Please Note: Paragraph 48 of the Settlement Agreement requires that within three months of the effective date of this Agreement, Juneau provide signage as necessary to comply with 28 C.F.R. § 35.163(b), after having surveyed all facilities that are the subject of this Agreement for the purpose of identifying those that have multiple entrances not all of which are accessible.

 

Altered Facilities:  In order to ensure that the following spaces and elements in Juneau facilities, for which alterations commenced after January 26, 1992, are readily accessible to and usable by persons with disabilities, Juneau will take the following actions:

 

A.        Within 12 months of the effective date of this Agreement, Juneau will complete the following modifications to Aurora Harbor.

 

1.         Parking Near Harbormaster's Office.

 

a. While 2 of the 30 parking spaces are reserved for persons with disabilities, none is designated as "van-accessible."  At van accessible spaces, provide a "Van-Accessible" sign located below the International Symbol of Accessibility such that the sign cannot be obstructed by vehicles parked in the space.  Standards §§ 4.1.2(5), 4.1.6(1)(b), 4.6.4, 4.30.7(1).

 

2.         North Parking

 

a. Only 2 of 188 parking spaces are reserved for persons with disabilities and neither is designated as "van-accessible."  Moreover, one of the spaces reserved for persons with disabilities is a parallel parking space without an access aisle and is on unpaved gravel, while most of the other spaces are on pavement.  On the shortest accessible route to the accessible entrance, provide 1 van accessible space and 5 standard spaces designated as reserved for people with disabilities.  Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards §§ 4.1.2(5), 4.1.6(1)(b), 4.6, 4.30.7(1).

 

3.         The required clear floor space at the lowest of the 3 pay telephones near the Harbormaster's Office is reduced by a wooden bench that patrons keep moving closer to the phones.  Provide and maintain an accessible telephone with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone.  Standards §§ 4.1.3(17), 4.1.6(1)(b), 4.31.

 

4.         Neither of the 2 telephones provided in the North Parking Lot are accessible to persons who use wheelchairs, due to their mounting height.  Provide accessible directional signage indicating the location of the nearest accessible telephones. Standards §§ 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

 

5.         Designated Accessible Single User Toilet Room - Unisex in Harbormaster's Office

 

a. The door sign is mounted on the door.  Provide permanent room signage with upper case, sans serif or simple serif type letters and numerals, meeting the requirements of the Standards for character height, raised characters, finish and contrast, accompanied by Grade 2 Braille; mounted on the wall adjacent to the latch side of the door or on the nearest adjacent wall at a height of 60 inches above the finished floor to the centerline of the sign; and located so that a person may approach within 3 inches of the signage without encountering protruding objects or standing within the swing of a door.  Standards §§ 4.1.2(7), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

b. The lavatory provides only 7 inches of knee space.  Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.2, Fig. 31.

 

c. The toilet flush control is on the closed side of the toilet.  Provide a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.5, 4.27.4.

 

6.         The sign for the second single user toilet room in the Harbormaster's Office is mounted on the door.  Provide permanent room signage with upper case, sans serif or simple serif type letters and numerals, meeting the requirements of the Standards for character height, raised characters, finish and contrast, accompanied by Grade 2 Braille; mounted on the wall adjacent to the latch side of the door or on the nearest adjacent wall at a height of 60 inches above the finished floor to the centerline of the sign; and located so that a person may approach within 3 inches of the signage without encountering protruding objects or standing within the swing of a door.  Standards §§ 4.1.2(7), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

B.         Within 12 months of the effective date of this Agreement, Juneau will complete the following modifications to the Douglas Harbor.

 

1.         Only 1 parking space out of approximately 200 spaces is designated as reserved for persons with disabilities.  The designated space has an uneven gravel surface with no demarcated access aisle and no "van-accessible" sign.  On the shortest accessible route to the accessible entrance, provide 1 van accessible space and 5 standard spaces designated as reserved for people with disabilities.  Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards §§ 4.1.2(5), 4.1.6(1)(b), 4.6, 4.30.7(1).

