Please Note: Paragraph 50 of the Settlement Agreement requires that within three months of the effective date of this Agreement, the County provide signage as necessary to comply with 28 C.F.R. § 35.163(b), after having surveyed all facilities that are the subject of this Agreement for the purpose of identifying those that have multiple entrances not all of which are accessible.

 

Program Access in County Existing Facilities:  In order to ensure that each of the County's programs, services, and activities operating at a facility that is the subject of this Agreement, when viewed in its entirety, is readily accessible to and usable by persons with mobility impairments, the County will take the actions listed below:

 

A.        Within 12 months of the effective date of this Agreement, the County will complete the following modifications to the Administration Building:

 

1.         Throughout the facility, visual alarms are missing in toilet rooms and in some common areas.  Provide visual alarm devices in toilet rooms and any other general usage areas (e.g., meeting rooms), hallways, lobbies, and any other area for common use.  Such devices shall be integrated into the facility alarm system and shall meet the requirements of the Standards for lamp type, color, pulse duration, intensity, and flash rate.  Visual alarm appliances shall be placed 80 inches above the highest floor level within the space or 6 inches below the ceiling, whichever is lower.  Visual alarm appliances shall be located such that no place in any room or space, including common corridors or hallways, required to have a visual alarm appliance shall be more than 50 feet from the signal.  In large rooms and spaces exceeding 100 feet across, without obstructions 6 feet above the finished floor, devices may be placed around the perimeter, spaced a maximum of 100 feet apart, in lieu of suspending appliances from the ceiling.  Standards § 4.28.3.

 

2.         Throughout the facility, permanent number rooms signs are mounted on the doors and do not have raised and Braille characters.  Provide permanent room number signs with upper case, sans serif or simple serif type letters and numerals, meeting the requirements of the Standards for character height, raised characters, finish and contrast, accompanied by Grade 2 Braille; mounted on the wall adjacent to the latch side of the door or on the nearest adjacent wall at a height of 60 inches above the finished floor to the centerline of the sign; and located so that a person may approach within 3 inches of the signage without encountering protruding objects or standing within the swing of a door.  Standards §§ 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

3.         The ramp to the main entrance does not have handrails.  Provide handrails that are between 1¼ inches and 1½ inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards § 4.8.5.No handrails are provided.

 

4.         The main entrance has no signage indicating that it is the accessible route for persons with disabilities and the inaccessible entrances have no directional signage.  Provide accessible directional signage with the International Symbol of Accessibility at inaccessible entrances directing users to the accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances.  Standards §§ 4.1.3(8)(d), 4.13, 4.30.

 

5.         The interior doors at the main entrance require 10 pounds of force to operate.  Provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

 

6.         Drinking Fountain (North End Near Men's Toilet Room):  There is no drinking fountain accessible to people who have trouble bending or stooping.  For each lower drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards §§ 4.15, 4.27.4, Fig. 27.

 

7.         Drinking Fountain - East Break Room:  The wall-mounted drinking fountain at the east break room lacks adequate knee space for persons using wheelchairs, the placement of the vending machine prevents a side approach, and there is no drinking fountain for people who have problems bending or stooping.  Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Ensure that fountain controls are operable with one hand, require 5 pounds of force or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards §§ 4.15, 4.27.4, Fig. 27.

 

8.         Main Entrance Reception Counter: The counter at the main entrance is mounted 43 inches above the finished floor.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards §§ 7.2(2), 4.3.

 

9.         County Engineer Counter: The counter is mounted 43 inches above the finished floor.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards §§ 7.2(2), 4.3.

 

10.       Main Free Holder Room:  Although there are 50 or more fixed seats, there is no assistive listening system.  Provide a permanently installed assistive listening system serving the fixed seating.  Ensure that the seating served by the system is located within a 50 foot viewing distance of the stage or playing area and has a complete view of the stage or playing area.  Provide at least 4 receivers for use by the general public and signage indicating their availability.  Standards §§ 4.30, 4.33.

 

11.       Men's Toilet Room With Stalls - North End

 

A.        The toilet room sign is mounted on the door and lacks the International Symbol of Accessibility and raised and Braille characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         From inside the toilet room, which is accessed using a front approach, the door has only 15 ½ inches of maneuvering clearance on the pull/latch side.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards § 4.13.6, Fig. 25(a).

 

C.        Toilet Stall for Persons with Disabilities

 

A.        The stall door swings into the clear floor space required at the toilet.  Ensure that no door swings into the required clear floor space at any accessible fixture.  Standards §§ 4.1.3(11), 4.22.2.

 

B.         The stall door hardware requires twisting of the wrist to operate.  Provide a door with hardware usable with one hand and without tight grasping, pinching, or twisting of the wrist.  Lever-operated, push-type, and U-shaped handles are acceptable designs.  Standards § 4.13.9.

 

C.        The toilet seat is 16 inches above the finished floor.  Provide a toilet with a seat that measures 17 to 19 inches above the finished floor.  Standards §§ 4.16.3, 4.17.2, Fig. 30(d).

