Attachment D: Modifications to Newly Constructed Facilities
Please Note: Paragraph 35 of the Agreement requires that within three months of the effective date of this Agreement, the Town will provide signage as necessary to comply with 28 C.F.R. § 35.163(b), after having surveyed all facilities that are the subject of this Agreement for the purpose of identifying those that have multiple entrances not all of which are accessible.
Newly Constructed Facilities: In order to ensure that the spaces and elements in Town facilities for which construction was commenced after January 26, 1992, are readily accessible to and usable by persons with disabilities, the Town will take the following actions:
1. The Town shall complete the following modifications to the Fountain Hills Community Center at 13001 E. La Montana, within 6 months of the effective date of this Agreement:
a. Men's Toilet Room with Stalls
i. The urinal has a rim mounted 17 ½ inches above the finished floor. Provide a urinal with an elongated rim mounted 17 inches or less above the finished floor. Standards §§ 4.1.3(11), 4.22.5, 4.18.2, 4.18.3, 4.18.4.
ii. The side grab bar at the toilet is mounted 37 inches above the finished floor. Provide a side grab bar mounted 33 to 36 inches above the finished floor. Standards §§ 4.1.3(11), 4.22.4, 4.17.6, 4.26.2, Fig. 30.
iii. No accessible coat hook has been provided. Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards §§ 4.1.3(12)(a), 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.
b. Signage identifying Art Room #1 is located on the door. Provide permanent room signage with upper case, sans serif or simple serif type letters and numerals, meeting the requirements of the Standards for character height, raised characters, finish and contrast, accompanied by Grade 2 Braille; mounted on the wall adjacent to the latch side of the door or on the nearest adjacent wall at a height of 60 inches above the finished floor to the centerline of the sign; and located so that a person may approach within 3 inches of the signage without encountering protruding objects or standing within the swing of a door. Standards §§ 4.1.2(7), 4.30.1, 4.30.4, 4.30.5, 4.30.6.
2. The Town shall complete the following modifications to the Library/Museum at 12901 E. La Montana, within 6 months of the effective date of this Agreement:
a. Museum
i. The video tape regarding Tonto Verde is not captioned and there was no script available. In order to provide equal access, make available appropriate auxiliary aids and services to ensure effective communication.

b. Library
i. The card catalog computers are on tables that are 37 ½ inches above the finished floor. Provide at least one accessible table on an accessible route at least 36 inches wide. Ensure that the table has clear floor space of 30 inches wide by 48 inches deep, knee clearance of at least 27 inches high by 30 inches wide by 19 inches deep, and a writing surface between 28 and 34 inches above the finished floor. Standards §§ 8.2, 4.2.4.1, 4.32.
3. The Town shall complete the following modifications to the Fire Station at 16821 E. Saguaro Blvd., within 12 months of the effective date of this Agreement, unless the Town has divested itself of this property within the 12 month period, in which case these requirements will be void:
a. Parking
i. Although there is a small parking lot with room for several vehicles, no spaces are designated as reserved for people with disabilities. On the shortest accessible route to the accessible entrance, provide 1 van accessible space designated as reserved for people with disabilities. Van accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 96 inches wide. All spaces designated as reserved for people with disabilities shall have vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. Van accessible spaces shall have an additional "Van-Accessible" sign located below the International Symbol of Accessibility. Standards §§ 4.1.2(5), 4.6, 4.30.7(1).
b. Main Entrance
i. The threshold at the front entrance rises 1 inch above the level of the circulation route. Provide a threshold not exceeding ½ inch in height and beveled with a slope no greater than 1:2. Standards §§ 4.1.3(7)(a), 4.13, Figs. 24, 25.
c. Equipment Bay
i. There is no accessible interior route from the equipment bay to all adjoining areas (except the dormitories), due to high curbs at each entryway. For each doorway off the equipment bay, provide an accessible route with no level changes in excess of ½ inch vertically. Standards §§ 4.1.3(1), 4.3, 4.5, Fig. 7.
