Attachment K: Program Access in Existing Facilities

Please Note: Paragraph 40 of the Agreement requires that within six months of the effective date of this Agreement, the County will provide signage as necessary to comply with 28 C.F.R. § 35.163(b), after having surveyed all facilities that are the subject of this Agreement for the purpose of identifying those that have multiple entrances not all of which are accessible.

1.     The technical requirements and, where appropriate, the scoping requirements of the Standards are used as a guide for determining whether a program or activity held in an existing facility is “readily accessible to and usable by” persons with disabilities and for determining what changes are necessary to make this program or activity accessible if it continues to be provided in the existing facility in question.  See 28 C.F.R. §§ 35.150(b)(1), 35.151.

2.     In order to ensure that each of the County’s programs, services, and activities operating at a facility that is the subject of this Agreement, when viewed in its entirety, are readily accessible to and usable by persons with disabilities, the County will take the following actions:

3.     Within 6 months of the effective date of this Agreement, the County will make the following modifications to Clarendon House, located at 3141 N. 10th Street.

a.     Parking.  There is no van accessible parking space provided and the designated accessible space does not have vertical signage.  On the shortest accessible route to the accessible entrance, provide at least 1 van accessible space a minimum of 96 inches wide, served by access aisles at least 96 inches wide, with vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles, and with an additional “Van-Accessible” sign located below the International Symbol of Accessibility.  Standards §§ 4.1.2(5)(b), 4.6, 4.30.7(1).

b.     Drinking Fountain

i.     Although an accessible drinking fountain is provided, there is no drinking fountain provided for people who have difficulty bending or stooping.  Provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a “hi-lo” fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards § 4.1.3(10)(a).

ii.     The route to the nurse’s office is inaccessible because the drinking fountain protrudes into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards § 4.4.

c.     Men’s Toilet Room

i.     The toilet room sign is mounted on the door 64 inches high to the center of the sign.  Provide a toilet room sign with raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

ii.     The pressure required to open the door is 10 pounds.  Within 12 months of the effective date of this Agreement, provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

iii.     The door, which is accessed through a front approach, has only 8½ inches of clear space on the pull side.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards § 4.13.6, Fig. 25(a).

iv.     The top of the lavatory rim is 36 inches above the finished floor.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31.  Standards § 4.19.2, Fig. 31.

v.     The urinal is mounted with the rim 20 inches and the flush control 45 ½ inches above the finished floor.  Provide a urinal with an elongated rim mounted 17 inches or less above the finished floor, a clear floor space of at least 30 inches wide and 48 inches deep centered on the urinal, and a flush control height of 44 inches or less above the finished floor.  Standards §§ 4.18.2, 4.18.3, 4.18.4.

vi.     The designated accessible toilet stall contains a free-standing side grab bar that interferes with the clear floor space at the toilet, and the toilet is mounted 25 inches from the side wall.  Provide a toilet stall that has clear floor space at least 60 inches wide and at least 59 inches deep, such that the centerline of the toilet is exactly 18 inches from the near side wall or partition.  Standards § 4.17, Fig. 30.

d.     Women’s Toilet Room

i.     The pressure required to open the door is 15 pounds.  Within 12 months of the effective date of this Agreement, provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

ii.     The door, which is accessed through a front approach, has only 7 inches of clear space on the pull side due to the presence of a trash can.  On the pull side of the door, provide maneuvering clearance at least 60 inches deep and provide a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards § 4.13.6, Fig. 25(a).

iii.     The top of the lavatory rim is 36 inches above the finished floor.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31.  Standards § 4.19.2, Fig. 31.

iv.     The designated accessible toilet stall contains a free-standing side grab bar that interferes with the clear floor space at the toilet, and the toilet is mounted 24 inches from the side wall.  Provide a toilet stall that has clear floor space at least 60 inches wide and at least 59 inches deep, such that the centerline of the toilet is exactly 18 inches from the near side wall or partition.  Standards § 4.17, Fig. 30.

4.     Within 6 months of the effective date of this Agreement, the County will make the following modifications to Langston-Brown Community Center, located at 1810 N. Edison Street.

a.     Accessible Route

i.     The primary curb cut is excessively sloped at 6 degrees.  Provide a curb ramp that is at least 36 inches wide, has a maximum slope of 1:12, is located so that it cannot be obstructed by parked vehicles, and has a stable, firm, and slip-resistant surface with a detectable warning extending the full width and depth of the ramp.  If the curb ramp is located where pedestrians must walk across it, provide either flared sides (with a maximum slope of 1:10) or handrails or guardrails to protect against cross traffic.  Standards § 4.3.8, 4.7, Fig. 12.

ii.     The route from the parking area to the main entrance contains a number of air conditioning units that protrude into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards § 4.4.

iii.     The turn onto the sidewalk along the side of the building has a cross slope of 2.8 degrees.  Provide at least one accessible route at this point that has a cross slope of less than 1:50 (1.15 degrees).  Standards §§ 4.3, 4.5, Fig. 7.

b.     Entrance.  The public entrance requires pinching of the latch to open.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards § 4.13.9.

c.     Signage.  There is no accessible interior signage provided.  Provide permanent room signage with upper case, sans serif or simple serif type letters and numerals, meeting the requirements of the Standards for character height, raised characters, finish and contrast, accompanied by Grade 2 Braille; mounted on the wall adjacent to the latch side of the door or on the nearest adjacent wall at a height of 60 inches above the finished floor to the centerline of the sign; and located so that a person may approach within 3 inches of the signage without encountering protruding objects or standing within the swing of a door.  Standards §§ 4.30.1, 4.30.4, 4.30.5, 4.30.6.

d.     Unisex Toilet Room Near Room 126

i.     The toilet room sign is mounted on the latch side of the door lower than 60 inches above the finished floor, and it does not have raised characters and Braille.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

ii.     The pressure required to open the door is 10 pounds.  Within 12 months of the effective date of this Agreement, provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

iii.     There is insufficient turning space within the toilet room due to the presence of the table.  Provide an unobstructed turning space at least 60 inches in diameter or a T-shaped space complying with Fig. 3(b).  Standards §§ 4.22.3, 4.2.3, Fig. 3.

