Attachment H: Program Access in Existing Facilities

Paragraph 29 of the Agreement requires that within nine months of the effective date of this Agreement, the City will provide signage as necessary to comply with 28 C.F.R. § 35.163(b), after having surveyed all facilities that are the subject of this Agreement for the purpose of identifying those that have multiple entrances not all of which are accessible.

1. The technical requirements and, where appropriate, the scoping requirements of the Standards are used as a guide for determining whether a program or activity held in an existing facility is "readily accessible to and usable by" persons with disabilities and for determining what changes are necessary to make this program or activity accessible if it continues to be provided in the existing facility in question. See 28 C.F.R. §§ 35.150(b)(1), 35.151.

2. In order to ensure that each of the City's programs, services, and activities operating at a facility that is the subject of this Agreement, when viewed in its entirety, are readily accessible to and usable by persons with mobility impairments, the City will take the following actions:

3. The City will make the following modifications to the City Hall located at 226 West 4^th Street, within eighteen months of the effective date of this Agreement:

A. Men's First Floor Toilet Room

i. Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room. Provide a visual alarm appliance in the toilet room. Standards §§ 4.28.1, 4.28.3.

ii. The urinal is inaccessible because its rim is 23 inches above the finished floor and the width of the stall is 24 inches. Provide a urinal with an elongated rim mounted 17 inches or less above the finished floor, a clear floor space of at least 30 inches wide and 48 inches deep centered on the urinal, and a flush control height of 44 inches or less above the finished floor. Standards §§ 4.22.5, 4.18.2, 4.18.3, 4.18.4.

iii. The toilet stall designated for persons with disabilities is an "alternate" stall. Provide a "standard" accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall's elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards. Standards §§ 4.22.4, 4.22.7, 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

iv. The coat hook in the designated accessible stall is inaccessible because it is mounted too high above the finished floor. Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards §§ 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

B. Women's First Floor Toilet Room

i. The toilet room sign is not on the latch side of the door. Provide a toilet room sign that is mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

ii. Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room. Provide a visual alarm appliance in the toilet room. Standards §§ 4.28.1, 4.28.3.

C. Men's and Women's Second Floor Toilet Rooms

i. There is no directional signage at the inaccessible second floor toilet rooms to the accessible toilet rooms located on the first floor. Provide directional signage using the International Symbol of Accessibility to identify that otherwise comply with the Standards. §§ 4.1.3(16)(b), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7(1).

D. Drinking Fountains

i. Although there are 2 accessible drinking fountains provided on the first floor near the toilet rooms, there is no drinking fountain provided for people who have difficulty bending or stooping. For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping. This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people. Standards §§ 4.1.3(10)(a).

ii. The built-in drinking fountain located on the third floor is inaccessible to persons who use wheelchairs. Provide a drinking fountain with a clear floor space of at least 30 inches by 48 inches that allows a person in a wheelchair to make a parallel approach to the unit. For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping. This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people. Standards §§ 4.1.3(10), 4.15, 4.2.4, Figs. 27(c), (d).

E. Elevator

i. The elevator is inaccessible because, although emergency communications are provided, the system can only be operated with voice command. Provide a two-way communication system such that it does not require voice communication, the highest operable part is a maximum of 48 inches above the finished floor of the car, and it is identified by a raised symbol and lettering located adjacent to the device. If the system uses a handset, ensure that the length of the cord from the panel to the handset is at least 29 inches. If the system is located in a closed compartment, ensure that the compartment door hardware operates without tight grasping, pinching or twisting of the wrist. Standards §§ 4.10.14.

F. Council Meeting Room on First Floor

i. There is no accessible route connecting the wheelchair seating areas and the council members' seats due to a raised dias. Provide an accessible route connecting the wheelchair seating locations to all spaces used by the public. Standards §§ 4.3, 4.33.5.

G. Service Counters

i. The main reception counter is inaccessible because it is 42 inches above the finished floor. Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation. Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means. Standards §§ 4.1.1(2), 7.2(2), 4.3.

ii. The finance counter is inaccessible because it is 41 inches above the finished floor. Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation. Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means. Standards §§ 4.1.1(2), 7.2(2), 4.3.

iii. The counter in the Human Resources Department (Rm 101) is inaccessible because it is 38 ½ inches above the finished floor. Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation. Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means. Standards §§ 4.1.1(2), 7.2(2), 4.3.

iv. The counter in the Community and Development Department (Rm 202) is inaccessible because it is 42 inches above the finished floor. Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation. Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means. Standards §§ 4.1.1(2), 7.2(2), 4.3.

v. The counter in the City Council Office (Rm 304) is inaccessible because it is 40 inches above the finished floor. Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation. Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means. Standards §§ 4.1.1(2), 7.2(2), 4.3.

4. The City will make the following modifications to the Credit Island Golf Course and Park located on Credit Island, within one year of the effective date of this Agreement:

A. Parking

i. On the shortest accessible route to the accessible entrance of the Club House and to the accessible route to the playground areas, provide at least 2 van accessible spaces and at least 8 standard spaces designated as reserved for people with disabilities. Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide. Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide. At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. At van accessible spaces, provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility. Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant. Standards §§ 4.1.2(5), 4.6, 4.30.7(1).

B. Entrances

i. There is no directional signage at the inaccessible Pro Shop exterior entrance directing persons with disabilities to the front accessible exterior entrance. Provide accessible, directional signage with the International Symbol of Accessibility at the inaccessible entrance directing users to the accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances. Standards §§ 4.1.3(16)(b), 4.13, 4.30.

C. Men's Toilet Room in Club House

i. The toilet room does not have a sign identifying the room as designated for persons with disabilities. Provide a toilet room sign with the International Symbol of Accessibility and raised and Braille characters. The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6, 4.30.7.

ii. The door to the toilet room is inaccessible because it is 30 inches wide and has twist type hardware. Provide a door with a clear opening at least 32 inches wide when measured from the face of the door to the opposite stop when the door is opened 90 degrees and with hardware usable with one hand and without tight grasping, pinching, or twisting of the wrist. Lever-operated, push-type, and U-shaped handles are acceptable designs. Standards §§ 4.22.2, 4.13.5, 4.13.9.

iii. The mirror is inaccessible because the bottom edge of its reflecting surface is too high above the finished floor. Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor. Standards §§ 4.22.6, 4.19.6.

iv. The lavatory is inaccessible because its rim is 37 inches above the finished floor. Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31. Standards §§ 4.22.6, 4.19.2, Fig. 31.

v. The lavatory is inaccessible because the hot water pipes are not insulated or otherwise configured to protect against contact. Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact. Standards §§ 4.22.6, 4.19.4.

vi. The lavatory is inaccessible because it has twist type controls. Provide a lavatory with a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs). Standards §§ 4.22.6, 4.19.5, 4.27.4.

vii. The toilet in the designated accessible stall is inaccessible because there is insufficient clear floor space. Provide clear floor space that complies with Fig. 30 at the toilet. Standards §§ 4.22.4, 4.17.3, Fig. 30.

viii. The toilet in the designated accessible stall is inaccessible because its centerline measures 21 ½ inches from the side wall. Provide a toilet with a centerline that measures 18 inches from the near side wall. Standards §§ 4.22.4, 4.17.3, Fig. 30.

ix. The toilet in the designated accessible stall is inaccessible because the top of the seat is 16 inches above the finished floor. Provide a toilet with a seat that measures 17 to 19 inches above the finished floor. Standards §§ 4.22.4, 4.16.3, 4.17.2, Fig. 30(d).

x. The toilet paper dispenser in the designated accessible stall is inaccessible because it is above the side grab bar. Provide a toilet paper dispenser that is mounted with its top at least 1½ inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor. Standards §§ 4.22.4, 4.17.3, Fig. 30(d).

xi. The coat hook in the designated accessible stall is inaccessible because it is mounted too high above the finished floor. Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards §§ 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

D. Women's Toilet Room in Club House

iv. The lavatory is inaccessible because the hot water pipes are not insulated or otherwise configured to protect against contact. Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact. Standards §§ 4.22.6, 4.19.4.

v. The lavatory is inaccessible because it has twist type controls. Provide a lavatory with a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs). Standards §§ 4.22.6, 4.19.5, 4.27.4.