 

C.        Within 24 months of the effective date of this Agreement, Juneau will complete the following modifications to the Downtown Cruise Ship Docks.

 

1.         The path of travel from the boardwalk outside Timberwolf Gifts to the cruise ship docks has an uneven and broken transition between the wooden boardwalk and the asphalt, making it difficult to traverse for persons who use wheelchairs.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards §§ 4.1.3(1), 4.1.6(1)(b), 4.3, 4.5, Fig. 7.

 

2.         One portion of the dock exceeds the permissible slope for a ramp of 1:12 and does not contain handrails.  Provide a ramp that is at least 36 inches wide and has a slope not exceeding 1:12 and a cross slope not exceeding 1:50.  Provide level landings at the top and bottom of the ramp that are at least as wide as the ramp and at least 60 inches long.  If the ramp changes direction, provide a level landing measuring at least 60 inches by 60 inches at the change in direction.  On both sides of the ramp, provide handrails between 1¼ inches and 1½ inches in diameter with a continuous gripping surface.  Ensure that the handrails extend at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface, that they are mounted between 34 inches and 38 inches above the ramp surface, that they will not rotate within their fittings, and that they have ends that are rounded or return smoothly to floor, wall, or post.  Provide edge protection that is at least 2 inches high at the ramp's drop off sides.  Ensure that the ramp and its level landing at the top and bottom are designed and maintained so that water does not accumulate on walking surfaces.  Standards §§ 4.1.2(1), 4.1.2(2), 4.1.6(1)(b), 4.3.8, 4.8.

 

D.        Within 24 months of the effective date of this Agreement, Juneau will complete the following modifications to the Harris Harbor.

 

1.         Only 3 of the 116 parking spaces are designated as reserved for persons with disabilities; none is marked as a "van-accessible" space; no access aisles are marked; and the pavement markings are not clear.  On the shortest accessible route to the accessible entrance, provide 1 van accessible space and 4 standard spaces designated as reserved for people with disabilities.  Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards §§ 4.1.2(5), 4.1.6(1)(b), 4.6, 4.30.7(1).

 

2.         Men's Single User Toilet Room (altered element)

 

a. The door sign does not contain raised letters.  Provide permanent room signage with upper case, sans serif or simple serif type letters and numerals, meeting the requirements of the Standards for character height, raised characters, finish and contrast, accompanied by Grade 2 Braille; mounted on the wall adjacent to the latch side of the door or on the nearest adjacent wall at a height of 60 inches above the finished floor to the centerline of the sign; and located so that a person may approach within 3 inches of the signage without encountering protruding objects or standing within the swing of a door.  Standards §§ 4.1.2(7), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

 

b. There is no accessible coat hook.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.1.3(12)(a), 4.1.6(1)(b), 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

c. The toilet flush valve is located on the closed side of the toilet.  Provide a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.5, 4.27.4.

 

d. The toilet paper dispenser is 43 inches from the rear wall.  Provide a toilet paper dispenser that is mounted within reach, with its top at least 1½ inches under the side grab bar, and centered at least 19 inches above the finished floor.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.6, Fig. 29(b).

 

e. The distance of the far end of the side grab bar to the rear wall is 52 inches.  Provide a side grab bar that is at least 42 inches in overall length, with the far end mounted at least 54 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.4, Fig. 29(b).

 

3.         Women's Single User Toilet Room (altered element)

 

a. The route to the toilet room is over gravel that is not a firm, stable, and slip-resistant surface.  Provide at least one accessible route within the boundary of the site to the toilet room that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards §§ 4.1.3(1), 4.1.6(1)(b), 4.3, 4.5, Fig. 7.

 

b. There is no accessible coat hook.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.1.3(12)(a), 4.1.6(1)(b), 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

c. The room dimensions of 57 inches wide by 73 inches deep provide inadequate turning space for persons who use wheelchairs.  Provide an unobstructed turning space at least 60 inches in diameter or a T-shaped space complying with Fig. 3(b).  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.3, 4.2.3, Fig. 3.