 

12.       Women's Toilet Room With Stalls - North End

 

A.        The toilet room sign is mounted on the door and lacks the International Symbol of Accessibility and raised and Braille characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         From inside, the door, which is accessed using a forward approach, has only 15 ½ inches of maneuvering clearance on the latch/pull side.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards § 4.13.6, Fig. 25(a).

 

C.        The toilet room door requires 6 pounds to operate.  Provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

 

D.        The toilet stall for persons using wheelchairs has a door which swings into the toilet clear floor space at the toilet and the latch is broken.  Provide a toilet stall that is at least 60 inches wide and at least 56 inches deep for a wall-mounted toilet or at least 59 inches deep for a floor-mounted toilet, such that the centerline of the toilet is exactly 18 inches from the near side wall or partition, and there is at least 9 inches of toe clearance above the floor at the front partition if the stall is no more than 60 inches deep.  Standards § 4.17, Fig. 30.

 

E.         Toilet Stall for People with Disabilities

 

A.        The stall door hardware requires twisting of the wrist to operate.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards § 4.13.9.

 

B.         The stall door swings into the required clear floor space at the toilet.  Ensure that no door swings into the required clear floor space at any accessible fixture.  Standards §§ 4.1.3(11), 4.22.2.

 

C.        The flush control is on the "closed" side.  Provide a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards §§ 4.16.5, 4.17.2, 4.27.4.

 

13.       Men's Toilet Room With Stalls (Next to the Office of the County Superintendent of Schools)

 

A.        The toilet room sign is mounted on the door and lacks the International Symbol of Accessibility and raised and Braille characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         Lavatory

 

A.        There is insufficient floor space centered on the lavatory and the door swings into the required clear floor space.  Provide a lavatory with clear floor space at least 30 inches wide and 48 inches deep centered on the lavatory and ensure that no door swings into the required clear floor space at any accessible fixture.  Standards §§ 4.1.3(11), 4.22.2..  Standards § 4.19.3, Fig. 32.

 

B.         The top of lavatory rim is 32 inches above the finished floor and cabinets under the lavatory obstruct the required knee and toe clearances.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31.  Standards § 4.19.2, Fig. 31.

 

C.        Toilet Stall for Persons with Disabilities

 

A.        The stall door hardware requires twisting of the wrist to operate.  Provide a door with hardware usable with one hand and without tight grasping, pinching, or twisting of the wrist.  Lever-operated, push-type, and U-shaped handles are acceptable designs.  Standards § 4.13.9.

 

B.         The flush control is mounted 50 inches above the finished floor and is on the "closed" side.  Provide a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards §§ 4.16.5, 4.17.2, 4.27.4.

 

C.        The overall length of the side grab bar is 24 inches and the distance of its farther end to the rear wall is less than 52 inches.  Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Standards § 4.17.6, Figs. 30(a), (d).

 

14.       Women's Toilet Room With Stalls - West End

 

A.        The toilet room sign is mounted on the door and lacks the International Symbol of Accessibility and raised and Braille characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         There is insufficient clear floor space centered on the lavatory and the toilet stall door swings into the clear floor space.  Provide a lavatory with clear floor space at least 30 inches wide and 48 inches deep centered on the lavatory.  Standards § 4.19.3, Fig. 32.  Ensure that no door swings into the required clear floor space at any accessible fixture.  Standards §§ 4.1.3(11), 4.22.2.

 

C.        Toilet Stall for Persons with Disabilities

 

A.        The stall door hardware requires twisting of the wrist to operate.  Provide a door with hardware usable with one hand and without tight grasping, pinching, or twisting of the wrist.  Lever-operated, push-type, and U-shaped handles are acceptable designs.  Standards § 4.13.9.

 

B.         The overall length of the side grab bar is 24 inches and the distance of its farther end to the rear wall is less than 52 inches.  Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Standards § 4.17.6, Figs. 30(a), (d).

 

15.       Men's Toilet Room with Stalls - East End

 

A.        The toilet room sign is mounted on the door and lacks the International Symbol of Accessibility and raised and Braille characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         From the room's interior, the door to the toilet room, which is accessed through a front approach, has only 6 inches of maneuvering clearance on the latch/pull side.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards § 4.13.6, Fig. 25(a).

 

C.        Toilet Stall for Persons with Disabilities:  The top of the toilet seat is 16 inches above the finished floor, the centerline measures 20 inches from the side wall, and the flush control is on the "closed" side of the stall.  Provide a toilet with a seat that measures 17 to 19 inches above the finished floor, a centerline that measures 18 inches from the near side wall, and a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards §§ 4.1.3(11), 4.22.4, 4.16.5, 4.17.2, 4.27.4, 4.16.3, Fig. 30(d), 4.17.3.

 

16.       Women's Toilet Room with Stalls - East End

 

A.        The toilet room sign is mounted on the door and lacks the International Symbol of Accessibility and raised and Braille characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         The toilet room door is inaccessible because the pressure required to open the door is 20 pounds.  Provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

 

C.        The door to the toilet room, which is accessed from inside the room through a forward approach, has only 6 inches of maneuvering clearance on the latch/pull side.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards § 4.13.6, Fig. 25(a).

 

D.        The sanitary napkin dispenser controls require twisting of the wrist to operate.  Provide a feminine napkin dispenser with mechanical controls, if any, that can be operated with 5 pounds of force or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards § 4.27.4.