vi. The toilet in the designated accessible stall is inaccessible because the flush control is on the closed side. Provide a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device. Standards §§ 4.22.4, 4.16.5, 4.17.2, 4.27.4.

vii. The coat hook in the designated accessible stall is inaccessible because it is mounted too high above the finished floor. Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards §§ 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

E. Men's Toilet Room near Playground

ii. The entrance is inaccessible because there is an one inch threshold at the door. Provide a designated accessible entrance that has a threshold not exceeding ½ inch in height and beveled with a slope no greater than 1:2. Standards §§ 4.13, Figs. 24, 25.

iii. The lavatory is inaccessible because it has twist type controls. Provide a lavatory with a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs). Standards §§ 4.22.6, 4.19.5, 4.27.4.

iv. The toilet paper dispenser in the designated accessible stall is inaccessible because it is 39 inches above the finished floor and above the side grab bar. Provide a toilet paper dispenser that is mounted with its top at least 1½ inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor. Standards §§ 4.22.4, 4.17.3, Fig. 30(d).

v. The coat hook in the designated accessible stall is inaccessible because it is mounted too high above the finished floor. Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards §§ 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

F. Women's Toilet Room near Playground

ii. The entrance is inaccessible because there is a 1 inch threshold at the door. Provide a designated accessible entrance that has a threshold not exceeding ½ inch in height and beveled with a slope no greater than 1:2. Standards §§ 4.13, Figs. 24, 25.

iv. The toilet in the designated accessible stall is inaccessible because its centerline measures 13 inches from the side wall. Provide a toilet with a centerline that measures 18 inches from the near side wall. Standards §§ 4.22.4, 4.17.3, Fig. 30.

v. The toilet in the designated accessible stall is inaccessible because the flush control is on the closed side. Provide a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device. Standards §§ 4.22.4, 4.16.5, 4.17.2, 4.27.4.

vi. The coat hook in the designated accessible stall is inaccessible because it is mounted too high above the finished floor. Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards §§ 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

G. Pro Shop and Café

i. The service counter in the Pro Shop and Café is inaccessible because it is 42" above the finished floor. Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation. Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means. Standards §§ 4.1.1(2), 7.2(2), 4.3.

ii. The interior door leading to the Pro Shop and Café from the Lodge is inaccessible because the pressure required to open the door is 15 pounds. Provide a door that requires no more than 5 pounds of force to open. Standards. §§ 4.13.11(2)(b).

H. Picnic Tables in Club House Lodge

i. The picnic area is inaccessible because the quantity of accessible picnic tables provided is fewer than 5% of the total number available to the general public. Provide at least one accessible picnic table in the picnic area. Standard § 5.1.

5. The City will make the following modifications to the Duck Creek Park, Lodge and Golf Course located at East Locust and Marlo Avenue, within eighteen months of the effective date of this Agreement:

A. Parking

i. The van accessible parking space reserved for persons with disabilities near the gazebo lacks the appropriate signage. At the van accessible space, provide a "Van-Accessible" sign located below the International Symbol of Accessibility such that the sign cannot be obstructed by vehicles parked in the space. Standards §§ 4.1.2(5), 4.6.4, 4.30.7(1).

ii. The 3 standard parking spaces designated for persons with disabilities near the Lodge lack the appropriate signage, and none are designated as van accessible. At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. Provide at least one van accessible space a minimum of 96 inches wide, served by an access aisle at least 96 inches wide, with a vertical sign with the International Symbol of Accessibility located such that it cannot be obstructed by parked vehicles, and with an additional "Van-Accessible" sign located below the International Symbol of Accessibility. Standards §§ 4.1.2(5)(b), 4.6, 4.30.7(1).

iii. Although the parking lot for the Golf Course has a total of 150 parking spaces, only 2 spaces are designated for persons with disabilities of which none are designated as van accessible. On the shortest accessible route to the accessible entrance, provide at least one van accessible space and 3 standard spaces designated as reserved for people with disabilities. Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide. Ensure that the van accessible space is a minimum of 96 inches wide and served by an access aisle at least 96 inches wide. At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. At the van accessible space, provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility. Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant. Standards §§ 4.1.2(5), 4.6, 4.30.7(1).

iv. Although there is public parking along the Park's road, there are no spaces designated for persons with disabilities. On the shortest accessible route to each point of interest, i.e. playgrounds, tennis courts, baseball fields, and pavilions, provide at least one van accessible space designated as reserved for people with disabilities. Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide. At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. At van accessible spaces, provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility. Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant. Standards §§ 4.1.2(5), 4.6, 4.30.7(1).

B. Accessible Routes at Golf Course

i. The route from the parking spaces designated for persons with disabilities to the Golf Course Club House is inaccessible because there is a 1 inch change in level. Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public. The accessible route must have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically. Standards §§ 4.3, 4.5, Fig. 7.

ii. The route from the Golf Course Club House to the driving range is inaccessible. Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public. The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%). Standards §§ 4.3, 4.5, Fig. 7.

C. Exterior Ramp at Duck Creek Lodge

i. The exterior ramp to Duck Creek Lodge is inaccessible because it has no handrail extensions and no edge protection on the left side. Provide handrails that extend at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface. Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings. Provide edge protection at least 2 inches high on the left side. Standards §§ 4.1.2(1), 4.1.2(2), 4.3.8, 4.8.5, 4.8.7.

D. Entrance to Duck Creek Lodge

i. There is no directional signage at the inaccessible Duck Creek Lodge front entrance directing persons with disabilities to the side accessible entrance. Provide accessible, directional signage with the International Symbol of Accessibility at the inaccessible entrances directing users to the accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances. Standards §§ 4.1.3(16)(b), 4.13, 4.30.

E. Unisex Single-User Toilet Room in Duck Creek Lodge

i. The toilet room does not have a sign identifying the room as designated for persons with disabilities. Provide a toilet room sign with raised and Braille characters. The sign shall be mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

ii. The lavatory is inaccessible because the trash receptacle protrudes into its knee and toe clearances. Provide a lavatory with knee and toe clearances that comply with Fig. 31. Standards §§ 4.22.6, 4.19.2, Fig. 31.

F. Women's Toilet Room in Golf Course Club House

ii. The entrance door is inaccessible because it has an opening width of only 29 inches. Provide a designated accessible entrance with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop. Standards §§ 4.13.5, Fig. 24.

iii. The entrance door is inaccessible because it has twist type hardware. Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate. Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs. Standard § 4.13.9.

iv. The entrance door is inaccessible because there is a 3 inch change in level at the threshold to the door. v. The route from Golf Course Club House to the Women's Toilet Room is inaccessible because overgrown bushes protrude into the main walkway. Provide an accessible route to the Women's Toilet Room with a minimum clear width of 36 inches. Standard § 4.3.3.

vi. The mirror is inaccessible because the bottom edge of its reflecting surface is too high above the finished floor. Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor. Standards §§ 4.22.6, 4.19.6.

vii. The lavatory is inaccessible because the hot water pipes are not insulated or otherwise configured to protect against contact. Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact. Standards §§ 4.22.6, 4.19.4.

viii. The coat hook in the designated accessible stall is inaccessible because it is mounted too high above the finished floor. Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards §§ 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

ix. The toilet paper dispenser in the designated accessible stall is inaccessible because it is 41 inches from the rear wall. Provide a toilet paper dispenser that is mounted with its top at least 1½ inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor. Standards §§ 4.22.4, 4.17.3, Fig. 30(d).

x. The side grab bar in the designated accessible stall is inaccessible because it is 27 inches long, 47 inches from the farther end to the rear wall, and 13 inches from the closer end to the rear wall. Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall; mounted 33 to 36 inches above the finished floor; with a diameter between 1¼ and 1½ inches; with 1½ inches between the grab bar and the wall; and at least 1½ inches between the grab bar and any other object, such as the toilet paper dispenser. Standards §§ 4.22.4, 4.17.6, 4.26.2, Figs. 30(a), (d).

xi. The rear grab bar in the designated accessible stall is inaccessible because it is 10 inches from the closer end to the side wall. Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall. Standards §§ 4.22.4, 4.17.6, 4.26.2, Fig. 30.