ii. The stairs just inside the storage area off the equipment bay have ten inch handrail extensions. Provide handrails on both sides of the stairs such that the inside handrail on switchbacks or doglegs is continuous; handrails that are not continuous beyond the top and bottom of the stairs extend at least 12 inches beyond the top riser and at least 12 inches plus the width of one tread beyond the bottom riser; there is a clear space between the handrails and the wall of 1½ inches; gripping surfaces are uninterrupted by newel posts, other construction elements, or obstructions; the handrails are mounted between 34 and 38 inches above stair nosings; the ends of the handrails are either rounded or returned smoothly to the floor, wall, or post; and the handrails do not rotate within their fittings. Standards §§ 4.1.3(4), 4.9.
d. Men's Toilet/Shower Room
i. The toilet room sign is mounted on the door and does not provide the International Symbol of Accessibility. Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters. The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.
ii. Although 1 of 2 stalls is larger, its dimensions and elements do not comply with the Standards. Provide a "standard" accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall's elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards. Standards §§ 4.1.3(11), 4.22.4, 4.22.7, 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.
iii. No accessible coat hook has been provided. Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards §§ 4.1.3(12)(a), 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.
iv. The urinal has a rim mounted at 25 ½ inches above the finished floor and a flush control mounted at 44 ½ inches above the finished floor. Provide a urinal with an elongated rim mounted 17 inches or less above the finished floor, and a flush control height of 44 inches or less above the finished floor. Standards §§ 4.1.3(11), 4.22.5, 4.18.2, 4.18.3, 4.18.4.
v. The lavatory is cabinet style. Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; knee and toe clearances that comply with Fig. 31; hot water and drain pipes covered or otherwise configured to protect against contact; clear floor space at least 30 inches wide and 48 inches deep centered on the lavatory; and a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs). Standards §§ 4.1.3(11), 4.22.6, 4.19.2, 4.19.3, 4.19.4, 4.19.5, 4.27.4, Figs. 31, 32.
vi. Neither of the 2 showers is designed for people with disabilities and both have significantly raised thresholds. Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening. If provided, curbs in shower stalls 36 inches by 36 inches shall be no higher than ½ inch. Shower stalls that are 30 inches by 60 inches minimum shall not have curbs. Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable. Standards §§ 4.1.3(11), 4.21, Figs. 35, 36, 37.
e. Women's Toilet/Shower Room.
i. The toilet room sign is mounted on the door. Provide a room sign with the International Symbol of Accessibility and raised and Braille characters. The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.
ii. The single toilet is not accessible to people with disabilities due to the space configuration, a lack of maneuvering clearances, and a lack of accessible elements such as grab bars, and others. Provide a "standard" accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall's elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards. Standards §§ 4.1.3(11), 4.22.4, 4.22.7, 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.
iii. The paper towel dispenser is mounted at 60 inches above the finished floor. Provide a paper towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards §§ 4.1.3(13), 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6, Fig. 4.
iv. The lavatory has a faucet with twist knobs. Provide a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs). Standards §§ 4.1.3(11), 4.22.6, 4.19.2, 4.19.3, 4.19.4, 4.19.5, 4.27.4, Figs. 31, 32.
v. There are no accessible elements in the shower. Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening. If provided, curbs in shower stalls 36 inches by 36 inches shall be no higher than ½ inch. Shower stalls that are 30 inches by 60 inches minimum shall not have curbs. Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable. Standards §§ 4.1.3(11), 4.21, Figs. 35, 36, 37.