 

E.         Toilet Stall for Persons with Disabilities

 

A.        The top of the toilet seat is 16 inches above the finished floor.  Provide a toilet with a seat that measures 17 to 19 inches above the finished floor.  Standards §§ 4.16.3, 4.17.2, Fig. 30(d).

 

B.         The toilet centerline measures 20 inches from the side wall.  Provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards § 4.17.3, Fig. 30.

 

17.       Men's Single User Toilet Room - South End. 

 

A.        The toilet room sign is mounted on the door and lacks the International Symbol of Accessibility and raised and Braille characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         The toilet room door swings into the required clear floor space at the lavatory.  Ensure that no door swings into the required clear floor space at any accessible fixture.  Standards §§ 4.1.3(11), 4.22.2.

 

C.        The paper towel dispenser controls are mounted at 65 inches above the finished floor.  Provide a paper towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

D.        The lavatory controls require 9 pounds of force to operate.  Provide lavatory controls with mechanical controls, if any, that can be operated with 5 pounds of force or less and that can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards § 4.27.4.

 

E.         The top of the toilet seat is 16 inches above the finished floor.  Provide a toilet with a seat that measures 17 to 19 inches above the finished floor.  Standards § 4.16.3, Fig. 29(b).

 

F.         The toilet centerline measures 17 inches from the side wall.  Provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards § 4.16.2, Fig. 28.

 

G.        The toilet flush control is on the "closed" side.  Provide a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards §§ 4.16.5, 4.17.2, 4.27.4.

 

18.       Women's Single User Toilet Room - South End.

 

A.        The toilet room sign is mounted on the door and lacks the International Symbol of Accessibility and raised and Braille characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         The toilet room door swings into the required clear floor space at the lavatory.  Ensure that no door swings into the required clear floor space at any accessible fixture.  Standards §§ 4.1.3(11), 4.22.2.

 

C.        The paper towel dispenser controls are 65 inches above the finished floor.  Provide a paper towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

D.        The top of the toilet seat is 16 inches above the finished floor.  Provide a toilet with a seat that measures 17 to 19 inches above the finished floor.  Standards § 4.16.3, Fig. 29(b).

 

E.         The toilet centerline measures 16½  inches from the side wall.  Provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards § 4.16.2, Fig. 28.

B.         Within 12 months of the effective date of this Agreement, the County will complete the following modifications in the Physical Therapy Area of the Health Department Building:

 

1.         Ramp:  The ramp is inaccessible because its slope exceeds 1:12 and it lacks handrails on both sides of the ramp, the handrails do not return smoothly,  and they lack 12 inch extensions at the top and bottom.  Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides.  Provide handrails that are between 1¼ inches and 1½ inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces.  Standards §§ 4.3.8, 4.8.

 

2.         Unisex Single User Toilet Room - #407

 

A.        The toilet room sign is mounted on the door and does not contain the International Symbol of Accessibility and raised or Braille characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         The mirror is not accessible.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards § 4.19.6.

 

C.        The lavatory hot water pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

 

D.        The toilet flush control is on the "closed" side.  Provide a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards §§ 4.16.5, 4.17.2, 4.27.4

 

E.         The toilet paper dispenser is not under the side grab bar.  Provide a toilet paper dispenser that is mounted with its top at least 1½ inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards § 4.17.3, Fig. 30(d).

 

F.         The overall length of the wall-side grab bar at the toilet  is 31 inches and it is mounted 30 ½ above the finished floor.  Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Standards § 4.17.6, Figs. 30(a), (d).

 

G.        There is no rear grab bar.  Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall; mounted 33 to 36 inches above the finished floor; with a diameter between 1¼ and 1½ inches; with 1½ inches between the grab bar and the wall; and at least 1½ inches between the grab bar and any other object, such as a toilet seat cover dispenser.  Standards §§ 4.16.4, 4.26.2, Fig. 29.

 

H.        The freestanding side grab bar interferes with the ability of persons using wheelchairs to transfer onto the toilet.  Provide clear floor space at the toilet that complies with Fig. 28.  Standards § 4.16.2, Fig. 28.

 

C.        Within 12 months of the effective date of this Agreement, the County will complete the following modifications in the Health Department Building at 4 Moore Road:

 

1.         Throughout the facility, visual alarms are missing in toilet rooms and in some common areas.  Provide visual alarm devices in toilet rooms and any other general usage areas (e.g., meeting rooms), hallways, lobbies, and any other area for common use.  Such devices shall be integrated into the facility alarm system and shall meet the requirements of the Standards for lamp type, color, pulse duration, intensity, and flash rate.  Visual alarm appliances shall be placed 80 inches above the highest floor level within the space or 6 inches below the ceiling, whichever is lower.  Visual alarm appliances shall be located such that no place in any room or space, including common corridors or hallways, required to have a visual alarm appliance shall be more than 50 feet from the signal.  In large rooms and spaces exceeding 100 feet across, without obstructions 6 feet above the finished floor, devices may be placed around the perimeter, spaced a maximum of 100 feet apart, in lieu of suspending appliances from the ceiling.  Standards § 4.28.3.