G. Men's Toilet Room in Golf Course Club House

iii. The route from Golf Course Club House to the Men's Toilet Room is inaccessible because overgrown bushes protrude into the main walkway. Provide an accessible route to the Men's Toilet Room with a minimum clear width of 36 inches. Standard § 4.3.3.

iv. The mirror is inaccessible because the bottom edge of its reflecting surface is too high above the finished floor. Provide a mirror with the bottom edge of its reflecting surface no more than 40 inches above the finished floor. Standards §§ 4.22.6, 4.19.6.

H. Service Counters/Tables

i. The café counter is inaccessible because it is 42 inches above the finished floor. Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation. Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means. Standards §§ 4.1.1(2), 7.2(2), 4.3.

ii. The pro shop counter is inaccessible because it is 42 inches above the finished floor. Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation. Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means. Standards §§ 4.1.1(2), 7.2(2), 4.3.

iii. The tables in the café are inaccessible because the tables do not provide sufficient width for persons who use wheelchairs. Provide at least one accessible table between 28 and 34 inches above the finished floor, 30 inches wide, and 19 inches deep on an accessible route. Standard § 4.32, Fig. 45.

6. The City will make the following modifications to the Emeis Golf Course located at Emeis Drive and Locust Street, within one year of the effective date of this Agreement:

A. Parking

i. Although the parking lot has a total of 140 parking spaces, there are only 3 standard parking spaces designated for persons with disabilities. On the shortest accessible route to the accessible entrance, and in addition to the existing van-accessible space, provide 4 standard spaces designated as reserved for people with disabilities. Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide. At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant. Standards §§ 4.1.2(5), 4.6, 4.30.7(1).

ii. The van accessible parking space designated for persons with disabilities lacks the appropriate signage. At the van accessible spaces, provide a "Van-Accessible" sign located below the International Symbol of Accessibility such that the sign cannot be obstructed by vehicles parked in the space. Standards §§ 4.1.2(5), 4.6.4, 4.30.7(1).

B. Women's Toilet Room

v. The toilet in the designated accessible stall is inaccessible because there is insufficient clear floor space. Provide clear floor space that complies with Fig. 30 at the toilet. Standards §§ 4.22.4, 4.17.3, Fig. 30.

vi. The toilet in the designated accessible stall is inaccessible because the top of the seat is 16 inches above the finished floor. Provide a toilet with a seat that measures 17 to 19 inches above the finished floor. Standards §§ 4.22.4, 4.16.3, 4.17.2, Fig. 30(d).

viii. The toilet paper dispenser in the designated accessible stall is inaccessible because it is 38 inches from the rear wall and is above the side grab bar. Provide a toilet paper dispenser that is mounted with its top at least 1½ inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor. Standards §§ 4.22.4, 4.17.3, Fig. 30(d).

ix. The side grab bar in the designated accessible stall is inaccessible because it is 34 inches long and 37 inches from the farther end to the rear wall. Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall. Standards §§ 4.22.4, 4.17.6, 4.26.2, Figs. 30(a), (d).

x. The rear grab bar in the designated accessible stall is inaccessible because it is 33 inches long, 37 inches above the finished floor, 41 inches from the farther end to the side wall, and 8 inches from the closer end to the side wall. Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall; mounted 33 to 36 inches above the finished floor; with a diameter between 1¼ and 1½ inches; with 1½ inches between the grab bar and the wall; and at least 1½ inches between the grab bar and any other object, such as a toilet seat cover dispenser. Standards §§ 4.22.4, 4.17.6, 4.26.2, Fig. 30.

C. Men's Toilet Room

vi. The toilet paper dispenser in the designated accessible stall is inaccessible because it is above the side grab bar. Provide a toilet paper dispenser that is mounted with its top at least 1½ inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor. Standards §§ 4.22.4, 4.17.3, Fig. 30(d).

vii. The side grab bar in the designated accessible stall is inaccessible because it is 33 inches long and 45 inches from the farther end to the rear wall. Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall. Standards §§ 4.22.4, 4.17.6, 4.26.2, Figs. 30(a), (d).

viii. The rear grab bar in the designated accessible stall is inaccessible because it is 33 inches long, 44 inches from the farther end to the side wall, and 11 inches from the closer end to the side wall Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall. Standards §§ 4.22.4, 4.17.6, 4.26.2, Fig. 30.

D. Service Counters

i. The outside starter window is inaccessible because it is 42 inches above the finished floor. Provide a window on an accessible route such that a portion of the window is at least 36 inches wide and no more than 36 inches above the finished, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation. Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means. Standards §§ 4.1.1(2), 7.2(2), 4.3.

ii. The pro shop counter is inaccessible because it is 47 inches above the finished floor. Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation. Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means. Standards §§ 4.1.1(2), 7.2(2), 4.3.

iii. The café counter is inaccessible because it is 42 inches above the finished floor. Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation. Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means. iv. The tables in the café are inaccessible because the tables do not provide sufficient width for persons who use wheelchairs. Provide at least one accessible table between 28 and 34 inches above the finished floor, 30 inches wide, and 19 inches deep on an accessible route. Standard § 4.32, Fig. 45.

7. The City will make the following modifications to the Fejervary Zoo and Park located at 12^th Street and Wiles Avenue, within one year of the effective date of this Agreement:

A. Parking

i. Although the parking lot has a total of 200 parking spaces, only 2 standard spaces are designated for persons with disabilities. On the shortest accessible route to the Park and to the accessible entrance to the Zoo, provide at least one van accessible space and 6 standard spaces designated as reserved for people with disabilities. Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide. Ensure that the van accessible space is a minimum of 96 inches wide and served by an access aisle at least 96 inches wide. At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. At the van accessible space, provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility. Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant. Standards §§ 4.1.2(5), 4.6, 4.30.7(1).

B. Men's and Women's Park Toilet Rooms

i. The Park's Men's and Women's Toilet Rooms are not accessible to people with disabilities. Provide an accessible toilet for each gender or provide an accessible "unisex" toilet room identified by the International Symbol of Accessibility on an accessible route so that the spaces and elements, including the room identification signage, entry door, clear floor space, turning space, accessible route, water closet, urinal (men's only if provided), grab bars, lavatory, mirror, and controls and dispensers comply with the Standards. §§ 4.1.2(7)(d), 4.22, 4.2, 4.3, 4.16 and Figs. 28 & 29, 4.19 and Figs. 31 & 32, 4.25, 4.26, 4.27, 4.30.

8. The City will make the following modifications to the Fire Station #3 located at 3606 Harrison Street, within six months of the effective date of this Agreement:

A. Main Entrance Door

i. The entrance door is inaccessible because there is a 3 inch change in level at the threshold to the door. Provide an accessible door with a threshold that is no greater than ¼ inch, or is no greater than ½ inch and is beveled with a slope no greater than 1:2. Standards §§ 4.13.8, 4.5.2.

B. Unisex Single-User Toilet Room

ii. The entrance door is inaccessible because it has an opening width of only 25 inches. Provide a designated accessible entrance with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop. Standards §§ 4.13.5, Fig. 24.

v. The paper towel dispenser is inaccessible because the controls are mounted at 56 inches above the finished floor. Provide a paper towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards §§ 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6, Fig. 4.

vi. The lavatory is inaccessible because the hot water pipes are not insulated or otherwise configured to protect against contact. Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact. Standards §§ 4.22.6, 4.19.4.

vii. The lavatory is inaccessible because it has twist type controls. Provide a lavatory with a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs). Standards §§ 4.22.6, 4.19.5, 4.27.4.

viii. The toilet is inaccessible because its centerline measures 15 inches from the side wall. Provide a toilet with a centerline that measures 18 inches from the near side wall. Standards §§ 4.22.4, 4.16.2, Fig. 28.

ix. The toilet is inaccessible because the flush control is on the closed side. Provide a flush control mounted on the "open" side of the toilet's clear floor space; 44 inches or less above the finished floor; and requiring a maximum of 5 pounds of force to operate; or provide an automatic flush device. Standards §§ 4.1.3(11), 4.22.4, 4.16.5, 4.27.4.

x. The toilet is inaccessible because there is no rear grab bar. Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall; mounted 33 to 36 inches above the finished floor; with a diameter between 1¼ and 1½ inches; with 1½ inches between the grab bar and the wall; and at least 1½ inches between the grab bar and any other object, such as a toilet seat cover dispenser. Standards §§ 4.22.4, 4.16.4, 4.26.2, Fig. 29.

xi. The toilet is inaccessible because it is no side grab bar. Provide a side grab bar that is at least 42 inches in overall length, with the far end mounted at least 54 inches from the rear wall and the closer end 12 inches or less from the rear wall; mounted 33 to 36 inches above the finished floor; with a diameter between 1¼ and 1½ inches; with 1½ inches between the grab bar and the wall; and at least 1½ inches between the grab bar and any other object, such as the toilet paper dispenser. Standards §§ 4.22.4, 4.16.4, 4.26.2, Fig. 29.