 

d. The soap dispenser is not accessible.  Provide a soap dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.1.3(13), 4.1.6(1)(b), 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6, Fig. 4.

 

e. The toilet paper dispenser is 44 inches from the rear wall.  Provide a toilet paper dispenser that is mounted within reach, with its top at least 1½ inches under the side grab bar, and centered at least 19 inches above the finished floor.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.6, Fig. 29(b).

 

f. The far end of the side grab bar measures 50½ inches from the rear wall. Provide a side grab bar that is at least 42 inches in overall length, with the far end mounted at least 54 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.4, Fig. 29(b).

 

E.         Within 24 months of the effective date of this Agreement, Juneau will complete the following modifications to the Augustus G. Brown Swimming Pool.

 

1.         While 2 of the 28 parking spaces are designated as reserved for persons with disabilities, there are numerous problems with those spaces: the access aisle they share is only 51½ inches wide; there is no "van-accessible" signage; the pavement markings are unclear; and the spaces and access aisle are not level.  On the shortest accessible route to the accessible entrance, provide 1 van accessible space and 1 standard space designated as reserved for people with disabilities.  Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards §§ 4.1.2(5), 4.1.6(1)(b), 4.6, 4.30.7(1).

 

2.         Lobby Drinking Fountain

 

a. The fountain requires a side approach for persons who use wheelchairs, but benches protrude impermissibly on the approach to the fountain.  Additionally, if the benches are removed, the fountain will be a protruding object that is not cane-detectable.  Provide and maintain a 30 inch by 48 inch clear floor space at the drinking fountain and provide an accessible route in this area such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards §§ 4.1.2(3), 4.1.6(1)(b), 4.4, 4.1.3(10), 4.1.6(1)(b), 4.15, 4.27.4, Fig. 27.

 

b. The fountain is not accessible to persons who have difficulty bending or stooping.  For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards §§ 4.1.3(10)(a), 4.1.6(1)(b).

 

3.         No volume control is provided for the lobby telephone.  Provide an accessible telephone that is hearing aid compatible and has a volume control mechanism.  Standards §§ 4.1.3(17), 4.1.6(1)(b), 4.31.

 

4.         Women's Toilet Room with Stalls off Lobby.

 

a. The door requires 14 pounds of force to operate.  Provide a door that requires no more than 5 pounds of force to open.  Standards §§ 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

 

b. The placement of a bench obstructs the required clearance on the pull side (latch side) of the door.  On the pull side of the door, provide and maintain maneuvering clearance at least 60 inches deep and provide and maintain a minimum of 18 inches (24 inches is preferred) of maneuvering clearance on the latch side of the door.  Standards §§ 4.1.3(7)(b), 4.1.6(1)(b), 4.13.6, Fig. 25(a).

 

c. Although an audible alarm is provided, there is no visual alarm appliance in the room.  Provide visual alarm devices in toilet rooms and any other general usage areas (e.g., meeting rooms), hallways, lobbies, and any other area for common use.  Such devices shall be integrated into the facility alarm system and shall meet the requirements of the Standards for lamp type, color, pulse duration, intensity, and flash rate.  Visual alarm appliances shall be placed 80 inches above the highest floor level within the space or 6 inches below the ceiling, whichever is lower.  Standards §§ 4.1.3(14), 4.1.6(1)(b), 4.28.3.

 

d. The toilet flush control is on the closed side of the stall.  Provide a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.5, 4.17.2, 4.27.4.

 

5.         Men's Toilet Room with Stalls off Lobby.

 

a. The door requires 10 pounds of force to operate.  Provide a door that requires no more than 5 pounds of force to open.  Standards §§ 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

 

b. Although an audible alarm is provided, there is no visual alarm appliance in the room.  Provide visual alarm devices in toilet rooms and any other general usage areas (e.g., meeting rooms), hallways, lobbies, and any other area for common use.  Such devices shall be integrated into the facility alarm system and shall meet the requirements of the Standards for lamp type, color, pulse duration, intensity, and flash rate.  Visual alarm appliances shall be placed 80 inches above the highest floor level within the space or 6 inches below the ceiling, whichever is lower.  Standards §§ 4.1.3(14), 4.1.6(1)(b), 4.28.3.