 

2.         Throughout the facility, permanent room number signs are painted on the doors.  Provide permanent room number signs with upper case, sans serif or simple serif type letters and numerals, meeting the requirements of the Standards for character height, raised characters, finish and contrast, accompanied by Grade 2 Braille; mounted on the wall adjacent to the latch side of the door or on the nearest adjacent wall at a height of 60 inches above the finished floor to the centerline of the sign; and located so that a person may approach within 3 inches of the signage without encountering protruding objects or standing within the swing of a door.  Standards §§ 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

3.         No handrails are provided at the ramp to the main entrance.  Provide handrails that are between 1¼ inches and 1½ inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards § 4.8.5.

 

4.         The ramp to the side entrance only has a handrail only on one side, the handrail is not mounted between 34 and 38 inches above the finished surface of the ramp, and the handrail lacks a 12 inch extension at the bottom.  Provide handrails that are between 1¼ inches and 1½ inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards § 4.8.5.Handrails are not provided on both sides of the ramp.

 

5.         Drinking Fountain - First Floor:  The water flow of the lower fountain does not measure at least 4 inches and no fountain is provided for people who have difficulty bending or stooping.  Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Ensure that fountain controls are operable with one hand, require 5 pounds of force or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards §§ 4.15, 4.27.4, Fig. 27.

 

6.         Drinking Fountain - Second Floor

 

A.        The water flow of the lower fountain does not measure at least 4 inches, there is inadequate knee and toe clearance and not parallel approach is possible, and there is no fountain for people who have difficulty bending or stooping.  Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Ensure that fountain controls are operable with one hand, require 5 pounds of force or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards §§ 4.15, 4.27.4, Fig. 27.

 

7.         Telephone - Near Main Entrance

 

A.        The telephone at main entrance lacks volume control and is not hearing aid compatible.  Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards.  Standards §§ 4.31, 4.30.7(2).

 

8.         Unisex Single User Toilet Room - #113 (Near The Public Waiting Room)

 

A.        The toilet room sign is mounted on the door and lacks the International Symbol of Accessibility and raised and Braille characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         The door hardware requires twisting of the wrist to operate.  Provide a door with hardware usable with one hand and without tight grasping, pinching, or twisting of the wrist.  Lever-operated, push-type, and U-shaped handles are acceptable designs.  Standards § 4.13.9.

 

C.        The mirror is not accessible.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards § 4.19.6.

 

D.        The lavatory hot water pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

 

E.         The door swings into the required clear floor space at the lavatory.  Ensure that no door swings into the required clear floor space at any accessible fixture.  Standards § 4.22.2.

 

F.         The toilet flush control is on the "closed" side.  Provide a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards §§ 4.16.5, 4.17.2, 4.27.4.

 

G.        There are no grab bars at the toilet.  Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall, and a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Ensure that the grab bars are mounted 33 to 36 inches above the finished floor; with a diameter between 1¼ and 1½ inches; with 1½ inches between the grab bars and the wall; and at least 1½ inches between the grab bars and any other object, such as a toilet paper dispenser or a toilet seat cover dispenser.  Standards §§ 4.16.4, 4.26.2, Fig. 29.

 

9.         Unisex Single User Toilet Room - #125 Near The Public Waiting Room

 

A.        The toilet room sign is mounted on the door and lacks the International Symbol of Accessibility and Braille and raised characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

G.        The wall-side grab bar at the toilet has an overall length of 29 inches, has its farthest end mounted less than 52 inches from the rear wall, and is mounted 31 inches above the finished floor.  Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall; mounted 33 to 36 inches above the finished floor; with a diameter between 1¼ and 1½ inches; with 1½ inches between the grab bar and the wall; and at least 1½ inches between the grab bar and any other object, such as the toilet paper dispenser.  Standards §§ 4.16.4, 4.26.2, Fig. 29.

 

H.        There is no rear grab bar.  Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall; mounted 33 to 36 inches above the finished floor; with a diameter between 1¼ and 1½ inches; with 1½ inches between the grab bar and the wall; and at least 1½ inches between the grab bar and any other object, such as a toilet seat cover dispenser.  Standards §§ 4.16.4, 4.26.2, Fig. 29.

10.       Elevator

 

A.        Audible and visual hall arrival signals are not provided.  Provide visual car position indicators above the car control panel or over the door to show the position of the elevator in the hoistway.  Ensure that indicators emit an audible and visual signal as the car passes or stops at a floor served by the elevator, with the corresponding floor designation being illuminated; and that numerals are a minimum of ½ inch high.  Standards § 4.10.13.

 

B.         The elevator lacks signage at the hoistways on each floor.  Provide signage at all hoistway entrances with raised and Braille floor designations on both jambs such that the centerline of the characters is 60 inches above the finished floor and the characters are 2 inches high.  Standards § 4.10.5, Fig. 20.

 

C.        The car position indicators do not ring as the car passes or stops at floors.  Provide visual car position indicators above the car control panel or over the door to show the position of the elevator in the hoistway.  Ensure that indicators emit an audible and visual signal as the car passes or stops at a floor served by the elevator, with the corresponding floor designation being illuminated; and that numerals are a minimum of ½ inch high.  Standards § 4.10.13.