iv.     The top of the toilet seat is 16 inches above the finished floor.  Provide a toilet with a seat that measures 17 to 19 inches above the finished floor.  Standards § 4.16.3, Fig. 29(b).

v.     The toilet paper dispenser is mounted directly against the side grab bar and the toilet seat cover dispenser is mounted directly against the rear grab bar.  Provide grab bars that have at least 1½ inches between the grab bar and any other object.  Standards §§ 4.16.4, 4.26.2, Fig. 39.

vi.     The rear grab bar at the toilet is only 30 inches long.  Provide a rear grab bar that is at least 36 inches in overall length with the closer end no more than 6 inches from the side wall.  Standards § 4.16.4, Fig. 29.

e.     Women’s Toilet Room in Lobby

i.     The toilet room sign is mounted on the door more than 60 inches above the finished floor.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

ii.     No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards § 4.19.6.

iii.     The toilet seat covers are mounted 63 inches above the finished floor over the toilet.  Provide a toilet seat cover dispenser such that the controls comply with Fig. 5 for a forward reach or with Fig. 6 for a side reach and such that it is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach, respectively, by a person using a wheelchair.  Standards §§ 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

iv.     The lavatory hot water pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

v.     No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

vi.     The toilet paper dispenser is mounted on the rear wall.  Provide a toilet paper dispenser that is mounted with its top at least 1½ inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards § 4.17.3, Fig. 30(d).

vii.     There is no rear grab bar at the toilet in the designated accessible stall.  Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall; mounted 33 to 36 inches above the finished floor; with a diameter between 1¼ and 1½ inches; with 1½ inches between the grab bar and the wall; and at least 1½ inches between the grab bar and any other object, such as a toilet seat cover dispenser.  Standards §§ 4.17.6, 4.26.2, Fig. 30.

f.     Men’s Toilet Room in Lobby

i.     The toilet room sign is mounted on the door more than 60 inches above the finished floor.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

ii.     The pressure required to open the door is 7 pounds.  Within 12 months of the effective date of this Agreement, provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

iii.     The lavatory hot water pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

iv.     The urinal is mounted with the rim 25 inches and the flush control 52 inches above the finished floor.  Provide a urinal with an elongated rim mounted 17 inches or less above the finished floor, a clear floor space of at least 30 inches wide and 48 inches deep centered on the urinal, and a flush control height of 44 inches or less above the finished floor.  Standards §§ 4.18.2, 4.18.3, 4.18.4.

v.     The designated accessible toilet stall is only 54 inches wide, there is a thick pipe running along the bottom of the wall that obstructs the clear floor space, and the centerline of the toilet is 16 inches from the side wall.  Provide a toilet stall that is at least 60 inches wide and at least 56 inches deep for a wall-mounted toilet or at least 59 inches deep for a floor-mounted toilet, such that the centerline of the toilet is exactly 18 inches from the near side wall or partition.  Standards § 4.17, Fig. 30.

vi.     No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

vii.     The toilet paper dispenser is mounted on the rear wall.  Provide a toilet paper dispenser that is mounted with its top at least 1½ inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards § 4.17.3, Fig. 30(d).

viii.     There is no rear grab bar at the toilet in the designated accessible stall.  Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall; mounted 33 to 36 inches above the finished floor; with a diameter between 1¼ and 1½ inches; with 1½ inches between the grab bar and the wall; and at least 1½ inches between the grab bar and any other object, such as a toilet seat cover dispenser.  Standards §§ 4.17.6, 4.26.2, Fig. 30.

g.     Drinking Fountain.  The higher drinking fountain outside room 115 protrudes into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards § 4.4.

5.     Within 36 months of the effective date of this Agreement, the County will make the following modifications to William Francis Drewry Center, located at 1725 N. George Mason Drive.

a.     Parking

i.     The parking lot is inaccessible because there are no access aisles.  At each standard accessible space, provide an access aisle at least 60 inches wide.  At each van accessible space, provide an access aisles at least 96 inches wide.  Ensure that all access aisles are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards §§ 4.1.2(5), 4.6.3, Fig. 9.

ii.     There is no van accessible parking space provided.  On the shortest accessible route to the accessible entrance, provide at least 1 van accessible space a minimum of 96 inches wide, served by access aisles at least 96 inches wide, with vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles, and with an additional “Van-Accessible” sign located below the International Symbol of Accessibility.  Standards §§ 4.1.2(5)(b), 4.6, 4.30.7(1).

b.     Accessible Route  

i.     The route from the parking lot to the main entrance has a cross slope of 2.5%.  Provide at least one accessible route at this point that has a cross slope of less than 1:50 (2%).  Standards §§ 4.3, 4.5, Fig. 7.

ii.     The exterior 2nd floor entrance door has a slope of 1.9 degrees within the door’s required maneuvering clearance.  Provide a door so that the floor or ground area within the required clearances is level and clear.  In the alternative, provide accessible directional signage with the International Symbol of Accessibility at the exterior 2nd floor entrance door directing users to the accessible main entrance, and provide accessible signage with the International Symbol of Accessibility at the accessible main entrance.  Standards §§4.1.3(8)(d), 4.13, 4.30, Fig. 25.

iii.     The ramp handrails on the ramp to the 2nd floor entrance are 31½ inches high.  Provide handrails that are between 1¼ inches and 1½ inches in diameter such that the inside handrail is continuous and both handrails have a continuous gripping surface along both sides of the ramp extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface; the handrails do not rotate within their fittings; and both handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post.  In the alternative, provide accessible directional signage with the International Symbol of Accessibility directing users to the accessible main entrance, and provide accessible signage with the International Symbol of Accessibility at the accessible main entrance.  Standards §§4.1.3(8)(d), 4.8.5, 4.13, 4.30, Fig. 25..

iv.     Both sets of double doors off the lobby are 28 inches wide for each leaf.  Provide doors at these locations that have at least one active leaf with a clear opening at least 32 inches wide when measured from the face of the door to the middle edge of the other door when one door is opened 90 degrees OR provide an automatic door opener that opens both doors simultaneously.  Standards § 4.13, Figs. 24, 25.