 

c. There is no accessible coat hook.  Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.1.3(12)(a), 4.1.6(1)(b), 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

 

d. The toilet seat height is more than 20 inches above the finished floor.  Provide a toilet with a seat that measures 17 to 19 inches above the finished floor.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.3, 4.17.2, Fig. 30(d).

 

6.         The door to the pool area requires 15 pounds of force to operate.  Provide a door that requires no more than 5 pounds of force to open.  Standards §§ 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

 

7.         Neither the women's nor the men's locker rooms in the pool area have room signage that includes Braille and raised lettering.  Provide a room sign with raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6. 

 

8.         There is no directional signage at the women's locker room pointing patrons with disabilities to the accessible unisex locker room.  Provide accessible directional signage with the International Symbol of Accessibility at inaccessible toilet rooms indicating the location of the nearest accessible toilet room, and provide accessible signage with the International Symbol of Accessibility at all accessible toilet rooms.  Standards §§ 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

 

9.         The route to the accessible unisex locker room through the pool area is obstructed by patron's shoes.  Provide and maintain an accessible route to the locker rooms that is at least 36 inches wide throughout.  Standards §§ 4.1.6(b), 4.1.3(1), 4.3.3.

 

10.       Unisex Accessible Locker Room (includes a lavatory, toilet, and shower)

 

a. The room signage is mounted on the door.   Provide a room sign with the International Symbol of Accessibility and raised and Braille characters.  The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing.  Standards §§ 4.1.2(7)(d), 4.1.6(1)(b), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

b. The door signage indicates that there is a toilet inside, but there is no indication of an accessible shower.  Provide signage at this room indicating the presence of an accessible shower. 

 

c. The door swings into the clear floor space required at the lockers.  Ensure that no door swings into the required clear floor space at any accessible fixture.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.2.

 

d. Although an audible alarm is provided, there is no visual alarm appliance in the room.  Provide visual alarm devices in toilet rooms and any other general usage areas (e.g., meeting rooms), hallways, lobbies, and any other area for common use.  Such devices shall be integrated into the facility alarm system and shall meet the requirements of the Standards for lamp type, color, pulse duration, intensity, and flash rate.  Visual alarm appliances shall be placed 80 inches above the highest floor level within the space or 6 inches below the ceiling, whichever is lower.  Visual alarm appliances shall be located such that no place in any room or space, including common corridors or hallways, required to have a visual alarm appliance shall be more than 50 feet from the signal.  In large rooms and spaces exceeding 100 feet across, without obstructions 6 feet above the finished floor, devices may be placed around the perimeter, spaced a maximum of 100 feet apart, in lieu of suspending appliances from the ceiling.  Standards §§ 4.1.3(14), 4.1.6(1)(b), 4.28.3.

 

e. The room does not contain adequate turning space, due to the storage of a child seat.  Provide an unobstructed turning space at least 60 inches in diameter or a T-shaped space complying with Fig. 3(b).  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.3, 4.2.3, Fig. 3.

 

f. Shower

 

i. The transfer seat does not extend the full depth of the stall; the grab bars are not continuous; and the hose is 58 inches long.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.21, Figs. 35, 36, 37.

 

F.         Within 24 months of the effective date of this Agreement, Juneau will complete the following modifications to the Juneau-Douglas City Museum.

 

1.         Ramp

 

a. The ends of the handrails at the lower end of the ramp are not rounded or returned smoothly to the wall, floor, or post.  Provide handrails that are between 1¼ inches and 1½ inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards §§ 4.1.2(1), 4.1.2(2), 4.1.6(1)(b), 4.3.8, 4.8.5.

 

b. The slope of the upper leg of the ramp exceeds the maximum allowable slope of 1:12.  Provide handrails that are between 1¼ inches and 1½ inches in diameter such that the inside handrail is continuous and both handrails have a continuous gripping surface along both sides of the ramp extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface; the handrails do not rotate within their fittings; and both handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post.  Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; with level landings measuring at least 60 inches by 60 inches when the ramp changes direction; and edge protection that is at least 2 inches high at the drop off sides.  Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces.  Standards §§ 4.1.2(1), 4.1.2(2), 4.1.6(1)(b), 4.3.8, 4.8.