 

11.       Environmental Services

 

A.        The route to the service counter at Environmental Services is inaccessible.  Provide at least one accessible route that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards §§ 4.3, 4.5, Fig. 7.

 

B.         The service counter is mounted 42 inches above the finished floor.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards §§ 7.2(2), 4.3.

 

12.       Men's Toilet Room with Stalls - Environmental Sciences Building Room #208  

 

A.        The toilet room sign is mounted on the door and lacks the International Symbol of Accessibility and raised and Braille characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         The mirror is not accessible.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards § 4.19.6.

 

C.        Both paper towel dispensers are mounted too high to be used by persons who use wheelchairs.  Provide at least one paper towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

D.        The lavatory is inaccessible because the hot water pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

 

E.         The paper towel dispenser closest to the door is a protruding object that is not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards § 4.4.

 

F.         There is no toilet stall for people who use wheelchairs.  Provide a "standard" accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall's elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, coat hook, and dispensers, comply with the Standards.  Standards §§ 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

 

13.       Women's Toilet Room with Stalls - Environmental Sciences Building Room #206

 

A.        The toilet room sign is mounted on the door and lacks the International Symbol of Accessibility and raised and Braille characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         The mirror is not accessible.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards § 4.19.6. 

 

C.        The paper towel dispenser controls are 57 inches above the finished floor.  Provide a paper towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

D.        The sanitary napkin dispenser and the paper towel holder are protruding objects that are not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards § 4.4.

 

E.         The lavatory hot water pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

 

F.         There is no toilet stall for persons who use wheelchairs.  Provide a "standard" accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall's elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards §§ 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

 

D.        Within 12 months of the effective date of this Agreement, the County will complete the following modifications in Correctional Center located at 125 Crest Haven Road:

 

1.         Parking

 

A.        No access aisles are provided at the parking spaces reserved for persons with disabilities.  At each standard accessible space, provide an access aisle at least 60 inches wide.  At each van accessible space, provide an access aisles at least 96 inches wide.  Ensure that all access aisles are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards §§ 4.1.2(5), 4.6.3, Fig. 9.

 

B.         The signage designating parking as reserved for persons with disabilities is too low.  At each space designated as reserved for persons with disabilities, provide a vertical sign with the International Symbol of Accessibility located such that it cannot be obstructed by vehicles parked in the space.  Standards §§ 4.6.4, 4.30.7(1).

 

C.        The van accessible parking reserved for persons with disabilities lacks the appropriate signage.  At van accessible spaces, provide a "Van-Accessible" sign located below the International Symbol of Accessibility such that the sign cannot be obstructed by vehicles parked in the space.  Standards §§ 4.6.4, 4.30.7(1).

 

2.         Cells and Dormitories: There are no accessible cells or dormitories for persons with disabilities in the current correctional facility.  The County has construction underway and will be opening a new correctional facility within the calendar year.  Before this facility is opened, the County will allow the Department to conduct an inspection to confirm that there are cells and dormitories that are accessible to persons with disabilities.  If issues are identified, the County will modify the facility as directed by the Department within a reasonable period of time.

 

3.         Men's Single User Toilet Room - Visitors Lobby

 

A.        The toilet room sign is mounted on the door and lacks raised and Braille characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         The pressure required to open the room door is 10 pounds.  Provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

 

C.        There is inadequate clear floor space centered on the lavatory.  Provide a lavatory with clear floor space at least 30 inches wide and 48 inches deep centered on the lavatory.  Standards § 4.19.3, Fig. 32.

 

D.        There is insufficient clear floor space at the toilet.  Provide clear floor space at the toilet that complies with Fig. 28.  Standards § 4.16.2, Fig. 28.

 

4.         Women's Single User Toilet Room - Visitors Lobby

 

A.        The toilet room sign is mounted on the door and lacks raised and Braille characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         The pressure required to open the room door is 8 pounds.  Provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

 

C.        The mirror is not accessible.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards § 4.19.6.

 

5.         Telephones

 

A.        The public telephone is not hearing aid compatible.  Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards.  Standards §§ 4.31, 4.30.7(2).

 

B.         The public telephone is a protruding object that is not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards § 4.4.

 

E.         Within 6 months of the effective date of this Agreement, the County will complete the following modifications in Juvenile Family Crisis Intervention and Family Court Assessment Team - North Trailer Office Building:

 

1.         The ramp lacks appropriate handrails.  Provide handrails that are between 1¼ inches and 1½ inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards § 4.8.5.

 

2.         Parking Lot:  There are no access aisles serving the spaces designated for persons with disabilities, no space is designated as "van accessible," the signage that is provided is too low, and the parking surface is not firm, stable, or slip resistant.  On the shortest accessible route to the accessible entrance, provide an appropriate number of van accessible spaces and standard spaces designated as reserved for people with disabilities.  Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards §§ 4.1.2(5), 4.6, 4.30.7(1).

 

3.         Juvenile Family Crisis Intervention:  The entrance door has knob hardware.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards § 4.13.9.