c.     Alarms.  Although the facility contains an emergency alarm system, there is no visual alarm provided in the auditorium (room 201).  Provide visual alarm devices in toilet rooms and any other general usage areas (e.g., meeting rooms), hallways, lobbies, and any other area for common use.  Such devices shall be integrated into the facility alarm system and shall meet the requirements of the Standards for lamp type, color, pulse duration, intensity, and flash rate.  Visual alarm appliances shall be placed 80 inches above the highest floor level within the space or 6 inches below the ceiling, whichever is lower.  Visual alarm appliances shall be located such that no place in any room or space, including common corridors or hallways, required to have a visual alarm appliance shall be more than 50 feet from the signal.  In large rooms and spaces exceeding 100 feet across, without obstructions 6 feet above the finished floor, devices may be placed around the perimeter, spaced a maximum of 100 feet apart, in lieu of suspending appliances from the ceiling.  In the alternative, provide programs and services in an alternate, accessible room on an accessible route. Standards § 4.28.3.

d.     Telephone.  The telephone in the vestibule has only 22 inches of clear floor width and the highest operable part is 54 inches above the finished floor with only a front approach available.  Remove the brochure rack from this area in order to provide at least 30 inches of clear floor width and a side approach.  Standards §§ 4.31, 4.30.7(2).

e.     Toilet Rooms.  Each of the toilet rooms contains a number of inaccessible elements and is not accessible to people with disabilities.  Provide an accessible unisex toilet room on an accessible route such that all of the room’s elements, including accessible route, signage, door, door hardware, clear floor space, water closet, stall size and arrangement, stall door, urinal (if provided), grab bars, lavatory, mirror, controls, and dispensers, comply with the Standards.  Provide accessible directional signage with the International Symbol of Accessibility at inaccessible toilet rooms indicating the location of the accessible toilet room, and provide accessible signage with the International Symbol of Accessibility at the accessible toilet room.  Standards §§ 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.13, 4.16, 4.17, 4.18, 4.19, 4.26, 4.27, 4.30, Fig. 30.

f.     Drinking Fountains

i.     The drinking fountain in the lobby has a spout that is 37½ inches above the finished floor.  Provide a fountain that has a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet, and that otherwise complies with the Standards.  Standards §§ 4.15, 4.27.4, Fig. 27.

ii.     The controls on the drinking fountain in the lobby require 12 pounds of force to operate.  Provide a drinking fountain with controls mounted on or near the front edge that are operable with one hand, that require 5 lbf or less to operate, and that can be operated without tight grasping, pinching, or twisting of the wrist.  Standards §§ 4.15.4, 4.27.4.

iii.     The lobby drinking fountain protrudes into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards § 4.4.

g.     Elevator

i.     The elevator has no hoistway signage.  Provide signage at hoistway entrances with raised and Braille floor designations on both jambs such that the centerline of the characters is 60 inches above the finished floor and the characters are 2 inches high.  In the alternative, provide all goods and services for members of the public on the first floor.  Standards § 4.10.5, Fig. 20.

ii.     The elevator has no door protective or reopening device.  Provide doors that open and close automatically with a reopening device that will stop and reopen the car door and hoistway door automatically if the door becomes obstructed by an object or person.  Ensure that the device is capable of completing these operations without requiring contact for obstructions passing through the opening at heights of 5 inches and 29 inches above the finished floor; that door reopening devices remain effective for at least 20 seconds, after which the doors may close; that the minimum time from notification that a car is answering a call until the doors of that car start to close is 5 seconds; and that the minimum time for elevator doors to remain fully open in response to a car call is 3 seconds.  In the alternative, provide all goods and services for members of the public on the first floor. Standards §§ 4.10.6, 4.10.7, 4.10.8, Figs. 20, 21.

iii.     The car control buttons do not have Braille or raised characters and the main entry floor call button is not designated by a raised star.  Provide car control buttons that are at least ¾ inch in their smallest dimension and are raised or flush and that are designated by Braille and by raised standard alphabet characters for letters, arabic characters for numerals, or standard symbols.  Ensure that the call button for the main entry floor is designated by a raised star at the left of the floor designation and that all raised designations for control buttons are placed immediately to the left of the buttons to which they apply.  In the alternative, provide all goods and services for members of the public on the first floor. Standards § 4.10.12, Fig. 23.

iv.     The emergency communications system is not identified by raised symbols and lettering.  Provide a two-way communication system identified by a raised symbol and lettering located adjacent to the device.  If the system is located in a closed compartment, ensure that the compartment door hardware operates without tight grasping, pinching or twisting of the wrist.  In the alternative, provide all goods and services for members of the public on the first floor.  Standards § 4.10.14.

6.     Within 36 months of the effective date of this Agreement, the County will make the following modifications to Madison Center, located at 3829 N. Stafford Street.

a.     Parking

i.     The access aisles are each 37 inches wide.  At each standard accessible space, provide an access aisle at least 60 inches wide.  At each van accessible space, provide an access aisle at least 96 inches wide.  Ensure that all access aisles are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards §§ 4.1.2(5), 4.6.3, Fig. 9.

ii.     There is no van accessible parking space provided.  On the shortest accessible route to the accessible entrance, provide at least 1 van accessible space a minimum of 96 inches wide, served by access aisles at least 96 inches wide, with vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles, and with an additional “Van-Accessible” sign located below the International Symbol of Accessibility.  Standards §§ 4.1.2(5)(b), 4.6, 4.30.7(1).

b.     Entrances.  The main entrance does not have signage directing people with disabilities to the accessible entrance, and the accessible entrance does not have the International Symbol of Accessibility.  Provide accessible directional signage with the International Symbol of Accessibility at inaccessible entrances directing users to the accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances.  Standards §§ 4.1.3(8)(d), 4.13, 4.30.

c.     Telephone.  The telephone has only 27½ inches of clear floor width and the highest operable part is 64 inches above the finished floor with only a front approach available.  Provide an accessible telephone with a clear floor space of at least 30 inches wide by 48 inches deep that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach.  Standards §§ 4.31, 4.30.7(2).

d.     Platform Lift.  The lift from the Health Services to the Parks area of the building requires assistance to use.  Provide a lift at this location that facilitates unassisted entry, operation, and exit from the lift.  Standards § 4.11.3.