 

c. The dimensions of the trapezoidal level landing between the upper and lower ramp legs are insufficient, since the building-side portion of the landing measures only 41 inches long and the road-side portion of the landing measures 63 inches long.  Provide a ramp with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; with level landings measuring at least 60 inches by 60 inches when the ramp changes direction; and edge protection that is at least 2 inches high at the drop off sides.   Standards §§ 4.1.2(1), 4.1.2(2), 4.1.6(1)(b), 4.3.8, 4.8.

 

2.         Many of the displays are positioned for the convenience of the standing patron and it would be difficult for persons who use wheelchairs to view them.  Provide program access to each.  For instance, for the three dimensional model of Gastineau Channel, which has high walls, program access may be achieved by mounting a mirror on the ceiling directly over the display.  The three-dimensional slides could be printed for persons who cannot access the stereoscopic viewers.  For other displays that cannot be viewed by persons who use wheelchairs, providing wall-mounted or hand-held mirrors that allow persons using wheelchairs to enjoy the exhibits may provide program access.

 

3.         The passageway closest to the concessions area has a clear opening width of 31 inches.  Because the other entrance to the display area is accessible, provide signage at the inaccessible route pointing patrons with disabilities to the accessible route.

 

4.         The coat hangers near the entrance vestibule are not accessible.  Provide coat hangers with a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair.  Standards §§ 4.1.3(13), 4.1.6(1)(b), 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6, Fig. 4.

 

5.         Single User Unisex Toilet Room

 

a. The clear opening width of the door is 27¾ inches.  Provide a door with a clear opening at least 32 inches wide when measured from the face of the door to the opposite stop when the door is opened 90 degrees and with hardware usable with one hand and without tight grasping, pinching, or twisting of the wrist.  Lever-operated, push-type, and U-shaped handles are acceptable designs.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.2, 4.13.5, 4.13.9.

 

b. Although an audible alarm is provided, there is no visual alarm appliance in the room.  Provide visual alarm devices in toilet rooms and any other general usage areas (e.g., meeting rooms), hallways, lobbies, and any other area for common use.  Such devices shall be integrated into the facility alarm system and shall meet the requirements of the Standards for lamp type, color, pulse duration, intensity, and flash rate.  Visual alarm appliances shall be placed 80 inches above the highest floor level within the space or 6 inches below the ceiling, whichever is lower.  Visual alarm appliances shall be located such that no place in any room or space, including common corridors or hallways, required to have a visual alarm appliance shall be more than 50 feet from the signal.  In large rooms and spaces exceeding 100 feet across, without obstructions 6 feet above the finished floor, devices may be placed around the perimeter, spaced a maximum of 100 feet apart, in lieu of suspending appliances from the ceiling.  Standards §§ 4.1.3(14), 4.1.6(1)(b), 4.28.3.

 

c. The room provides a turning diameter of only 54¾ inches.  Provide an unobstructed turning space at least 60 inches in diameter or a T-shaped space complying with Fig. 3(b).  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.3, 4.2.3, Fig. 3.

 

d. The toilet flush control is on the closed side of the toilet.  Provide a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.5, 4.27.4.

 

e. The far end of the side grab bar is 46 inches from the rear wall.  Provide a side grab bar that is at least 42 inches in overall length, with the far end mounted at least 54 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.4, Fig. 29(b).

 

G.        Within 12 months of the effective date of this Agreement, Juneau will complete the following modifications to the Mt. Jumbo Gym.

 

1.         The front entrance has a vertical change in level of 1-7/8 inches with the mat, or 2-3/8 inches without the mat.  Provide an accessible door with a threshold that is no greater than ¼ inch, or is no greater than ½ inch and is beveled with a slope no greater than 1:2.  Standards §§ 4.1.3(7)(a), 4.1.6(1)(b), 4.13.8, 4.5.2.