4. The Town shall complete the following modifications to Fountain Park at 17070 E. El Lago Blvd., within 24 months of the effective date of this Agreement:
a. Parking
i. The East parking lot has a total of 33 parking spaces. There is no vertical signage designating any space for people with disabilities, no van accessible space, and there is a built up curb in the only access aisle provided for people with disabilities. On the shortest accessible route to the accessible entrance, provide one standard accessible space a minimum of 96 inches wide and served by access aisles at least 60 inches wide and one van accessible space a minimum of 96 inches wide and served by access aisles at least 96 inches wide. All spaces designated as reserved for people with disabilities shall have vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. Van accessible spaces shall have an additional "Van-Accessible" sign located below the International Symbol of Accessibility. All spaces and access aisles for people with disabilities shall be flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and their surfaces shall be firm, stable, and slip-resistant. Standards §§ 4.1.2(5), 4.6, 4.30.7(1).
ii. Men's Toilet Room with Stalls
(1) The urinal flush control is mounted at 46 inches above the finished floor. Provide a urinal with a flush control height of 44 inches or less above the finished floor. Standards §§ 4.1.3(11), 4.22.5, 4.18.2, 4.18.3, 4.18.4.
(2) The toilet seat is 20 inches above the finished floor and the centerline measures 17 inches from the side wall. Provide a toilet with a seat that measures 17 to 19 inches above the finished floor and a centerline that measures 18 inches from the near side wall. Standards §§ 4.1.3(11), 4.22.4, 4.16.3, 4.17.2, 4.17.3, Fig. 30, Fig. 30(d).
(3) The higher drinking fountain of the ‘hi-lo' configuration is a protruding object that is not cane detectable. The bottom leading edge is 33 inches above the finished floor and extends 18 inches into the circulation route. Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles. Free-standing objects mounted on posts or pylons may overhang 12 inches maximum from 27 inches to 80 inches above the ground or finished floor. Standards §§ 4.1.2(3), 4.4.
iii. Red Yucca and Golden Barrel Ramadas
(1) There are no accessible routes from the Red Yucca and Golden Barrel Ramadas to the barbeques located at each of the Ramadas. Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public. Standards §§ 4.1.3(1), 4.3, 4.5, Fig. 7. (photos 102, 103)
5. The Town shall complete the following modifications to Golden Eagle Park at 15900 N. Golden Eagle Blvd., within 24 months of the effective date of this Agreement:
a. Men's Toilet Room with Stalls
i. The toilet room sign is mounted with the centerline at 67 ½ inches above the finished floor. Provide a toilet room sign mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.
ii. The urinal does not have an elongated rim and the flush control is mounted at 48 inches above the finished floor. Provide a urinal with an elongated rim and a flush control height of 44 inches or less above the finished floor. Standards §§ 4.1.3(11), 4.22.5, 4.18.2, 4.18.3, 4.18.4.
iii. The top of the lavatory is 35 inches above the finished floor. Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31. Standards §§ 4.1.3(11), 4.22.6, 4.19.2, Fig. 31.
iv. The hot water pipes under the lavatory are not completely insulated or otherwise configured to protect against contact. Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact. Standards §§ 4.1.3(11), 4.22.6, 4.19.4.
v. Toilet Stall for Persons with Disabilities
(1) The toilet centerline measures 16 inches from the near side wall. Provide a toilet with a centerline that measures 18 inches from the near side wall. Standards §§ 4.1.3(11), 4.22.4, 4.17.3, Fig. 30.
(2) The toilet flush control is on the closed side. Provide a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device. Standards §§ 4.1.3(11), 4.22.4, 4.16.5, 4.17.2, 4.27.4.
b. Women's Toilet Room with Stalls
i. The toilet room sign is mounted with the centerline at 67 ½ inches above the finished floor. Provide a toilet room sign mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.
ii. The hot water pipes under the lavatory are not completely insulated or otherwise configured to protect against contact. Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact. Standards §§ 4.1.3(11), 4.22.6, 4.19.4.
iii. Toilet Stall for Persons with Disabilities
(1) The toilet seat is 20 1/4 inches above the finished floor. Provide a toilet with a seat that measures 17 to 19 inches above the finished floor. Standards §§ 4.1.3(11), 4.22.4, 4.16.3, 4.17.2, Fig. 30(d).