C. Drinking Fountain

i. The wall-mounted drinking fountain is inaccessible because its spout is 45 inches above the finished floor and there is no knee or toe clearance for persons who use wheelchairs. Provide at least one drinking fountain with a spout height no higher than 36 inches, measured from the finished floor or ground surface to the spout outlet; and a spout located at the front of the unit that directs the water flow in a trajectory that is nearly parallel to the front of the unit and is positioned so the flow of water is within 3 inches of the front edge of the fountain and at least 4 inches high. Ensure that fountain controls are operable with one hand, require 5 lbf or less to operate without tight grasping, pinching, or twisting of the wrist; and are front mounted or side mounted near the front edge. For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping. This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser; or by such other means as would achieve the required accessibility for each group of people. Standards §§ 4.1.3(10), 4.15, 4.27.4, Fig. 27.

9. The City will make the following modifications to the Garfield Park located at 30^th Street and Tremont Avenue, within six months of the effective date of this Agreement:

A. Parking

i. Although the parking lot has a total of 60 parking spaces, none are designated for persons with disabilities. On the shortest accessible route to the accessible entrance, provide at least one van accessible space and 2 standard spaces designated as reserved for people with disabilities. Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide. Ensure that the van accessible space is a minimum of 96 inches wide and served by an access aisle at least 96 inches wide. At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. At the van accessible space, provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility. Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant. Standards §§ 4.1.2(5), 4.6, 4.30.7(1).

B. Men's and Women's Park Toilet Rooms

i. The Park's Men's and Women's Toilet Rooms are not accessible to people with disabilities. Provide an accessible toilet for each gender, or provide an accessible "unisex" toilet room identified by the International Symbol of Accessibility on an accessible route so that the spaces and elements, including the room identification signage, entry door, clear floor space, turning space, accessible route, water closet, urinal (men's only if provided), grab bars, lavatory, mirror, and controls and dispensers comply with the Standards. §§ 4.1.2(7)(d), 4.22, 4.2, 4.3, 4.16 and Figs. 28 & 29, 4.19 and Figs. 31 & 32, 4.25, 4.26, 4.27, 4.30.

10. The City will make the following modifications to the Ground Transit Center located at 300 West River Drive, within one year of the effective date of this Agreement:

A. Men's Toilet Room

i. The grab bars in the designated accessible stall are inaccessible because they are 38 inches above the finished floor. Provide grab bars that are mounted between 33 and 36 inches above the finished floor. Standards §§ 4.22.4, 4.17.6, Fig. 30.

B. Women's Toilet Room

ii. The grab bars in the designated accessible stall are inaccessible because they are 38 inches above the finished floor. Provide grab bars that are mounted between 33 and 36 inches above the finished floor. Standards §§ 4.22.4, 4.17.6, Fig. 30.

C. Drinking Fountains near Toilet Rooms

i. Although 2 accessible drinking fountains are provided, there is no drinking fountain provided for people who have difficulty bending or stooping, and the drinking fountain near the Men's Toilet Room is a protruding object. Provide an accessible drinking fountain that is not a protruding object and one additional drinking fountain that is accessible to people who have difficulty bending or stooping. This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people. Standards §§ 4.1.3(10)(a), 4.4.1.

D. Public Telephone Bank Inside Terminal

i. The telephones are inaccessible because they do have volume control. Provide accessible telephones that have a volume control mechanism. Standards §§ 4.31.

ii. Although there are 3 public telephones provided, an electrical outlet and a shelf is not provided. Provide at least one accessible shelf and an electric outlet that comply with Standards §§ 4.1.3(17)(d), 4.31.9(2).

11. The City will make the following modifications to the Junge Park located at 32^nd Street and Western Avenue, within six months of the effective date of this Agreement:

A. Parking

i. Although the parking lot has a total of 60 parking spaces, only 2 standard spaces are designated for persons with disabilities of which neither has vertical signs nor has clear pavement markings. On the shortest accessible route to the accessible entrance, provide at least one van accessible space and 2 standard spaces designated as reserved for people with disabilities. Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide. Ensure that the van accessible space is a minimum of 96 inches wide and served by an access aisle at least 96 inches wide. At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. At the van accessible space, provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility. Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant. Standards §§ 4.1.2(5), 4.6, 4.30.7(1).

B. Accessible Route

i. The route from the parking spaces designate for persons with disabilities to the Men's and Women's Toilet Rooms is inaccessible. Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public. The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%). Standards §§ 4.3, 4.5, Fig. 7.

C. Men's Toilet Room

ii. The lavatory is inaccessible because its rim is 36 inches above the finished floor. Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31. Standards §§ 4.22.6, 4.19.2, Fig. 31.

iii. The toilet stall is inaccessible to persons with disabilities. Provide a "standard" accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall's elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, and dispensers, comply with the Standards. Standards §§ 4.22.4, 4.22.7, 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

D. Women's Toilet Room

12. The City will make the following modifications to the Junior Theater located at 2800 Eastern Avenue, within eighteen months of the effective date of this Agreement:

A. Parking

i. The parking lot behind the Theater has an inadequate number of van accessible parking spaces. On the shortest accessible route to the accessible entrance, provide at least one van accessible space a minimum of 96 inches wide, served by an access aisle at least 96 inches wide, with a vertical sign with the International Symbol of Accessibility located such that it cannot be obstructed by parked vehicles, and with an additional "Van-Accessible" sign located below the International Symbol of Accessibility. Standards §§ 4.1.2(5)(b), 4.6, 4.30.7(1).

B. Exterior Ramp

i. The ramp is inaccessible because its slope is 1:10, it has no edge protection, and its handrails are inaccessible. Provide a ramp that is at least 36 inches wide with a slope not exceeding 1:12 and a cross slope not exceeding 1:50; with level landings at least as wide as the ramp and 60 inches long at the top and bottom of the ramp; and with edge protection at least 2 inches high at the drop off sides. Provide handrails that are between 1¼ inches and 1½ inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface. Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings. Ensure that the ramp and approaches are designed so that water will not accumulate on walking surfaces. Standards §§ 4.1.2(1), 4.1.2(2), 4.3.8, 4.8, 4.26.

C. Interior Ramp to Stage

i. The ramp is inaccessible because its inside handrail is inaccessible and there is no outside handrail. Provide handrails that are between 1¼ inches and 1½ inches in diameter with a continuous gripping surface along both sides of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface. Ensure that handrails are mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings. Standards §§ 4.1.2(1), 4.1.2(2), 4.3.8, 4.8.5, 4.26.

D. Main Entrance

i. The main entrance door is inaccessible because there is a 2 inch change in level at the threshold to the door. Provide an accessible door with a threshold that is no greater than ¼ inch, or is no greater than ½ inch and is beveled with a slope no greater than 1:2. Standards §§ 4.13.8, 4.5.2.

E. Men's Toilet Room near Lobby

ii. The paper towel dispenser is inaccessible because the controls are mounted at 54 inches above the finished floor where a forward approach is required. Provide a paper towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards §§ 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6, Fig. 4.

iii. The lavatory is inaccessible because the hot water pipes are not insulated or otherwise configured to protect against contact. Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact. Standards §§ 4.22.6, 4.19.4.

iv. The toilet stall designated for persons with disabilities is an "alternate" stall. Provide a "standard" accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall's elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, coat hooks and dispensers, comply with the Standards. Standards §§ 4.22.4, 4.22.7, 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

F. Women's Toilet Room near Lobby

ii. The second door in the series is inaccessible because the pressure required to open the door is 10 pounds. Provide a door that requires no more than 5 pounds of force to open. Standards §§ 4.13.11(2)(b).

iii. The paper towel dispenser is inaccessible because the controls are mounted at 54 inches above the finished floor where a forward approach is required. Provide a paper towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. v. The lavatory is inaccessible because the trash receptacle protrudes into its knee and toe clearances. Provide a lavatory with knee and toe clearances that comply with Fig. 31. Standards §§ 4.22.6, 4.19.2, Fig. 31.

vi. The toilet stall designated for persons with disabilities is an "alternate" stall. Provide a "standard" accessible toilet stall at least 60 inches wide and at least 59 inches deep (or at least 56 inches deep with a wall-mounted toilet) such that all of the stall's elements, including stall door, stall door hardware, water closet, size and arrangement, toe clearances, grab bars, controls, coat hooks and dispensers, comply with the Standards. Standards §§ 4.22.4, 4.22.7, 4.13, 4.16, 4.17, 4.26, 4.27, Fig. 30.