e.     Drinking Fountains.  The routes in the auditorium and across from the coop playgroup contain drinking fountains that protrude into the main walkway and would not be detectable to a blind person using a cane.  Provide accessible routes at these locations such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards § 4.4.

f.     Women’s Main Toilet Room

i.     The toilet room signs are mounted on the door and above the door and do not have raised characters and Braille.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters   mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

ii.     Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards §§ 4.28.1, 4.28.3.

iii.     The toilet seat cover dispenser is mounted 56 inches above the finished floor in the right-hand side designated accessible stall.  Provide a toilet seat cover dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

iv.     No accessible coat hook has been provided in the right-hand side designated accessible stall.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

v.     The toilet paper dispenser is mounted 43 inches from the rear wall in the left-hand side designated accessible stall.  Provide a toilet paper dispenser that is mounted with its top at least 1½ inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards § 4.17.3, Fig. 30(d).

vi.     Each designated accessible toilet stall contains a table that interferes with the clear floor space at the toilet.  Provide a toilet stall that has clear floor space at least 60 inches wide and at least 59 inches deep.  Standards § 4.17, Fig. 30.

vii.     The shower stall in this room is 43 inches wide and 37 inches deep, has a single 24 inch long grab bar on the rear wall, and has controls mounted 36 inches above the shower floor.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards § 4.21, Figs. 35, 36, 37.

g.     Men’s Main Toilet Room

i.     The toilet room signs are mounted on the door and above the door and do not have raised characters and Braille.  Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters   mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

ii.     Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room.  Provide a visual alarm appliance in the toilet room.  Standards §§ 4.28.1, 4.28.3.

iii.     The toilet seat cover dispenser in the designated accessible stall is mounted 54 inches above the finished floor over the toilet.  Provide a toilet seat cover dispenser such that the controls comply with Fig. 5 for a forward reach or with Fig. 6 for a side reach and such that it is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach, respectively, by a person using a wheelchair.  Standards §§ 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

iv.     The flush control of the toilet in the designated accessible stall is on the closed side.  Provide a flush control mounted on the “open” side of the toilet’s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards §§ 4.16.5, 4.17.2, 4.27.4.

h.     “Boiler Room” Single User Toilet Rooms

i.     There is no signage directing people with disabilities from these inaccessible toilet rooms to the accessible toilet rooms.  Provide accessible directional signage with the International Symbol of Accessibility at inaccessible toilet rooms indicating the location of the nearest accessible toilet room, and provide accessible signage with the International Symbol of Accessibility at all accessible toilet rooms.  Standards §§ 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

ii.     The toilet room signs are mounted inaccessibly and have no raised characters or Braille.  Provide a toilet room sign with raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

7.     Within 6 months of the effective date of this Agreement, the County will make the following modifications to the Glencarlyn Library, located at 300 S. Kensington Street.

a.     Parking.  The parking lot has no van accessible space, and the existing access aisle is insufficient.  On the shortest accessible route to the accessible entrance, provide at least one van accessible space designated as reserved for people with disabilities.  Ensure that the van accessible space is a minimum of 96 inches wide and served by an access aisle at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional “Van-Accessible” sign located below the International Symbol of Accessibility.  Standards §§ 4.1.2(5), 4.6, 4.30.7(1).

b.     Entrance.  The pressure required to open the interior main entrance is 10 pounds.  Within 12 months of the effective date of this Agreement, provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

c.     Telephone

i.     The highest operable part of the public telephone is 55 inches above the finished floor, and the cord is only 27 inches long.  Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards.  Standards §§ 4.31, 4.30.7(2).

ii.     The public telephone protrudes into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards § 4.4.

d.     Check-Out Counter.  The top of the check-out counter is 38½ inches above the finished floor.  Provide at least one check out area such that the counter is on an accessible route at least 36 inches wide and it has a section at least 36 inches wide and no more than 36 inches above the finished floor.  Standards §§ 8.3, 7.2(1).

e.     Computer Tables.  The computer tables for the internet have insufficient knee clearance.  Provide computers with access to the internet on a table or counter that has clear floor space that is 30 inches wide and 48 inches deep, knee clearance at least 27 inches high, 30 inches wide, and 19 inches deep, and a writing surface between 28 and 34 inches above the finished floor.  Standards §§ 4.2.4.1, 4.32.

f.     Drinking Fountain.  Although an accessible drinking fountain is provided, there is no drinking fountain provided for people who have difficulty bending or stooping.  Provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a “hi-lo” fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards § 4.1.3(10)(a).

g.     Single User Toilet Room

i.     The pressure required to open the is 15 pounds.  Within 12 months of the effective date of this Agreement, provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

ii.     Although the facility contains an emergency alarm system, there is no visual alarm provided in the toilet room.  Provide visual alarm devices in toilet rooms and any other general usage areas (e.g., meeting rooms), hallways, lobbies, and any other area for common use.  Such devices shall be integrated into the facility alarm system and shall meet the requirements of the Standards for lamp type, color, pulse duration, intensity, and flash rate.  Visual alarm appliances shall be placed 80 inches above the highest floor level within the space or 6 inches below the ceiling, whichever is lower.  Visual alarm appliances shall be located such that no place in any room or space, including common corridors or hallways, required to have a visual alarm appliance shall be more than 50 feet from the signal.  In large rooms and spaces exceeding 100 feet across, without obstructions 6 feet above the finished floor, devices may be placed around the perimeter, spaced a maximum of 100 feet apart, in lieu of suspending appliances from the ceiling.  Standards § 4.28.3.

iii.     No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards § 4.19.6.

iv.     The toilet flush control is on the closed side of the toilet.  Provide a flush control mounted on the “open” side of the toilet’s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards §§ 4.16.5, 4.27.4.

v.     The toilet paper dispenser is mounted directly against the side grab bar at the toilet.  Provide a side grab bar that has at least 1½ inches between the grab bar and any other object.  Standards §§ 4.16.4, 4.26.2, Fig. 39.

vi.     The seat cover dispenser is mounted directly against the rear grab bar at the toilet.  Provide a rear grab bar that has at least 1½ inches between the grab bar and any other object.  Standards §§ 4.16.4, 4.26.2, Fig. 39.