 

2.         The drinking fountain is not accessible to persons who have difficulty bending or stooping.  For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards §§ 4.1.3(10)(a), 4.1.6(1)(b).

 

3.         Unisex Single User Toilet and Shower Room.

 

a. The door requires 10 pounds of force to open.  Provide a door that requires no more than 5 pounds of force to open.  Standards §§ 4.1.3(7)(b), 4.1.6(1)(b), 4.13.11(2)(b).

 

b. The shower transfer bench does not extend the full length of the stall.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.21, Figs. 35, 36, 37.

 

H.        Within 36 months of the effective date of this Agreement, Juneau will complete the following modifications to Savikko Park.

 

1.         In the north lot, although 3 out of 21 parking spaces are designated as reserved for persons with disabilities, no access aisles are provided.  At each standard accessible space, provide an access aisle at least 60 inches wide.  At each van accessible space, provide an access aisles at least 96 inches wide.  Ensure that all access aisles are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards §§ 4.1.2(5), 4.1.6(1)(b), 4.6.3, Fig. 9.

 

2.         Women's Toilet Room with Stalls - North

 

a. The air dryer is a protruding object that is not cane-detectable, as its bottom leading edge is 43 inches above the finished floor and it protrudes into the circulation path 8½ inches.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards §§ 4.1.2(3), 4.1.6(1)(b), 4.4.

 

b. The lavatory faucet requires more than 5 pounds of force to operate.  Provide a lavatory with a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs).  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.6, 4.19.5, 4.27.4.

 

c. The toilet paper dispenser is mounted above the side grab bar.  Provide a toilet paper dispenser that is mounted with its top at least 1½ inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.3, Fig. 30(d).

 

3.         Men's Toilet Room with Stalls - North

 

a. The air dryer is a protruding object that is not cane-detectable.  Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles.  Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor.  Standards §§ 4.1.2(3), 4.1.6(1)(b), 4.4.

 

b. The toilet paper dispenser is mounted above the side grab bar.  Provide a toilet paper dispenser that is mounted with its top at least 1½ inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.17.3, Fig. 30(d).

 

4.         None of the 8 picnic tables in Shelter #2 are accessible to persons who use wheelchairs.  Provide at least one picnic table on an accessible route such that there is knee space at the table at least 27 inches high, 30 inches wide, and 19 inches deep, and such that the height of the top of the table is between 28 inches and 34 inches above the ground.  Standards §§ 4.1.3(18), 4.1.6(1)(b), 4.32.3, 4.32.4.

 

5.         There is no accessible route to the playground equipment at the south end of the park, due to a sandy surface.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards §§ 4.1.3(1), 4.1.6(1)(b), 4.3, 4.5, Fig. 7.

 

6.         There is no drinking fountain that is accessible to persons who have difficulty bending or stooping.  For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards §§ 4.1.3(10)(a), 4.1.6(1)(b).

 

7.         In the south parking lot, 3 of 82 parking spaces are designated as reserved for persons with disabilities.  One of these, the northern-most space, is only 92 inches wide.  Provide designated accessible parking spaces that are a minimum of 96 inches wide and served by access aisles at least 60 inches wide.  Provide van accessible spaces that are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  Standards §§ 4.1.2(5), 4.1.6(1)(b), 4.6.3, Fig.9.

 

I.          Within 12 months of the effective date of this Agreement, Juneau will complete the following modifications to the Zach Gordon Youth Center.

 

1.         Although 1 of the 9 parking spaces is reserved for persons with disabilities, it is not designated as "van-accessible" and neither the space nor the access aisle is level.  Provide designated accessible parking spaces and access aisles that are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, with surfaces that are firm, stable, and slip-resistant.  Standards §§ 4.1.2(5), 4.1.6(1)(b), 4.3.6, 4.5.1, 4.6.3.

 

2.         The entrance consists of 2 sets of double doors, creating a vestibule.  Considered singly, each of the interior doors provides only 29½ inches of clear opening width and requires 10 pounds of force to operate.  Provide program access by keeping both interior doors propped open at all times the center is used.