G. Drinking Fountain

i. Although an accessible drinking fountain is provided, there is no drinking fountain provided for people who have difficulty bending or stooping. For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping. This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people. Standards §§ 4.1.3(10)(a).

H. Public Telephone

i. The telephone in the Lobby is inaccessible because it does not have volume control. Provide an accessible telephone that has a volume control mechanism. Standards §§ 4.31.

I. Assembly Area

i. The auditorium containing 465 seats is inaccessible because it does not have wheelchair seating locations. Provide 6 wheelchair seating areas, each with a minimum clear ground or floor space of 66 inches wide by 48 inches deep for forward or rear access, or 66 inches wide by 60 inches deep for side access. Ensure that the ground or floor at all wheelchair locations is level, firm, stable, and slip resistant; that wheelchair seating areas are an integral part of the fixed seating plan and are located so as to provide people with physical disabilities a choice of admission prices and lines of sight comparable to those available for members of the general public; that wheelchair seating areas adjoin an accessible route that also serves as a means of egress in case of emergency; and that at least one fixed companion seat is provided next to each wheelchair seating area. Standards §§ 4.1.3(19)(a), 4.5, 4.33.

ii. The auditorium is inaccessible to people with hearing impairments because although there are 50 or more fixed seats, there is no assistive listening system. Provide a permanently installed assistive listening system serving the fixed seating. Ensure that the seating served by the system is located within a 50 foot viewing distance of the stage or playing area and has a complete view of the stage or playing area. Provide 19 receivers for use by the general public and signage indicating their availability. Standards §§ 4.1.3(19)(b), 4.33.6, 4.33.7.

J. Dressing Rooms

i. The dressing rooms at the Theater are inaccessible. Provide at least one accessible dressing room in this area on an accessible route with accessible signage indicating its location. Ensure that accessible dressing rooms fitted with swinging or sliding doors contain sufficient clear floor space to allow a person using a wheelchair to make a 180-degree turn inside the room and that no door swings into any part of the turning space. Ensure that private accessible dressing/fitting rooms fitted with curtained openings at least 32 inches wide contain either a clear space of 60 inches in diameter, or a "T" shaped turning space that complies with Fig. 3(b). Provide a bench 24 inches by 48 inches fixed to the wall along the longer dimension and mounted between 17 and 19 inches above the finished floor to the top of the bench. If mirrors are provided in dressing rooms of the same use, provide one full-length mirror, measuring at least 18 inches wide by 54 inches high, mounted in a position affording a view to a person on the bench as well as to a person in a standing position. Standards §§ 4.35, 4.30, 4.2, 4.3, Fig. 3.

13. The City will make the following modifications to the LeClaire Park located at Main Street and Riverfront, within eighteen months of the effective date of this Agreement:

A. Parking and Accessible Route

i. The van accessible parking space designated for persons with disabilities lacks the appropriate signage. At van accessible spaces, provide a "Van-Accessible" sign located below the International Symbol of Accessibility such that the sign cannot be obstructed by vehicles parked in the space. Standards §§ 4.1.2(5), 4.6.4, 4.30.7(1).

ii. The route from the parking spaces designated for persons with disabilities is inaccessible because there is no way for someone who uses a wheelchair to get on or off the sidewalk. Provide a curb ramp that is at least 36 inches wide, has a maximum slope of 1:12, is located so that it cannot be obstructed by parked vehicles, and has a stable, firm, and slip-resistant surface with a detectable warning extending the full width and depth of the ramp. If the curb ramp is located where pedestrians must walk across it, provide either flared sides (with a maximum slope of 1:10) or handrails or guardrails to protect against cross traffic. Standards §§ 4.1.2(1), 4.1.2(2), 4.3.8, 4.7, Fig. 12.

B. Men's Toilet Room

ii. The entrance door is inaccessible because there is an 1 ½ inch change in level at the threshold to the door. Provide an accessible door with a threshold that is no greater than ¼ inch, or is no greater than ½ inch and is beveled with a slope no greater than 1:2. Standards §§ 4.13.8, 4.5.2.

vi. The toilet in the designated accessible stall is inaccessible because its centerline measures 20 inches from the side wall. Provide a toilet with a centerline that measures 18 inches from the near side wall. Standards §§ 4.22.4, 4.17.3, Fig. 30.

viii. The toilet in the designated accessible stall is inaccessible because there is no rear grab bar. Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall; mounted 33 to 36 inches above the finished floor; with a diameter between 1¼ and 1½ inches; with 1½ inches between the grab bar and the wall; and at least 1½ inches between the grab bar and any other object, such as a toilet seat cover dispenser. Standards §§ 4.22.4, 4.17.6, 4.26.2, Fig. 30.

ix. The toilet in the designated accessible stall is inaccessible because there is no side grab bar. Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall; mounted 33 to 36 inches above the finished floor; with a diameter between 1¼ and 1½ inches; with 1½ inches between the grab bar and the wall; and at least 1½ inches between the grab bar and any other object, such as the toilet paper dispenser. Standards §§ 4.22.4, 4.17.6, 4.26.2, Figs. 30(a), (d).

C. Women's Toilet Room

iv. The paper towel dispenser is inaccessible because the controls are mounted at 62 inches above the finished floor. Provide a paper towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards §§ 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6, Fig. 4.

v. The toilet in the designated accessible stall is inaccessible because its centerline measures 10 inches from the side wall. Provide a toilet with a centerline that measures 18 inches from the near side wall. Standards §§ 4.22.4, 4.17.3, Fig. 30.

vii. The toilet in the designated accessible stall is inaccessible because there is no rear grab bar. Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall; mounted 33 to 36 inches above the finished floor; with a diameter between 1¼ and 1½ inches; with 1½ inches between the grab bar and the wall; and at least 1½ inches between the grab bar and any other object, such as a toilet seat cover dispenser. Standards §§ 4.22.4, 4.17.6, 4.26.2, Fig. 30.

viii. The toilet in the designated accessible stall is inaccessible because there is no side grab bar. Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall; mounted 33 to 36 inches above the finished floor; with a diameter between 1¼ and 1½ inches; with 1½ inches between the grab bar and the wall; and at least 1½ inches between the grab bar and any other object, such as the toilet paper dispenser. Standards §§ 4.22.4, 4.17.6, 4.26.2, Figs. 30(a), (d).

D. LeClaire Bandstand

i. The bandstand containing 200 seats is inaccessible because it does not have wheelchair seating locations. Provide 4 wheelchair seating areas, each with a minimum clear ground or floor space of 66 inches wide by 48 inches deep for forward or rear access, or 66 inches wide by 60 inches deep for side access. Ensure that the ground or floor at all wheelchair locations is level, firm, stable, and slip resistant; that wheelchair seating areas are an integral part of the fixed seating plan and are located so as to provide people with physical disabilities a choice of admission prices and lines of sight comparable to those available for members of the general public; that wheelchair seating areas adjoin an accessible route that also serves as a means of egress in case of emergency; and that at least one fixed companion seat is provided next to each wheelchair seating area. Standards §§ 4.1.3(19)(a), 4.5, 4.33.

ii. There is no accessible route connecting the wheelchair seating areas and the stage. Provide an accessible route connecting the wheelchair seating locations to all spaces used by performers. Standards §§ 4.3, 4.33.5.

iii. The bandstand is inaccessible to people with hearing impairments because although there are 50 or more fixed seats, there is no assistive listening system. Provide a permanently installed assistive listening system serving the fixed seating. Ensure that the seating served by the system is located within a 50 foot viewing distance of the stage or playing area and has a complete view of the stage or playing area. Provide 8 receivers for use by the general public and signage indicating their availability. Standards §§ 4.1.3(19)(b), 4.30, 4.33.