 

4.         Interior Ramp - Juvenile Family Crisis Intervention:  The ramp lacks handrails.  Provide handrails that are between 1¼ inches and 1½ inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards §§ 4.1.2(1), 4.1.2(2), 4.1.6(1)(b), 4.8.5.

 

5.         Old Unisex Single User Toilet Rooms - Juvenile Family Crisis Intervention: There is no signage at the inaccessible toilet rooms directing people with disabilities to the accessible toilet rooms.  Provide accessible directional signage with the International Symbol of Accessibility at inaccessible toilet rooms indicating the location of the nearest accessible toilet room, and provide accessible signage with the International Symbol of Accessibility at all accessible toilet rooms.  Standards §§ 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

 

6.         New Unisex Toilet Room for Persons with Disabilities:

 

A.        The room sign is mounted on the door.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         The toilet flush control is on the "closed" side of the room.  Provide a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.5, 4.27.4.

 

F.         Within 12 months of the effective date of this Agreement, the County will complete the following modifications in Cape Counseling Behavioral Health Care Services - Building A:

 

1.         Parking Lot:  There are no access aisles serving the spaces designated as reserved for persons with disabilities, the signs are too low, and there is no space designated as "van-accessible."  On the shortest accessible route to the accessible entrance, provide at least 1 van accessible space and an appropriate number of standard spaces designated as reserved for people with disabilities.  Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards §§ 4.1.2(5), 4.1.6(1)(b), 4.6, 4.30.7(1).

 

2.         Ramp from the Sidewalk to the Entry Landing:  The slope of the ramp exceeds 1:12, it lacks edge protection, there is a handrail only on 1 side, the handrail that is provided is too low, and the landing at the top of the ramp is not level, due to a built-up ramp at the door entrance.  Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides.  Provide handrails that are between 1¼ inches and 1½ inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces.  Standards §§ 4.3.8, 4.8.

 

3.         Ramp On Landing of Main Entrance: 

 

A.        The surface of the ramp is not firm, stable, and slip resistant because the concrete at the bottom edge of the ramp is broken, the slope of the ramp exceeds 1:12, the cross slope exceeds 1:50, and there is no edge protection.  Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides.  Provide handrails that are between 1¼ inches and 1½ inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces.  Standards §§ 4.3.8, 4.8.

 

B.         Due to this ramp, there is no level landing at the doorway.  Provide a door so that the floor or ground area within the required clearances is level and clear.  Standards §§ 4.1.3(7)(a), 4.1.6(1)(b), 4.13.6, Fig. 25.

 

4.         Drinking Fountain:  Seven pounds of force are required to operate the lower fountain and no fountain is provided for people who have trouble bending or stooping.  Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Ensure that fountain controls are operable with one hand, require 5 pounds of force or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards §§ 4.15, 4.27.4, Fig. 27.

 

5.         Unisex Single User Toilet Room - Main Office

 

A.        The toilet room sign is mounted on the door and lacks the International Symbol of Accessibility and raised and Braille characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         The lavatory hot water pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

 

C.        The toilet room door swings into the required clear floor space at the lavatory.  Ensure that no door swings into the required clear floor space at any accessible fixture.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.2.

 

D.        The toilet flush control is on the "closed" side.  Provide a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards §§ 4.16.5, 4.17.2, 4.27.4.

 

6.         Unisex Single User Toilet Room - Children's Partial Care

 

A.        There is no International Symbol of Accessibility, no raised or Braille characters, and the sign is not mounted on the wall to the latch side of the door.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         The lavatory hot water pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

 

C.        The toilet room door swings into the required clear floor space at the lavatory.  Ensure that no door swings into the required clear floor space at any accessible fixture.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.2.

 

D.        The toilet centerline measures 15 ½  inches from the side wall.  Provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards § 4.16.2, Fig. 28. 

 

E.         The toilet paper dispenser is mounted above the side grab bar.  Provide a toilet paper dispenser that is mounted within reach, with its top at least 1½ inches under the side grab bar, and centered at least 19 inches above the finished floor.  Standards § 4.16.6, Fig. 29(b).

 

G.        Within 6 months of the effective date of this Agreement, the County will complete the following modifications in the Hall of Records:

 

1.         Parking:  None of the spaces reserved for persons with disabilities have access aisles and there is no space designated as "van accessible."  At each standard accessible space, provide an access aisle at least 60 inches wide.  At each van accessible space, provide an access aisles at least 96 inches wide.  Ensure that all access aisles are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards §§ 4.1.2(5), 4.6.3, Fig. 9.  At van accessible spaces, provide a "Van-Accessible" sign located below the International Symbol of Accessibility such that the sign cannot be obstructed by vehicles parked in the space.  Standards §§ 4.6.4, 4.30.7(1).

 

2.         Drinking Fountain - Main Corridor:  There is no drinking fountain that is accessible to persons who have difficulty bending or stooping.  For each lower drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards §§ 4.1.3(10)(a), 4.1.6(1)(b).

 

3.         Drinking Fountain - Rear Hall:  No fountain is provided for persons who have trouble bending or stooping.  For each lower drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards §§ 4.15, 4.27.4, Fig. 27.

