Dear Mr. Patino:

Thank you for your response to our supplemental investigation. We received your email of November 16, 2011, but did not receive any attachments.

As you know, based on a compliance review and referral from the Federal Motor Carrier Safety Administration (FMCSA) of the U.S. Department of Transportation, the FMCSA determined that your company failed to file required annual reports with the Department of Transportation regarding compliance with the Americans with Disabilities Act, 42 U.S.C. §§ 12181 et seq. (ADA) and its implementing regulations, 28 C.F.R. Part 36 and 49 C.F.R. Part 37.

Accordingly, we request that you enter into the enclosed Letter of Resolution requiring that your company file these reports for the years in which any such reports were not filed, and continue to do so in the future.

By no later than fourteen (14) days from the date of this letter, please sign the enclosed Letter of Resolution and return it to me either by fax at 202-307-1198, email at Elaine.Grant@usdoj.gov, or by overnight delivery at the address above. Please do not send your response by regular mail, as it is subject to unnecessary delay.

LETTER OF RESOLUTION BETWEEN AUTOBUSES ZACATECANOS, INC. AND THE UNITED STATES OF AMERICA

Based on a compliance review and referral from the Federal Motor Carrier Safety Administration (FMCSA) of the U.S. Department of Transportation, the FMCSA determined that American Asia Express, Inc. failed to file required annual reports with the Department of Transportation regarding compliance with the Americans with Disabilities Act, 42 U.S.C. §§ 12181 et seq. (ADA) and its implementing regulations, 28 C.F.R. Part 36 and 49 C.F.R. Part 37.

Autobuses Zacatenos, Inc. agrees to file annual reports for the years in which any such reports were not filed by no later than December 15, 2011, and will continue to do so in the future as required by the ADA and its implementing regulations.