14. The City will make the following modifications to the Library located at 321 Main Street, within eighteen months of the effective date of this Agreement:

A. Signage

i. There is no signage directing people with disabilities from the inaccessible toilet rooms located on the lower level, Special Collection level, and second level to the accessible toilet rooms on the first level. Provide accessible directional signage with the International Symbol of Accessibility at inaccessible toilet rooms indicating the location of the nearest accessible toilet room, and provide accessible signage with the International Symbol of Accessibility at all accessible toilet rooms. Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

B. Men's First Floor Single-User Toilet Room

ii. Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room. Provide a visual alarm appliance in the toilet room. Standards §§ 4.28.1, 4.28.3.

C. Women's First Floor Single-User Toilet Room

ii. Although an audible alarm is provided in this facility, there is no visual alarm appliance in the toilet room. Provide a visual alarm appliance in the toilet room. Standards §§ 4.28.1, 4.28.3.

D. Drinking Fountains

i. The wall-mounted drinking fountain located on the lower level is inaccessible to persons who use wheelchairs. Provide a drinking fountain with clear knee space between the bottom of the apron and the finished floor or ground of at least 27 inches high, 30 inches wide, and 17 to 19 inches deep; and a minimum clear floor space of 30 inches by 48 inches to allow a person in a wheelchair to approach the unit facing forward. Standards §§ 4.1.3(10), 4.15, Figs. 27(a), (b).

ii. The wall-mounted drinking fountain located on the first level is inaccessible to persons who use wheelchairs. Provide a drinking fountain with clear knee space between the bottom of the apron and the finished floor or ground of at least 27 inches high, 30 inches wide, and 17 to 19 inches deep; and a minimum clear floor space of 30 inches by 48 inches to allow a person in a wheelchair to approach the unit facing forward. Standards §§ 4.1.3(10), 4.15, Figs. 27(a), (b).

iii. For each accessible drinking fountain provided in the Library, provide a drinking fountain that is accessible to people who have difficulty bending or stooping. This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people. Standards §§ 4.1.3(10)(a).

E. Stacks

i. The book stacks in the Library extend beyond the reach ranges for persons who use wheelchairs. Provide signage in conspicuous locations throughout the Library indicating "if require assistance, please inform the front desk" with the International Symbol of Accessibility. Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

15. The City will make the following modifications to the Marquette Park located at Duck Creek Parkway, within one year of the effective date of this Agreement:

A. Parking

i. Although the parking lot has approximately a total of 18 parking spaces, none are designated for persons with disabilities. On the shortest accessible route to the accessible entrance, provide at least one van accessible space. Ensure that the van accessible space is a minimum of 96 inches wide and served by an access aisle at least 96 inches wide. Provide a vertical sign with the International Symbol of Accessibility located such that it cannot be obstructed by parked vehicles. Provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility. Ensure that the space and access aisle for persons with disabilities is flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that its surface is firm, stable, and slip-resistant. Standards §§ 4.1.2(5), 4.6, 4.30.7(1).

B. Men's and Women's Park Toilet Rooms

16. The City will make the following modifications to the Nahant Marsh Office located at 4220 Wapello Avenue, within one year of the effective date of this Agreement:

A. Parking

i. Although there is public parking, there are no spaces designated for persons with disabilities. On the shortest accessible route to the accessible entrance, provide at least one van accessible space. Ensure that the van accessible space is a minimum of 96 inches wide and served by an access aisle at least 96 inches wide. Provide a vertical sign with the International Symbol of Accessibility located such that it cannot be obstructed by parked vehicles. Provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility. Ensure that the space and access aisle for persons with disabilities is flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that its surface is firm, stable, and slip-resistant. Standards §§ 4.1.2(5), 4.6, 4.30.7(1).

B. Unisex Toilet Room

ii. The entrance door is inaccessible because it has twist type hardware. Provide a door with hardware usable with one hand and without tight grasping, pinching, or twisting of the wrist. Lever-operated, push-type, and U-shaped handles are acceptable designs. Standards §§ 4.22.2, 4.13.9.

C. Drinking Fountain

D. Picnic Tables

17. The City will make the following modifications to the Northwest Park located at West 34^th Street and Division Street, within six months of the effective date of this Agreement:

A. Parking

i. Although the parking lot has approximately a total of 70 parking spaces, none are designated for persons with disabilities. On the shortest accessible route to the accessible entrance, provide at least one van accessible space and 2 standard spaces designated as reserved for people with disabilities. Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide. Ensure that the van accessible space is a minimum of 96 inches wide and served by an access aisle at least 96 inches wide. At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. At the van accessible space, provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility. Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant. Standards §§ 4.1.2(5), 4.6, 4.30.7(1).

18. The City will make the following modifications to the Police Department located at 420 Harrison Street, within one year of the effective date of this Agreement:

A. Unisex Single-User Toilet Room

i. The toilet room sign is mounted on the entrance door. Provide a toilet room sign that is mounted on the wall adjacent to the latch side of the door with the centerline of the sign at 60 inches above the finished floor and situated such that a person can approach within 3 inches of the sign without encountering an obstruction or standing within a door swing. Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.4, 4.30.5, 4.30.6.

ii. The lavatory is inaccessible because the hot water pipes are not insulated or otherwise configured to protect against contact. Provide hot water and drain pipes that are insulated or otherwise configured to protect against contact. Standards §§ 4.22.6, 4.19.4.

iii. The rear grab bar at the toilet is inaccessible because it is 33 ½ inches long and 35 ½ inches from the farther end to the side wall. Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall. Standards §§ 4.22.4, 4.16.4, 4.26.2, Fig. 29.

B. Drinking Fountain

i. The wall-mounted drinking fountain is inaccessible to persons who use wheelchairs. Provide a drinking fountain with clear knee space between the bottom of the apron and the finished floor or ground of at least 27 inches high, 30 inches wide, and 17 to 19 inches deep; and a minimum clear floor space of 30 inches by 48 inches to allow a person in a wheelchair to approach the unit facing forward. i. The telephone is inaccessible because it does not have volume control. Provide an accessible telephone that has a volume control mechanism. Standards §§ 4.31.

D. Screens/Windows

i. The Citizen's Information Center screen is inaccessible because it begins at 48 inches above the finished floor and requires a forward approach. Provide a Citizen's Information Center on an accessible route such that the highest operable controls on the screen are a maximum height above the finished floor of 48 inches for a forward approach. If a counter is provided, ensure that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor. Standards §§ 4.1.1(2), 4.27.2, 4.27.3, 7.2(1), 4.3.

ii. The Bureau Records window is inaccessible because it is 45 inches above the finished floor. Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation. Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means. Standards §§ 4.1.1(2), 7.2(2), 4.3.

iii. The Traffic Division has a call button to request assistance but it lacks identification signage. Provide signage nest to the call button stating "if require assistance, please ring button" with the International Symbol of Accessibility. Standards §§ 4.1.2(7)(d), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

19. The City will make the following modifications to the River Center North and Adler Theater located at 100 East 3^rd Street, within eighteen months of the effective date of this Agreement:

A. Accessible Routes

i. The River Center North is inaccessible because there is no directional signage at the inaccessible north side entrance. Provide accessible, directional signage with the International Symbol of Accessibility at the inaccessible north side entrance directing users to the south side accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances. Standards §§ 4.1.3(8)(d), 4.1.3(16)(b), 4.13, 4.30.

ii. The Adler Theater is inaccessible because there is no directional signage at the inaccessible entrance. Provide accessible, directional signage with the International Symbol of Accessibility at the inaccessible entrance directing users to the River Center North's south side accessible entrance, and provide accessible signage with the International Symbol of Accessibility at all permanent accessible entrances. Standards §§ 4.1.3(8)(d), 4.1.3(16)(b), 4.13, 4.30.

B. Interior Ramp in River Center North

i. The ramp is inaccessible because the bottom segment of the ramp does not have an inside handrail. Provide an inside handrail that is between 1¼ inches and 1½ inches in diameter with a continuous gripping surface along the side of the ramp, extending at least 12 inches beyond the top and bottom of the ramp parallel with the ground surface. Ensure that the handrail is mounted between 34 inches and 38 inches above the ramp surface, with ends rounded or returned smoothly to the floor, wall, or post, and that they do not rotate within their fittings. Standards §§ 4.1.2(1), 4.1.2(2), 4.3.8, 4.8.5, 4.26.