(2) The toilet centerline measures 16 inches from the near side wall. Provide a toilet with a centerline that measures 18 inches from the near side wall. Standards §§ 4.1.3(11), 4.22.4, 4.17.3, Fig. 30.
(3) The toilet flush control is on the closed side of the stall. Provide a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device. Standards §§ 4.1.3(11), 4.22.4, 4.16.5, 4.17.2, 4.27.4.
c. Drinking Fountain Outside Toilet Rooms
i. The drinking fountain located outside the toilet rooms is not accessible to individuals who use wheelchairs and protrudes 18 ½ inches into the main walkway and would not be detectable to a blind person using a cane. Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high. Ensure that fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge. Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles. Standards §§ 4.1.3(10), 4.15, 4.27.4, Fig. 27, 4.1.2(3), 4.4.
d. Accessible Routes
i. The ramp to the lower level (ball fields) from the upper level (parking) and toilet rooms is incorrectly purported to be accessible. The handrails do not extend at each level landing; some of the handrails do not return smoothly; the handrail is not continuous on the lowest leg of the ramp; and the slope exceeds the maximum allowable slope (1:12) in some areas. Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; with level landings measuring at least 60 inches by 60 inches when the ramp changes direction; and edge protection that is at least 2 inches high at the drop off sides. Provide handrails that are between 1¼ inches and 1½ inches in diameter such that the inside handrail is continuous and both handrails have a continuous gripping surface along both sides of the ramp extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface; the handrails do not rotate within their fittings; and both handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post. Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces. Standards §§ 4.1.2(1), 4.1.2(2), 4.3.8, 4.8.
ii. Along the route between the Ocotillo Ramada and the Saguaro Ramada, at the beginning of the wash overpass, there is a metal transition that rises more than ½ inch above the walkway surface. Provide an accessible route with a surface that is firm, stable, and slip resistant; has, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and has a running slope of less than 1:20 (5%) (or has been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%). Standards §§ 4.3, 4.5, Fig. 7.
iii. The ramp leading to Saguaro Ramada exceeds the maximum allowable slope of 1:12 and there are no handrails. Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides. Provide handrails that are between 1¼ inches and 1½ inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface. Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings. Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces. Standards §§ 4.1.2(1), 4.1.2(2), 4.3.8, 4.8.
iv. There is no accessible route to the play equipment in the younger kids' playground because it is surrounded by a low brick enclosure and the play surface is sand. Provide at least one accessible route connecting the sidewalk with at least one piece of play equipment that, to the maximum extent feasible, coincides with the route for the general public. The accessible route must have a surface that is firm, stable, and slip resistant; have, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%). Standards §§ 4.1.2(2), 4.3, 4.5, Fig. 7.
v. There is no accessible route to the play equipment in the older kids' playground because the play surface is sand. Provide at least one accessible route within the boundary of the site connecting the sidewalk and at least one piece of play equipment that, to the maximum extent feasible, coincides with the route for the general public. The accessible route must have a surface that is firm, stable, and slip resistant; have, in the absence of a ramp, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%). Standards §§ 4.1.2(2), 4.3, 4.5, Fig. 7.
vi. The ramp leading to the volleyball court exceeds the maximum allowable slope of 1:12, there are no handrails, and there is an 8 inch drop off at the bottom of the ramp. Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides. Provide handrails that are between 1¼ inches and 1½ inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface. Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings. Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces. Standards §§ 4.1.2(1), 4.1.2(2), 4.3.8, 4.8.
e. Drinking Fountain On Lower Level
i. The drinking fountain on the lower level is not accessible to individuals who use wheelchairs. Also, its bottom leading edge is 33 inches above the finished floor and protrudes 13 inches into the main walkway and would not be detectable to a blind person using a cane. Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high. Ensure that fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge. Provide an accessible route at this location such that no objects with their bottom leading edges measuring between 27 inches and 80 inches above the finished floor protrude more than 4 inches into walks, halls, corridors, passageways, or aisles. Standards §§ 4.1.3(10), 4.15, 4.27.4, Fig. 27, 4.1.2(3), 4.4.
f. Concession Window
i. The concession window is 41 inches above the finished floor. Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor. Standards §§ 4.1.1(2), 7.2(1), 4.1.3(1), 4.3.