 

3.         Single User Unisex Toilet and Shower Room

 

a. The far end of the toilet side grab bar is 46 inches to the rear wall.  Provide a side grab bar that is at least 42 inches in overall length, with the far end mounted at least 54 inches from the rear wall and the closer end 12 inches or less from the rear wall.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.22.4, 4.16.4, Fig. 29(b).

 

b. The shower transfer seat does not extend the full depth of the shower stall.  Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening.  Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable.  Standards §§ 4.1.3(11), 4.1.6(1)(b), 4.21, Figs. 35, 36, 37.

 

4.         Some of the interior doors, such as the doors to the weight room and the family teen center, as well as the interior of the room with the rock climbing wall, have round door knobs.  Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate.  Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs.  Standards §§ 4.1.3(7)(b), 4.1.6(1)(b), 4.13.9.

 

5.         The drinking fountain near the front desk provides only 26 inches of vertical knee clearance.  Provide cups at front desk and mount signage at the drinking fountain indicating their availability.

 

J.          Within 24 months of the effective date of this Agreement, Juneau will complete the following modifications to the Parking Lot Across from the Irish Shop (435, 439 S. Franklin).

 

1.         None of the 17 parking spaces is designated as reserved for persons with disabilities.  On the shortest accessible route to the accessible entrance, provide one van accessible space designated as reserved for people with disabilities.  Van accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  All spaces designated as reserved for people with disabilities shall have vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  Van accessible spaces shall have an additional "Van-Accessible" sign located below the International Symbol of Accessibility.  Standards §§ 4.1.2(5), 4.1.6(1)(b), 4.6, 4.30.7(1).

 

2.         The transition from the parking lot to concrete sidewalk has a change in level greater than ½ inch.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards §§ 4.1.3(1), 4.1.6(1)(b), 4.3, 4.5, Fig. 7.

 

3.         The transition from the concrete to wooden boardwalk leading to the Cruise Ship Dock has a concrete mini-ramp that does not have flared sides and, in places, has more than a ½ inch vertical rise between the wood and the concrete.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards §§ 4.1.3(1), 4.1.6(1)(b), 4.3, 4.5, Fig. 7.

 

K.        Within 12 months of the effective date of this Agreement, Juneau will complete the following modifications to the Downtown Visitors' Center.

 

1.         While 8 pay telephones are provided outside the Visitors' Center, there is no electricity in the telephone kiosk.  Provide signage directing users to a TTY available at the Tramway.

 

2.         The drinking fountain inside the Visitors' Center is not accessible to persons who have difficulty bending or stooping.  For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people.  Standards §§ 4.1.3(10)(a), 4.1.6(1)(b).

 

L.         Within 24 months of the effective date of this Agreement, Juneau will complete the following modifications to the Capital School Park:

 

1.         Although the 2 available parking spaces have both been reserved for persons with disabilities, neither is marked "van-accessible," the spaces and the access aisle that serves them have cross slopes that are too steep to be accessible.  On the shortest accessible route to the accessible entrance, provide one van accessible space designated as reserved for people with disabilities.  Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide.  At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles.  At van accessible spaces, provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility.  Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant.  Standards §§ 4.1.2(5), 4.6, 4.30.7(1).

 

2.         There is no accessible route to the portable toilet or play equipment.  Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public.  The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%).  Standards §§ 4.3, 4.5, Fig. 7.

 

3.         The portable toilet is not designed or configured to be accessible to persons with disabilities.  Provide toileting facilities for persons with disabilities, all elements of which comply with the Standards.

 

4.         The spout of the drinking fountain is too high and too far back from the front of the bowl and there is no fountain available for persons who have difficulty bending or stooping.  Ensure that fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge.  For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping.  This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people.  Standards §§ 4.15, 4.27.4, Fig. 27.

 

5.         The ramp to the basketball court does not have any handrails.  Provide handrails that are between 1¼ inches and 1½ inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface.  Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings.  Standards § 4.8.5.