C. Interior Entrance Doors to Adler Theater

i. The entrance doors are inaccessible because they have an opening width of only 30 inches. Provide a designated accessible entrance with a clear opening of 32 inches with the door open 90 degrees, measured between the face of the door and the opposite stop. Standards §§ 4.13.5, Fig. 24.

ii. The entrance doors to the Theater are inaccessible because the pressure required to open the doors is 20 pounds. Provide an accessible entrance door that requires no more than 5 pounds of force to open. Standards §§ 4.13.11(2)(b).

D. Signage

i. Provide accessible directional signage with the International Symbol of Accessibility at the inaccessible toilet rooms, drinking fountain, and concession counter indicating the location of the nearest accessible toilet rooms, drinking fountain, and concession counter on the first level, and provide accessible signage with the International Symbol of Accessibility at the accessible toilet rooms, drinking fountain, and concession counter. Standards §§ 4.1.2(7)(d), 4.1.6(3)(e)(iii), 4.30.1, 4.30.2, 4.30.3, 4.30.5, 4.30.7.

E. Men's Toilet Room in River Center North

i. The lavatory is inaccessible because the hot water pipes are not insulated or otherwise configured to protect against contact. Provide hot water and drain pipes (under the far left lavatory) that are insulated or otherwise configured to protect against contact. Standards §§ 4.22.6, 4.19.4.

ii. The coat hook in the designated accessible stall is inaccessible because it is mounted too high above the finished floor. Provide a coat hook at a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards §§ 4.25.2, 4.25.3, 4.2.4, 4.2.5, 4.2.6.

iii. The side grab bar in the designated accessible stall is inaccessible because it is 36 inches long and 49 inches from the farther end to the rear wall. Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall. Standards §§ 4.22.4, 4.17.6, 4.26.2, Figs. 30(a), (d).

iv. The rear grab bar in the designated accessible stall is inaccessible because it is 26 inches long and 32 inches from the farther end to the side wall. Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall. Standards §§ 4.22.4, 4.17.6, 4.26.2, Fig. 30.

F. Women's Toilet Room in River Center North

iv. The rear grab bar in the designated accessible stall is inaccessible because it is 24 inches long and 32 inches from the farther end to the side wall. Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall. Standards §§ 4.22.4, 4.17.6, 4.26.2, Fig. 30.

G. Dressing Rooms

i. The dressing rooms in Adler Theater are inaccessible because they are located on the second floor, which can only be accessed by stairs. Provide at least one accessible dressing room in this area on an accessible route with accessible signage indicating its location. Ensure that accessible dressing rooms fitted with swinging or sliding doors contain sufficient clear floor space to allow a person using a wheelchair to make a 180-degree turn inside the room and that no door swings into any part of the turning space. Ensure that private accessible dressing rooms fitted with curtained openings at least 32 inches wide contain either a clear space of 60 inches in diameter, or a "T" shaped turning space that complies with Fig. 3(b). Provide a bench 24 inches by 48 inches fixed to the wall along the longer dimension and mounted between 17 and 19 inches above the finished floor to the top of the bench. If mirrors are provided in dressing rooms of the same use, provide one full-length mirror, measuring at least 18 inches wide by 54 inches high, mounted in a position affording a view to a person on the bench as well as to a person in a standing position. Standards §§ 4.35, 4.30, 4.2, 4.3, Fig. 3.

H. Unisex Toilet Room in "Conductor's Dressing Room"

ii. The door to the toilet room and the door to the water closet are inaccessible because they have twist type hardware. Provide doors with hardware usable with one hand and without tight grasping, pinching, or twisting of the wrist. Lever-operated, push-type, and U-shaped handles are acceptable designs. Standards §§ 4.22.2, 4.13.9.

iii. The light switch is inaccessible because the controls are mounted at 60 inches above the finished floor. Provide a light switch with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards §§ 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6, Fig. 4.

iv. The hand dyer is inaccessible because the controls are mounted at 63 inches above the finished floor. Provide a hand dyer with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards §§ 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6, Fig. 4.

v. The paper towel dispenser is inaccessible because the controls are mounted at 60 inches above the finished floor. Provide a paper towel dispenser with the controls a maximum height above the finished floor of 48 inches for a forward approach or 54 inches for a side approach and that is accompanied by clear floor space of 30 by 48 inches that allows a forward or parallel approach by a person using a wheelchair. Standards §§ 4.27.2, 4.27.3, 4.2.4, 4.2.5, 4.2.6, Fig. 4.

vi. The lavatory is inaccessible because its apron is 24 ½ inches above the finished floor. Provide a lavatory with the top of its rim or counter 34 inches or less above the finished floor; the bottom edge of the apron at least 29 inches above the finished floor; and knee and toe clearances that comply with Fig. 31. Standards §§ 4.22.6, 4.19.2, Fig. 31.

viii. The lavatory is inaccessible because it has twist type controls. Provide a lavatory with a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs). Standards §§ 4.22.6, 4.19.5, 4.27.4.

ix. The toilet is inaccessible because there is insufficient clear floor space. Provide clear floor space at the toilet that complies with Fig. 28. Standards §§ 4.22.4, 4.16.2, Fig. 28.

x. The toilet is inaccessible because there is no side grab bar. Provide a side grab bar that is at least 42 inches in overall length, with the far end mounted at least 54 inches from the rear wall and the closer end 12 inches or less from the rear wall; mounted 33 to 36 inches above the finished floor; with a diameter between 1¼ and 1½ inches; with 1½ inches between the grab bar and the wall; and at least 1½ inches between the grab bar and any other object, such as the toilet paper dispenser. Standards §§ 4.22.4, 4.16.4, 4.26.2, Fig. 29.

xi. The toilet is inaccessible because there is no rear grab bar. Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall; mounted 33 to 36 inches above the finished floor; with a diameter between 1¼ and 1½ inches; with 1½ inches between the grab bar and the wall; and at least 1½ inches between the grab bar and any other object, such as a toilet seat cover dispenser. Standards §§ 4.22.4, 4.16.4, 4.26.2, Fig. 29.

I. Shower in "Conductor's Dressing Room"

i. The shower is inaccessible to persons with disabilities. Provide a shower in this room that is exactly 36 inches wide and 36 inches deep with a 48 inch long and 36 inch wide clear floor space alongside the shower opening, and an L-shaped shower seat mounted on the wall opposite the controls and extending the full depth of the stall; OR a shower that is at least 30 inches deep and 60 inches wide with no curb or threshold and with a 36 inch deep and 60 inch wide clear floor space at the shower opening. Ensure that the shower has grab bars, controls, a shower spray unit, and a seat, curb, and enclosure, if provided, that comply fully with the Standards and with Figs. 35, 36, and 37, as applicable. Standards §§ 4.21, Figs. 35, 36, 37.

J. Drinking Fountain

i. The wall-mounted drinking fountain near the toilet rooms in the River Center North is inaccessible because it has insufficient knee clearance. Provide a drinking fountain with clear knee space between the bottom of the apron and the finished floor or ground of at least 27 inches high, 30 inches wide, and 17 to 19 inches deep; and a minimum clear floor space of 30 inches by 48 inches to allow a person in a wheelchair to approach the unit facing forward. For each accessible drinking fountain, provide a drinking fountain that is accessible to people who have difficulty bending or stooping. This can be accommodated by the use of a "hi-lo" fountain; by providing one fountain accessible to those who use wheelchairs and one fountain at a standard height convenient for those who have difficulty bending; by providing a fountain accessible to people who use wheelchairs and a cup dispenser, or by such other means as would achieve the required accessibility for each group of people. Standards §§ 4.1.3(10), 4.15.5(1), Figs. 27(a), (b).

K. Public Telephone Bank

i. The telephones located on the first floor of the River Center North are inaccessible because they have no volume control. Provide an accessible telephone that has a volume control mechanism. Standards §§ 4.31.