6. The Town shall complete the following modifications to Desert Vista Neighborhood Park (Dog Park) at 11800 North Desert Vista, within 12 months of the effective date of this Agreement:
a. Although the only two parking spaces in the lot have been designated for people with disabilities, there is no striping, the ground surface is gravel, and there is only one sign with the International Symbol of Accessibility. On the shortest accessible route to the accessible entrance, provide one van accessible space designated as reserved for people with disabilities. Van accessible spaces shall be a minimum of 96 inches wide and served by access aisles at least 96 inches wide. Spaces designated as reserved for people with disabilities shall have vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. Van accessible spaces shall have an additional "Van-Accessible" sign located below the International Symbol of Accessibility. All spaces and access aisles for people with disabilities shall be flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and their surfaces shall be firm, stable, and slip-resistant. Standards §§ 4.1.2(5), 4.6, 4.30.7(1).
b. To access the dog exercise area, users must traverse a packed dirt path and go through two gateways, each of which has concrete pavers creating a raised threshold of 1 ½ inches above the circulation route. Provide a surface that is firm, stable, and slip resistant with no level changes in excess of ½ inch vertically. Standards §§ 4.1.2(4), 4.5, Fig. 7.
7. The Town shall complete the following modifications to Four Peaks Neighborhood Park at 14825 North Del Cambre Avenue, within 24 months of the effective date of this Agreement:
a. Telephone
i. The coin slot (highest operable part) is 56 inches above the finished floor. Also, the length of the cord is 27 inches. Provide an accessible telephone with the highest operable part of the telephone mounted no more than 48 inches above the finished floor for a front approach or no more than 54 inches above the finished floor for a side approach; and with a cord of at least 29 inches long from the telephone to the handset. Standards §§ 4.1.3(17), 4.31.
b. Route to Maintenance Area in Control Building
i. The ramp leading to the employee-only control building exceeds the maximum allowable slope of 1:12, there are no handrails, and the landing at the door is not level. Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides. Provide handrails that are between 1¼ inches and 1½ inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface. Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings. Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces. Standards §§ 4.1.2(1), 4.1.2(2), 4.3.8, 4.8.
ii. There are no handrail extensions at the bottom of the bridge leading to the South Athletic Fields. Provide handrails that extend at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface, are mounted between 34 inches and 38 inches above the ramp surface, will not rotate within their fittings, and have ends that are rounded or return smoothly to floor, wall, or post. Standards §§ 4.1.2(1), 4.1.2(2), 4.3.8, 4.8.
c. Men's Toilet Room with Stalls
i. The toilet room sign centerline measures 64 inches above the finished floor. Provide a toilet room sign mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.
ii. The urinal does not have an elongated rim. Provide a urinal with an elongated rim mounted 17 inches or less above the finished floor. Standards §§ 4.1.3(11), 4.22.5, 4.18.2.
iii. Toilet Stall for Persons with Disabilities
(1) The toilet centerline measures 21 inches from the side wall. Provide a toilet with a centerline that measures 18 inches from the near side wall. Standards §§ 4.1.3(11), 4.22.4, 4.17.3, Fig. 30.
