccessible entrances directing users to the accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances. Standards '' 4.1.3(8)(d), 4.13, 4.30.

d. Unisex Single-User Toilet Room (Altered)

i. The sign to the toilet room is mounted on the door. Provide a toilet room sign with raised and Braille characters. The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards '' 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

ii. The pressure required to open the door is 8 pounds of force. Provide a door that requires no more than 5 pounds of force to open. Standards '' 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

iii. Although the facility contains an emergency alarm system, there is no visual alarm in the toilet room. Provide visual alarm devices in toilet rooms and any other general usage areas (e.g., meeting rooms), hallways, lobbies, and any other area for common use. Such devices shall be integrated into the facility alarm system and shall meet the requirements of the Standards for lamp type, color, pulse duration, intensity, and flash rate. Visual alarm appliances shall be placed 80 inches above the highest floor level within the space or 6 inches below the ceiling, whichever is lower. Visual alarm appliances shall be located such that no place in any room or space, including common corridors or hallways, required to have a visual alarm appliance shall be more than 50 feet from the signal. In large rooms and spaces exceeding 100 feet across, without obstructions 6 feet above the finished floor, devices may be placed around the perimeter, spaced a maximum of 100 feet apart, in lieu of suspending appliances from the ceiling. Standards '' 4.1.3(14), 4.1.6(1)(b), 4.28.3.Visual alarm appliance not provided.

v. There is insufficient turning space within the toilet room. Provide an unobstructed turning space at least 60 inches in diameter or a T-shaped space complying with Fig. 3(b). Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.3, 4.2.3, Fig. 3.

vii. The toilet centerline is 16 inches from the side wall. Provide a toilet with a centerline that measures 18 inches from the near side wall. Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.2, Fig. 28.

viii. The grab bars at the toilet are inaccessible because they are mounted at 40 inches above the finished floor. Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall, and a side grab bar that is at least 42 inches in overall length, with the far end mounted at least 54 inches from the rear wall and the closer end 12 inches or less from the rear wall. Ensure that the grab bars are mounted 33 to 36 inches above the finished floor; with a diameter between 13 and 12 inches; with 12 inches between the grab bars and the wall; and at least 12 inches between the grab bars and any other object, such as a toilet paper dispenser or a toilet seat cover dispenser. Standards '' 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.4, 4.26.2, Fig. 29.

e. Outdoor Drinking Fountains by Locker Rooms (Altered)

i. The wall-mounted, hi-lo drinking fountains by the locker rooms are inaccessible because there is 16 inches of knee space depth. Provide a drinking fountain with clear knee space between the bottom of the apron and the finished floor or ground of at least 27 inches high, 30 inches wide, and 17 to 19 inches deep; and a minimum clear floor space of 30 inches by 48 inches to allow a person in a wheelchair to approach the unit facing forward. Standards '' 4.1.3(10), 4.1.6(1)(b), 4.15.5(1), Figs. 27(a), (b).

ii. The route near the hi-lo drinking fountain is inaccessible because the high fountain is not detectable to a blind person using a cane. Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles. Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor. Standards ' 4.4.

f. Men=s Locker Room

i. There is no signage directing people with disabilities to the accessible toilet room. Provide accessible directional signage with the International Symbol of Accessibility at inaccessible toilet rooms indicating the location of the nearest accessible toilet room, and provide accessible signage with the International Symbol of Accessibility at all accessible toilet rooms. Standards '' 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

ii. No accessible shower is provided in the men=s locker room. Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening. Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable. Standards ' 4.21, Figs. 35, 36, 37.

iii. The benches in the men=s locker room are inaccessible because they are 10 inches wide and are not attached to the wall. Provide a 24 inch by 48 inch bench fixed to the wall along the bench=s longer dimension. Ensure that the bench has sufficient structural strength and is mounted with its surface between 17 inches and 19 inches above the finished floor. Provide clear floor space alongside the bench to allow a person using a wheelchair to make a parallel transfer onto the bench. Standards '' 4.35.4, 4.26.3.

g. Women=s Locker Room

ii. No accessible shower is provided in the women=s locker room. Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening. Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable. Standards ' 4.21, Figs. 35, 36, 37.

iii. The benches in the women=s locker room are inaccessible because they are 10 inches wide and are not attached to the wall. Provide a 24 inch by 48 inch bench fixed to the wall along the bench=s longer dimension. Ensure that the bench has sufficient structural strength and is mounted with its surface between 17 inches and 19 inches above the finished floor. Provide clear floor space alongside the bench to allow a person using a wheelchair to make a parallel transfer onto the bench. Standards '' 4.35.4, 4.26.3.

h. Picnic Area

i. The picnic tables are inaccessible to a person using a wheelchair. Provide at least one picnic table on an accessible route such that there is knee space at the table at least 27 inches high, 30 inches wide, and 19 inches deep, and such that the height of the top of the table is between 28 inches and 34 inches above the ground. Standards '' 4.32.3, 4.32.4.

ii. The route from the picnic area to the barbecue is inaccessible because there is no level or paved area to the barbecue. Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public. The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%). Standards '' 4.3, 4.5, Fig. 7.

i. Children=s Play Areas B Playground, Swing Set, Sandbox

i. None of the play equipment is usable by children with disabilities. Ensure program access by providing at least one piece of play equipment that is on an accessible route and has a transfer platform to enable children who use wheelchairs to use it.

ii. There are no accessible routes to the children=s play areas. Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public. The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of 2 inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%). Standards '' 4.1.3(1), 4.1.6(1)(b), 4.3, 4.5, Fig. 7.

j. Pool Ramps (Altered)

i. Main Pool Ramp: The ramp is inaccessible because it lacks adequate edge protection, has a handrail on one side only, and lacks adequate handrail extensions. Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides. Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface. Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings. ii. Kiddie Pool Ramp: The ramp is inaccessible because it lacks adequate edge protection, and has a handrail on one side only. Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides. Provide handrails that are between 13 inches and 12 inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface. Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.