L. In-House Telephones

i. The "in-house" telephones located on the first and second floors of the River Center North are inaccessible because their controls are greater than 54 inches above the finished floor. Provide accessible "in-house" telephones with a clear floor space of at least 30 inches by 48 inches that allows either a forward or parallel approach by a person using a wheelchair such that bases, enclosures, and fixed seats do not impede approaches to the telephone; with the highest operable part of the telephone mounted no more than 48 inches above the floor for a front approach or no more than 54 inches above the floor for a side approach; that are hearing aid compatible and have a volume control mechanism; with telephone books, if provided, located between 15 and 48 inches above the finished floor for a front approach or between 9 and 54 inches above the finished floor for a side approach; and with a cord of at least 29 inches long from the telephone to the handset. Standards §§ 4.31.

M. Assembly Area - Adler Theater

i. There is no accessible route connecting the wheelchair seating areas and the stage. Provide an accessible route connecting the wheelchair seating locations to all spaces used by performers. Standards §§ 4.3, 4.33.5.

ii. The Theater containing approximately 2400 seats is inaccessible because there are an insufficient number of wheelchair seating locations and some of the existing wheelchair seating locations are not level. Provide at least 25 wheelchair seating areas, each with a minimum clear ground or floor space of 66 inches wide by 48 inches deep for forward or rear access, or 66 inches wide by 60 inches deep for side access. Ensure that the ground or floor at all wheelchair locations is level, firm, stable, and slip resistant; that wheelchair seating areas are an integral part of the fixed seating plan and are located so as to provide people with physical disabilities a choice of admission prices and lines of sight comparable to those available for members of the general public; that wheelchair seating areas adjoin an accessible route that also serves as a means of egress in case of emergency; and that at least one fixed companion seat is provided next to each wheelchair seating area. Standards §§ 4.1.3(19)(a), 4.5, 4.33.

iii. The Theater is inaccessible to people with hearing impairments because although there are 50 or more fixed seats provided, there is no assistive listening system. Provide a permanently installed assistive listening system serving the fixed seating. Ensure that the seating served by the system is located within a 50 foot viewing distance of the stage or playing area and has a complete view of the stage or playing area. Provide 96 receivers for use by the general public and signage indicating their availability. Standards §§ 4.1.3(19)(b), 4.30, 4.33.

N. Service Counters

i. The reception counter located on the first floor of the River Center North is inaccessible because it is 43 inches above the finished floor. Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation. Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means. Standards §§ 4.1.1(2), 7.2(2), 4.3.

ii. The concession counter located in the lobby of the Adler Theater is inaccessible because it starts at 39 inches and ends at 46 inches above the finished floor and is not level. Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation. Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means. Standards §§ 4.1.1(2), 7.2(2), 4.3.

20. The City will make the following modifications to the Vander Veer Park located at West Central Park Avenue, within one year of the effective date of this Agreement:

A. Parking

i. The parking lot near the Botanical Gardens has a total of 50 parking spaces with 6 spaces designated for persons with disabilities; none of the spaces designated for persons with disabilities have vertical signs nor have van accessible signage, and 4 do not have access aisles. On the shortest accessible route to the accessible entrance, provide at least one van accessible space and at least one standard space designated as reserved for people with disabilities. Ensure that standard accessible spaces are a minimum of 96 inches wide and served by access aisles at least 60 inches wide. Ensure that van accessible spaces are a minimum of 96 inches wide and served by access aisles at least 96 inches wide. At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. At van accessible spaces, provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility. Ensure that all spaces and access aisles for persons with disabilities are flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that their surfaces are firm, stable, and slip-resistant. Standards §§ 4.1.2(5), 4.6, 4.30.7(1).

ii. The 2 parking spaces reserved for persons with disabilities near the Ice Skating Rink lacks appropriate signage. At all spaces designated as reserved for persons with disabilities, provide vertical signs with the International Symbol of Accessibility located such that they cannot be obstructed by parked vehicles. At van accessible spaces, provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility. Standards §§ 4.6.4, 4.30.7(1).

B. Men's Toilet Room near Botanical Gardens

ii. The entrance door is inaccessible because it has twist type hardware. Provide a door with hardware that is easy to grasp with one hand and that does not require tight grasping, pinching, or twisting of the wrist to operate. Lever-operated mechanisms, push-type mechanisms, and U-shaped handles are acceptable designs. Standards § 4.13.9.

iv. The lavatory is inaccessible because it has twist type controls. Provide a lavatory with a faucet that can be operated with 5 pounds of force or less and can be used with one hand and without tight grasping, pinching, or twisting of the wrist (lever-operated, push-type, and electronically controlled mechanisms are examples of acceptable designs). Standards §§ 4.19.5, 4.27.4.

vii. The side grab bar in the designated accessible stall is inaccessible because it is 25 inches long and 37 inches from the farther end to the rear wall. Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall. Standards §§ 4.17.6, 4.26.2, Figs. 30(a), (d).

C. Women's Toilet Room near Botanical Gardens

v. The toilet in the designated accessible stall is inaccessible because its centerline measures 12 inches from the side wall. Provide a toilet with a centerline that measures 18 inches from the near side wall. Standards § 4.17.3, Fig. 30.

viii. The toilet paper dispenser in the designated accessible stall is inaccessible because it is above the side grab bar. Provide a toilet paper dispenser that is mounted with its top at least 1½ inches under the side grab bar and 36 inches or less from the rear wall and is centered at least 19 inches above the finished floor. Standards § 4.17.3, Fig. 30(d).

ix. The side grab bar in the designated accessible stall is inaccessible because it is 26 inches long, 51 inches from the farther end to the rear wall and 25 inches from the closer end to the rear wall. Provide a side grab bar that is at least 40 inches in overall length, with the far end mounted at least 52 inches from the rear wall and the closer end 12 inches or less from the rear wall. Standards §§ 4.17.6, 4.26.2, Figs. 30(a), (d).

x. The toilet in the designated accessible stall is inaccessible because there is no rear grab bar. Provide a rear grab bar that is at least 36 inches in overall length, with the closer end no more than 6 inches from the side wall; mounted 33 to 36 inches above the finished floor; with a diameter between 1¼ and 1½ inches; with 1½ inches between the grab bar and the wall; and at least 1½ inches between the grab bar and any other object, such as a toilet seat cover dispenser. Standards §§ 4.17.6, 4.26.2, Fig. 30.

D. Gift Shop Counter

i. The gift shop counter is inaccessible because it is 41 ½ inches above the finished floor. Provide a counter on an accessible route such that a portion of the counter is at least 36 inches wide and no more than 36 inches above the finished floor, or provide an auxiliary counter with a maximum height of 36 inches in close proximity to the main counter, or provide equivalent facilitation. Equivalent facilitation may be provided in the form of a folding shelf attached to the main counter, an auxiliary table nearby, a clip board made available to the public, or other means. Standards §§ 7.2(2), 4.3.

E. Park Benches

i. The route from the Park's walkways to the outdoor benches is inaccessible to persons with disabilities. Provide at least one accessible route within the boundary of the site connecting these elements that, to the maximum extent feasible, coincides with the route for the general public. The accessible route must have a minimum clear width of 36 inches, or a minimum clear width of 42 inches if there is a turn around an obstruction less than 48 inches wide; have passing spaces at least 60 inches by 60 inches at least every 200 feet; have a minimum clear headroom of 80 inches; have a surface that is firm, stable, and slip resistant; have, in the absence of a curb ramp, ramp, elevator, or platform lift, no level changes in excess of ½ inch vertically; and have a running slope of less than 1:20 (5%) (or have been constructed as a fully accessible ramp) and a cross slope of less than 1:50 (2%). Standards §§ 4.3, 4.5, Fig. 7.

21. The City will make the following modifications to the Waste Water Treatment Office located at 2606 South Concord Street, within six months of the effective date of this Agreement:

A. Parking

i. Although the parking lot has a total of 10 parking spaces, none are designated for persons with disabilities. On the shortest accessible route to the accessible entrance, provide at least one van accessible space designated as reserved for people with disabilities. Ensure that the van accessible space is a minimum of 96 inches wide and served by an access aisle at least 96 inches wide. At the space designated as reserved for persons with disabilities, provide a vertical sign with the International Symbol of Accessibility located such that it cannot be obstructed by parked vehicles. At the van accessible space, provide an additional "Van-Accessible" sign located below the International Symbol of Accessibility. Ensure that the space and access aisle for persons with disabilities is flat and level, with slopes and cross-slopes not exceeding 1:50 in all directions, and that its surfaces are firm, stable, and slip-resistant. Standards §§ 4.1.2(5), 4.6, 4.30.7(1).