 

4.         County Records Room:  The door uses knob hardware and requires 13 pounds of force to operate.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards § 4.13.9.  Provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

 

5.         Tax Board Room: 

 

A.        The door uses knob hardware and requires 13 pounds of force to operate.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards § 4.13.9.  Provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

 

B.         The main counter is mounted 43 inches above the finished floor and the tax record counter is 42 inches above the finished floor and no method of equivalent facilitation is provided.  For each, provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.  Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards §§ 7.2(2), 4.3.

 

C.        The computer counter at is inaccessible because it is mounted 41 inches above the finished floor and there is no directional signage to indicate the accessible computers in the County Records Room.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards §§ 7.2(2), 4.3.

 

6.         Tax Records Room:  The counter is mounted 43 ½ inches above the finished floor.  Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation.   Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means.  Standards §§ 7.2(2), 4.3.

 

7.         Toilet Rooms on the Main Corridor and South Side: The County will provide measurements and detailed, well-labeled of all elements of these toilet rooms, including approach, entry, and exit; room sign; lavatories, urinals, and toilets; stall walls and configuration; door swings, and all dispensers and mirrors.

 

H.        Within 12 months of the effective date of this Agreement, the County will complete the following modifications in the Sheriff's Office:

 

1.         The front entrance has knob door hardware.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards § 4.13.9.

 

2.         Men's Single User Toilet Room - Main Annex

 

A.        The toilet room sign is mounted on the door and lacks the International Symbol of Accessibility and raised and Braille characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         The door to the toilet room has a clear opening width of only 28 inches and it has knob hardware.  Provide a door with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop.  Standards § 4.13.5, Fig. 24.  Also ensure that the door hardware is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards § 4.13.9.

 

C.        The toilet room door swings into the required clear floor space at the lavatory.  Ensure that no door swings into the required clear floor space at any accessible fixture.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.2.

 

D.        The door to the toilet room, which is accessed through a front approach, is inaccessible because it lacks maneuvering space on the pull side of the door.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards § 4.13.6, Fig. 25(a).

 

E.         There is no visual alarm appliance in the toilet room.  Provide visual alarm devices in toilet rooms and any other general usage areas (e.g., meeting rooms), hallways, lobbies, and any other area for common use.  Such devices shall be integrated into the facility alarm system and shall meet the requirements of the Standards for lamp type, color, pulse duration, intensity, and flash rate.  Visual alarm appliances shall be placed 80 inches above the highest floor level within the space or 6 inches below the ceiling, whichever is lower.  Visual alarm appliances shall be located such that no place in any room or space, including common corridors or hallways, required to have a visual alarm appliance shall be more than 50 feet from the signal.  In large rooms and spaces exceeding 100 feet across, without obstructions 6 feet above the finished floor, devices may be placed around the perimeter, spaced a maximum of 100 feet apart, in lieu of suspending appliances from the ceiling.  Standards § 4.28.3.

 

F.         The mirror is not accessible.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards § 4.19.6.

 

G.        The paper towel dispenser controls are 58 inches above the finished floor.  Provide a paper towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

H.        The lavatory hot water pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

 

I.          There is insufficient clear floor space at the toilet.  Provide clear floor space at the toilet that complies with Fig. 28.  Standards § 4.16.2, Fig. 28.

 

J.          The toilet flush control is on the "closed" side.  Provide a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.5, 4.27.4.

 

K.        The toilet's side grab bar has an overall length of 28 inches and is mounted 41 inches above the finished floor.  The rear grab bar has an overall length of 29 inches.  Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall, and a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Ensure that the grab bars are mounted 33 to 36 inches above the finished floor; with a diameter between 1¼ and 1½ inches; with 1½ inches between the grab bars and the wall; and at least 1½ inches between the grab bars and any other object, such as a toilet paper dispenser or a toilet seat cover dispenser.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.4, 4.26.2, Fig. 29.

 

3.         Women's Single User Toilet Room - Main Annex

 

A.        The toilet room sign is mounted on the door and lacks the International Symbol of Accessibility and raised and Braille characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

F.         The lavatory hot water pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

 

G.        The bottom edge of the lavatory apron is 27 inches above the finished floor.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31.  Standards § 4.19.2, Fig. 31. 

 

H.        The toilet is not accessible to persons who use wheelchairs.  Provide a toilet such that all of its elements, including clear floor space, water closet, grab bars, controls, and dispensers, comply with the Standards.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22, 4.13, 4.16, 4.18, 4.19, 4.26, 4.27, 4.30, Figs. 28, 29.

 

I.          Within 12 months of the effective date of this Agreement, the County will complete the following modifications in the Youth Shelter:

 

1.         The parking reserved for persons with disabilities lacks appropriate signage.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility.  Standards §§ 4.6.4, 4.30.7(1).

 

2.         The ramp sidewalk to the main entrance lacks handrails.  Provide handrails that are between 1¼ inches and 1½ inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards § 4.8.5.

 

3.         There is no fountain accessible for people who have trouble bending or stooping.  For each lower drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards §§ 4.15, 4.27.4, Fig. 27.

 

4.         Drinking Fountain - Recreation Area:  Although a lower drinking fountain is provided, none is provided for persons who have difficulty bending or stooping.  For each lower drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards §§ 4.15, 4.27.4, Fig. 27.