8.     Within 12 months of the effective date of this Agreement, the County will make the following modifications to the Courthouse, located at 1425 N. Courthouse Road.

a.     Exterior Accessible Route.  The route from Courthouse Road to the sidewalk in front of the Courthouse has a slope of 15.8%.  Provide a curb ramp that is at least 36 inches wide, has a maximum slope of 1:12, is located so that it cannot be obstructed by parked vehicles, and has a stable, firm, and slip-resistant surface with a detectable warning extending the full width and depth of the ramp.  If the curb ramp is located where pedestrians must walk across it, provide either flared sides (with a maximum slope of 1:10) or handrails or guardrails to protect against cross traffic.  Standards § 4.3.8, 4.7, Fig. 12.

b.     Interior Accessible Route

i.     Outside courtroom 4B, the lip of the desk protrudes into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards § 4.4.

ii.     Doors throughout the facility are inaccessible because the pressure required to open them  is more than 5 pounds.  Within 12 months of the effective date of this Agreement, provide doors that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

c.     Courtrooms

i.     Courtrooms 10A, 10B, 10C, and 10D contain more than 100 seats each and have only two wheelchair seating locations per room.  In each courtroom, provide at least 4 wheelchair seating areas, each with a minimum clear ground or floor space of 66 inches wide by 48 inches deep for forward or rear access, or 66 inches wide by 60 inches deep for side access.  Ensure that the ground or floor at all wheelchair locations is level, firm, stable, and slip resistant; that wheelchair seating areas are an integral part of the fixed seating plan and are located so as to provide people with physical disabilities a choice of lines of sight comparable to those available for members of the general public; that wheelchair seating areas adjoin an accessible route that also serves as a means of egress in case of emergency; and that at least one fixed companion seat is provided next to each wheelchair seating area.  Standards §§ 4.1.3(19)(a), 4.5, 4.33.

ii.     The tables in the jury deliberation rooms for Courtrooms 10A, 10B, 10C, and 10D provide 25 inches of knee clearance height.  Provide an accessible table in each room on an accessible route at least 36 inches wide.  Ensure that the tables have clear floor space of 30 inches wide by 48 inches deep, knee clearance of at least 27 inches high by 30 inches wide by 19 inches deep, and a writing surface between 28 and 34 inches above the finished floor.  Standards §§ 4.2.4.1, 4.32.

iii.     The attorney tables in Courtroom 3C provide 20 inches of knee clearance height because the privacy shield is positioned at the front of the table.  Provide accessible tables on an accessible route at least 36 inches wide.  Ensure that the tables have clear floor space of 30 inches wide by 48 inches deep, knee clearance of at least 27 inches high by 30 inches wide by 19 inches deep, and a writing surface between 28 and 34 inches above the finished floor.  Standards §§ 4.2.4.1, 4.32.

iv.     The forms displayed outside Courtroom 3B are mounted too high.  Provide the forms at an accessible location no more than 48 inches above the finished floor for a front approach or no more than 54 inches above the finished floor for a side approach.  Standards §§ 4.2.5, 4.2.6.

d.     Elevator.  The elevator emergency communications system does not operate without voice communication.  Provide a two-way communication system such that it does not require voice communication.  Standards § 4.10.14.

e.     Vending Area.  In the ground floor vending room, the Canteen vending machine reach ranges are too high.  Provide an accessible vending machine with the highest operable part no more than 48 inches above the finished floor for a front approach or no more than 54 inches above the finished floor for a side approach.  Standards §§ 5.8, 4.2.5, 4.2.6.

f.     Telephones

i.     The telephone on the 11th floor is inaccessible because the counter is 35 inches high, the highest operable part of the telephone is 55 inches high, and the cord is 28 inches long.  Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards.  Standards §§ 4.31, 4.30.7(2).

ii.     The telephones on the 9th and 10th floors are inaccessible because the cords are 28 inches long.  Provide an accessible telephone on each floor with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards.  Standards §§ 4.31, 4.30.7(2).

iii.     The telephones on the 4th floor are inaccessible because the highest operable part of each telephone is 55 inches high and the cord is 28 inches long.  Provide an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards.  Standards §§ 4.31, 4.30.7(2).

iv.     The telephones on the 3rd and 2nd floors are inaccessible because the highest operable parts are 55 inches high and the cords are 25 inches long.  Provide an accessible telephone on each floor with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that is hearing aid compatible and has a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; with a cord of at least 29 inches long from the telephone to the handset; and with signage that complies with the Standards.  Standards §§ 4.31, 4.30.7(2).

g.     Drinking Fountains.  Throughout the facility, the drinking fountains protrude into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at these locations such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards § 4.4.

h.     Toilet Rooms with Stalls

i.     Throughout the facility, no accessible coat hook has been provided in the toilet rooms with stalls.  Provide a coat hook in each room at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

ii.     Throughout the facility, the side grab bar at the toilet in the designated accessible stall is 49 inches from the wall to the farther end of the grab bar.  In each accessible toilet stall, provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Standards § 4.17.6, Figs. 30(a), (d).

iii.     Throughout the facility, the rear grab bar at the toilet in the designated accessible stall is 33 inches long.    In each accessible toilet stall, provide a rear grab bar that is at least 36 inches in overall length with the closer end no more than 6 inches from the side wall.  Standards § 4.17.6, Fig. 30.

iv.     At the 10th floor public women’s toilet room, the sign is mounted on the hinge side of the door.  Provide a toilet room sign with raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

v.     In the 4th floor women’s toilet room, the lavatory pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

vi.     At the 3rd floor men’s and women’s toilet rooms, the doors, which are accessed through a front approach and which have both a closer and a latch, have only 11 inches of maneuvering clearance on the push side.  On the push side of the door, provide maneuvering clearance at least 48 inches deep and provide a minimum of 12 inches of maneuvering clearance on the latch side of the door, or remove the closer or the latch.  Standards § 4.13.6, Fig. 25(a).

i.     Single User Toilet Rooms

i.     Throughout the facility, the side grab bar at the toilet is 49 inches from the wall to the farther end of the grab bar.  In each room, provide a side grab bar that is at least 42 inches in overall length, with the far end mounted at least 54 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Standards § 4.16.4, Fig. 29(b).