(2) The overall length of the rear grab bar at the toilet is 35 inches and the height is 36 ½ inches above the finished floor. Provide a rear grab bar that is at least 36 inches in overall length, mounted 33 to 36 inches above the finished floor. Standards §§ 4.1.3(11), 4.22.4, 4.17.6, Fig. 30.
d. Women's Toilet Room with Stalls
i. The toilet room sign centerline measures 64 inches above the finished floor. Provide a toilet room sign mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.
ii. Three toilet stalls are provided, one of which is configured for people with disabilities. In that stall the toilet seat is 20 inches above the finished floor and the toilet centerline measures 22 inches from the near side wall. Provide a toilet with a seat that measures 17 to 19 inches above the finished floor and a centerline that measures 18 inches from the near side wall. Standards §§ 4.1.3(11), 4.22.4, 4.16.3, 4.17.2, Fig. 30(d), 4.17.3, Fig. 30.
iii. Toilet Stall for Persons with Disabilities
(1) In the stall for people with disabilities, the toilet paper dispenser is above the side grab bar. Provide a toilet paper dispenser that is mounted with its top at least 1½ inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor. Standards §§ 4.1.3(11), 4.22.4, 4.17.3, Fig. 30(d).
(2) In the stall for people with disabilities, the side grab bar at the toilet is mounted 37 inches above the finished floor. Provide a side grab bar that is mounted 33 to 36 inches above the finished floor. Standards §§ 4.1.3(11), 4.22.4, 4.17.6, Fig. 30.
(3) In the stall for people with disabilities, the rear grab bar at the toilet is mounted 37 inches above the finished floor. Provide a rear grab bar that is mounted 33 to 36 inches above the finished floor. Standards §§ 4.1.3(11), 4.22.4, 4.17.6, Fig. 30.
e. Accessible Route
i. There is no accessible route to play equipment at the older or younger kids' play areas or the swingset or slide. Provide at least one accessible route within the boundary of the site connecting the sidewalk and at least one piece of play equipment that, to the maximum extent feasible, coincides with the route for the general public. The accessible route must have a minimum clear width of 36 inches; a surface that is firm, stable, and slip resistant; no level changes in excess of ½ inch vertically; and a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%). Standards §§ 4.1.3(1), 4.3, 4.5, Fig. 7.
8. The Town shall complete the following modifications to the Maintenance Yard located at 17137 E. Falcon Dr., within 12 months of the effective date of this Agreement:
a. Public Entrance
i. The threshold is one inch above the circulation route and the door handle is a round knob. Provide a designated accessible entrance that has a threshold not exceeding ½ inch in height and beveled with a slope no greater than 1:2. Provide hardware and operating devices that have shapes that are easy to grasp with one hand and do not require tight grasping, pinching or twisting of the wrist to operate and are mounted no higher than 48 inches above the finished floor. Standards §§ 4.1.3(7)(a), 4.13, Figs. 24, 25.
b. Unisex Single-User Toilet Room
i. There is no toilet room sign. Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters. The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.
ii. The door handle is a round door knob. Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate. Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs. Standards §§ 4.1.3(7)(b), 4.13.9.
iii. The maneuvering clearance on the push side of the door is blocked by a file cabinet and storage box. On the push side of the door, provide and maintain maneuvering clearance at least 48 inches deep and provide a minimum of 12 inches of maneuvering clearance on the latch side of the door, or remove the closer or the latch. Standards §§ 4.1.3(7)(b), 4.13.6, Fig. 25(a).
iv. The soap dispenser requires a forward reach and is mounted 49 inches above the finished floor. Provide a soap dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards §§ 4.1.3(13), 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6, Fig. 4.
v. The paper towel dispenser is mounted at 56 ½ inches above the finished floor. Provide a paper towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards §§ 4.1.3(13), 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6, Fig. 4.
vi. The required clear floor space at the lavatory is blocked by two lockers. Provide a lavatory with the clear floor space at least 30 inches wide and 48 inches deep centered on the lavatory. Standards §§ 4.1.3(11), 4.22.6, 4.19.3, Figs. 31, 32.
vii. The required clear floor space at the toilet is blocked by a storage cabinet. Provide clear floor space at the toilet that complies with Fig. 28. Standards §§ 4.1.3(11), 4.22.4, 4.16.2, Fig. 28.
viii. The flush control for the toilet is on the closed side. Provide a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device. Standards §§ 4.1.3(11), 4.22.4, 4.16.5, 4.27.4.