 

5.         Girls' Toilet and Shower Room

 

A.        The toilet room sign is mounted on the door and lacks the International Symbol of Accessibility and raised and Braille characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         The lavatory hot water pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

 

C.        The toilet flush control is on the "closed" side.  Provide a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards §§ 4.16.5, 4.17.2, 4.27.4.

 

D.        There is no shower that is accessible to persons who use wheelchairs. Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards § 4.21, Figs. 35, 36, 37.

 

6.         Boys' Toilet and Shower Room

 

A.        The toilet room sign is mounted on the door and lacks the International Symbol of Accessibility and raised and Braille characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         The lavatory hot water pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

 

C.        No shower is provided for persons who use wheelchairs.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards § 4.21, Figs. 35, 36, 37.

 

7.         Routes to Basketball and Tennis Courts:  The routes to the basketball and tennis courts are not on level, firm, stable, and slip resistant surfaces.  Provide at least one accessible route within the boundary of the site to the basketball courts and to the tennis courts that, to the maximum extent feasible, coincide with the route for the general public.  The accessible routes must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards §§ 4.3, 4.5, Fig. 7.

 

J.          Within 12 months of the effective date of this Agreement, the County will complete the following modifications in Victim Advocacy Center:

 

1.         The top landing of the main entrance ramp is not large enough and the handrails do not extend at the top.  Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides.  Provide handrails that are between 1¼ inches and 1½ inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces.  Standards §§ 4.3.8, 4.8.

 

2.         Men's Toilet Room with Stalls - South Hall

 

A.        The toilet room sign is mounted on the door and does not contain the International Symbol of Accessibility or raised or Braille characters. Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         The door has a clear opening width of only 27 inches and has knob hardware.  Provide a door with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop.  Ensure that the door hardware is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards §§ 4.13.9, 4.13.5, Fig. 24.

 

C.        The marble threshold at the door is 1 inch high.  Provide a door with a threshold no greater than ¼ inch, or between ¼ inch and ½ inch and beveled with a slope no greater than 1:2.  Standards §§ 4.13.8, 4.5.2.

 

D.        There is inadequate maneuvering clearance on the latch/pull side of the toilet room door, which requires a forward approach.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards § 4.13.6, Fig. 25(a).

 

E.         The toilet room door swings into the required clear floor space at the lavatory.  Ensure that no door swings into the required clear floor space at any accessible fixture.  Standards § 4.22.2.

 

F.         The mirror is not accessible.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor. Standards § 4.19.6.

 

G.        The paper towel dispenser controls are 63 inches above the finished floor.  Provide a paper towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

 

H.        The lavatory hot water pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

 

I.          There is no toilet stall for persons with disabilities.  Provide a "standard" accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall's elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards §§ 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

 

3.         Women's Single-User Toilet Room - South Hall

 

A.        The toilet room sign is mounted on the door and does not contain the International Symbol of Accessibility or raised or Braille characters.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

 

B.         The toilet room door swings into the required clear floor space at the lavatory.  Ensure that no door swings into the required clear floor space at any accessible fixture.  Standards § 4.22.2.

 

C.        The mirror is not accessible.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards § 4.19.6. 

 

D.        The bottom edge of the lavatory apron is 27 inches above the finished floor.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31.  Standards § 4.19.2, Fig. 31.

 

E.         The lavatory hot water pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

 

F.         The toilet flush control  is on the "closed" side.  Provide a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards §§ 4.16.5, 4.17.2, 4.27.4 The toilet flush control is on the "closed" side.

 

G.        The overall length of the toilet's side grab bar is 12 inches.  Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Standards § 4.17.6, Figs. 30(a), (d).

 

4.         Drinking Fountain - South Hall:  Access to the drinking fountain is obstructed by stored items and office equipment.  Provide at least one accessible route to the drinking fountain that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards §§ 4.3, 4.5, Fig. 7.

 

K.        Within 3 months of the effective date of this Agreement, the County will complete the following modifications in the Board of Elections Facility:

 

1.         The ramp to the main entrance has a handrail only on one side.  Provide handrails that are between 1¼ inches and 1½  inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards § 4.8.5.

 

L.         Within 6 months of the effective date of this Agreement, the County will complete the following modifications in the Cape May County Park:

 

1.         There is inadequate parking provided for persons with disabilities at the East Shelter, the White Shelter on the Lake, the Grill Area Across from the White Shelter, the Picnic and Recreation Facilities' Grill Area, and the Zoo.  On the shortest accessible routes to the accessible entrances, for each of these lots (scoped separately), provide the required number of van accessible spaces and standard spaces designated as reserved for people with disabilities.  Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards §§ 4.1.2(5), 4.6, 4.30.7(1).

 

2.         There is no accessible route from the adjacent parking to the East Picnic Shelter, East Toilet Room, Shelter #1, or the Play Area.  Provide accessible routes within the boundary of the site from the parking areas to each of these elements that, to the maximum extent feasible, coincide with the routes for the general public.  Each of these accessible routes must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards §§ 4.3, 4.5, Fig. 7.