ii.     Throughout the facility, the overall length of the rear grab bar is 33 inches.  In each room, provide a rear grab bar that is at least 36 inches in overall length with the closer end no more than 6 inches from the side wall.  Standards § 4.16.4, Fig. 29.

iii.     In the Courtroom 10B jury deliberation toilet rooms, the lavatory pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes in each room that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

iv.     In the Courtroom 10B jury deliberation toilet rooms, there are no grab bars provided.  In each room, provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall, and a side grab bar that is at least 42 inches in overall length, with the far end mounted at least 54 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Ensure that the grab bars are mounted 33 to 36 inches above the finished floor; with a diameter between 1¼ and 1½ inches; with 1½ inches between the grab bars and the wall; and at least 1½ inches between the grab bars and any other object, such as a toilet paper dispenser or a toilet seat cover dispenser.  Standards §§ 4.16.4, 4.26.2, Fig. 29.

v.     In the near Courtroom 10B jury deliberation toilet room, the toilet flush control is on the closed side of the toilet.  Provide a flush control mounted on the “open” side of the toilet’s clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards §§ 4.16.5, 4.27.4.

vi.     In the 10th floor jury assembly room men’s and women’s toilet rooms, the lavatory pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

9.     Within 36 months of the effective date of this Agreement, the County will make the following modifications to the Courthouse, located at 1425 N. Courthouse Road.

a.     Exterior Accessible Route.  The lower portions of both ramps from Courthouse Road to the entrance plaza contain portions that slope between 9.3% and 9.5%.  Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; with level landings measuring at least 60 inches by 60 inches when the ramp changes direction; and edge protection that is at least 2 inches high at the drop off sides.  Provide handrails that are between 1¼ inches and 1½ inches in diameter such that the inside handrail is continuous and both handrails have a continuous gripping surface along both sides of the ramp extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface; the handrails do not rotate within their fittings; and both handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post.  Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces.  Standards §§ 4.3.8, 4.8.

10.     Within 6 months of the effective date of this Agreement, the County will make the following modifications to Court Square West, located at 1400 N. Uhle Street.

a.     Accessible Route.  The desk in the front lobby of room 102 protrudes into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards § 4.4.

b.     Information Brochures.  The brochures in room 102 are mounted too high.  Provide brochures a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.2.4, 4.2.5, 4.2.6.

c.     Elevator.  Although emergency communications are provided, they are not identified by raised symbols and lettering.  Provide a two-way communication system such that it does not require voice communication, the highest operable part is a maximum of 48 inches above the finished floor of the car, and it is identified by a raised symbol and lettering located adjacent to the device.  If the system uses a handset, ensure that the length of the cord from the panel to the handset is at least 29 inches.  If the system is located in a closed compartment, ensure that the compartment door hardware operates without tight grasping, pinching or twisting of the wrist.  Standards § 4.10.14.

d.     Drinking Fountains.  There is no accessible drinking fountain provided on the 7th floor.  Provide at least one drinking fountain on the 7th floor with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Ensure that fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  Additionally, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a “hi-lo” fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards §§ 4.15, 4.27.4, Fig. 27.

e.     Toilet Rooms with Stalls.  There is no signage directing people with disabilities from the inaccessible toilet rooms to the designated accessible single user unisex toilet room on the 1st floor.  Provide accessible directional signage with the International Symbol of Accessibility at all inaccessible toilet rooms indicating the location of the nearest accessible toilet room, and provide accessible signage with the International Symbol of Accessibility at all accessible toilet rooms.  Standards §§ 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

f.     1st Floor Single User Unisex Toilet Room

i.     The unisex toilet room sign is mounted with the centerline 54 inches above the finished floor.  Provide a toilet room sign with raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

ii.     The pressure required to open the entrance door is 8 pounds.  Within 12 months of the effective date of this Agreement, provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

iii.     The toilet paper dispenser is mounted on the rear wall.  Provide a toilet paper dispenser that is mounted within reach, with its top at least 1½ inches under the side grab bar, and centered at least 19 inches above the finished floor.  Standards § 4.16.6, Fig. 29(b).

iv.     The rear grab bar at the toilet is mounted 10½ inches from the side wall.  Provide a rear grab bar that is at least 36 inches in overall length with the closer end no more than 6 inches from the side wall.  Standards § 4.16.4, Fig. 29.

11.     Within 36 months of the effective date of this Agreement, the County will make the following modifications to Court Square West, located at 1400 N. Uhle Street.

a.     Accessible Route.  The route from the parking lot to the sidewalk in front of Court Square West has a slope of 14%.  Provide a curb ramp that is at least 36 inches wide, has a maximum slope of 1:12, is located so that it cannot be obstructed by parked vehicles, and has a stable, firm, and slip-resistant surface with a detectable warning extending the full width and depth of the ramp.  If the curb ramp is located where pedestrians must walk across it, provide either flared sides (with a maximum slope of 1:10) or handrails or guardrails to protect against cross traffic.  Standards § 4.3.8, 4.7, Fig. 12.

12.     Within 6 months of the effective date of this Agreement, the County will make the following modifications to Bon Air Park, located at 850 North Lexington Street.

a.     Parking

i.     There is no van accessible parking space provided.  On the shortest accessible route to the accessible entrance, provide at least 1 van accessible space a minimum of 96 inches wide, served by access aisles at least 96 inches wide, with vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles, and with an additional “Van-Accessible” sign located below the International Symbol of Accessibility.  Standards §§ 4.1.2(5)(b), 4.6, 4.30.7(1).

ii.     Only one of the parking spaces reserved for persons with disabilities has vertical signage.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional “Van-Accessible” sign located below the International Symbol of Accessibility.  Standards §§ 4.6.4, 4.30.7(1).

b.     Accessible Route.  The route from the path onto the picnic/barbeque platform contains an inaccessible lip.  Provide at least one accessible route connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards §§ 4.3, 4.5, Fig. 7.

c.     Drinking Fountain.  Although an accessible drinking fountain is provided, there is no drinking fountain provided for people who have difficulty bending or stooping.  Provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a “hi-lo” fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards § 4.1.3(10)(a).

d.     Toilet Rooms with Stalls

i.     The toilet room signs are mounted on the doors, are mounted too high, and have no raised or Braille characters.  Provide toilet room signs with raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the signs at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

ii.     The toilet rooms are not fully accessible to people with disabilities.  Provide a fully accessible portable toilet on an accessible route at this location.  Standards §§ 4.1.2(6), 4.2.3, 4.3, 4.22, 4.13, 4.16.

13.     Within 36 months of the effective date of this Agreement, the County will make the following modifications to Penrose Park, located at 2200 S. 6th Street.

a.     Accessible Routes

i.     The route from the sidewalk to the playground transfer platform is not firm, stable or slip resistant.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards §§ 4.3, 4.5, Fig. 7.

ii.     The route from the sidewalk to the picnic tables and barbeque area is not firm, stable or slip resistant.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards §§ 4.3, 4.5, Fig. 7.

i.     The drinking fountain spout is located in a corner of the fountain under a hood, the water does not flow within 3 inches of the front of the fountain, and there is no fountain provided for people who have difficulty bending or stooping.  Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high.  Ensure that fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  Additionally, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a “hi-lo” fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards §§ 4.15, 4.27.4, Fig. 27.

ii.     The drinking fountain protrudes into the main walkway and would not be detectable to a blind person using a cane.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards § 4.4.

14.     Within 6 months of the effective date of this Agreement, the County will make the following modifications to the RPC Homeless Shelter, located at 1554 Columbia Pike.

a.     Parking.  There is no van accessible parking space provided.  On the shortest accessible route to the accessible entrance, provide at least one van accessible space a minimum of 96 inches wide, served by an access aisle at least 96 inches wide, with a vertical sign with the International Symbol of Accessibility located such that it cannot be obstructed by parked vehicles, and with an additional “Van-Accessible” sign located below the International Symbol of Accessibility.  Standards §§ 4.1.2(5)(b), 4.6, 4.30.7(1).

b.     Entrance

i.     The exterior approach to the main entry door has a slope of 3.9% within the door’s required maneuvering clearance.  Provide a door with a level and clear ground area within the required clearances.  Standards § 4.13.6, Fig. 25.

ii.     The force required to open the interior door to the main lobby is 14 pounds.  Within 12 months of the effective date of this Agreement, provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

iii.     In the Detoxification entry lobby, the path of travel between the couch and the copier is 31 inches wide.  Provide an accessible route in this area with a minimum clear width of 36 inches, except at doors, where the width may decrease to 32 inches for no more than 24 inches of depth.  Standards §§ 4.3.3, 4.13.5.

c.     Drinking Fountain.  Although an accessible drinking fountain is provided, there is no drinking fountain provided for people who have difficulty bending or stooping.  Provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a “hi-lo” fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards § 4.1.3(10)(a).

d.     Designated Accessible Shelter Bedroom – Room 228.  The force required to open the entry door is 11 pounds.  Within 12 months of the effective date of this Agreement, provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

e.     Group Room.  The computer provides only 22¾ inches of knee clearance to the bottom of the keyboard.  Provide a computer on a table or counter that has clear floor space that is 30 inches wide and 48 inches deep, knee clearance at least 27 inches high, 30 inches wide, and 19 inches deep, and a writing surface between 28 and 34 inches above the finished floor.  Standards §§ 4.2.4.1, 4.32.

f.     Unisex Shower Room Next to Room 132

i.     The force required to open the entry door is 16 pounds.  Within 12 months of the effective date of this Agreement, provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

ii.     The shower room door swings into the required clear floor space at the shower.  Ensure that no door swings into the required clear floor space at any accessible fixture.  Standards § 4.23.2.

iii.     The seat cover dispenser is mounted with the seat covers 57 inches above the finished floor.  Provide a seat cover dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

iv.     The rear grab bar at the toilet in the designated accessible stall is mounted 2½ inches from the wall.  Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall; mounted 33 to 36 inches above the finished floor; with a diameter between 1¼ and 1½ inches; with 1½ inches between the grab bar and the wall; and at least 1½ inches between the grab bar and any other object, such as a toilet seat cover dispenser.  Standards §§ 4.16.4, 4.26.2, Fig. 29.

v.     The shower spray unit cannot be used as a handheld shower, and the shower head is higher than 48 inches above the finished floor.  Provide a shower in this room that has a shower spray unit with a hose at least 60 inches long that can be used both as a fixed shower head and as a hand-held shower.  In unmonitored facilities where vandalism is a consideration, a fixed shower head mounted at 48 inches above the shower floor may be used in lieu of a hand-held shower head.  Standards § 4.21.6, Fig. 37.

g.     Unisex Lobby Shower Room.  This shower room is designated as accessible but is not.  Remove the sign designating this room as accessible and provide accessible directional signage with the International Symbol of Accessibility indicating the location of the nearest accessible shower room.  Standards §§ 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

h.     Men’s Toilet Room with Stalls Across from Room 231

i.     The force required to open the entry door is 11 pounds.  Within 12 months of the effective date of this Agreement, provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

ii.     No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards § 4.19.6.

iii.     The seat cover dispenser is mounted with the seat covers 58 inches above the finished floor.  Provide a seat cover dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

iv.     The paper towel dispenser is mounted with the controls 61 inches above the finished floor.  Provide a paper towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

v.     The lavatory pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

vi.     There is no accessible toilet stall provided.  Provide a “standard” accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall’s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards §§ 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

vii.     The shower has no transfer seat, the controls are not on the wall opposite the seat, and the spray unit is not mounted on a vertical bar.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards § 4.21, Figs. 35, 36, 37.

i.     Men’s Lobby Toilet Room with Stalls

i.     The force required to open the entry door is 11 pounds.  Within 12 months of the effective date of this Agreement, provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

ii.     No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards § 4.19.6.

iii.     The seat cover dispenser is mounted with the seat covers 56 inches above the finished floor.  Provide a seat cover dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6.

iv.     The bottom of the lavatory apron is 27 inches high.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31.  Standards § 4.19.2, Fig. 31.

v.     The lavatory pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

vi.     The toilet’s centerline measures 21 inches from the side wall.  Provide a toilet with a centerline that measures 18 inches from the near side wall.  Standards § 4.17.3, Fig. 30.

vii.     No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

k.     Men’s Detox Bathroom with Stalls – Next to Room 107

i.     The toilet room sign is mounted 63 inches high to the centerline.  Provide a toilet room sign with raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

ii.     The force required to open the entry door is 14½ pounds.  Within 12 months of the effective date of this Agreement, provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

vi.     The side grab bar at the toilet in the designated accessible stall is inaccessible because it is covered with seat covers.  Provide a side grab bar that has at least 1½ inches between the grab bar and any other object, such as seat covers.  Standards §§ 4.17.6, 4.26.2, Fig. 39.

vii.     The rear grab bar at the toilet is obstructed by the toilet’s pipes.  Provide a rear grab bar that has at least 1½ inches between the grab bar and any other object, such as pipes.  Standards §§ 4.17.6, 4.26.2, Fig. 39.

viii.     The bathtub’s double parallel grab bars start 18 inches from the control wall at the foot of the tub.  Provide a bathtub that has one horizontal grab bar at the foot of the tub that extends at least 24 inches from the outer edge of the tub toward the back (long) wall of the tub; two parallel horizontal grab bars, each at least 24 inches long, located no more than 12 inches from the foot of the tub and 24 inches from the head of the tub (one bar should be mounted 9 inches above the rim of the tub and the other mounted between 33 and 36 inches above the bathroom floor); and one horizontal grab bar at least 12 inches long located on the wall at the head of the tub, towards the outside of the tub.  Standards §§ 4.20.4, 4.26, Fig. 34(a).

ix.     The bathtub has no seat.  Given the configuration of the grab bars, provide an in-tub seat as shown in Figs. 33 and 34.  Standards §§ 4.20.3, 4.26.3, Figs. 33(a), 34(a).

x.     The bathtub has no spray unit provided.  Provide a bathtub in this room that has a shower spray unit with a hose at least 60 inches long that can be used both as a fixed shower head and as a hand-held shower.  Standards § 4.20.6.

xi.     The vertical bar on the shower’s shower spray unit is broken.  Provide a shower in this room that has a shower spray unit with a hose at least 60 inches long that can be used both as a fixed shower head and as a hand-held shower.  In unmonitored facilities where vandalism is a consideration, a fixed shower head mounted at 48 inches above the shower floor may be used in lieu of a hand-held shower head.  Standards § 4.21.6, Fig. 37.

l.     Men’s Toilet Room with Stalls Across from Room 214

ii.     No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards § 4.19.6.

iii.     The lavatory pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

iv.     The urinal’s rim is 21½ inches above the finished floor.  Provide a urinal with an elongated rim mounted 17 inches or less above the finished floor, a clear floor space of at least 30 inches wide and 48 inches deep centered on the urinal, and a flush control height of 44 inches or less above the finished floor.  Standards §§ 4.18.2, 4.18.3, 4.18.4.

v.     There is no accessible toilet stall provided.  Provide a “standard” accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall’s elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards.  Standards §§ 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

vi.     The shower transfer seat is 22 inches high, there is no L-shaped continuous grab bar provided, and the shower controls are mounted 36 inches high.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards § 4.21, Figs. 35, 36, 37.

m.     Women’s Early Recovery Toilet Room with Stalls Across from Room 202

i.     The force required to open the entry door is 13 pounds.  Within 12 months of the effective date of this Agreement, provide a door that requires no more than 5 pounds of force to open.  Standards § 4.13.11(2)(b).

ii.     No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards § 4.19.6.

iii.     The lavatory pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

n.     Women’s Shelter Toilet Room with Stalls Across from Room 222

i.     No accessible mirror has been provided.  Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor.  Standards § 4.19.6.

ii.     The lavatory pipes are not insulated or otherwise configured to protect against contact.  Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact.  Standards § 4.19.4.

iii.     No accessible coat hook has been provided.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

iv.     The toilet paper dispenser is mounted 43 inches from the rear wall.  Provide a toilet paper dispenser that is mounted with its top at least 1½ inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards § 4.17.3, Fig. 30(d).

v.     There is no shower transfer seat provided, the shower controls are not mounted on the wall opposite the seat, and the shower spray unit’s vertical bar is broken.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards § 4.21, Figs. 35, 36, 37.

15.     Within 6 months of the effective date of this Agreement, the County will make the following modifications to the Long Branch Nature Center, located at 625 S. Carlin Springs Road.

a.     Drinking Fountain.  Although an accessible drinking fountain is provided, there is no drinking fountain provided for people who have difficulty bending or stooping.  Provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a “hi-lo” fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards § 4.1.3(10)(a).

b.     Toilet Rooms with Stalls  

i.     The toilet room signs are not accessible.  For each room, provide a toilet room sign with raised and Braille characters mounted on the wall adjacent to the latch side of the door with the centerline of the sign 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

ii.     The toilet rooms are not fully accessible to people with disabilities.  Provide a fully accessible portable toilet on an accessible route at this location.  Standards §§ 4.1.2(6), 4.2.3, 4.3, 4.22, 4.13, 4.16.

16.     Within 36 months of the effective date of this Agreement, the County will make the following modifications to Woodmont Center, located at 2422 N. Fillmore Street.

a.     Parking.  One of the designated accessible parking spaces has no access aisle and the van accessible parking reserved for persons with disabilities lacks appropriate signage.    At each standard accessible space, provide an access aisle at least 60 inches wide.  At each van accessible space, provide an access aisles at least 96 inches wide.  Ensure that all access aisles are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  At van accessible spaces, provide a “Van-Accessible” sign located below the International Symbol of Accessibility such that the sign cannot be obstructed by vehicles parked in the space.  Standards §§ 4.1.2(5), 4.6.3, Fig. 9, 4.6.4, 4.30.7(1).

b.     Accessible Route.  There is a hump in the sidewalk just before the entrance that makes it inaccessible.  Provide at least one accessible route to this entrance that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards §§ 4.3, 4.5, Fig. 7.

c.     Entrance.  There is no directional signage at inaccessible entrances and no signage with the International Symbol of Accessibility at accessible entrances.  Provide accessible directional signage with the International Symbol of Accessibility at inaccessible entrances directing users to the accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances.  Standards §§ 4.1.3(8)(d), 4.13, 4.30.
